1 THE SIGMA CHI CHAPTER OF THE AMERICAN CRIMINAL JUSTICE ASSOCIATION LAMBDA ALPHA EPSILON CALIFORNIA STATE UNIVERSITY, SACRAMENTO BYLAWS (Updated as of December 2011) We, the Sigma Chi Chapter of the American Criminal Justice Association Lambda Alpha Epsilon accept the Grand Chapter Bylaws in total and make certain additions hereafter listed to be made to our subordinate chapter. ARTICLE I: NAME 1. This organization shall be known as the Sigma Chi Chapter of the American Criminal Justice Association Lambda Alpha Epsilon. ARTICLE II: OBJECTIVES 1. Improve criminal justice through educational activities 2. Foster professionalism in law enforcement personnel and agencies. 3. Promote professional, academic, and public awareness of criminal justice issues. 4. Encourage the establishment and expansion of higher education and professional training in criminal justice. 5. Provide a unified voice for professionals in, and students of criminal justice. 6. Promote high standards of ethical conduct, professional training, and higher education within the criminal justice field. ARTICLE III: MEMBERSHIP A. CODE OF CONDUCT 1. When representing the ACJA/LAE Sigma Chi Chapter you are expected to abide by the objectives of the Sigma Chi Chapter. 2. If a member is found to be in violation of any of the listed objectives (refer to Article II) then the member in question shall be fined according to Article IX, Section G. Depending on the severity of the violation, the member can face possible expulsion from the Sigma Chi Chapter. a. If the person denies the accusation, the Executive Board shall poll the membership whom were present at the occasion, and have private one-on-one sessions between the member and the Executive Board. If three-fourths (3/4) of membership polled agrees that the member was in violation of one or more of the Sigma Chi Chapter objectives, the punishment will stand. If less than three-fourths (3/4) of the membership polled agrees with the charges, the punishment will be repealed. 1/15

2 3. The LAE Sigma Chi Chapter follows the California State University Sacramento Policy against harassment, including but not limited to physical, sexually, or emotional. Sigma Chi has no tolerance for harassment. Any member in violation of these policies will be subject to hearing with the chapter Executive Board with an LAE and an academic advisor present. B. QUALIFICATION FOR MEMBERSHIP 1. Membership in the association shall be composed of persons who are currently, or were at the time of their application for membership, employed or retired from a career in a criminal justice related field, or are enrolled in a program of study in this field, or persons who are seriously interested in promoting professionalism in criminal justice. 2. No persons shall be considered for membership whose occupation or activities are inconsistent with the objectives of the American Criminal Justice Association Lambda Alpha Epsilon. 3. No qualified applicant shall be refused membership in the association on the basis of ethnic origin, gender, creed, marital status, religion, or sexual orientation. 4. Each student member shall maintain a grade point average of 2.0 or better, on a scale of 4.0 C. APPLICATION FOR MEMBERSHIP 1. Applications shall be completed and presented to the Chapter Membership Coordinator prior to submission to the national secretary. The application must be endorsed by the Recording Secretary and the President of the Chapter. Admittance shall be based upon participation in the following: a. Interviews 1) When there are more than 10 prospective members in any given semester, each prospective member shall participate in a personal interview with each the President, Vice-President, and Membership Coordinator, before the panel interview. 2) Panel Interview: The prospective member shall participate in a formal panel interview with the Executive Board. The guidelines for the panel interview shall be determined by the Executive Committee. 3) A signature book shall be completed and returned to the Membership Coordinator by the end of the panel interview. b. Prospective Member Requirements 1) Each prospective member shall abide by active member attendance requirements. (See Art. III. Sec. D sub. 1) 2) Each prospective member will complete a signature book, whose guidelines shall be determined by the membership coordinator. 3) A signature sheet shall be completed and returned to the Membership Coordinator by the end of the panel interview. 2/15

