7 Foreword The Making Home Affordable (MHA) Servicer Reporting Requirements document is intended to provide servicers with a consolidated resource containing reporting guidance that supports the following aspects of the MHA Program: Home Affordable Modification Program (HAMP) Home Affordable Foreclosure Alternatives (HAFA) Program Second Lien Modification Program (2MP) Treasury FHA-Home Affordable Modification Program (Treasury FHA-HAMP) Home Affordable Unemployment Program (UP) Principal Reduction Alternative (PRA) Interaction with the Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (HFA Hardest-Hit Fund) federally declared disaster (FDD) guidance References to documents residing on HMPadmin.com are included in this document. NOTE: The reporting guidance contained herein is applicable to mortgage loans not owned by Fannie Mae and Freddie Mac (non-gse loans). Furthermore, this reporting guidance is applicable to loans that are owned or guaranteed by Fannie Mae or Freddie Mac (GSE loans) to the extent the relevant guidance issued by Fannie Mae or Freddie Mac so requires. Accordingly, to the extent Fannie Mae or Freddie Mac is not participating in an MHA Program or an aspect of an MHA Program, the reporting guidance contained herein should be read accordingly. Finally, any references to the Making Home Affordable Program Handbook for Servicers of Non-GSE Mortgages (MHA Handbook) are applicable only to non-gse loans. Updates The MHA Servicer Reporting Requirements document will be updated periodically with new terms, policies and/or procedural changes as they are announced. Questions about this document or compliance with document guidance should be referred to Fannie Mae, designated by the U.S. Department of the Treasury as program administrator. Business Definitions HAMP Reporting System: The technology application that processes loan modification data from participating HAMP servicers. The HAMP Reporting Tool: The Web application where participating HAMP servicers submit loan modification data and view reports. 8 1. Home Affordable Modification Program (HAMP) Reporting Requirements Introduction The Home Affordable Modification Program (HAMP) is designed to assist borrowers to avoid foreclosure by restructuring their mortgages Servicer Registration Servicers are required to register to participate in HAMP using the HAMP registration form. Once the servicer is registered, the servicer will be allowed to modify both government-sponsored enterprise (GSE) and non- GSE first lien mortgage loans under GSE-HAMP or MHA-HAMP, respectively. Servicers are also required to register with Lender Processing Services, Inc. (LPS) to have the ability to report periodic loan level data via the HAMP Reporting Tool. A first time user of the HAMP Reporting Tool should contact LPS at and select option 1, and then option 5 to register. Cap Allocation Monitoring For a non-gse servicer, the HAMP trial period loan setup will be rejected when submitted by an active non- GSE servicer that reaches its Program Participation Cap with the following error message: The transaction cannot be processed because the cap allocation for the HAMP Registration Number associated with the Servicer Number has been reached. Reporting Servicers are required to report periodic loan-level data for all transactions related to HAMP using the HAMP Reporting Tool. HAMP has the following transaction types: Trial Setup Trial Period Activity Official Modification Loan Activity Additional Data Requirements Servicers are able to submit these transactions through the file upload tab, as described in the Upload Files section of this document, or through user interface (UI) forms found in the HAMP Reporting Tool. 9 To access the HAMP Reporting Tool: 1. Log in to HMPadmin.com. 2. Click the HAMP Loan Reporting Tools & Documents link. 3. Select the HAMP Reporting Tool. 4. Enter the login name and password assigned to you after registering for the tool. The home page has a list of tabs across the top of the HAMP Reporting Tool. The HAMP tab provides a dropdown menu of the required transaction forms for data reporting. Figure 1-1: HAMP tab Trial Setup Servicers must report the trial period loan setup data and the first trial period payment no later than the fourth business day of the month immediately following the trial period plan (TPP) effective date. The TPP effective date is determined based on when the TPP is sent to the borrower. If the TPP is transmitted to the borrower on or before the 15th of the month, the servicer should use the first day of the next month as the TPP effective date. If the TPP is transmitted to the borrower after the 15th of