2 Bank of the West Rewards Program Rules for Credit Card Accounts Definitions 1. a. Account means the eligible Bank of the West Rewards credit card, or any replacement thereof, enrolled in the Bank of the West Rewards Program ( Program ). b. Award(s) means the rebates, services, merchandise and travel offered to the holder(s) of an Account after you claim the Points you may accrue pursuant to these Rules. c. Bank means Bank of the West. d. Good Standing means not closed, cancelled or terminated by either party, over-the-credit-limit, delinquent, or otherwise not available to use for new transactions. e. Rules means the Bank of the West Rewards Program rules. f. You or Your refers to the holder(s) of an Account. How Points work 2. As provided in these Rules, Bank accrues Points on an Account that: (i) You charge with your Bank of the West credit card enrolled in the Program; and (ii) Appears on your Account statement during the Program. Bank accrues Point(s) for every one ($1) dollar in net qualifying purchases (purchases minus returns/credits) at the rate specified in the table below based on Account type and merchant category. Points are calculated separately on each transaction by rounding to the nearest whole point. Balance transfers, cash advances, convenience checks, interest charges and any kind of fees charged to the account do not count as purchases and no Points are accrued. Any credits, except payments made on the account, will reduce the number of Points available based on the dollar amount of the credit. Bank is not responsible for any delay in a merchant posting of a transaction to your Account. Bank is not involved or responsible for how merchants are classified. There is a possibility that a merchant might be classified differently than what you expect. In that case, purchases with that merchant will not qualify for the rate specified for that merchant category. Bank reserves the right to determine which purchases qualify for a given rate. Examples of merchants in the travel category include airlines, hotels, motels, timeshares, campgrounds, car rental agencies, cruise lines, travel agencies (including online), and operators of trains, buses, taxis, limousines, and ferries. Please note, some merchants that provide transportation and travelrelated services are not included in this category. Back to General Credit Card Rules

3 Merchants that are classified in the restaurant category primarily prepare food and drinks for immediate consumption by consumers on the merchant's premises or packaged for take-out, and include merchants that sell alcoholic beverages for consumption on the premises and fast food restaurants. Year-End Loyalty Bonus On certain Account types, Bank provides a Year-End Loyalty Bonus of Points when net qualifying purchases made in the calendar year, January 1 st through December 31 st (posted within one week after December 31 st ) meet the spending requirement as specified below. Year End Loyalty Bonus will be awarded by the end of January of the following year. You must claim Points accrued through the Program through the redemption process to exchange the Points for Awards. No other person, including, without limitation, any trustee, administrator, executor or heir, may claim the Points on your behalf. Points can be claimed and used for Awards available in the then current Program. You may select Awards from any level, as long as you have accrued and can claim a sufficient number of Points available in your rewards account. Point requirements assigned to any Award are subject to change from time to time without notice, and Awards may be substituted at any time. Should an Award be discontinued, it may be replaced with an Award of equal or greater value or, if no suitable substitute is available, you will be advised to make an alternate selection. Please refer to the Travel Redemption Rules located on for applicable rules and fees. Merchandise Awards 4. Any merchandise Award usually will be delivered by a commercial delivery service or by the U.S. Postal Service within 4-6 weeks of processing your order. We may require verification of your identity and Account prior to processing your order. Shipments cannot be made to a post office box or outside the United States and eligible territories. If you have an APO address, please contact Bank of the West Rewards Award Headquarters at (866) for details regarding merchandise options and shipments. Damages to Merchandise 5. Upon receipt of any merchandise Award, you should note any damages or shortages on the delivery receipt before signing to accept delivery from the carrier. A product which is received damaged or defective must be returned to the shipper within thirty (30) days of receipt for replacement. All parts, instructions, warranty cards and original packaging materials must be returned with the product. Manufacturer Warranties 6. Applicable manufacturers warranties will be included with your Award. Warranty claims must be directed to the manufacturer. BANK AND ITS SERVICE PROVIDERS MAKE NO PRODUCT REPRESENTATIONS, GUARANTEES, OR WARRANTIES, EXPRESS OR IMPLIED IN FACT OR LAW, REGARDING ANY AWARD, INCLUDING BUT NOT LIMITED TO, ITS QUALITY, CONDITION, MERCHANTABLITY OR FITNESS FOR A PARTICULAR PURPOSE, AND DISCLAIM ANY AND ALL LIABILITY AS TO THE CONDITION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF PRODUCTS AND/OR SERVICES PROVIDED THROUGH THIS PROGRAM. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. 