3 4) All Prospective Members will, at the beginning of their pledging process, show a valid ID, that displays proof of age, to the Recording Secretary, who will in turn record the information. 5) Each prospective member will receive a, Prospective Member Packet. Packet will include: Prospective member guidelines, Signature Sheet, Chapter Bylaws, and Prospective Member Contract. Prospective member guidelines are an extension of the Chapter Bylaws. c. Fees 1) Prospective members will be ineligible to attend any events if they have not paid their first installment by the assigned due date. Prospective members who have not made their first installment by the second installment will be given one (1) week to submit the full amount. If they have not submitted the full amount due, their pledging process will be terminated. 2) The Sigma Chi Chapter shall institute dues at the rate of $ for pledging semester only. 3) The Sigma Chi Chapter shall institute dues at the rate of $40.00 per semester (fall and spring) or $80.00 per year for active members. 4) The Sigma Chi Chapter shall institute semester dues at the rate of $40.00 per semester (fall and spring) or $80.00 per year for active alumni and professionals. 5) Honorary Members of the subordinate chapter shall be excluded from paying initiation fee, dues, and all assessments to the Grand Chapter and the subordinate chapter and region. a) Honorary membership may be awarded in recognition of an individual s hard work and dedication in relation to the objectives of Sigma Chi. b) Honorary Chapter membership shall be determined by a 3/5 of the entire eligible voting membership D. ATTENDANCE 1. Each member shall be required to attend the following: a. 50 percent (50%) of all the Sigma Chi Chapter regular business meetings, per semester. b. 50 percent (50%) of the Sigma Chi chapter activities, per semester. c. At least three (3) hours of documented community service activities, per semester as defined by the Executive Board. Events will be suggested to the Executive Board at least two weeks in advance. 3/15

4 1) Documentation of attendance must be shown to the recording secretary at least one week before bad standing is announced. d. At least 3 hours of fundraising as defined by the board of the Sigma Chi Chapter, per semester. 1) More hours may be required if the member signs up for an event that requires them to be in attendance for the entire duration of that event. Exclusions and exceptions will be made on a case by case basis as determined by the Executive Board of the Sigma Chi Chapter 2. Each Executive Board member of the Sigma Chi Chapter shall be required to attend 90 percent (90%) of all regular business meetings as defined by the Executive Board of the Sigma Chi Chapter. a. In addition, each Executive Board member must be available one (1) hour prior to regular business meetings. b. In the event that any Executive Board member is unable to attend the required meetings as defined above, they must advise the chapter president or the preceding member of the Executive Board prior to the expected absence. 3. Members unable to attend fifty percent (50%) of all regular business meetings shall submit an exemption form. This will exempt the member from business meetings, but will still require the member to attend at least fifty percent (50%) of the chapter s activities. This exempt form is to be submitted to either the President or Vice President, by the third (3 rd ) regular business meeting of the Sigma Chi Chapter. 4. Active Alumni or Professional Member a. 25 percent (25%) of all the Sigma Chi Chapter regular business meetings, per semester as defined by the Executive Board of the Sigma Chi Chapter. b. One (1) of the Sigma Chi Chapter activities, per semester. c. At least three (3) hours of documented community service activities, or at least one fundraiser as defined by the board of the Sigma Chi Chapter, per semester. d. Is a recognized national member of the American Criminal Justice Association Lambda Alpha Epsilon. 5. Active Alumni or Professional members unable to attend twenty-five percent (25%) of all regular business meetings shall submit an exemption form. This will exempt the member from business meetings, but will still require the member to attend at least one (1) of the chapter s activities. This exempt form is to be submitted to either the President or Vice President, by the third (3 rd ) regular business meeting of the Sigma Chi Chapter. 6. No member, active alumni, or professional member shall be exempt two semesters in row unless extenuating circumstances arise. Additionally, no member, active alumni, or professional member shall go exempt immediately following their pledge semester unless 4/15