the month, the servicer may use either: (i) the first day of the month after next month as the TPP effective date; or (ii) the first day of the next month so long as the borrower consents to commencing the TPP earlier. Scenario 1: Servicer sends the borrower s TPP on May 10th. The servicer should use June 1st as the TPP effective date and must report the trial period loan setup data and the first trial period payment on or before the fourth business day of July. Scenario 2A: Servicer sends the borrower s TPP on May 20th. The servicer may use June 1st as the TPP effective date and must report the trial period loan setup data and the first trial period payment on or before the fourth business day of July. Scenario 2B: Servicer sends the borrower s TPP on May 20th. The servicer may use July 1st as the TPP effective date and must report the trial period loan setup data and the first trial period payment on or before the fourth business day of August. NOTE: In scenario 2B, the borrower is required to make the contractual payment due in June in order to maintain their current (HMP7) status. Borrowers in an active Chapter 13 bankruptcy who are determined to be eligible for HAMP may be converted to an official modification without completing a trial period as long as the borrower has been making payments in a bankruptcy plan for at least three months. Servicers must report a Trial Plan Type Code to indicate whether the loan will be modified as a standard HAMP TPP or a bankruptcy plan in lieu of a HAMP trial period. 10 To report data at the start of a trial period: 1. Select the Trial Setup option from the HAMP drop-down menu. 2. Complete all the required fields, which are denoted by a red border. 3. 11 Servicers can make corrections to the trial period loan setup record. Servicers need to resubmit complete loan setup data using the Submission Status = 1 Trial. Corrections can be made at any time during the month. Servicers can cancel a Trial Modification by submitting a loan setup record using Submission Status = 5 Trial Cancellation. Trial Cancellations can be made at any time during the month. NOTE: For a full set of Trial Set Up data attributes, their definitions, and the conditions under which each is required, refer to the HAMP Data Dictionary. (This file includes any new edits or changes due to release implementations.) Trial Period Activity Servicers are required to report payment activity during the HAMP trial period to substantiate the receipt of proceeds during the trial period. While the first trial period payment is reported at trial setup, servicers must report remaining trial payments no later than the fourth business day of the month following each trial period month. NOTE: Trial Period Activity data cannot be reported if the Trial Plan Type Code is Chapter 13 Bankruptcy reported at Trial Setup. To report trial period payments: 1. Select the Trial Period Activity option from the HAMP drop-down menu. 2. Complete all the required fields, which are denoted by a red border. 3. Click Add Activity to submit the data When entering data, the following should be considered: The Trial Payment Number must be greater than or equal to 2. The Trial Payment Amount must be entered and must be greater than or equal to $0. Official Modification At the end of the trial period, if the borrower has satisfied the conditions for conversion from a trial period modification to an official modification, servicers must report the official loan setup data to establish the official Making Home Affordable (MHA) Servicer Reporting Requirements
12 modification. This information must be reported no later than the fourth business day of the month in which the official modification is effective. The official modification effective date is the first day of the month following the month when the last trial period payment is due. However, if the borrower does not pay the final trial period payment by its due date but does pay it by the end of the final trial period month, the servicer may elect to establish as the modification effective date the first day of the second month following the final trial period month. The Modification Effective Date and the First Payment Due Date under the modified terms must be the same date. For example, if the official modification date is May 1st, then the first payment due date is also May 1st. To report loan setup data for an Official HAMP Modification: 1. Select the Official Modification option from the HAMP drop-down menu. 2. Complete all the required fields, which are denoted by a red border. 