32 Sweett Group CDM 2015 Regulation Changes
33 Construction (Design and Management) Regulations came into force on 6th April The HSE has published legal (L) guidance on the requirements of the CDM Regulations 2015.
34 The HSE has also published industry guidance for the six named duty holders:- Clients Principal Designer Designer Principal Contractor Contractors Workers

36 What the regulations are about - key elements e) consulting workers and engaging with them to promote and develop effective measures to secure health, safety and welfare
37 The aim behind the new regulations is to: Align them more closely with European legislation (particularly in terms of domestic clients) To make them simpler to use To reduce the need for detailed competence assessments To ensure the CDM process is further embedded in the project team
38 Managing Change - Transitional Arrangements Six month transition period expires on 6 th October 2015 for existing CDM Co-ordinator appointments to be terminated and for a Principal Designer to be appointed.

42 The role of the CDM Co-ordinator is revoked and a new role of Principal Designer is established for projects involving two or more contractors Domestic clients are now covered by these Regulations There is an increase in the Client s obligations The Approved Code of Practice is replaced by L-series industry guidance. (L153) Projects requiring an HSE notification have changed. A notification now only has to be made for projects lasting more than 30 days and involving more than 20 workers simultaneously / or 500 person days.
43 Explicit competence requirements have been changed and there is now a requirement to have the correct attributes to deliver a healthy and safe project A Construction Phase Plan is now required for all projects that fall under CDM
44 Regulation 5 - Appointment
45 CDM 2015 makes the Client accountable for the impact their decisions and approach have on health, safety and welfare on the project. CDM 2015 recognises the importance and influence the Client has over the construction process and that they are best placed to set the health and safety standards to be achieved They now also have responsibility for a number of tasks that were the CDM Co-ordinator s responsibility under CDM 2007.
46 To ensure each construction project is set up so that it is carried out from start to finish in a way that adequately controls risks to health and safety of those that might be affected by it. To produce a Client brief outlining their requirements and expectations. To make suitable arrangements to ensure the project is properly managed. Appoint the Principal Designer and Principal Contractor in writing otherwise the Client will be deemed to be undertaking these roles.
47 To ensure those appointed have the necessary skills and knowledge to deliver the project in a way that secures health and safety. To ensure suitable Pre Construction Information is produced and passed to those who might need it. Submit an F10 Notification of Project to the HSE. To take measures to ensure the Principal Designer is carrying out their duty. Where there is more than one contractor on site appoint one company to be the Principal Contractor.
48 Not to allow construction to commence until the Principal Contractor has an adequate Construction Phase Plan in place and that suitable welfare facilities are provided. To ensure arrangements that are made for managing health and safety on site are working successfully throughout the construction period. To ensure a Health and Safety File is provided on completion of the project. The Client also has obligations under other Health and Safety legislation such as the Health and Safety at Work Act.
49 Principal Designer Under CDM 2015 the Principal Designer assumes many of the responsibilities that were undertaken by the CDM Co-ordinator in CDM The intention behind this change is to ensure that health and safety is fully integrated into the design process as an embedded skill within the design team. The Principal Designer should have the necessary designer skills, knowledge and experience to carry out this role in a way that secures health and safety and have control over the design and planning stage.
50 The Principal Designer s duties will include: To assist the Client with the project set up To assist the Client to identify, obtain and collate Construction Information and ensure this is those that might need it. Pre passed to To co-ordinate health and safety during the pre- construction stage. To ensure other designers comply with their duties and co-operate.
51 To liaise and communicate with the Principal Contractor for the duration of the project. To prepare the Health and Safety File. To comply with other designer s obligations under these Regulations.
52 The Principal Designer shall have the specific skills, knowledge and experience to carry out this role. The Principal Designer shall have control over the Pre Construction Phase of a project. The Principal Designer can be an organisation (or on smaller projects an individual) that has the technical knowledge of the construction industry and have the understanding and skills to manage and co-ordinate the pre construction phase. The Principal Designer may have separate design duties.
53 Designers duties are similar to what they were the old revoked CDM 2007 Regulations Who is a designer An organisation or an individual that proposes or modifies a design or who arranges or instructs someone else to do it. Who can be a designer An architect, engineer, interior designer, temporary works engineer, chartered surveyor, technician, specifier, principal contractor and specialist contractor. Clients can also have design responsibilities.
54 Designers responsibilities include:- Understand and be aware of significant risks Have the right skills, knowledge and experience Check Clients are aware of their responsibilities Co-operate with others with design responsibilities Provide information on risks arising from the design Co-ordinate their work with others
55 Who is the Principal Contractor The Principal Contractor is the contractor in overall charge of the construction phase. They must be appointed by the Client. There should only be one Principal Contractor for a project at one time. Who can be the Principal Contractor A company that can deliver the project in a way that secures health and safety. A company that has the necessary skills, knowledge and resources. Understands their roles and responsibilities.
56 What the Principal Contractor has to do Prepare a Construction Phase Plan that ensures work is carried out without risks to health and safety. Implement the plan and facilitate co-operation between contractors. Monitor the plan, including reviewing, revising and updating. Secure the site. Provide welfare facilities. Provide site induction. Liaise on design.
