3 has become an important source of information in a lawsuit As a result a well managed archiving system is vital to an organization s ability to mitigate legal risks from a lawsuit Introduction Across all industries and among organizations of all shapes and sizes, increasing numbers of messages are being sent and received an estimated volume of 156 messages per day per mailbox. The content contained in these messages is used for improving business communications, enhancing customer satisfaction, and maintaining a competitive edge in today s business environment. This deluge of communication has created an enormous challenge and risk to businesses which must manage the content that contains for legal discovery (internal legal audits and investigations) and overall corporate governance. This white paper will present an improved approach to legal discovery for Microsoft Exchange systems provided by Mimosa Systems. Unlike existing methods for legal discovery of Exchange Server data, Mimosa s approach delivers major advances in performance and granularity of information. To begin this paper, we will review the industry forces that are driving the need to manage for legal discovery, followed by a discussion of the market-leading enterprise messaging application Microsoft Exchange Server and the challenges it presents for legal discovery. Next, Mimosa s new approach to legal discovery for Microsoft Exchange will be described in detail and compared to existing methods. Mimosa s innovative new approach to legal discovery on Exchange Server offers legal discovery benefits for performance, quality of information captured, and for reducing the overall cost and risk of legal discovery. 4 Legal Discovery There are a growing number of regulations in addition to the ones already in existence (Sarbanes-Oxley Act, Health Insurance Portability and Accountability Act (HIPAA), SEC Rule 17a-3/17a-4, and Graham-Leech-Bliley Act) that dictate the need to preserve for record keeping. Increased regulatory scrutiny and fines imposed on the financial services industry in 2002 caused the initial push to manage and preserve data for compliance. A second major market driver is now emerging for retention, which is the need to manage and preserve for legal discovery. Legal requests to search come from external civil legal proceedings, and frequently from internal requests. A common example of internal drives is an HR manager who needs to search sent between two employees who are suspected of passing offensive information. According to a recent survey by Osterman Research, 75% of organizations have been ordered to produce in litigation. In the same survey, it was found that 74% of organizations surveyed have had to rely on backup tapes, local message stores, etc. to retrieve s in response to a request from the in-house legal department 1. Facing an increasing number of internal and external requests to retrieve data, organizations have no choice but to pay the added cost of searching backup tapes or invest in an archival solution to manage historical data for discovery. In a 2005 ESG report, the cost to search backup tapes was estimated between $1,500 and $3,000 per tape, in 2008, it is now closer to $4000 per tape. For a typical discovery of a mid- to large-sized organization, thousands of tapes can be involved, so the total cost of discovery based on backup tapes can be in the millions 2. As a result, the cost of one discovery can be an order of magnitude greater than the cost of an archival solution. This is strong financial incentive to invest in archiving and avoid the high cost of searching backup tapes and custodian storage spaces. 5 Microsoft Exchange Server The market leading enterprise messaging application is Microsoft Exchange Server. Exchange is a powerful messaging collaboration application that can support tens of thousands of users simultaneously. With Exchange, users create, send and receive , make changes, and delete messages at will. Exchange also stores a wide range of information besides such as meeting invitations, contacts, and notes. Exchange information is very difficult to manage for legal discovery due to its highly dynamic nature. Even a simple request to roll-back Exchange information 24 hours can be a major undertaking. To preserve Exchange for compliance and legal discovery, a capability of Exchange Server called journaling is most often used. Exchange journaling was introduced in Exchange Server v5.5 as a means to preserve Exchange data. Exchange Server has many native capabilities to manage for user productivity, but it does not automatically preserve all user transactions. To record communication, journaling is enabled for each Mailbox Store for it to record all sent and received for the Mailbox Store in a separate (tamperproof) mailbox, defined by the Administrator. It is in this special journal mailbox that all sent and received by the Mailbox Store is recorded. Thirdparty archive applications access this journal mailbox and copy the data into an archive where it is indexed and made searchable for discovery. In an Exchange environment, without journaling enabled, there is no practical means of preserving for discovery. For example, consider a simple discovery request to review all the that Joe Smith received yesterday. Simply searching in Joe Smith s current mailbox is not sufficient since important may have been deleted by Joe or the system. To produce complete results an Exchange administrator would