5 extenuating circumstances arise. Exemption will be granted or denied by the Executive Board. Exemption status can be appealed to the Chapter. 7. In the event, active alumni or professional member unable to attend the required meetings or events, then the Recording Secretary shall hold the member, active alumni, or professional member in Bad Standing. E. DEFINITION OF BAD STANDING 1. Any Member, active alumni, or professional member regardless of exemptions who does not meet the minimum attendance requirements or who has not paid the required dues, fees, or fines shall be held in bad standing status and who has not completed required fundraising and/or community service. 2. The Recording Secretary is responsible for posting a bad standing list no less than two weeks before the last general meeting of the Sigma Chi Chapter. 3. A member, active alumni, or professional member in bad standing loses all Sigma Chi privileges, i.e. funding, voting rights, right to hold office, etc. 4. Voting on bad standing: a. The membership will vote on bad standing on the second to the last business meeting of the semester. b. The purpose of this vote will be to either retain or expel from the organization those members held in bad standing. c. This vote shall be conducted by written ballot and shall be determined by a majority vote of the eligible voting membership present. d. The general membership is responsible to vote on all members in bad standing on week before the last meeting of the Sigma Chi Chapter. 5. Results of the vote on bad standing a. In the event that a membership votes not to retain a member held in bad standing, that member is no longer a member of the chapter. b. In the event that the membership votes to retain a member held in bad standing, that member is therefore kept in the Sigma Chi Chapter. c. Members who have been retained in this manner will have their lack of attendance at business meetings and Sigma Chi Chapter events absolved. d. All retained members shall still be required to pay all fees, fines, and dues. No exceptions. ARTICLE IV: VOTING PRIVILEGES OF THE SIGMA CHI CHAPTER A. QUALIFCATION AND ELIGIBILITY 1. 6 a. At the time of placing the vote, the active member cannot be in bad standing as defined by Article III, Section E, Subsection 1. b. Per the California State University, Sacramento Student Organizations and Leadership, any member, professional or alumnus, whom is not a registered student at Sacramento State, will have no voting privileges. 2. Honorary Member a. Are excluded from all voting privileges. ARTICLE V: OFFICERS OF THE SIGMA CHI CHAPTER A. QUALIFICATION AND ELIGIBILITY 1. The positions of elected officers of the Sigma Chi Chapter shall be that of President, Vice President, Recording Secretary, Corresponding Secretary, Treasurer, Sergeant-at-arms, and Membership Coordinator. (The immediate Past President shall be an Ex-Official member). These shall be the only members of the Executive Board. 2. To be eligible to hold an Executive position in the Sigma Chi Chapter, a nominee must be a student and must maintain a cumulative grade point average of at least 2.5 on a scale of 2.0 to 4.0. Additionally, a nominee cannot be on academic probation at the time they are considered for an Executive position nor can they be in their pledging process. 3. To be eligible for the position of President: a. The candidate must have a minimum of one (1) full semester of active membership. b. Must not be in bad standing the previous semester. c. If the candidate is a new member without one (1) full semester of active membership in the Sigma Chi Chapter, then they must have within the last three (3) years, one (1) year of experience at one of the following: 1) A leadership position of another University level related organization. 2) Supervising position. d. All nominations for President are submitted by an active member who is not on bad standing or in their first semester. B. DUTIES OF OFFICERS 1. The officers of the Sigma Chi Chapter are to advise and support the members and follow the rules mandated by the Grand Chapter and Robert s Rules of Orderly Newly Revised and shall apply them to the best of their ability as an elected or appointed officer. 2. In the instances in which circumstantial decisions are to be made by the chapter Executive Board, the decision will be made by a 2/3 (or 5 of the 7) majority vote. 3. The specific duties of the officers of the Sigma Chi Chapter shall be as follows: a. President 6/15

