1 Town of Silver Plume Drawer F Silver Plume, CO RESOLUTION RESOLUTION TO SET WATER AND SEWER RATES FOR CALENDAR YEAR 2014 A RESOLUTION ESTABLISHING RATES FOR WATER AND SEWER SERVICE FOR USERS IN THE TOWN OF SILVER PLUME, COLORADO BEGINNING JANUARY 1, WHEREAS, the Town of Silver Plume operates a water treatment plant and distributes drinking water to all premises within the town as well as provides water for firefighting use, and WHERAS, the Town of Silver Plume is a member of the Joint Sewer Commission which operates the Sewer Treatment Plant located in Georgetown, and WHERAS, the Town of Silver Plume maintains the infrastructure for distributing water and collecting waste water, and WHEREAS, the Town of Silver Plume has established an Enterprise Funds for Water and an Enterprise Fund for Sewer requiring that both enterprises operate in an economically self-sufficient manner, and WHERAS, The Town must collect sufficient revenues to pay costs for operation and maintenance of facilities, pay off the debt service of the systems, and provide sufficient reserves to meet unanticipated expenses, and WHEREAS, clean drinking water and waste water collection and processing are essential to promote the health, safety, order, convenience, prosperity and welfare of present and future citizens of the Town. NOW THEREFORE, BE IT RESOLVED by the Board of Trustees, Town of Silver Plume Colorado, that the following fees be established and effective the 1 st day of January Section One: Water Four categories of service are provided for within the Town s Water Ordinance 319 and are defined as follow: Domestic Water use that is of or related to the running of a home.
2 Agriculture Water use that is of pertaining to the science or practice of farming, including the cultivation of soil for the growing of plants and/or the rearing of animals. Commercial Water use that is concerned with or engaged in making or intending to make a profit. Industrial Water use that is of, rerated to, or characterized by economic activity concerned with the processing of raw materials and manufacture of goods in factories. Section 1A. -- Fixed Service Charge Domestic: The minimum Fixed Service Charge on the basis of which all Fixed Service Charges are established. That charge shall be $ per month. Agricultural: 1.5 times the Domestic Fixed Service Charge. With this Resolution, that equals to $ per month. Commercial: 1.5 times the Domestic Fixed Service Charge. At present that equals to $ per month. Industrial: 3.0 times the Domestic Fixed Service Charge. At present that equals to $ per month. Section 1B Delivered Water Charge The delivered water charge shall be per the table below for the water delivered during each one-month cycle. Consumptive Use of Water When arrangements have been made for the consumptive use of water in excess of the presumed 5% domestic consumptive use, a Consumptive Use Adjustment will be negotiated with the Town Board. The negotiation shall include whether or not the prospective consumptive user brings either water rights or leased water to the negotiation and will take into account the demands placed on the infrastructure (water processing and delivery via the mains).