need to search from the Exchange Server, from backup tapes, and possibly from Joe s local PST files. It would take hours to search all this information and there would be no assurance that the search is 100% complete and accurate. It s possible that Joe was involved in some malicious behavior and deleted the offensive . With journaling enabled for Joe Smith, the administrator can search the journal mailbox and retrieve all that Joe sent or received, completing the search request in a short amount of time and with more reliable results. The importance of journaling can be stated simply without journaling the management of Exchange for legal discovery is, for all practical purposes, impossible. Most archival solutions that manage Exchange for compliance and legal discovery use journaling. archival solutions also use the Exchange MAPI interface for storage management, but this 5

6 is not sufficient for legal discovery. In a court of law, for accurate legal discovery, it is essential to have a complete history. If days of history are missing and not represented in the archive, legal discovery cannot be considered complete. Organizations can face enormous risk as a result. Morgan Stanley is an example of an organization that has been fined multiple times by the SEC for not preserving adequately. Exchange Journaling Challenges There are several major challenges for deployment of journaling in a production Exchange environment. The first is the performance impact on Exchange Server, which can be 15 to 35 percent performance degradation 3. A Microsoft TechNet article describes the necessary provisioning steps for implementing journaling. The basic challenge is that journaling doubles the traffic for the Mailbox Store. To keep Exchange overall performance equivalent to its performance before journaling is enabled; Exchange resources (e.g. memory, storage, and bandwidth) must be doubled. Depending on the number of Mailbox Stores enabled, it is recommended that journaling be located on a dedicated Exchange Server. For many Exchange environments it is too disruptive and costly to add additional journaling servers and resources. In organizations that have deployed journaling, the implementation has been selective, deployed only for mailboxes that absolutely require it. For the financial services industry, it is the brokerdealers. In public corporations, adhering to the Sarbanes-Oxley Act, it is those who are responsible for financial results, financial auditors, and executive officers. A second major challenge of journaling is that not all mailbox information is captured. Consider all the information that a standard Exchange mailbox contains. In addition to , Exchange mailboxes contain calendar appointments, address books (called Contacts), and multiple productivity tools (e.g. Notes, Journal, and Tasks). Exchange also tracks in user-defined folders and standard folders such as Drafts, Outbox, Inbox, Sent, and Deleted Items as well as message attributes such as opened or unopened. All of these message items constitute a complete Exchange mailbox. As stated previously, journaling records all communication that is sent or received at single instance in time. What journaling misses is the activity that is neither sent nor received as well as changes that occur over time. 3 Journaling with Exchange Server Microsoft TechNet Chapter 6. 6

7 There is a need for a new, improved method of managing Exchange mailbox informatoin for legal discovery that goes beyond the capabilities of journaling. What journaling misses is the activity that is neither sent nor received as well as changes that occur over time. For example, when a user deletes an (or any message item) that activity is not captured by journaling. When messages are created or modified, but not sent, they are not captured by journaling. When users file into subfolders, journaling does not record this folder information. And when users create personal calendar appointments, journaling has no record. All the information that journaling does not capture constitutes a major percentage of the total historical mailbox information as well as data that could be requested in discovery. It includes both the content of all message items and the context of the same message data specifically the properties, the folder location, and the item history. Exchange Journaling for ediscovery Based on interviews with users and legal experts in the field of legal discovery (ediscovery), the current state of the art for ediscovery on Exchange Server is journaling. It provides a documented record of all incoming and outgoing for a given mailbox. The content preserved provides legal proof of that a user either sent or received. However, there is a growing number of organizations that have enabled journaling (at substantial cost) with the understanding that journaling would address all needs for ediscovery. They have discovered that journaling does not capture all potentially discoverable data for litigation. An example is calendar items. Journaling does not capture when calendar items are created, modified, or deleted. Another example is the history of a message item. Journaling does not capture when a message was created, when it was moved to a subfolder, or when it was deleted. This data is crucial to understanding the intent of the user under investigation. When you consider that the user being investigated will try to cover his tracks by moving or deleting message data, it is critical to have access to the complete history of each message item. Relying on journaling alone for Exchange ediscovery, organizations have had to resort to retrieving backup tapes to restore calendar items, folder information, and other information that journaling does not record. As discussed earlier, restoring and searching old backup tapes is expensive and is the reason that Journaling was implemented in the first place. There is a need for a new, improved method of managing Exchange mailbox information for legal discovery that goes beyond the capabilities of journaling and avoids having to restore and search old backup tapes. 7

