1 רש וטות כתבי אמנה ד 18 כתב סופי של הועידה הבינלאומית הראשונה בדבר חור, האויר הפרטי שנתקיימה בחסותו של ארגון התעופה האזרחית הבינלאומית נחתם ברומא ביום 7 באוקטובר, 1952 ישראל חתמה על הכתב ביום 7 באוקטובר, צירי הועידה הבינלאומית הראשונה בדבר חוק האויר הפרטי, שנתקיימה בחסותו של ארגון התעופה האז דחית הבינלאומית, נתכנסו ברומא לפי הזמנתה של ממשלת איטליה, מיום 9 בספטמבר עד יום 7 באוק טובר, 1952, כדי לעיין בהצעת אמנה בדבר בזק הנגרם על ידי מטוס זר לצד שלישי על פני השטח, שהכינה הועדה המשפטית של ארגון התעופה האז דחית הבינלאומית. PRIVE AERIEN TENUE SOUS LES FERENCE INTERNATIONALE DE DROIT ACTE FINAL DE LA PREMIERE CON- AUSPICES DE L'ORGANISATION DE L'AVIATION CIVÏLE INTERNATIONALE FINAL ACT OF THE FIRST INTER NATIONAL CONFERENCE ON PRIVATE AIR LAW HELD UNDER THE AUSPICES OF THE INTERNATIONAL CIVIL AVIATION ORGANIZATION Les Délégués à la première Conférence internationale de droit privé aérien, tenue sous les auspices de l'organisation de l'aviation civile internationale, se sont réunis à Rome, sur l'invitation du Gouvernement italien, du 9 septembre au 7 octobre 1952, dans le but d'examiner un projet de convention relative aux dommages causés aux tiers à la surface par des aéronefs étrangers, élaboré par le Comité juridique de l'organisation de l'aviation civile internationale. 8 מהארגון לתעופה אזרחית בינלאומית מזכירים. מר ל. בוםאר, פקיד לשכת המודיעין של הארגון, סיפק לועידה שירותי מודיעין צבוריים. הועידה מינתה ועדת ניסוח המורכבת מהאנשים הבאים: ד ר א. מ. לואזה יו ד! ה ה ק. מ. בומון, ג/ נ. קלקינם, מ. דיקלה ר. גולםטיין ק. גומם חרה, ם. יול, ר. מונאקו ומ. ו. סוסה..1 בעקבות דיוניהם הסכימו הצירים הנזכרים לעיל על נוסח של אמנה בדבר נזק הנגרם על ידי כלי טיס זר לצד שלישי על פני השטח, שנחתמה היום הזה ברומא ותעמוד פתוחה לחתימה במשרדו הראשי של ארגון התעופה האזרחית הבינלאומית, כאמור בסעיף 31 לאמנה. טפסי התעודות הנידונות בפרק ג לאמנה הא מורה מצורפים לכתב סופי זה והועידה המליצה עלי הס לפני אותן המדינות אשר אליהן יועבר העתק מאושר של האמנה כאמור בהוראות הסיום שלה..2 כן קבלה הועידה את ההחלטה וההמלצה שלהלן: GERALD, G- BOLLA, G. M.L BOTJSSARD, Chef des services d'information de l'organisation, a assuré les services d'information de la Conférence. La Conférence a désigné un comité de rédaction composé du Dr. E. M. LOAEZA, Président, et de MM. K. M. BEAUMONT, G. N. CALKINS, M. DUCLOS, R. GOLSTEIN, C. GOMEZ JARA, S. IUUL, R. MONACO et M. V. SOSA. A la suite de leurs délibérations, les Délégués sus-indiqués sont tombés d'accord sur le texte d'une Convention relative aux dommages causés aux tiers à la surface par des aéronefs étrangers qui a été signée ce jour à Rome et restera ouverte à la signature au siège de l'organisation de l'aviation civile internationale dans les conditions prévues à l'article 31 de la Convention. Des modèles des certificats visés au Chapitre III de ladite Convention sont annexés au présent Acte Final et ont été recommandés par la Conférence à l'attention des Etats auxquels, conformément aux dispositions finales de la Convention, sera transmise une copie certifiée conforme de celle-ci. I Following their deliberations, the abovementioned Delegates agreed on the text of a Convention on damage caused by foreign aircraft to third parties on the surface, which was signed this day in Rome and shall remain open for signature at the headquarters of the International Civil Aviation Organization as provided in Article 31 of the Convention. The forms of certificates referred to in Chapter III of the said Convention are attached to this Final Act and have been recommended by the Conference to the attention of States, to which, in accordance with the final provisions of the Convention, will be transmitted a certified copy of the Convention. 