7 1) The elected student shall preside over all regular meetings and all Executive Committee meetings. 2) The elected student member is responsible for coordinating and informing his/her fellow officers of all association policies, procedures, meetings, and projects relating to program research, community service, and social/athletic events. To represent the association in matters pertaining to academic endeavors at program faculty/staff meetings and to maintain active, ongoing communication between the Sigma Chi Chapter and the Grand Chapter of the American Criminal Justice Association-Lambda Alpha Epsilon. Said member is also responsible for maintaining liaison with other student organizations on the Sacramento State University campus in the implementation of all relevant matters to the best of the Sigma Chi Chapter, the Criminal Justice Program, its faculty, staff, and students. 3) The elected student has the authority to: a. Form ad hoc committees b. Fill vacancies of elected officers by appointment c. Form new offices as the need arises d. Appoint an historian All photographs that are submitted to the Sigma Chi Chapter are subject to being posted in the photo scrapbook as well as being posted on the main web page. All photos must adhere to bylaw regulations and refrain from being derogatory, disrespectful, indecent, and/or of distasteful conduct. e. Appoint a president Pro Temp if he/she is unable to maintain his/her position for those months of the school year that school is not in session. b. Vice President 1) The elected student member is responsible for assigning, coordinating, and informing his/her fellow members of committee assignments, projects, and tasks. (The Vice President will appoint a person to convene the committee meetings). 2) The President/Vice President shall appoint alumnus of LAE-Sigma-Chi, who is currently working in the field, or enrolled in the graduate program, to coordinate the announcement of LAE-Sigma Chi events to alumni members. This appointment will take place in the fall semester and last no less than two semesters. A spring appointee may occur in the event the alumni coordinator must resign his or her position, or is not fulfilling the duties set forth. a. Create and maintain a contact list of LAE-Sigma Chi alumni. b. Contact and invite alumni to LAE-Sigma Chi events. c. Report, as needed, to the Executive Board of LAE-Sigma Chi. 7/15

8 3) LAE-Sigma Chi shall have a suggestion box/drop slot attached or near the LAE- Sigma Chi Board. The purpose of this box includes, but is not limited to: a. Suggestions b. Critiques c. Absentee Ballots d. All entries in the suggestion box/drop slot may be anonymous. All entries will be reviewed by the President or Vice President, as to the seriousness or its contents. The box will be maintained by the President or Vice President. c. Treasurer 1) The elected student member is responsible for maintaining all fiscal records pertaining to the Sigma Chi Chapter s financial status, i.e. membership dues, list of active and associated members, social/professional, fund raising, etc., and the issuance of annual income statements. d. Recording Secretary 1) The elected student member is responsible for maintaining the minutes of each Executive Board meeting, each local chapter meeting with attending membership, implement roll call for each aforementioned meeting, and assist the President in those activities requiring the record keeping of their assigned responsibilities. e. Corresponding Secretary 1) The elected student member is responsible for public relations and correspondence activity for the Sigma Chi Chapter, i.e. invitations, thank you letters, press releases, and other publicity. f. Sergeant-At-Arms 1) The elected student member is responsible for having a workable knowledge of Robert s Rules of Order, for maintaining order at the Sigma Chi Chapter s various meetings, assisting the Vice President in coordinating various activities and assignments, and to ensure that the proper decorum prevails with each Chapter activity and endeavor. They are also responsible for tallying all of the votes taken. g. Membership Coordinator 1) The elected student member is responsible for screening all applicants for membership in the American Criminal Justice Association Lambda Alpha Epsilon, Sigma Chi Chapter. He/she is responsible for setting up the interview process of prospective members. He/she is also responsible for maintaining the Big Brother-Big Sister/Little Brother-Little Sister Program. He/she is also responsible for conducting membership drives and continued high enrollment in the Sigma Chi Chapter. He/she will also be responsible to motivate the interest of existing members of the Sigma Chi Chapter. 2) The membership coordinator will make themselves available to the existing and prospective members. 8/15

9 C. ELECTION OF OFFICERS 1. Election for Sigma Chi Officers shall take place during the last meeting of every semester. The nominations shall be opened at the meeting prior to the elections and shall be reopened the meeting of the election. 2. Any member not present at a meeting where an election of officers takes place, (or motion to a change in the bylaws is made) may submit a proxy vote to be turned in by another member. Both members must be in good standing. 3. Between the time of nominations and elections, the nominee will present to the Recording Secretary proof of his/her grade point average. 4. During the interviewing week, a Bylaws test will be administered to all nominees by the President of the Sigma Chi Chapter. This test must be passed with at least 80% to qualify for the elected officer. a. Those that are nominated on Election Day must fulfill the same requirements as stated above, if elected. b. Members will only be allowed to take the bylaws test once per semester. 5. Executive Board member s Cross-Over a. After the election of the new Executive Board, and no later one (1) week prior to the new semester, all responsibilities of the previous Executive Board member must be turned over to the succeeding Executive Board members and one (1) advisor must be present. D. RECALL OF OFFICERS 1. Officers of the Sigma Chi Chapter may be recalled for any violation of the Chapter Bylaws and/or any ruling of the Sigma Chi Chapter. 2. A motion for recall may be made at any Executive Board meeting or any regular meeting of the Sigma Chi Chapter. 3. Procedures found in Robert s rules of Order Newly Revised shall be followed. E. SUCCESSION OF OFFICE 1. In the event of Resignation by the President, he/she shall be replaced by the Vice President until the end of term. 2. Other vacancies occurring during the term of office shall be filled by appointment by the President with the approval of the Executive Board majority vote. 3. The only exception to this rule is that of elections of officers held in recall. ARTICLE VI: COMPOSITION OF THE SIGMA CHI CHAPTER A. COMMITTEES AND CHAIRPERSONS 9/15

