1 Rental Car Policy Pricing Policy Jay Munie Auto Sales makes every effort to provide the most accurate, up-to-date pricing information. however, occasionally, errors in stated rental rates or charges occur due to errors resulting from our rate management software or rental software. in the event a reservation is made at an incorrect rate or with incorrect charges, due to technical error, Jay Munie Auto Sales shall have the right to refuse or cancel any reservation made at the incorrect price. Age Policy The minimum age of the renter or any additional driver must be 21. drivers ages may rent for an additional charge of dollars a day. Refueling Requirements on Return vehicle must be returned with the same amount of fuel as rented to avoid a refueling service charge of $9.99 per gallon. General Rules The car rental company requires a credit card to confirm this reservation. although your credit card will not be charged at time of reservation, fees may apply for cancellation or no-show. as a general guideline, cancellation should be made at least 72 hours before your scheduled pick up time. Late return fee: rent max offers a 59 minute grace period, if the car is returned after this grace period rent max will assess an hourly rate plus an additional $10.99 per hour, maximum $59.00, and if the customer obtained our coverage's, an additional daily charge will also be assessed. Reservations: any changes to the reservation or rental may result in a change of rate or additional fees. if a customer calls to extend a rental and our rates have increased, the customer will be charged the higher rate. A credit card guarantee is required for each reservation. although your credit card will not be charged at time of the reservation customers who fail to cancel their reservation at least 48 hours prior to pick up the reserved vehicle from the source that the reservation was originally booked, or fail to show up for their rental, will be subject to a one day rental charge or $ 29.00

2 fee, whichever is higher. as a general guideline, cancellation should be made at least 72 hours before your scheduled pick up time. Insurance Cdw is a product that limits the renters financial responsibility for any damages done to the rented vehicle to a maximum deductible that varies by vehicle type. purchased of cdw will be mandatory in certain instances. please review the policies regarding insurance, debit cards and local/ Fargo, ND resident renters. insurance required coverage purchase of cdw may be mandatory unless the renter can provide proof of insurance for loss or damage to the rented vehicle that is valid in the state of North Dakota, Minnesota, New Jersey or Pennsylvania. Insurance from outside the U.S (including puerto rico) is not acceptable. local resident renters must show acceptable proof of auto liability and physical damage insurance coverage or purchase collision damage waiver (cdw). acceptable proof of insurance must include the name and address of the insurer and the policy and the required coverage. if a customer cannot provide acceptable proof of insurance the customer will be required to purchase our coverage in order to rent our vehicle. if the customer does not wish to purchase our coverage, and has acceptable proof of insurance then a $ 1, usd deposit will be held from their credit card. we can elect not to rent to the customer who does not present the required proof of insurance coverage or does not purchase our coverage. Customers who rent either a 12 or 15 passenger van are required to present at the time of rental a valid insurance certificate with $1,000,000 excess liability coverage naming Jay Munie Auto Sales as an additional insured for the entire rental period. those customers who cannot produce this insurance certificate will be required to purchase our coverage if they wish to rent either of these vans. Road side assistance: (era) is an optional product, this program will have a cost of $5.59 usd per day. with era, key services (lost or locked in car), jump starts and gas service (in case you run out of gas) will be provided at no cost. if customer prefers not to purchase era, then will be responsible for any *service fees* in the event said customer requires any of the services listed above. Valid driver s license Renter must present a valid driver license at the time of rental. foreign renters must present a valid driver license and a valid passport and based on the date of the entry stamp, will be allowed to rent a vehicle for up to 28 days. United States Citizens and U.S. Military Personnel: A renter or any additional authorized driver who is a citizen of the United States, must present at the time of rental:

3 (1) a driver's license issued by any state, territory or possession of the United States, and valid for the entire rental period (2) a temporary driver's license, valid for the entire rental period (3) a traffic citation issued as a temporary license, valid for the entire rental period (the court date being the expiration date) and a second form of identification with signature (excluding the credit card used for rental), (4) a valid U.S. military identification card plus an expired driver's license for active duty U.S. military personnel in those states where active duty U.S. military can drive on an expired driver's license. (5) A valid driver's license issued by a province or territory of Canada (6) A foreign driver s license* issued by the country of residence of the renter and additional drivers. If the driver s license in not in English, the renter and drivers will be required to present both the foreign issued driver s license and a current International Driver s Permit ( IDP ); or, if from Japan, a Japanese Translation Service. An IDP does not give a person the right to drive, but provides a certified translation of the valid foreign driver s license. An IDP can be obtained in the driver's country of residence only with a valid driver s license. An IDP (or certified translation) without the foreign issued driver s license is not acceptable. *If the foreign issued driver s license is from a country where permanent or non-expiring driver s licenses are issued, the renter and any additional drivers will also be required to show their passport, visa or other current U.S. issued documentation at the beginning of the rental authorizing the renter or driver to be present in the USA at the time of rental. M. One-way Rentals: One-way rentals within the United States and within Canada vary by location and vehicle availability. A one-way drop fee will apply. N. Optional Equipment: 1. Child Safety Seats: For an additional charge, which varies by location, infant, toddler, and child/ youth safety seats are available at many locations. Acceptable forms of payment A major credit/debit card in the renters own name must be presented at the time of pick-up. a hold will be placed on all credit/debit cards for the estimated amount of the rental plus a minimum of $250 security deposit, except that debit cards are not an acceptable form of payment for residents. The hold will be released at the end of the rental when the final charges are settled.