4 Points Have No Cash Value 7. Points have no cash value and may not be used to repay other obligations to us or anyone else. You have no property rights or other legal interests in the Points accrued through the Program, and they may not be transferred (including any transfer upon death or as part of a domestic relations matter), assigned, bought, or sold. Viewing Your Points/Checking Point balance 8. You may view accrued Points subject to adjustment, online at by logging into your rewards account, or over the phone at (866) If there is any error in your Points as disclosed to you, you must report the discrepancy to us within 30 days of the date of the report. Closed Accounts; Account Standing 9. If your Account is closed for any reason, you will no longer be able to accrue Points and all accrued Points not claimed and redeemed for that Account will be forfeited. Your Account must be in Good Standing at the time you claim and redeem Points for an Award. Bank reserves the right to suspend your participation in the Program and the accrual of additional Points until the Account is in Good Standing. Upon bringing your Account into Good Standing, your participation in the Program will be reinstituted, but Points previously forfeited or eliminated will not be reinstated. Printing Errors 10. Despite the Program s best efforts to ensure accuracy, printing errors occasionally occur. The Program reserves the right to correct such errors at any time even if it affects a pending claim of Points or Award redemption. Rewards Program Modifications 11. This Program may be modified, suspended or cancelled at any time. These Rules may be added to, deleted from or otherwise amended at any time upon such notice as is required by law. Changes to the Program may include, but are not limited to, modifications which affect Point accrual and the expiration of Points. Only if you have an Account will you be provided with written notice of any material change to the Program and Rules. All notices pertinent to this Program or the Rules may be sent by mail addressed to the last address shown in our records for you or sent to you by at the address on file with us. Your continued participation in the Program after the effective date of any notice of change shall constitute your agreement to the Program or Rules as amended. Any notice provided to you hereunder will be deemed received by you no later than the earlier of the date received or within five days from the date it is sent or posted. Contact Bank for details on any current promotions affecting Point accrual or redemption options. Accrued Points may be eliminated due to Rules violations. This Program is void where prohibited or restricted by law. You are responsible for any applicable federal, state or local taxes. Liability 12. You release and agree to hold Bank, its officers, employees, agents and service providers harmless in connection with any injuries and damages of every kind and nature arising in connection with or as a result of your claiming and redeeming Points and with your receipt of and use of an Award. You waive and release any and all rights, demands, losses, liabilities, claims and causes of action whatsoever that you may now or hereafter be entitled to assert, including, but not limited to, any death, injury, loss of enjoyment or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of any Award, its acceptance or use. You further agree to hold Bank and any of its service providers harmless if an Award vendor or provider files for bankruptcy, or otherwise goes out of business, after you have redeemed your Points for an Award from the vendor or provider but before you are able to receive or use the Award. BP Driver Rewards 13. If the Rewards Customer elects to link his or her FIS Loyalty participating Payment Card and Driver Rewards account, the accounts will be linked for future Reward Transactions and that Rewards Customer will not have the option to opt-out of combining his/her points balance at the time of each corresponding Reward Transaction. 5 Program Restrictions 14. Certain restrictions may apply to travel certificates, tickets and documents. Travel and other certificates are not exchangeable, refundable, transferable or redeemable for cash. All travel certificates, tickets and documents will be mailed first class U.S. Mail and will not be replaceable in the event of loss, destruction or theft. Your award will usually be delivered within 4-6 weeks of processing your order. You may request travel certificates, tickets and documents to be delivered by overnight carrier and agree to pay the associated additional delivery fees by card. Unless otherwise stated, you are responsible for federally imposed airline security fees as well as any surcharges or additional fees as may be imposed by the airlines or local aviation authority and must pay them by card at the time of the reservation booking. Please refer to the Travel Redemption Rules located on for applicable rules and fees. About These Rules 15. The Bank shall resolve all questions of what constitutes an eligible charge. All Program Rule determinations by the Bank are final. By using the card enrolled in this Program or otherwise accruing Points, you agree these Program Rules, as amended from time to time, will govern the Bank of the West Rewards Program. 