10 1. There will be permanent and ad hoc committees set up to handle activities for the Sigma Chi Chapter at the discretion of the Vice President a. Permanent Committees include: 1) Fundraising 2) Social 3) Bylaws b. Ad hoc Committees include: 1) Physical Fitness 2) Conference 3) Firearms, etc. 2. The Vice President will appoint the chairperson of each committee and members will be chosen on a voluntary basis. The membership committee will be headed by the membership coordinator. 3. Committees are open to all members, active alumni, professional, and prospective members. a. Only an active member can chair a committee. b. A chair person must be an active member not on the Executive Board. c. An Executive Board member can co-chair a committee. d. If no active member is available to chair a committee, then an Executive Board member is eligible to chair that committee. ARTICLE VII: FINANCES A. AUTHORIZATION AND EXPENDITURES 1. To issue checks, there must be two (2) signatures; the President, Vice President, and/or Treasurer. 2. The Executive Board may authorize up to two hundred dollars ($200.00) in spending per semester. All executive spending will be for necessities for the organization or its events. a. Receipts for all spending authorized in this manner will be submitted to the treasurer. b. All spending authorized in this manner will be reported to the membership as part of the treasurer s minutes at the next meeting. 3. All expenditures over two hundred dollars ($200.00) must be approved by the majority of the members present at the next regular meeting. 4. All bills must be submitted to the Treasurer within thirty (30) days or will be null and void. 10/15

11 ARTICLE VIII: BUDGET/SPENDING GUIDELINES A. Each committee chairperson is required to submit an Activity Summary, with a budget request, at an Executive Board meeting at least one (1) week before the event. ARTICLE IX: FINES A. Dues of forty dollars ($40.00) must be paid by the fifth (5 th ) chapter meeting of the semester. 1. The fine of the ten dollars ($10.00) shall be imposed for those members who have not paid their dues by the ending of the fifth (5 th ) chapter meeting. The fine will then be increased by ten dollars ($10.00) for every week after the fifth (5 th ) chapter meeting that the dues are late. Exceptions may be made by a vote of the Executive Board. Failure to adhere to this fine schedule will result in the individual being placed on bad standing. 2. The member in bad standing loses all membership privileges, i.e. funding, voting rights, right to hold office, etc. 3. Any bounced checks will be treated as if delinquent dues and appropriate handling fees will be attached. B. At the end of each month, the Treasurer will submit to the Executive Board a list of delinquent members. The Executive Board will review the list and submit it to the membership at the regular meeting, to decide, by majority vote, to keep, or expel the delinquent members. C. If exigent circumstances exist, any delinquent member may apply to the Executive Board to remain in the chapter. D. Any member who signs up to attend a specific event and subsequently fails to attend the said event will be fined the sum of ten dollars ($10.00) furthermore for Safe Rides, chapter fundraising events and prison tours in which the fine will be twenty-five dollars ($25.00). E. If a member is unable to attend an event for which they have signed up, they must notify an Executive Board member at least 24 hours prior to the event. If a signed contract is required the individual must notify an Executive Board Member 24 hours before that contract is due. 1. If that member is able to find a replacement he/she will be exempt from the fine. If the replacement fails to show up, the original member will be held accountable. F. Safe Ride fines will be donated directly to Safe Rides. G. CODE OF CONDUCT VIOLATIONS 1. Code of conduct violations are subject to a thirty-dollar ($30.00) fine per violation. ARTICLE X: PARLIMENTARY AUTHORITY A. Rules contained in the current edition of Robert s Rules of Order Newly Revised shall govern the Chapter in all cases to which they are applicable and in which they are consistent with the Bylaws and any special rules of order the Sigma Chi Chapter may adopt. 11/15