4 note: funds charged against a debit card will no longer be available for immediate use and may take up to 14 days or longer depending on the bank to become available. we will not be responsible for any returned checks, insufficient funds charges or bank fees related to this process. a confirmation of your reservation does not mean that your debit/check card is acceptable rent max does not accept the small key ring credit cards. in the event a customer presents the key ring credit card at the time of rental the location will ask the customer to present the standard size credit card or another form of payment. prepaid cards are not accepted. Mileage Restriction Vehicles cannot be taken outside the state of North Dakota any renter who takes the rental vehicle outside the state of will be charged a $ out of state fee plus a mileage charge of $0.49 cents per mile. Pennsylvania, New Jersey, or Minnesota license holders are entitled to unlimited mileage within the state of North Dakota. All holders of a North Dakota driver s license will be allowed 150 miles free per day, 350 miles per week, any excess of mileage allowance will be charged at $ 0.49 cents per mile. LIABILITY, INSURANCE AND OPTIONAL PROTECTION PACKAGE A. Loss or Damage to the vehicle: The renter and any additional drivers are absolutely liable for any loss or damage to the rental vehicle, even if someone else caused it or the cause is unknown, whether due to theft, fire, hail, flood, collision, vandalism, or any other cause, subject to limitations imposed by the law where the vehicle is rented. This liability will not exceed the full value of the vehicle, plus: 1. Actual towing and storage charges; 2. Loss of use; 3. Diminution in value, regardless of whether the vehicle is repaired or not; 4. All rental charges through the date you report the incident if not returnable or the return date, whichever is later; 5. Any out-of-pocket expenses incurred by us as a result of the loss or damage to the vehicle; 6. A reasonable administrative fee; and 7. Pro-rata license plate fees, all as allowed by law. B. Third Party Liability Claims:

5 Unless otherwise required by applicable law, a renter and/or any additional authorized driver (and the respective insurance company of each) is primarily responsible for all third party claims of personal injury, including death, and property damage caused or arising from the use and operation of the Thrifty vehicle during the rental. (To the extent THRIFTY is required to provide coverage, in spite of the terms of the rental agreement, it shall only be in an amount necessary to satisfy the minimum financial responsibility limits required by applicable law.) C. Uninsured and Underinsured Motorist Coverage: Where permitted by law, Jay Munie Auto Sales does not provide Uninsured and underinsured motorist coverage. In those states where Jay Munie Auto Sales must provide such coverage, THRIFTY will only provide such coverage up to the minimum limits required by law. In some U.S. locations, Jay Munie Auto Sales offers the option to purchase Uninsured and Underinsured Motorist Protection ("UMP"). D. Optional Protection Package: At the time of rental, THRIFTY offers for purchase at the option of the renter, Loss Damage Waiver ("LDW"), Personal Protection Plan ("P&P"), Protection Plus(PP), Personal Accident Insurance ("PAI"), Personal Effects Insurance("PEI"), Emergency Sickness Protection ("ESP"), Liability Insurance Supplement ("LIS") and Uninsured and Underinsured Motorist Protection ("UMP"). The cost, coverage, provider and availability vary by location, vehicle category and rate. Please refer to the location's Terms & Conditions to determine whether SLI is required for travel into Canada and the cost of such coverage. The optional products offered by the rental company may duplicate coverage provided by the renter's personal automobile insurance or insurance the renter may have through another source. Purchase of optional products is not required to rent the vehicle. Separate brochures available at the rental location summarize the optional products. We charge a per day fee for each day, or part of a day, the vehicle is rented for any optional products you select. 1. Loss Damage Waiver ("LDW"): If the renter purchases one of the optional LDW plans, Jay Munie Auto Sales will agree to waive the renter's responsibility for loss or damage to the vehicle in full or in part (depending on the LDW plan accepted). LDW is not insurance or an insurance product. LDW does not apply if: (1) the renter uses the vehicle in violation of the rental agreement; (2) the renter fails to remove the keys, or close and lock all windows, doors and trunk, and the vehicle is stolen or vandalized; (3) the renter fails to notify us and the police immediately after the loss; and (4) the renter fails to pay the charges under the rental agreement; or (5) other exceptions as allowed by the applicable state or provincial law. Before deciding whether to purchase LDW, the renter may wish to determine whether their own automobile insurance or credit card agreement provides coverage for rental vehicle damage or loss

6 and determine the amount of the deductible under your own insurance coverage. The purchase of LDW is not mandatory. LDW is not insurance. 2. Personal Protection Plan ("P&P"): P&P includes Personal Accident Insurance ("PAI") and Personal Effects Insurance ( PEI ) and where offered must be purchased together. P&P is not offered in Canada. a.) PAI provides benefits to the renter and the renter's passengers for accidental medical expenses, ambulance expenses and accidental death benefits during the rental. If this optional coverage is purchased by a renter, the renter is covered twenty-four hours a day for all accidents, whether the renter is actually in the rental vehicle or not at the time of the accident. Passengers in a Jay Munie Auto Sales vehicle are only covered for accidents occurring while the passengers occupy the Jay Munie Auto Sales vehicle. b.) PEI insures the personal effects of the renter and any member of the renter's immediate family traveling with the renter. A member of a renter's immediate family must permanently reside in the renter's household. If this optional coverage is purchased by the renter, PEI covers only personal effects with which the renter or immediate family member are traveling. PEI pays covered claims even if the renter's homeowner's policy provides coverage
