4 Accounts Your checking account will transition to Cape Cod Five checking account that is most similar to account you currently have at Mutual Bank beginning on Friday, April 29, at 2:30 p.m. Please locate your current Mutual Bank account and review features and changes your new account. To help facilitate a smooth transition, your Mutual Bank account will be automatically transitioned to account type shown below. Your account number will remain same. Where applicable, account monthly maintenance fees will be waived for first month following your account s transition to Cape Cod Five. Over next month, you will receive via mail: new Cape Cod Five checks, new Cape Cod Five Visa Check Card (debit card) or ATM card if you currently have a Mutual Bank debit card or ATM card, and additional detailed information regarding transition your account. The MasterCard currency conversion procedure includes use eir a governmentmandated exchange rate, or a wholesale rate selected by MasterCard. ATM Fees You will be charged $1.00 for using a non Cape Cod Five ATM after 5 free transactions per card number per statement cycle. Card Opt In - Cape Cod Five does not allow personal cardholders to opt-in to overdraft service for debit and ATM transactions. Link to a savings or money market By linking a savings or money market account to your checking account, Bank will automatically transfer funds from your savings or money market to your checking account when your checking account has a negative balance. It s called Overdraft Transfer Service and costs $5 per daily transfer. Money is transferred from your savings or money market in increments $25 until balance in checking account is above $0. 6

We will treat and record all transactions received after our daily cutf time on a business day we are open, or received on a day we are not open for business, as if initiated on next business day that we are open. At our option, we may take an item for collection rar than for deposit. WITHDRAWALS - Generally - Unless clearly indicated orwise on account records, any you, acting alone, who signs to open account or has authority to make withdrawals may withdraw or transfer all or any part account balance at any time. Each you (until we receive written notice to contrary) authorizes each or person who signs or has authority to make withdrawals to indorse any item payable to you or your order for deposit to this account or any or transaction with us. Postdated checks - A postdated check is one which bears a date later than date on which check is written. We may properly pay and charge your account for a postdated check even though payment was made before date check, unless we have received written notice postdating in time to have a reasonable opportunity to act. Because we process checks mechanically, your notice will not be effective and we will not be liable for failing to honor your notice unless it precisely identifies number, date, amount and payee item. Checks and withdrawal rules - If you do not purchase your check blanks from us, you must be certain that we approve check blanks you purchase. We may refuse any withdrawal or transfer request which you attempt on forms not approved by us or by any method we do not specifically permit. We may refuse any withdrawal or transfer request which is greater in number than frequency permitted, or which is for an amount greater or less than any withdrawal limitations. We will use date transaction is completed by us (as opposed to date you initiate it) to apply frequency limitations. In addition, we may place limitations on account until your identity is verified. Even if we honor a nonconforming request, we are not required to do so later. If you violate stated transaction limitations (if any), in our discretion we may close your account or reclassify it as a transaction account. A temporary debit authorization hold affects your account balance - On debit card purchases, merchants may request a temporary hold on your account for a specified sum money, which may be more than actual amount your purchase. When this happens, our processing system cannot determine that amount hold exceeds actual amount your purchase. This temporary hold, and amount charged to your account, will eventually be adjusted to actual amount your purchase, but it may be up to three days before adjustment is made. Until adjustment is made, amount funds in your account available for or transactions will be reduced by amount temporary hold. If anor transaction is presented for payment in an amount greater than funds left after deduction temporary hold amount, that transaction will be a nonsufficient funds (NSF) transaction if we do not pay it or an overdraft transaction if we do pay it. You will be charged an NSF or overdraft fee according to our NSF or overdraft fee policy. You will be charged fee even if you would have had sufficient funds in your account if amount hold had been equal to amount your purchase. Overdrafts - You understand that we may, at our discretion, honor withdrawal requests that overdraw your account. However, fact that we may honor withdrawal requests that overdraw account balance does not obligate us to do so later. So you can NOT rely on us to pay overdrafts on your account regardless how frequently or under what circumstances we have paid overdrafts on your account in past. We can change our practice paying overdrafts on your account without notice to you. You can ask us if we have or account services that might be available to you where we commit to paying overdrafts under certain circumstances, such as an overdraft protection line--credit or a plan to sweep funds from anor account you have with us. Multiple signatures, electronic check conversion, and similar transactions - An electronic check conversion transaction is a transaction where a check or similar item is converted into an electronic fund transfer as defined in Electronic Fund Transfers regulation. You