3. Click Add Activity to submit the data. Figure 1-5: Official Modification Servicers can make corrections to the official modification loan setup data. Servicers need to resubmit complete loan setup data using the Submission Status = 6 Official Correction. Corrections can be made during the first four business days of the month. 13 Loan Activity The Official Monthly Report (OMR) is used to report monthly payments. Reporting begins the first month after the official modification is effective. For example, if the official Modification Effective Date is May 1st, an OMR is due by June 4 for May activity, since the OMR is due by the fourth business day of each month. Servicers have until two business days prior to the monthly close to clear up any edits and have the final OMR reported to the HAMP Reporting Tool. The monthly close is on the 17th calendar day of each month or the first business day prior to the 17th, if the 17th of a particular month falls on a weekend or a holiday. Monthly reporting of the OMR directly affects borrower, servicer, and investor incentives. Servicers should ensure the accuracy of all data reported through OMRs. OMRs are due even if a payment was not received. To report loan payments after the official modification: 1. Select the Loan Activity option from the HAMP drop-down menu. 2. Complete all the required fields, which are denoted by a red border. 3. Click Add Activity to submit the data. Home Affordable Unemployment Program (UP) The Home Affordable Unemployment Program (UP) is a supplemental program to HAMP that provides assistance to qualified unemployed borrowers by granting a forbearance period which reduces or suspends their monthly mortgage payments. There is no additional registration required to participate in UP. UP is part of the First Lien Trial and Official Loan Setup transactions; therefore, loan-level data must be reported no later than the fourth business day of the month. If an investor is participating in UP and such investor s borrower is transitioning from UP to a HAMP trial period plan, the applicable servicer must choose between two Forbearance Plan Type Codes: Making Home Affordable (MHA) Servicer Reporting Requirements
14 1 Unemployment 3 Unemployment and Federally Declared Disaster As indicated, Forbearance Plan Type Code 3 - Unemployment and Federally Declared Disaster applies when a borrower qualifies for and participates in both an UP Forbearance Plan and a FDD Forbearance Plan. 15 For a borrower transitioning from a HAMP trial period plan to UP, refer to the UP Additional Data Requirements section of this document. Principal Reduction Alternative (PRA) For non-gse loans, servicers may be given additional flexibility to offer relief to borrowers whose homes are worth significantly less than the remaining amounts owed under their first lien mortgage loans. A servicer is required under applicable guidelines to evaluate the benefit of principal reduction for every HAMP-eligible loan with high negative equity. PRA is part of the First Lien Trial and Official Loan Setup transactions; therefore loan-level data must be reported no later than the fourth business day of the month. There is no additional registration required to participate in PRA. The Principal Reduction Alternative Code in the Trial Setup and Official Modification section of the HAMP Reporting Tool is a mandatory data attribute for non-gse loans. If a servicer is required under applicable guidelines to offer PRA, such servicer must choose between options 2 and 3 below; otherwise option 1 signifies PRA was not offered. 1 - No PRA Standard waterfall 2 - PRA waterfall incented forgiveness 3 - PRA waterfall non-incented forgiveness Figure 1-9: PRA data attribute When the Principal Reduction Alternative Code is either 2 PRA waterfall incented forgiveness or 3 PRA waterfall non-incented forgiveness, the following data attributes must be populated with the appropriate values: Principal Reduction Alternative Amount Amount Capitalized The PRA NPV Model Result Amount Post-mod The PRA NPV Model Result Amount Pre-mod Making Home Affordable (MHA) Servicer Reporting Requirements
