1 1 Applying for leave to pay referendum expenses Who this document is for: Registered campaigners and suppliers to registered campaigners who want to know how to apply for leave to allow payment of referendum expenses where the invoice is received after 18 October 2014 or where an invoice received before 18 October is not paid by 17 November. 2 2 Registered campaigners in the referendum on independence for Scotland must pay invoices in relation to referendum expenses if the invoices are received by 18 October 2014; and they must pay these invoices by 17 November If an invoice is sent after 18 October, the registered campaigner must not pay the invoice unless the Electoral Commission grants leave to do so. If an invoice is received before 18 October but not paid by 17 November the campaigner must not pay the invoice unless the Commission grants leave to do so. This document provides information on who can apply to the Electoral Commission and how to do this. Introduction Applying for leave to pay referendum expenses
3 3 It is important that there is transparency in paying referendum expenses. The Scottish Independence Referendum Act 2013 sets deadlines for the payment of invoices related to referendum expenses which is in common with other polls. Suppliers need to send their invoices to campaigners within 30 days of the referendum (18 October) if they don t, the campaigner must not pay the supplier, unless leave is granted by the Commission. As long as a supplier submits the invoice on time, the campaigner must pay the supplier within 60 days of the poll (17 November). If the campaigner does not pay the supplier within 60 days, the campaigner must not pay the invoice unless the Commission grants leave to do so. If we grant leave, the invoice must be paid by the date we stipulate. It is an offence to pay the invoice after that date. It is an offence for registered campaigners in the referendum on independence for Scotland to: pay invoices for referendum expenses that are sent after 18 October 2014; and pay an invoice submitted by 18 October, any later than 17 November without a reasonable excuse. However, registered campaigners and suppliers can apply to the Commission for permission to pay invoices sent after 18 October and pay invoices received before 18 October but not paid by 17 November. 4 4 Registered campaigners must pay all invoices received by 18 October 2014 from suppliers by 17 November We can grant leave to pay after 17 November if a registered campaigner has a reasonable excuse for not paying the invoice earlier. We may take enforcement action if you pay an invoice after 17 November without leave to do so. Applying for leave to pay invoices related to referendum expenses Reasons for an application 1. Suppliers must send invoices to registered campaigners by 18 October. If however, this has not been possible and there is a reasonable explanation for missing the deadline, the Commission can grant leave for an invoice received after that date to be paid. 2. Registered campaigners must pay all invoices received by 18 October for referendum expenses by 17 November. If however, this has not been possible and there is a reasonable explanation for missing the deadline, the Commission can grant leave for an invoice to be paid. Either the supplier or the registered campaigner may apply for leave to pay. Applicants will need to set out their reasons for requesting leave to pay. Each case will be judged on its merits. We consider that reasonable explanations for delay will include illness, death, some form of misconduct by others or in some cases dispute between a registered campaigner and a supplier and we will consider each application on its facts. Who can apply for leave to pay? Applying for leave to pay referendum expenses
5 5 a registered campaigner, the responsible person or a person authorised in writing by the responsible person; a supplier to a registered campaigner. When should I apply? You should apply as soon as possible after you become aware that leave is required. We will take delay in applying into account when considering whether or not to grant leave. Please provide sufficient information to allow us to assess your request to pay expenses late. Please include any other supporting evidence you think will help us assess your application. You will receive an acknowledgement of your application. We will assess your application and inform you of our decision within 14 working days. If we approve your application, you can pay the invoice by the deadline that we will set out in the decision. If we reject your application you cannot pay the invoice. Need help? Just call us. 6 6 The appeal process If your application has been rejected you have 14 working days to appeal the decision in writing. Please provide reasons why you consider our initial decision was wrong.