9 א. מכירה בתו שהיא לאחד הועידה, עלת שיפיקו םובלי נזקים אם יגישו את תביעות הפי צויים שלהם לפי םדרי דיון מיוחדים, אם רצונם בכד סבורה כי אין זה שהיא לאחר הרצוי בכל זאת, להכניס בשעה זו סעיף מן באמנה לענין זה, כי מועצת הארגון לתעופה האז ממליצה דחית הבינלאומית (א) תודה את המזכירות ואת הועדה המשפטית לחקור בדבר שיטה ליישב, לפחות בשלב הער עור םכםוכי משפט בינלאומי פרטי העשויים להתעורר מתור האמנה שנחתמה היום או מתוך כל אמנת תעופה אחרת אם על ידי הרכבת בית דין קבוע מיוחד, או על ידי הרכבת בית דין מיוחד למטרה זו, או על ידי בורדים הפועלים לפי סדרי דין אחידים שיותקנו או על ידי היזקקות לכל מוסד בינ לאומי קיים אחד* (ב) תערוך מיד חקירה בקרב המדינות על מנת לברר את ההתנגדויות האפשריות לשיטות אלה של יישוב סכסוכים המתעוררים בקשר לתעופה אזרחית בינלאומית. LA CONFÉRENCE, A RECONNAISSANT l'intérêt qu'il y aurait pour les personnes ayant subi des dommages de pouvoir soumettre leurs demandes de réparation à une procédure spéciale, mais N'AYANT CEPENDANT PAS JUGE OPPORTUN d'insérer pour le moment dans le texte de la Convention un article à cet effet, RECOMMANDE au Conseil de l'organisation de l'aviation civile internationale (a) de charger le Secrétariat et le Comité juridique d'étudier la possibilité d'instituer, au moins en instance d'appel, un système de règlement des différends internationaux de droit privé pouvant naître soit de la Convention signée ce jour, soit de toute autre convention en matière d'aviation soit par la constitution d'un tribunal permanent spécial, soit par la constitution d'un tribunal spécial ad hoc, soit par des arbitres agissant suivant un règlement uniforme à préparer, soit en utilisant toute autre institution internationale existante ; (b) de demander dès maintenant aux Etats quelles sont les objections qu'ils pourraient avoir à des tels systèmes de règlement de différends pouvant naître du fait de l'aviation civile internationale. THE CONFERENCE, A HAVING RECOGNIZED the advantage, for persons suffering damage, of submitting their claims for compensation to a special procedure, if they so desire, HAVING CONSIDERED IT INADVISABLE, however, to insert an article to this end in the Convention at the present time, RECOMMENDS that the Council of the International Civil Aviation Organization (a) instruct the Secretariat and the Legal Committee to study a system of settlement, at least in appeal proceedings, of international private law disputes that may arise either from the Convention signed this day, or from any other aviation convention, either by the establishment of a special permanent tribunal, or by the establishment of a special ad hoc tribunal, or by arbitrators acting under uniform rules of procedure to be developed, or by resorting to any other existing international institution; (6) make an immediate enquiry from States to ascertain the objections that may exist against such system of settlement of disputes arising in conection with international civil aviation. כתבי אמנה 187, אמנה בדבר נזקים הנגרמים ע י כלי טיס זר לצד שלישי על פני השטח. 331

PRINCIPLES OF LIABILITY ARTICLE 1 1. Any person who suffers damage on the surface shall, upon proof only that the damage was caused by an aircraft in flight or by any person or thing falling therefrom, be entitled to compensation as provided by this Convention. Nevertheless there shall be no right to compensation if the damage is not a direct consequence of the incident giving rise thereto, or if the damage results from the mere fact of passage of the aircraft through the airspace in conformity with existing air traffic regulations. 2. This rule shall not apply to any such person who is guilty of a deliberate act or omission done with intent to cause damage.