6 Bank of the West Rewards Program Rules for Debit Card Accounts Definitions 1. a. Account means the eligible Bank of the West Debit Card, or any replacement thereof, enrolled in the Bank of the West Rewards Program ( Program ). b. Award(s) means the rebates, services, merchandise and travel offered to the holder(s) of an Account after you claim the Points you may accrue pursuant to these Rules. c. Bank means Bank of the West. d. Deposit Account means the deposit account to which an Account is linked. e. Good Standing means not closed, cancelled or terminated by either party, overdrawn, delinquent, or otherwise not available to use for new transactions. f. Rules means the Bank of the West Rewards Program rules. g. You or Your refers to the holder(s) of an Account. How Points work 2. As provided in these Rules, Bank accrues ten (10) Points for every net qualifying purchase (purchase transactions minus returns/credit transactions) on an Account that: (i) You charge with your Bank of the West Debit Card enrolled in the Program; and (ii) Appears on your Deposit Account statement during the Program. Qualifying purchases include purchases made with a Personal Identification Number (PIN) or purchases you sign for, Internet, phone or mail-order purchases, small dollar purchases that don t require a signature, and payments on your bills. Any returned purchase will reduce the number of Points available by ten (10) Points. No Points are accrued for fees, cash transactions, or foreign transaction currency conversion charges. Bank is not responsible for any delay in a merchant posting of a transaction to your Account. The Program constitutes a consumer retention program operated by Bank to provide consumers with Points that upon being claimed are redeemable for or towards goods or services or other monetary value as a reward for purchases made. Annual Fee 3. Bank will charge Debit Rewards Annual Membership Fee at the amount specified in the table below based on Account, Deposit Account, or bundle type. The Debit Rewards Annual Membership Fee will be charged the business day following enrollment and then annually on or near the same date. Consult your Deposit Account disclosures for any applicable fee waiver information. 9 Travel Program Redemption Rules Please review the complete rules and restrictions listed below. Your use of this Web site ( Site ) or your redemption of Points or purchase of travel components constitutes your agreement to all such terms, conditions, and notices. In addition to these Travel Program Redemption Rules, please see the General Credit Card Rules, the General Debit Card Rules, the Travel Fees and the FAQs for additional award and program information (together these documents are referred to as the Rules ) for the Bank of the West Reward Program ( Program ). Please read all information carefully before making any payment or redemptions. General Terms and Conditions 1. THE TRAVEL INVENTORY AND RELATED SERVICES AVAILABLE ON THE SITE ARE PROVIDED BY INDEPENDENT CONTRACTORS ( TRAVEL SUPPLIERS ). TRAVEL SUPPLIERS ARE NOT AGENTS OR EMPLOYEES OF THE PROGRAM OR THE SITE. UNLESS PROHIBITED BY LAW, ORDINANCE, OR REGULATION, THE PROGRAM AND THE SITE DO NOT ASSUME LIABILITY FOR ANY ACTS, ERRORS, OMISSIONS, REPRESENATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE OR LOSS, INCONVENIENCE, LOSS OF ENJOYMENT, MENTAL DISTRESS OR OTHER SIMILAR MATTER, DELAYED DEPARTURE, MISSED CONNECTION, SUBSTIUTION OF SERVICE OR ACCOMODATIONS, TERMINATIONS OF SERVICE, OR CHANGES IN FARES AND RATES, AND/OR CANCELLATION OR DOUBLE BOOKING OF RESERVATIONS BY THE SUPPLIER. 2. You acknowledge the reward portion of your transaction will be paid for by your Reward Program s Account. 3. Additional charges not covered by the Program will be charged to your payment card. If applicable, any fees or redemption associated charges will appear on your monthly card statement. 4. All international itineraries require a valid passport. Visa policies vary by country, should be obtained prior to departure, and is the sole responsibility of the traveler. 5. Minors under the age of 18 who are traveling with only one parent may be required to have additional documentation if leaving their country of residence. Please contact the nearest Consulate of the country to which you are traveling for additional information. 6. Charges may show from the airline, hotel chain, car rental company, activity provider and/or travel insurance agency on your payment card statement. 7. Bank of the West or the travel supplier has the right to cancel the booking in the event of non-payment or payment dispute. All refund requests must be made by calling the Travel Rewards Center at A delay in requesting a refund may limit the travel supplier s ability to work the request, and prevent a refund from being processed. 8. Because Bank of the West may use different travel suppliers for each aspect of travel (i.e., for air, hotel and car rentals), your travel transactions may not be linked within the system. IF YOU WISH TO MAKE CANCELLATIONS OR CHANGES TO YOUR TRAVEL, YOU MUST MAKE SUCH REQUESTS FOR EACH ELEMENT OF YOUR TRAVEL. For example, if you change your air travel dates, that request will not result in any changes to your hotel dates. 9. If a payment card was used in conjunction or solely for a travel redemption and/or transaction, and a refund is processed to the payment card, the timing of when the funds will be available on your payment card account is dependent upon the individual financial institution which issued your payment card, and may take up to 1 to 2 billing cycles.