agree that, as to se or any items as to which we have no opportunity to examine signatures, you waive any requirement multiple signatures. You should notify us if you or your spouse qualify so that we may administer your account accordingly. Despite this exemption, we may assess a fee for certain services in accordance with our published service charge schedule, including stop payment orders, wire transfers, certified or bank checks, money orders and deposit items returned, transactions at electronic branches and through or electronic devices, and services not directly associated with deposit, withdrawal or transfer funds from any such account; and we may assess you a reasonable charge when payment has been refused because insufficient funds on any check or or transaction on account (as permitted by law). OWNERSHIP OF ACCOUNT AND BENEFICIARY DESIGNATION - These rules apply to this account depending on form ownership and beneficiary designation, if any, specified on account records. We reserve right to refuse some forms ownership on any or all our accounts. We make no representations as to appropriateness or effect ownership and beneficiary designations, except as y determine to whom we pay account funds. Individual Account - is an account in name one person. Joint Account - With Survivorship (And Not As Tenants In Common) - is an account in name two or more persons. Revocable Trust Account - One or two you (called trustees) may create such an account in trust for or persons. Processing Order We may establish different processing orders for checks and or items. We process deposit and or credit transactions prior to withdrawals and or debit transactions. Payments may not be processed in order received. We typically, as described below, process first by category and n within each category by dollar amount. We process low dollar transactions up to high dollar transactions. If re are not enough available funds to cover all checks and or items processed on any given day, our processing orders typically results in fewer unavailable funds items and fewer fees than may have resulted if we had used a high-to-low processing order. Credits are processed first Debits - In person payments and withdrawals (Cape Cod Five Online, Automated Telephone Banking and In Branch payment orders) - Previously authorized withdrawals (Loan payment, Bill payment, Safe Deposit Box payment, ATM and/or Check Card withdrawals) - Inclearing transactions (Checks, ACH and or electronic payments) - Scheduled transfers - Service charges We may in our sole discretion change our priorities, categories, or payment orders at any time without notice to you. STOP PAYMENTS - Unless orwise provided, rules in this section cover stopping payment items such as checks and drafts. Rules for stopping payment or types transfers funds, such as consumer electronic fund transfers, may be established by law or our policy. If we have not disclosed se rules to you elsewhere, you may ask us about those rules. We may accept an order to stop payment on any item from any one you. You must make any stop-payment order in manner required by law and we must receive it in time to give us a reasonable opportunity to act on it before our stoppayment cutf time. When you place your stop-payment order we will tell you what information we need to stop payment. This information must be exact since stop-payment orders are handled by computers. If your information is not exact your order will not be effective and we will not be responsible for failure to stop payment. If any provision this document is found to be unenforceable according to its terms, all remaining provisions will continue in full force and effect. We may permit some variations from our standard agreement, but we must agree to any variation in writing eir on signature card for your account or in some or document. As used in this document words we, our, and us mean financial institution and words you and your mean account holder(s) and anyone else with authority to deposit, withdraw, or exercise control over funds in account. However, this agreement does not intend, and terms you and your should not be interpreted, to expand an individual s responsibility for an organization s liability. If this account is owned by a corporation, partnership or or organization, individual liability is determined by laws generally applicable to that type organization. The headings in this document are for convenience or reference only and will not govern interpretation provisions. Unless it would be inconsistent to do so, words and phrases used in this document should be construed so singular includes plural and plural includes singular. LIABILITY - You agree, for yourself (and person or entity you represent if you sign as a representative anor) to terms this account and schedule charges. You authorize us to deduct se charges, without notice to you, directly from account balance as accrued. You will pay any additional reasonable charges for services you request which are not covered by this agreement. Each you also agrees to be jointly and severally (individually) liable for any account shortage resulting from charges or overdrafts, wher caused by you or anor with access to this account. This liability is due immediately, and can be deducted directly from account balance whenever sufficient funds are available. You have no right to defer payment this liability, and you are liable regardless wher you signed item or benefited from charge or overdraft. You will be liable for our costs as well as for our reasonable attorneys fees, to extent permitted by law, wher incurred as a result collection or in any or dispute involving your account. This includes, but is not limited to, disputes between you and anor joint owner; you and an authorized signer or similar party; or a third party claiming an interest in your account. This also includes any action that you or a third party takes regarding account