16 Figure 1-10: PRA data attributes Figure 1-11: PRA data attributes The Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (HHF) The HHF includes funding for several states that have been hit the hardest by the housing crisis and economic downturn. To indicate a borrower s receipt of funds under the HHF program, servicers must include the Supplementary Assistance Code as part of the HAMP First Lien Trial and Official Loan Setup transactions. This loan-level data must be reported no later than the fourth business day of the month. The Supplementary Assistance Code is a mandatory data attribute. 17 Figure 1-12: HHF data attribute Federally Declared Disaster (FDD) Guidance The FDD guidance in the MHA Handbook provides servicers of non-gse loans with parameters for dealing with borrowers affected by a federally declared disaster. There is no additional registration required for non- GSE servicers following the FDD guidance. Implementation of the FDD guidance is part of the First Lien Trial and Official Loan Setup transactions; therefore, loan-level data must be reported no later than the fourth business day of the month. To report an FDD forbearance plan, non-gse servicers should select the Forbearance Plan Type Code - 2 Federally Declared Disaster. When a borrower qualifies for and participates in both an UP Forbearance Plan and a FDD Forbearance plan, the non-gse servicer should select Forbearance Plan Type Code 3 Unemployment and Federally Declared Disaster. 18 Figure 1-13: FDD data attribute Reporting Transfer A reporting transfer involves the reassignment of the servicing rights for a loan from one servicer to another. To initiate a reporting transfer for a HAMP trial or official modification, the servicer (transferor) must submit the required HAMP Reporting Transfers paperwork to the address provided. The HAMP Reporting Transfer paperwork is available on HMPadmin.com within the Servicer Documents section of the HAMP Programs menu. The MHA Program Administrator will validate the reporting transfer request for completeness and, in the case of a non-gse servicer, adjust the servicer s cap allocation accordingly. Loans in trial or official modification will be processed by a HAMP Operations Analyst. The servicer will be notified once the transfer is completed. Additional Data Requirements Servicers may be required to provide additional data requirements for the following aspects of the MHA programs: HAMP UP FDD PRA Servicers should access the following sections of the SD tab within the HAMP Reporting Tool to report the additional data requirements: Identifying Information, Government Monitoring Data, NPV Model Inputs, and Reason Code. 20 Figure 1-17: NPV Model Inputs Servicers must report a Trial Not Accepted/Not Approved Reason Code for each loan that is evaluated and not offered a TPP or does not accept a TPP. Similarly, servicers must report a Trial Fallout Reason Code for each loan that falls out of or withdraws from a trial period or completes the trial period but does not result in an official modification. Figure 1-18: Reason Code HAMP Additional Data Requirements In support of the additional data required on the SD tab, as mentioned, HAMP Exhibit A sets forth additional guidance regarding which data is required to be reported for mortgage loans under scenarios that may occur when a mortgage loan is evaluated for HAMP. Each time data elements are reported in the Government Monitoring, NPV Model Inputs, or Reason Code sections, servicers must re-submit the applicable, current data in the Identifying Information section. UP Additional Data Requirements In addition to the data required on the SD tab, as mentioned, servicers supporting UP should be aware of the Reason Codes required for loans in the following scenarios: Making Home Affordable (MHA) Servicer Reporting Requirements

A borrower that has been approved for a HAMP trial modification and has not yet completed the trial period can enter into the UP Forbearance Plan; however, the existing HAMP trial modification must be cancelled by submitting via the Additional Data Requirements transaction with the Trial Fallout Reason Code 19 Unemployment Forbearance Plan. 2. A borrower not approved for a trial modification, and for which an UP forbearance plan is not completed, should be reported via the Additional Data Requirements transaction with a Trial Not Approved/Not Accepted Reason 19 Unemployment Forbearance Plan; however, if another Trial Not Approved/Not Accepted Reason Code is more appropriate, the more appropriate reason code should be used in lieu of 19 Unemployment Forbearance Plan. FDD Additional Data Requirements In addition to the data required on the SD tab, as mentioned, servicers supporting FDD should be aware of the Reason Codes required for loans in the following scenarios: 1. A borrower that has been approved for a HAMP trial modification and has not yet completed the trial period can enter into the FDD forbearance plan; however, the existing HAMP trial modification must be cancelled by submitting an Additional Data Requirements transaction with the Trial Fallout Reason Code 20 Federally Declared Disaster. 