12 ARTICLE XI: AMENDMENTS A. Chapter bylaws may be amended only after properly being presented through the bylaws committee, in writing, for reconsideration at all regular meetings to be voted on at the following meeting. B. A two-thirds (2/3) vote of the voting membership present at the meeting shall be necessary to amend any section of these bylaws. C. Voting shall be by roll call. The Recording Secretary shall call roll. The members shall declare their vote(s) by aye (yes) or no. The Recording Secretary shall record the vote(s) and then repeat them to be sure of their accuracy. ARTICLE XII: QUORUM A. One-fourth (1/4) of the full membership in good standing shall constitute a quorum for the transaction of any business. ARTICLE XIII: SIMGA CHI EVENTS A. A LAE/Sigma Chi event is classified as any function in which individuals are acting as representatives of the American Criminal Justice Association, Lambda Alpha Epsilon, including but not limited to meetings, social events, fundraisers, and community service. B. Some LAE/Sigma Chi events are designed to create a bond between members. In light of this, guests will only be allowed at certain events. The decision to allow guests at an event will be at the discretion of the Executive Board. If guests are allowed at an event, the member that invited them will be held liable for their actions and will be subject to any penalties outlined in the Bylaws as if they themselves committed the infraction. C. At a LAE/Sigma event in which individuals pay for admittance the fee must be paid at in advance, the day of the event, or the chapter meeting immediately following the event. Exclusions and exceptions will be made on a case by case basis as determined by the Executive Board. 1. If an individual does not pay this fee within the allotted time constraint, he or she will be fined ten dollars ($10.00) each consecutive week the fee is late. ARTICLE XIV: CONSUMPTION OF ALCOHOLIC BEVERAGES A. CONSUMPTION OF ALCOHOLIC BEVERAGES 1. No member, prospective member, alumni, professional or guest of ACJA/LAE Sigma Chi Chapter, less than 21 years of age, shall be permitted to consume alcoholic beverages before or while attending any ACJA/LAE sponsored function. 2. For these purposes, a member is described as any person who has been sworn in under the ACJA/LAE Oath as a Sigma Chi Chapter member, including alumni, Executive Board, Professional, and general members. 3. For these purposes, a prospective member is described as any individual who is undergoing the process of pledging ACJA/LAE Sigma Chi Chapter. 12/15

13 4. For these purposes, a guest is described as any individual that has been invited to an ACJA/LAE Sigma Chi event, by an LAE Sigma Chi Chapter member, prospective member, or Alumnus. 5. Any member of legal drinking age who consumes alcohol while wearing ACJA/LAE letters must act in a professional manner. Any member who becomes intoxicated and/or begins to act in an unprofessional manner while wearing ACJA/LAE letters will be asked to remove their letters and may be subject to a bylaw violation fine as defined by Article XIV: Consumption of Alcoholic Beverages. 6. Any individual defined above that engages in such behavior will be escorted from the activity. If a member is involved he/she will also be subject to a Bylaw violation fine of sixty dollars ($60.00). Upon a review of the factual circumstances surrounding the incident conducted by the Executive Board, the individual may be subject to expulsion from LAE and the Sigma Chi Chapter. Prospective members who engage in illegal consumption of alcohol will be terminated from the LAE/Sigma Chi Chapter pledging process. 7. If a guest is involved, the member that brought the guest shall be held liable for their actions. If a guest of a member violates this policy, members will be subject to a bylaws violation fine in the amount of sixty dollars ($60.00). Again, upon a review of the factual circumstances surrounding the incident by the Executive Board, the member may be subject to expulsion from LAE and the Sigma Chi Chapter. If a guest of a prospective member violates this policy, prospective members will also be subject to a sixty dollar ($60.00) fine and the prospective members actions will be reviewed by the Executive Board. The Executive Board has the authority to terminate the prospective members pledging process upon review of the circumstance. B. ILLEGAL CONTRIBUTION OF ALCOHOL 1. No member or guest of ACJA/LAE Sigma Chi Chapter shall be permitted to contribute, buy, or supply alcoholic beverages for ANY individual less than 21 years of age at ANY ACJA/LAE Sigma Chi Chapter sponsored event. 2. Any member who engages in such behavior will be reprimanded with a sixty dollar ($60.00) fine, and MAY be subject to expulsion from the Sigma Chi Chapter. The member in question is allowed to state the reason for his/her actions in a closed meeting with the Executive Board. 3. Any prospective member who engages in the above mention behavior will immediately be terminated from the pledging process after Executive Board review. If a guest violates this policy, the member or prospective members who brought the guest will be subject to above mentioned penalties depending on membership status. 4. If in the course of review, a member of the Executive Board is found to be engaged in the above mentioned behavior, his/her seat shall be immediately vacated in accordance with the bylaws procedural regulations. The member will also be reprimanded with a sixty dollar ($60.00) fine, and MAY be subject to expulsion from the Sigma Chi Chapter. 5. Any member who is of age that arrives at an event or becomes intoxicated at an event which specifically requires them to be sober shall be subject to the same penalties and fines 13/15