that causes us, in good faith, to seek advice an attorney, wher or not we become involved in dispute. All costs and attorneys fees can be deducted from your account when y are incurred, without notice to you. DEPOSITS - We will give only provisional credit until collection is final for any items, or than cash, we accept for deposit (including items drawn on us ). We may refuse, accept for collection only, or return all or part any deposit. Before settlement any item becomes final, we act only as your agent, regardless form indorsement or lack indorsement on item and even though we may provide you provisional credit for item. If we have given you credit for an item and it is not paid for any reason, we may revoke credit and charge amount item back to your account, even if this causes your account to be overdrawn. Actual credit for deposits, or payable in, foreign currency will be at exchange rate in effect on final collection in U.S. dollars. We are not responsible for transactions by mail or outside depository until we actually record m. We will treat and record all transactions received after our daily cutf time on a business day we are open, or received on a day we are not open for business, as if initiated on next business day that we are open. At our option, we may take an item for collection rar than for deposit. If we accept a third-party check for deposit, we may require any third-party indorsers to verify or guarantee ir indorsements, or indorse in our presence. WITHDRAWALS - Generally - Unless clearly indicated orwise on account records, any you, acting alone, who signs to open account or has authority to make withdrawals may withdraw or transfer all or any part account balance at any time. Each you (until we receive written notice to contrary) authorizes each or person who signs or has authority to make withdrawals to indorse any item payable to you or your order for deposit to this account or any or transaction with us. Postdated checks - A postdated check is one which bears a date later than date on which check is written. We may properly pay and charge your account for a postdated check even though payment was made before date check, unless we have received written notice postdating in time to have a reasonable opportunity to act. Because we process checks mechanically, your notice will not be effective and we will not be liable for failing to honor your notice unless it precisely identifies number, date, amount and payee item. Checks and withdrawal rules - If you do not purchase your check blanks from us, you must be certain that we approve check blanks you purchase. We may refuse any withdrawal or transfer request which you attempt on forms not approved by us or by any method we do not specifically permit. We may refuse any withdrawal or transfer request which is greater in number than frequency permitted, or which is for an amount greater or less than any withdrawal limitations. We will use date transaction is completed by us (as opposed to date you initiate it) to apply frequency limitations. In addition, we may place limitations on account until your identity is verified. Even if we honor a nonconforming request, we are not required to do so later. If you violate stated transaction limitations (if any), in our discretion we may close your account or reclassify it as a transaction account. If we reclassify your account, your account will be subject to fees and earnings rules new account classification. If we are presented with an item drawn against your account that would be a substitute check, as defined by law, but for an error or defect in item introduced in substitute check creation process, you agree that we may pay such item. See funds availability policy disclosure for information about when you can withdraw funds you deposit. For those accounts to which our funds availability policy disclosure does not apply, you can ask us when you make a deposit when those funds will be available for withdrawal. We may determine amount available funds in your account for purpose deciding wher to return an item for insufficient funds at any time between time we receive item and when we return item or send a notice in lieu return. We need only make one determination, but if we choose to make a subsequent determination, account balance at subsequent time will determine wher re are insufficient available funds. A temporary debit authorization hold affects your account balance - On debit card purchases, merchants may request a temporary hold on your account for a specified sum money, which may be more than actual amount your purchase. When this happens, our processing system cannot determine that amount hold exceeds actual amount your purchase. This temporary hold, and amount charged to your account, will eventually be adjusted to actual amount your purchase, but it may be up to three days before adjustment is made. Until adjustment is made, amount funds in your account available for or transactions will be reduced by amount temporary hold. If anor transaction is presented for payment in an amount greater than funds left after deduction temporary hold amount, that transaction will be a nonsufficient funds (NSF) transaction if we do not pay it or an overdraft transaction if we do pay it. You will be charged an NSF or overdraft fee according to our NSF or overdraft fee policy. You will be charged fee even if you would have had sufficient funds in your account if amount hold had been equal to amount your purchase. Overdrafts - You understand that we may, at our discretion, honor withdrawal requests that overdraw your account. However, fact that we may honor withdrawal requests that overdraw account balance does not obligate us to do so later. So you can NOT rely on us to pay overdrafts on your account regardless how frequently or under what circumstances we have paid overdrafts on your account in past. We can change our practice paying overdrafts on your account