8 Mimosa NearPoint for Microsoft Exchange Server Mimosa NearPoint for Microsoft Exchange Server is a unified information management solution for Microsoft Exchange that combines immediate recovery, mailbox extension, archival, and discovery in a single solution. The Mimosa NearPoint software solution (Figure 1) is based on standard Microsoft technologies, and runs on a standard Intel server. Mimosa NearPoint serves as a platform for ediscovery for Exchange Servers by providing non-invasive data capture of all Exchange historical mailbox information using a unique process called Continuous Application Shadowing. Continuous Application Shadowing replaces Exchange Journaling and captures Exchange Transaction Log Files as a real-time process and stores all the mailbox information in an Indexed Object Repository where it can be accessed for discovery. 10 ediscovery Using NearPoint This paper will now trace six common steps of ediscovery and compare the features of NearPoint to existing ediscovery methods. The six steps described in this paper are a representation of a typical in-house ediscovery, although the process can vary between organizations. In each step, unique Mimosa NearPoint methods for data capture, protection, and processing will be described, in the order that they impact ediscovery. As measured by quality of data captured, protection of data, and efficient data handling, Mimosa NearPoint raises the bar for ediscovery for Microsoft Exchange Server. Step 1: Identification Identification involves determining the types of information to be collected and the persons or custodians most likely to have it. For ediscovery of , the potentially responsive information is all contained in the Microsoft Exchange Server. Exchange contains as well as other information such as calendar appointments, address books, personal notes, task lists, and daily journals. Taken together, these message items constitute a complete Exchange mailbox. Considering only content and ignoring these other message items would be a significant omission in the discovery process. The other items also contain original content and they create an electronic trail of information that leads to understanding user behavior. A major strength of Mimosa NearPoint is that it automatically captures all mailbox information, including messages, attachments, calendars, contacts, notes, tasks, etc. Every Exchange user is a possible target for ediscovery. In the Exchange environment, users (or custodians) are synonymous with mailboxes. Mailboxes in Exchange are managed in Mailbox Stores with a maximum of twenty Mailbox Stores in one Exchange Server. A decision is made for each Mailbox Store whether or not to enable journaling. Since journaling places a very large performance burden on Exchange, administrators are careful about enabling journaling. To simply enable journaling for every Mailbox Store would be costly and highly disruptive to the existing Exchange environment. Generally, journaling is most effective when the mailboxes (users) selected for archiving are co-located in the same Mailbox Store. That way, a minimal number of Stores will be impacted. Mimosa NearPoint raises the bar for Legal Discovery for Microsoft Exchange Server.performs automatic recovery of all Exchange servers. However, a major flaw with this approach is that it assumes you know ahead of time which users will be involved in litigation. With NearPoint in place, when new mailboxes are added to Exchange, NearPoint automatically includes them in processing. When mailboxes are removed from Exchange, they are preserved in NearPoint according to the retention rules you set. With NearPoint you have more confidence in your discovery results because all 10

11 NearPoint can track the complete activity history for the object, including all historical edits, deletions, and forwards. mailboxes are archived, so it doesn t matter which user is subpoenaed, you are always prepared. The Mimosa NearPoint approach is a major improvement over existing firstgeneration methods because it archives all mailboxes completely and automatically so no mailbox pre-selection is necessary. Step 2: Collection Collection involves the reliable and complete capture of information from Exchange. Mimosa NearPoint supports all versions of Exchange 2007, 2003, and 2000 for complete data capture of the mailbox information located on the Exchange Server. NearPoint is able to capture this information directly and automatically in near real-time without placing any agents on the Exchange servers. As discussed previously, traditional data capture of Exchange Server mailbox information relies on Exchange journaling. To overcome the limitations of journaling, Mimosa developed a new approach to Exchange data capture called Continuous Application Shadowing. Continuous Application Shadowing Continuous