10 Fees: The following fees will be collected by Travel Services, unless otherwise noted, and will depend on the type of award redeemed or purchase made and whether travel is booked online or by calling Travel Services. For additional award information or descriptions, please see the FAQs. Fee(s) will appear on your monthly card statement as "Award Headquarters." The applicable fees must be paid at the time of redemption or purchase. Booking fees are included in the total number of points required for the travel redemption. 11 Airline Terms and Conditions: 1. Any fees associated to the applicable redemption or ticket purchase will be the responsibility of the traveler at the time of booking. These fees include, but are not limited to, ticketing fees, airline fuel surcharges, and security fees. Please refer to the Rules for additional information. 2. Airline tickets are NON-REFUNDABLE and NON-CHANGEABLE unless permitted by the terms of the fare and are subject to airline rules, penalties and fare difference. 3. Points listed for airline tickets do not include any applicable baggage fees or any additional charges by the airlines and charges for incidentals obtained from the airline 4. Changes to and cancellations of airline tickets can be made only if the supplier and specific air ticket rules permit the changes or cancellations. A $40 per ticket service fee will be collected by the travel supplier for all exchanges, modifications, or cancellations, in addition to airline penalties and fare difference. 5. Unused tickets contain no value if not canceled prior to departure. 6. All reservations must be made in the EXACT name of the person traveling. Tickets may not be reassigned or transferred to a different passenger or airline. Name changes are not permitted. You will be responsible for any charges issued by the Supplier and/or airline due to incorrect passenger information entered by you at the time of making the reservation. 7. Airline passengers must present applicable travel documents at the airport on the day of travel along with a valid government-issued photo identity card. 8. It is recommended that passengers check in with the airline a minimum of 2 hours prior to scheduled departure time for domestic flight itineraries and 3 hours prior to scheduled departure time for international itineraries due to federal security requirements. Recommended check in times could differ depending on the airport, please check with your airport to confirm check in times. Please note that airline schedules change frequently. Please reconfirm all flight dates and times with the airline 24 hours prior to departure. 9. Upgrades are not permitted on certain itineraries. Please check with the carrier directly. 10. Please review your itinerary, as code-share flights may exist. If a code-share flight exists in your itinerary, passengers must check in with the operating airline on day of departure. 11. If the traveler s itinerary requires a paper ticket, there will be an additional charge to cover printing and express delivery of the paper ticket(s). 12. Bank of the West and travel suppliers are not responsible for any lost or damaged luggage. 13. Airline policies are subject to change at any time without notice. Baggage Fees: Airline baggage policies vary and charges may apply for checked baggage. You are responsible for such charges. These include but are not limited to resort fees, hotel energy surcharges, parking fees, baby sitting, room service, telephone fees, internet usage fees, in-room movies, mini-bar charges, gratuities, and other incidentals. 7. Special requests made to hotel properties are on a request only basis and cannot be guaranteed. Fees and charges may apply, depending on the service request. 8. At check-in, you must furnish a valid government-issued photo ID and a credit card for incidentals. Minimum age for booking a hotel is 18 years of age at time of stay, but some hotels have different age requirements for booking. 9. Reservations do not include services not specified in the reservation confirmation. 10. Travel suppliers will attempt to notify guests of hotel renovation or refurbishment as reasonably soon as travel suppliers are notified by the hotel; however, Bank of the West and travel suppliers are not liable if the hotel has failed to notify travel suppliers in advance.