14 as in the above sections, such as a sixty dollar ($60.00) fine, review by the Executive Board, possible expulsion from the Sigma Chi Chapter and, if a Executive Board member, the seat will be vacated. C. ALCOHOL INDUCED BEHAVIOR 1. Any member, prospective or active, who is visibly under the influence of any alcoholic beverage, or under the combined influence of alcoholic beverages and drugs, and whom operates a motor vehicle arriving, while attending, or leaving LAE/Sigma Chi events, shall be fined the sum of one hundred dollars ($100.00), may be expelled from the Sigma Chi Chapter, and may be reported to the National Executive Board. If the offender is an alumni, professional or member of another chapter, their actions will be reported to their Executive Board and the National Executive Board for immediate action. For guests, please refer to Article XIV, section A, subsection 4. a. If the person denies the accusation the Executive Board shall poll the membership whom were present at the occasion and have private one-on-one sessions between the member and the Executive Board. If three-fourths (3/4) of membership polled agrees that the member was visibly intoxicated the punishment will stand. If less than threefourths (3/4) of the membership polled agrees with the charges the punishment will be repealed. 2. Any member, prospective or active, who has violated Article XIV, section C, subsection 1 on a previous occasion and violates for a second time will be immediately expelled from the Sigma Chi Chapter and will be reported to the National Executive Board. If the offender is an alumni or member of another chapter, their actions will be reported to their Executive Board and the National Executive Board for immediate action. For guests, please refer to Article XIV, section A, subsection 4. ARTICLE XV: DRUGS/ILLEGAL/UNAUTHORIZED SUBSTANCES A. Any member, prospective, professional, or active, who brings, consumes or distributes illegal drugs or substances at any LAE/Sigma Chi event, meeting, or gathering will be immediately expelled from the organization. If the offender is an alumni, professional or member of another chapter, their actions will be reported to the Executive Board and the National Executive Board for immediate action. For guests, please refer to Article XIV, section A, subsection 4. B. Any alumni, prospective, professional, or active member, or guest who distributes illegal drugs or substances at any LAE/Sigma Chi events will be reported to the local authorities. The Sergeant at Arms will be responsible for contacting the local authorities. In the event that the Sergeant at Arms is unable to take action, it is up to a member of the Executive Board to alert the authorities. ARTICLE XVI: TRIALS AND PENALTIES OF MEMBERS A. Any member who shall be guilty of an immoral, dishonest, fraudulent or criminal act or who shall act in such a way as to discredit the Association or who shall offend against the Bylaws of the Chapter shall be fined, reprimanded, suspended and/or expelled as the Executive Board of the Chapter by five-sevenths (5/7) vote may determine. B. Any member disciplined by the Executive Board may appeal such action to the general membership at the next general membership meeting. The Chapter President will present the 14/15

15 facts and rationale of the disciplinary action to the membership who will, by majority vote, either sustain the Executive Boards action; modify it; or reverse it. 15/15