Application Shadowing copies Exchange databases and transaction logs to the NearPoint server, using the Exchange Extensible Storage Engine (ESE) Backup API. The ESE Backup API was chosen because it delivers reliable, accurate results with minimal disruption to Exchange. Another important advantage of using the ESE Backup API is that it provides a complete record of all mailbox information. NearPoint captures complete Exchange mailbox information using a continuous process that captures the Exchange transaction log files in real-time as they are written to disk. NearPoint processes the log file information into individual message items and stores all the information in an Indexed Object Repository. The Indexed Object Repository is accessed by the NearPoint ediscovery Option for legal discovery. Off-Host Capture Local Personal Store (PST) files are an off-host location for Exchange mailbox information which can contain considerable amounts of data that can be requested in ediscovery. To manage these off host PST files, Mimosa NearPoint provides manual and automated tools such as the PST Archiving Option to search, open, and migrate the contents into the NearPoint archive. After PST data is read by NearPoint, it is indexed and made searchable like all mailbox information that was captured directly from the Exchange Server. The NearPoint archive repository ensures complete and accurate search results by managing all Exchange data from Exchange Servers and PST files in a single archive repository. 11

12 Rich Mailbox Information The mailbox information that NearPoint processes and manages in its archive repository contains full message content and context including message properties, flags, permissions, and folder location. NearPoint allows quick exploration of relationships amongst items such as conversation threads and item history and provides the ability to re-create point in time snapshots of any mailbox or folder for interactive viewing or batch export. NearPoint can track the complete activity history for the object, including all historical edits, deletions, and forwards. Using NearPoint ediscovery Option, administrators and auditors can perform complex search and discovery of who, what, when, and where of every item throughout its lifetime, from creation to destruction in each and every mailbox, for senders and recipients. Mimosa NearPoint is superior to other first-generation archive solutions because it captures complete mailbox content and contextual information without the performance impact of Exchange journaling and avoiding the need to search backup tapes. Step 3: Preservation Mimosa NearPoint preserves data authenticity and protects data against unauthorized tampering using multiple methods. First, NearPoint leverages the native security of Windows 2003 server and manages all the individual message items and attachments securely on the NTFS file system. All files and folders are controlled with permissions and access rights and only NearPoint has the rights to edit, delete, or make any modification to its file archive. NearPoint provides further protection by creating digital signatures using the MD5 hashing algorithm. For every , NearPoint calculates a MD5 hash. It also calculates a MD5 hash for the body and the attachment (if one exists). Each time an or attachment is retrieved from the NearPoint archive, a new MD5 hash is calculated and compared to the original stored in a Microsoft SQL database. This process ensures that the data in the NearPoint archive is always in original form. The ediscovery Option lets auditors place retention holds on any selected messages. These holds take precedence over the standard retention policies, thereby ensuring that the data is preserved for the duration of the legal matter or internal inquiry. Mimosa NearPoint preserves data authenticity and protects data against unauthorized tampering using multiple methods. 12

13 Step 4: Processing NearPoint provides multiple means to begin processing for ediscovery. Using the NearPoint base product, auditors or legal counsel have access to three search tools via Outlook named Quick Search, Browse Search, and Advanced Search. Access is controlled by the NearPoint administrator, and when configured, auditors can access multiple mailboxes and perform quick search and discovery of all historical information. These Outlook search tools are easy to use and allow anyone to quickly determine the scope of a potential investigation. By defining search time period, search content, and recipient names, a fast ad hoc search can be performed and the search results can be exported in a PST file. This capability in the NearPoint base product is perfectly suited to perform quick in-house searches. But for larger discovery projects that will span thousands of messages and require the coordination of multiple auditors and legal counsel, Mimosa designed the ediscovery Option for Mimosa NearPoint. NearPoint ediscovery Option The NearPoint ediscovery Option is a specialized ediscovery application that integrates seamlessly with NearPoint and supports full search and discovery of all historical mailbox information contained in the NearPoint archive repository. (Figure 2) Using ediscovery, auditors and legal counsel can perform detailed searches, save searches, and share search results with other discovery team members. The first step in the discovery process is to construct a new search. The ediscovery Option provides easy access to all