Approved rooms on the main level include the kitchen, living room, and play room. There is one bathroom available for child use. The master bedroom is not approved for use. The basement and second levels are not approved for child use. Approved Variances - No Yes Description: III. DESCRIPTION OF FINDINGS & CONCLUSIONS This renewal inspection involved a review of all applicable child care home administrative rules and statutes. Verification of compliance included direct observations of the physical environment and the program, discussions with staff, and a review of the home s records, including staff records and children s records. Staff records include background checks, medical clearance information, and training information. Children s records include child information cards and child in care statements/receipts. During the inspection, the child care home was found to be in compliance with all applicable rules and statutes except for the following violations: R Caregiver Responsibilities. (1) A caregiver shall be responsible for all of the following provisions: (f) Have a written and signed agreement with a responsible 2
4 person who is 18 years of age or older to provide care and supervision for children during an emergency situation. There is no written and signed agreement with a person 18 years of age or older to provide care and supervision in the event of an emergency. R Caregiver Responsibilities. (1) A caregiver shall be responsible for all of the following provisions: (h) Report to the department, within 7 working days, any changes in the household composition or when any new or existing member of the household has any of the following: (i) Arrests or convictions. (ii) Involvement in substantiated abuse or neglect of children. (iii) Court-supervised parole or probation of the caregiver or any member of the household. (iv) Been admitted to, or released from, a correctional facility, or hospital, institution, or facility for the treatment of an emotional, mental, or substance abuse problem. Ms. Masters did not report to the department, within 7 working days, that her daughter and five grandchildren moved in to her home. R Caregiver responsibilities. (4) The caregiver shall cooperate with the department in connection with an inspection or investigation. Cooperation shall include, but not be limited to, both of the following: (b) Information provided to the department shall be accurate and truthful. Ms. Masters was not accurate and truthful when she reported that her daughter and grandchildren were visiting to help her clean out her attic. She stated this numerous times throughout the on-site inspection. When I was viewing the second level and speaking with Ms. Masters daughter, she told me that she and her children were living in the home and had been for a number of weeks. Ms. Masters was not accurate and truthful when she submitted the same furnace and water heater inspections three times, with the dates changed each time. (See R (5) for further information.) 3
5 R Training. (1) The caregiver shall complete not less than 10 clock hours of training each year related to child development, program planning, and administrative management for a child care business, not including CPR, first aid, and blood-borne pathogen training. Ms. Masters only received 10 of the 30 clock hours of required training for the last licensing cycle. The 10 hours were received in December of R Children's records. (1) Prior to initial attendance, the caregiver shall obtain the following documents: (a) A completed child information card on a form provided by the department or a comparable substitute approved by the department. The child information cards are outdated, one child did not have a child information card, and all four of the child information cards that had been obtained were missing information. Missing information on the cards included admission date, allergies, and parent information. R Children's records. (1) Prior to initial attendance, the caregiver shall obtain the following documents: (b) A child in care statement/receipt using a form provided by the department and signed by the parent certifying the following: (i) Receipt of a written discipline policy. (ii) Condition of the child's health. (iii) Receipt of a copy of the family and group child care home rules. (iv) Agreement as to who will provide food for the child. (v) Acknowledgement that the assistant caregiver is 14 to 17 years of age, if applicable. (vi) Acknowledgement that firearms are on the premises, if applicable. (vii) If the child care home was built prior to 1978, then the caregiver shall inform the parents of each child in care and all assistant caregivers of the potential presence of lead-based paint or lead dust hazards, unless the caregiver maintains documentation from a lead testing professional that the home is lead safe. 4
6 Ms. Masters could not produce child in care statements for any of the children enrolled in her care. R Children's records. (3) Dated daily attendance records of children in care shall be maintained and shall include the child's first and last name and the time of arrival and departure. Ms. Masters is not maintaining attendance records. R Discipline and child handling. (2) Developmentally appropriate positive methods of discipline which encourage self-control, self-direction, self-esteem, and cooperation shall be used. Ms. Masters discipline policy does not describe how she will manage children s behavior by using positive methods of discipline and encouraging children to develop self-control. It states that time outs will be used for children over 18 months of age time out is not an acceptable method of discipline for children under 3 years of age. R Diapering and toilet learning. (2) The designated changing area shall comply with all of the following: (d) Have a nonabsorbent, easily sanitized surface with a changing pad between the child and the surface. The diaper changing pad is covered with a nonabsorbent cloth cover. R Home maintenance and safety. (2) All dangerous and hazardous materials or items shall be stored securely and out of the reach of children. Dangerous and hazardous materials are accessible to children in kitchen cabinets. Materials include batteries and other small choking hazards, and cleaning supplies. R Heating; ventilation; lighting. (3) A carbon monoxide detector, bearing a safety certification mark of a recognized testing laboratory such as UL (Underwriters Laboratories) or ETL (Electrotechnical Laboratory), shall be 5
7 placed on all levels approved for child care. There is no carbon monoxide detector on the main level of the home. R Heat-producing equipment. (2) Combustible materials and equipment shall not be stored within 4 feet of furnaces, other flame or heat-producing equipment, or fuel-fired water heaters. Combustible materials are stored within 4 feet of the furnace and hot water heater. Materials include boxes of board games, plastic storage bins filled with clothing, and blankets. R Heat-producing equipment. (5) For group child care homes, the inspection specified in subrule (4) of this rule shall be conducted before the initial license issuance and every 2 years thereafter at the time of license renewal. The furnace and fuel-fired water heater inspections are not current. A service order/invoice was submitted for each, however this is the third time the same service order/invoice was submitted. The original furnace service order/invoice was dated 9/28/07 and was numbered The original water heater service order/invoice was dated 12/7/07 and was numbered The original service orders/ invoices were submitted to the department 12/11/07. Each service order/invoice was submitted to the department again on 1/12/11 and on 12/18/13. Each time the service order/invoice was resubmitted the date was changed. All other information on the service orders/invoices remained the same, including the description of work performed. R Exit and escape requirements for each floor level used by children. (5) All exits shall be unobstructed and accessible at all times. One of the two exits on the main floor is obstructed by a large chair. R Smoke detectors; fire extinguishers. (1) Operable smoke detectors approved by a nationally recognized testing laboratory shall be installed and maintained on each floor of the home, including the basement, and in all sleeping areas and bedrooms used by children in care. 6
8 A smoke detector is not installed on the second level of the home, or in the living room, which is used as a sleeping area Fire; tornado; serious accident and injury plans. (3) Fire drills shall be practiced at least once a month and a written record that includes the date and time it takes to evacuate shall be maintained. Fire drills are not being conducted. Ms. Masters stated that she is not conducting fire drills because she has a 2 ½ year old child that cannot walk and is unable to do the drills. R Fire; tornado; serious accident and injury plans. (4) Tornado drills shall be practiced once a month, April to October, and a written record that includes the date shall be maintained. Tornado drills are not being conducted. Ms. Masters stated that she is not conducting the drills because she has a 2 ½ year old child that cannot walk and is unable to do the drills. IV.