13 Hotel Taxes and Fees for Non-Point Transactions: 1. In connection with facilitating your hotel transaction, the charge to your payment card will include a charge for Taxes and Fees. This charge includes an estimated amount to recover the amount paid to the hotel in connection with your reservation for taxes owed by the hotel including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value-added tax and/or other similar taxes. In certain locations, the tax amount may also include government imposed service fees or other fees not paid directly to the taxing authorities but required by law to be collected by the hotel. 2. The amount paid to the hotel in connection with your reservation for taxes may vary from the amount estimated and included in the charge to you. The balance of the charge for Taxes and Fees is a fee retained as part of the compensation for services and to cover the costs of processing your reservation. The charge for Taxes and Fees varies based on a number of factors including, without limitation, the amount paid to the hotel and the location of the hotel where you will be staying, and may include profit. 3. Except as described below, Bank of the West is not the vendor collecting and remitting taxes to the applicable taxing authorities. Hotel travel suppliers, as vendors, include all applicable taxes in the amount billed to Bank of the West and Bank of the West pays such amounts directly to the vendors. Bank of the West is not a co-vendor associated with the vendor with whom you book or reserve your travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location. 4. For transactions involving hotels located within certain jurisdictions, the charge to your payment card for Taxes and Fees includes a payment of tax required to be collected and remitted to the applicable jurisdiction for tax owed on amounts retained as compensation for services. 5. Please note that Bank of the West and travel suppliers are unable to facilitate a refund of Goods and Services Tax ( GST ) or Value added Tax ( VAT ) for passengers booking hotel accommodations. Car Rental Terms and Conditions: 1. You must contact the Travel Rewards Center for all cancellation or modification requests. Cancellations or modifications handled by the rental car agency directly may result in no refund. Car rentals can only be canceled in full, and not just a portion of the reservation. If desiring to shorten or extend your length of rental, you will need to cancel the existing reservation and book a new reservation. 2. A valid driver s license and credit card is required at the time of pick-up of the vehicle. The driver s license and credit card must be in the name of the individual that reserved the vehicle for his/her use. Debit cards may not be accepted by a car rental company. 3. Rentals do not include local taxes, airport fees, state surcharges, or any other fees imposed by local jurisdictions or the rental agency. It is the responsibility of the passenger in whose name the vehicle is being rented to pay these charges directly to the rental company at the time of rental. 4. No shows are non-refundable and will result in a total forfeiture of settlement and points and without credit due. 5. Cancellation fees, rental terms, and any additional fees are subject to change without notice and may vary by location. 6. Rental rates are based on 24 hour periods and may be subject to additional fees depending on time of return, including but not limited to hourly rental charges which will be billed directly to you by the car rental company. 7. Charges for optional services such as insurance waivers, fuel, additional or underage drivers, special equipment charges, etc., are not included in your rental and must be paid directly to the car rental company. 8. Personal accident insurance, liability insurance and loss damage waiver are not included in your rental, but may be available for an additional charge, and must be paid directly to the rental car company. 9. Cruise Terms and Conditions: 1. Rates quoted are per person/double occupancy unless specified otherwise. 2. A valid passport (with appropriate expiration date, visa, and other requirements) is required at the time of disembarkation for each passenger. It is the responsibility of the passenger to ensure they have the proper identification, passport, visa and all other valid documentation available. When traveling with a minor and both parents/legal guardians are not cruising, Bank of the West and travel suppliers strongly recommend you bring an original signed letter from the absent parent/legal guardian authorizing the minor to travel with you. This will expedite processing by the Department of Homeland Security. 4. If you cancel your reservation after a specific date, you may be subject to cancellation charges. The cancellation time period and any associated charges are dependent upon the cruise line. 5. The passenger s ticket may not be assigned, sold or otherwise transferred by the passenger or any other person. Among other things, this means that the passenger cannot sell or transfer the ticket to someone else, and the cruise line shall not be liable to the passenger or any other person in possession of a ticket for honoring or refunding such ticket when presented by such other person. 6. The cruise line reserves the right to impose a supplemental charge relating to unanticipated occurrences including, but not limited to, increases in the price of fuel. Any such supplement charges may apply, at the cruise line s sole discretion, to both existing and new bookings. This varies based upon the cruise line company. If travel insurance is purchased, you will receive an confirmation including your policy number and specific details of your policy within 24 hours. Please review your policy details immediately upon receipt for important coverage information. 3. Travel Insurance coverage will not cover cancellation fees. Bank of the West or the travel supplier has the right to cancel the booking in the event of non-payment or payment dispute. All refund requests must be made in writing and any negotiable documents (i.e. airline tickets, redeemable certificates or vouchers, etc.) issued must be returned prior to processing of any refund. All refund claims must be submitted within 30 days after the scheduled departure date. Special cancellation provisions may apply to group, holiday and school vacation reservations. 4. Please note that you are fully responsible for any potential losses that may arise from your travels if you choose not to select this option. 5. Travel Guard insurance does not cover pre-existing conditions unless coverage is purchased on the same day as the redemption or purchase of the corresponding travel. Passport Requirement A valid passport is required for destinations outside the 50 states or territories. Travelers are responsible for ascertaining, obtaining and possessing all required documentation needed for travel to your destination and it is strongly recommended that both U.S. and non-u.s. citizens verify current entry requirements before making reservations.