2. The file size must not exceed the 5MB size limit. The validation will occur at the same level as the current Business Rule validation, which is at the loan level. If the Submission Status code and the Program Type provided do not match a valid value for the LFN file number uploaded, the loan will receive an error in the HAMP Reporting Tool response file report. The loan will not be transmitted to the HAMP Reporting System for processing. The loans that pass validation will continue to be processed. File Structure Validation HAMP loan-level transactions submitted via the UI or by uploading a file to the HAMP Reporting Tool will be validated for structure. If any data attribute within a file fails structural validation, then the entire file will be rejected and a structural validation error message will be provided. If the loan-level transactions pass the structural validation, the HAMP Reporting Tool will validate the transactions against a suite of business edits. Loan records that fail business rules validation will be rejected, and a business rule error message will be provided in the response file report. Loan records that pass business rules validation will be transmitted to the HAMP Reporting System for processing. The HAMP Reporting System will edit and validate the input XML file. 24 will generate an XML response file that servicers can view and download from the Reports tab within the HAMP Reporting Tool. HAMP Reporting System Response Files The following are the response file reports: Files Received Web Data Submissions Files Received The Files Received report is composed of transactions submitted via the Upload Files functionality. This report provides a transaction processing status from both the HAMP Reporting Tool and the HAMP Reporting System for each submitted transaction, and includes a description of any warning or error messages (if applicable) that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue. To access the Files Received report: 1. Select the Reports tab. 2. Click on the Files Received link option. Figure 1-23: Reports/Files Received Web Data Submissions The Web Data Submissions report lists the transactions that the servicer submitted via the Web forms submissions (manual entry). The report provides a transaction processing status from the HAMP Reporting System for each submitted transaction and includes a description of any warning or error messages that occurred for each individual transaction in the file. Transactions with errors must be corrected and resubmitted for processing to continue. At 30 minute intervals, any transaction successfully entered via the Web site forms are bundled together and sent to the HAMP Reporting System for processing. 25 Figure 1-24: Web Data Submissions Report HAMP Incentive Payments Servicers, borrowers and investors are eligible for incentive payments for official loan modifications in HAMP. The HAMP Compensation Matrix provides details on the incentive amount, frequency, timing and conditions required. After the initial one-time set-up payments have been disbursed, servicers must submit an OMR on a monthly basis to ensure timely subsidy payments and accruals to the investor, borrower and servicer. Program incentives are deposited on the 27th calendar day of each month or previous business day if the 27th falls on a weekend or a holiday in a particular month. The deposit is transferred via the Automated Clearing House (ACH) Network. Servicers must provide ACH banking instructions in Section 3 of the HAMP registration form for the account that will be used as the default account for the receipt of payments. Servicers are allowed to designate three additional accounts in Section 4 of the HAMP registration form to receive payments. Viewing Reports HAMP participating servicers will have access to the following reports using the HAMP Reporting Tool: First Lien Cash Payment Summary HAMP Master Servicer Loan Reconciliation First Lien Missing OMRs First Lien Disqualified Loans First Lien Cash Payment Summary The First Lien Cash Payment Summary report provides loan-level compensation payment data for each reporting cycle and is available the day before payments are deposited and for 180 calendar days, thereafter. An Incentive Type code will allow servicers to identify the program for which the incentive payment was made. There will be one row per loan per program incentive. The monthly close is the 17th calendar day or the previous business day prior to the 17th, if the 17th falls on a weekend or holiday. This reconciliation data is posted four business days after the end of a loan cycle (the 17th calendar day of the month) and is available for 180 calendar days, thereafter. Reports are differentiated with a Program Type. To view and download the HAMP