3 Consumptive Use Adjustment Per negotiations with the Town Board Section 1C. Other Fees applicable to Water System When a check is rejected by the banking system for Insufficient Funds, a penalty of $ shall be assessed and the account marked as delinquent. System Investment Fee -- When a System Investment Fee for water within the Corporate Limits is required by Ordinance of other circumstances, the fee shall be as outlined below. A system investment fee for a residential shall be ¾ inch (or smaller). Larger connections shall have a larger fee. This fee varies proportionally with the cross sectional area and is related to capacity. Size Cost ¾ Inch $ 5, inch $ 8, inch $ 20, inch $ 35, System Investment Fee for properties wholly or partially outside Municipal Corporate Limits Cost is double the applicable rate for Inside Corporate Limits. NOTE: The System Investment Fee for Sewer is separate and additional to Water System Investment Fee. Water Turn On/Turn Off Fee At Curb Stop When requested by a customer that the water be turned off or on, the fees shall be: On/Off Fee - $ per account Either when requested by a customer or when water is turned off for delinquency of utility payment the fee shall be: -- $ per account At Corporate Stop When water is turned off at the corporation stop, either at the customer s request or because the water is being turned off as the result of non-payment of water and/or sewer bills and the curb stop is inoperative the cost shall be: Water Turn Off - $ 135 per account or actual costs (including excavation) whichever is higher. Water Turn On - $ 135 per account or actual costs (including excavation) whichever is higher. At the Main: When water is required to be turned off at one of the main valves (blocking other users of water on that segment of the main), either at the customers request or because of some deficiency in the customer s service, the following fees shall obtain:
4 Water Turn Off -- $ per account Water Turn On -- $ per account Late Fee When a customer is late in payment of the utility bill (due on the last business day of the month), a Penalty will be applied. The Penalty will be 5% of the unpaid balance to be assessed cumulatively until the entire balance is paid. Liens When an account is three or more months in arrears, a lien may be filed and/or water service turned off. In the event a lien is filed, there shall be a $ fee for filing of the lien and a $ fee for release of the lien. Account Reconciliation Fee When requested by a customer because he or she believes a problem exists with metering, computations, payment schedule or other account issues, a reconciliation of the account may be made. Account Reconciliation Fee shall be $ per account (if it is believed that the error on the part of the Town, this fee may be waived). If a customer requests a reconciliation of an account because he or she does not have records of their bills and payments and requires research, this shall incur a fee of $ per hour. Town Augmentation/Leased Water Fee During periods when water rights senior to those of Silver Plume have required that the Town lease water for augmentation, the Town may impose an Augmentation Fee of $ 1.00 per account per month. Duplicate/Additional Bill Fee: If a customer requests a duplicate bill (whether to be mailed by the Town to another party or for other purposes) a duplicate bill fee will be imposed for each account for each period requested. The Duplicate Bill Fee shall be $ 3.50 per bill. Plan Review Fee -- The Plan Review Fee is assessed in those instances where an extension of the water delivery system is proposed, or when service connections are contemplated to more than one water-using unit. The intent of this fee is to cover costs for engineering studies and reviews of the proposed extension or connections to determine feasibility and the impact on the water infrastructure overall. The Plan Review Amount shall be the actual costs for review of engineering work. Included are to be both the direct costs (consultants) and indirect costs (town employees, copies, etc.). To initiate the review, a deposit of either a Surety Bond, or a minimum of $ cash shall be paid. In the event the costs are less than $ 500 a refund shall be made. Utility Service Permit Fee See Water Ordinance 329 and the Town s Standards and Specifications document for the definition and a discussion of the Utility Service Permit. The fee for a Utility Service Permit is $
5 Section Two: Sewer Section A Sewer Usage Rates Fixed Availability/Service Charge -- The Fixed Availability/Service Charge is assessed to each established account monthly, whether used or not. This charge generates revenue needed to support the capability of collecting waste water. Unless a Tap Connection has been declared Terminated, this charge shall apply. Users with Taps, but no facilities will pay one-half the Fixed Availability/Service charge ($ 24.75). Charges Each residential unit pays a fee of 1 EQR (Equivalent Residential Rate) and that rate is $ per month. Commercial, Industrial and Agricultural users will be billed according to the EQR system. Total EQRs Equivalent Residential Unit this number may change over time, but the Town currently pays for waste water processing for EQR. Usage Charge -- Each sewer account will also be assessed an additional charge based upon water delivered to the account during each one month billing cycle. This charge will be $ (3/8 cent) per gallon of water used. Section B Other Sewer Fees System Investment Fee (Tap Fee) The tap fee depends on whether the new service connection is inside or wholly or partially outside the Town Corporate Limits and on the water connection size. Tap Fee Charge For sewer connections inside the Town Corporate Limits that have a ¾ inch water connection, the charge is $ 5, Tap Fee Charges For sewer connections either wholly or partially outside the Town Corporate Limits, the charge is $ 10, Tap fees for those sewer connections what have water connections larger than a ¾ inch line shall be proportionate to capacity and shall vary with the cross sectional area of the service line.