relevant parameters including mailboxes, search words, sender/recipient names, time period, and a host of detailed message properties like size, importance, permissions, flags, etc. Searches are performed with a click of a button in seconds the complete NearPoint archive is searched and the results are displayed. Results can be sorted and displayed without having to leave the application. Advanced Search Capability The NearPoint ediscovery legal discovery application is able to perform complex searches of the NearPoint archive providing rich detailed results to speed ediscovery. In the figure below (Figure 3), auditors or legal counsel begin the discovery process by defining searches using a wide number of settings for mailbox, time period, search content, recipients, and internal/external . The first step is to select the custodians for search. Each auditor is assigned a set of mailboxes by the administrator and can select any or all of these mailboxes via the Search Criteria screen. Next the auditor can define the search time period, the search words, and optionally, specify recipient names. NearPoint provides the ability to search recipients by To/From/CC and BCC. Figure 3. ediscovery Search Criteria Interface Another unique search feature allows auditors to identify by direction. For example, this feature makes it simple to search all sent or received that is external to the organization. Searches can be saved and later recalled for reuse or modification. 14

15 Further search choices are provided by NearPoint and allow access to message property information such as read/unread, attachments yes/no, attachment size, importance, and tag filters. (Figure 4) These filters make it easy to screen for unread message or message that only have attachments. The tag filters are self-defined and assigned by the auditors during their review of search results. By tagging messages with useful designations such as confidential, sensitive, or Jones Case, other auditors can save time when search results overlap with other investigations. Item History and Conversation Thread This is a powerful feature not found in other Exchange discovery tools. The history of a message item is a record of when a message was created, every person to whom it was sent, every folder to which it was moved, and when the message was deleted. NearPoint records every movement of a message with in the Exchange environment. Using item history, you can quickly discover every change made to a particular message and every person that ever received it. The conversation thread display shows the communication history of a message. It links every Forward or Reply for a particular message thus displaying its conversation history. Both the item history and conversation thread illustrate the power of the NearPoint archive. Since the NearPoint archive manages a complete historical view of Exchange mailboxes, it is able to support these comprehensive views requiring complete detail of a mailbox s history. Further search choices are provided by NearPoint and allow access to message property information such as read/unread, attachments yes/no, attachment size, importance and tag filters. 16 Step 5: Review For matching real-world conditions where multiple auditors and legal counsel work on the same case, NearPoint ediscovery allows multiple persons to work together efficiently on thousands of s. Working independently in the ediscovery workspace, auditors search and review the contents for responsiveness. Messages that are deemed important are selected and stored in a Selection List. This allows the auditor to return to the same search results at a different time and not lose their work. Auditors can also apply tags to results that they defined. These tags are stored with the message until removed. By using tags, multiple reviewers can work more efficiently, with less redundancy, reducing overall discovery cost. In a typical discovery, multiple auditors and legal counsel will be working separately on different search results, reading, tagging, and saving in their respective Selection Lists. At anytime, the results in the Selection Lists can be saved in a common result set called the Review List. The Review List is different from the normal saved results because it contains results from multiple searches. In this manner, the Review List functions as a central repository of search results for the entire discovery team. Typically a senior discovery team leader will perform one final review of the results in the Review List before applying a case-specific litigation hold and exporting the results to opposing counsel. Using NearPoint ediscovery, reviewers can realistically tackle thousands of messages in a fraction of time it would take using traditional tools that depend on backup tapes and IT involvement. Step 6: Production The final step of legal discovery is production of search results for export to external counsel and/or for the case archives. NearPoint performs production by saving search results to a PST file. A PST file can be written to a CD or DVD for long-term archival and it can be attached to an for easy transport. A PST file has the advantages of easy handling and it displays the message data in native format, including all Exchange metadata information. Using Outlook, a PST file can be opened and accessed just like normal , with full access to all message information. For paper production, PST data can be printed and/or converted to PDF format. 16