Master Servicer Loan Reconciliation report: 1. Log in to the HAMP Reporting Tool. 2. Select the Reports tab. Home Affordable Foreclosure Alternatives (HAFA) Reporting Requirements Introduction The Home Affordable Foreclosure Alternatives (HAFA) Program provides foreclosure options to borrowers who may have: met the eligibility criteria for HAMP but did not qualify for a HAMP trial period plan (TPP); failed to complete a HAMP TPP; missed at least two consecutive payments on an official modification; or requested a short sale agreement (SSA) or a deed-in-lieu agreement (DIL). Servicer Registration To participate in HAFA, a servicer must be registered as a HAMP-participating servicer using the HAMP registration form. Servicers participating in HAFA are also required to register with Lender Processing Services, Inc. (LPS) to have the ability to report scheduled loan-level data via the HAMP Reporting Tool. A first time user of the HAMP Reporting Tool should contact LPS at and select option 1, and then option 5 to register. Cap Allocation Monitoring If a HAFA transaction causes a non-gse servicer to exceed its Program Participation Cap, the system shall reject the transaction with the following error message: The transaction cannot be processed because the cap allocation for the HAMP Registration Number associated with the Servicer Number has been reached. Reporting Servicers participating in HAFA are required to report loan-level data to the HAMP Reporting Tool at key milestones. Each milestone is a separate data transmission and is listed as the following: Notification the SSA or a DIL is signed and executed by both servicer and borrower; Short Sale/Deed-in-Lieu Loan Setup the transfer of property ownership (closing of the SSA or acceptance of the DIL) is complete; and Cancellation when the SSA or DIL agreement expires or is terminated by the servicer. Servicers will be able to submit these transactions through file upload, as described in the Upload Files section of this document, or through the user interface (UI) forms found in the HAMP Reporting Tool. To access the HAMP Reporting Tool: 1. Log in to HMPadmin.com. 2. Click the HAMP Loan Reporting Tools & Documents link. 3. Click the Launch the HAMP Reporting Tool. 4. Log in by using the logon name and password assigned to you after registering for the tool. Once logged in, see the home page for a list of tabs at the top of the HAMP Reporting Tool. 33 Short Sale/Deed-in-Lieu Notification Servicers participating in HAFA must report notification loan-level data on or before the fourth business day of the month after a borrower and servicer have fully executed a signed agreement for an SSA or DIL. A HAFA notification must be submitted before a HAFA loan setup transaction can be processed. Servicers participating in HAFA must cancel an existing HAFA notification and resubmit a HAFA notification if the agreement termination date is exceeded and a new agreement has been signed. The new notification should be submitted using the original Agreement Issue Date and the new Agreement Expiration Date. To process a HAFA notification, the servicer participating in HAFA must have either evaluated the borrower for HAMP or given the borrower the opportunity to be evaluated for HAMP. Therefore, one of the following corresponding records (matched by HAMP Registration Number, HAMP Servicer Number and Servicer Loan Number) must exist in the HAMP Reporting Tool: A corresponding HAMP Additional Data Requirements data submission with an acceptable Trial Not Approved/Not Accepted Reason Code*; A first lien TPP record that falls out of trial with an acceptable Trial Fallout Reason Code**; or A first lien official modification that has not been paid off. *The allowable Trial Not Approved/Not Accepted Reason Codes are: 5 - Investor Guarantor Not Participating 6 - B/K Court Declined 7 - Negative NPV 8 - Offer Not Accepted by Borrower/Request Withdrawn 10 - Previous Official HAMP Modification 12 - Excessive Forbearance 19 - Unemployment Forbearance Plan 20 - Federally Declared Disaster ** The allowable Trial Fallout Reason Codes are: 8 - Offer Not Accepted by Borrower/Request Withdrawn 12 - Excessive Forbearance 13 - Request Incomplete 14 - Trial Plan Default 19 - Unemployment Forbearance Plan 20 - Federally Declared Disaster NOTE: If a borrower requests an SSA or DIL and declines to be evaluated for HAMP, servicers must report an Additional Data Requirements transaction with a Trial Not Approved/Not Accepted Reason Code equal to 8 - Offer Not Accepted by Borrower/Request Withdrawn and a HAFA Short Sale or Deed-in-Lieu Reason Code of "Does Not Qualify for a Trial Period Plan.
