1 NAVAJO COUNTY AGENDA ITEM REQUEST FORM Meeting Date: March 22, 2016 Requesting Department: Board of Supervisors Time Needed: 20 minutes Presenter(s) Name: Emery La Barge/Kristopher Carter Motion before the Board: Presentation of the Volunteer Lawyers Program - Family Law Clinic Recommendation: Presentation Background: In February 2015, Southern Arizona Legal Aid s (SALA) Volunteer Lawyers Program (VLP) partnered with the Navajo County Superior Court to launch a monthly self-service clinic to help self-represented litigants complete and file forms, as well as provide legal counsel. The purpose of this advice and brief service clinic is to provide individuals, who may not be afforded one otherwise, the opportunity to discuss their legal matter with an attorney. Individuals may seek advice through this clinic for family law or estate issues in any stage of their proceeding. This project benefits the individuals attending, the community, the volunteer attorneys, the Bench, and the Court. The following presentation will explain how and why it is worth approving funding for this project. 9 SOUTHERN ARIZONA LEGAL AID, INC....restoring hope through equal access to justice When someone is faced with the loss of shelter, income, safety, or education... the best solution is often the legal system. That s where Southern Arizona Legal Aid, Inc. (SALA), a private, non-profit law firm works to fill the gap. Established in 1951, SALA uses the power of the law to provide free legal assistance to qualified low income people in 9 counties in Southern Arizona and 11 of Arizona s 22 Native American tribes. Our services include advice, referrals, workshops, and direct representation. Our mission is to provide quality legal services to people who would not otherwise have equal access to justice, in ways which affirm their individual and collective dignity, integrity, and power. SALA clients, board members, and staff have identified our case priorities as follows: Domestic relations: cases involving domestic violence, child abuse or child snatching, and cases involving elderly clients who face loss of housing or income. Limited services are available for other domestic cases involving divorce, paternity, and custody. Loss of home/unsafe housing: cases involving loss of home due to foreclosure, mobile home repossession, eviction from subsidized or private housing, landlord/tenant problems, substandard housing conditions, lockouts and utility shut offs.
10 Immigration: services to legal permanent residents, certain qualified aliens, derivative citizens, victims of domestic abuse and serious crime. Services include representation before the US Citizenship and Immigration Services, Immigration Court and the Board of Immigration Appeals. Public benefits: cases involving welfare programs such as SNAP (Food Stamps), AHCCCS Medical Assistance, TANF Cash Assistance, Unemployment Benefits, and Social Security disability. Public benefits issues include denials, reduction in benefits, and overpayment of benefits. Consumer Protection: cases involving deceptive and predatory practices, debt collection, repossession, fraud, deficiency, garnishment, and bankruptcy. Education: cases involving due process, bilingual, and special education. Representation in Tribal Court: cases involving domestic relations, juvenile dependency, delinquency, Indian wills and probate, housing, public benefits, consumer matters, education, and criminal.
11 Community Education: SALA s community education programs provide legal education, pamphlets, self-help workshops and seminars to community agencies and clients. Volunteer Lawyers Program (VLP): SALA's VLP matches attorneys who wish to do pro bono work with clients in need of civil legal assistance. Volunteer attorneys provide assistance to clients through direct representation, self-help clinics, and educational programs designed to help clients navigate the court system. Every year, more than 1,000 attorneys and law students volunteer through SALA's VLP and give the generous gift of time, service, and expertise to thousands of Arizonans who would not otherwise have access to justice. SALA does not provide assistance in: criminal cases (except in tribal areas) traffic violations fee-generating cases