without notice to you. You can ask us if we have or account services that might be available to you where we commit to paying overdrafts under certain circumstances, such as an overdraft protection line--credit or a plan to sweep funds from anor account you have with us. You agree that we may charge fees for overdrafts. We may use subsequent deposits, including direct deposits social security or or government benefits, to cover such overdrafts and overdraft fees. Multiple signatures, electronic check conversion, and similar transactions - An electronic check conversion transaction is a transaction where a check or similar item is converted into an electronic fund transfer as defined in Electronic Fund Transfers regulation. In se types transactions check or similar item is eir removed from circulation (truncated) or given back to you. As a result, we have no opportunity to review check to examine signatures on item. You agree that, as to se or any items as to which we have no opportunity to examine signatures, you waive any requirement multiple signatures. CHAPTER 167D ACCOUNTS - Except as indicated below, we do not intend vto subject your account to (i) a service, maintenance or similar charge, (ii) a minimum balance requirement, (iii) a charge for a check, deposit or withdrawal, or (iv) a fee for initial order or subsequent refills basic line checks fered by us if you qualify for minor or senior citizen fee exemption under Chapter 167D Massachusetts General Laws. You should notify us if you or your spouse qualify so that we may administer your account accordingly. Despite this exemption, we may assess a fee for certain services in accordance with our published service charge schedule, including stop payment orders, wire transfers, certified or bank checks, money orders and deposit items returned, transactions at electronic branches and through or electronic devices, and services not directly associated with deposit, withdrawal or transfer funds from any such account; and we may assess you a reasonable charge when payment has been refused because insufficient funds on any check or or transaction on account (as permitted by law). OWNERSHIP OF ACCOUNT AND BENEFICIARY DESIGNATION - These rules apply to this account depending on form ownership and beneficiary designation, if any, specified on account records. We reserve right to refuse some forms ownership on any or all our accounts. We make no representations as to appropriateness or effect ownership and beneficiary designations, except as y determine to whom we pay account funds. Individual Account - is an account in name one person. Joint Account - With Survivorship (And Not As Tenants In Common) - is an account in name two or more persons. Each you intend that when you die balance in account (subject to any previous pledge to which we have agreed) will belong to survivor(s). If two or more you survive, you will own balance in account as joint tenants with survivorship and not as tenants in common. Revocable Trust Account - One or two you (called trustees) may create such an account in trust for or persons. Payments may be made to trustee, or if re are two trustees, to eir or both trustees or survivor. Upon death trustee or death both trustees, payment may be made to person or persons who survive death last surviving trustee in an equal portion funds for whom trust was made, or that person s legal representative. OVERDRAFTS [Insufficient (NSF) and/or Unavailable Funds (UAF)] An overdraft is an advance funds made by Bank to you, at our sole discretion, to pay a check or substitute check image, in-person withdrawal, ATM withdrawal, ATM Card or Visa CheckCard withdrawal, or any withdrawal by or electronic means from your account. If your account is presented with any withdrawal request for payment, for more money than you have available for withdrawal from your account, at our sole discretion, we may eir permit withdrawal or we may refuse payment, and return it unpaid. Please note that ATM and Debit Card transactions will not be considered for discretionary payment. There may be a fee for each paid or returned item that is presented against insufficient fu nds (N SF) or un available funds (UAF). Please refer to FEE SCHEDULE, Or Fees and Charges for specific information regarding fees. We will not be liable to you for any Bank decision to pay or not pay your overdrawn item(s). If we pay overdrawn item(s) on one or more occasions, we are not obligated to continue to pay overdrawn items. At any time without advance notice to you, we may decline an item and return it unpaid. If we pay item(s), you agree to immediately pay amount account is overdrawn. If your account is a joint account, each owner is responsible for overdraft(s) regardless whose payment order caused overdraft(s). If you fail to pay an overdraft that has occurred on your account, we may report this information to a consumer reporting agency. If we take any legal action to collect any amount that you owe us, such as filing a lawsuit, you will pay all reasonable expenses, including attorney s fees. If you do not wish to have us pay overdraft(s), you may opt-out by providing written instructions to Bank. A customer service representative can provide you with details. To help you manage overdrafts on your account, you may apply for an Overdraft Protection Line Credit for your account. You will incur finance charges on your Overdraft Protection Line Credit, or, you may link anor account from which we will transfer funds to cover overdrafts. Under federal regulations, you are allowed six (6) transfers within a statement cycle to or from a savings account or a money market account. We may charge you a transfer fee each time we transfer funds to cover an overdraft. Please refer to separate Fee Schedule, Or Fees and Charges section for specific information regarding fees. If an Overdraft Protection Line Credit is linked to your account for overdraft protection and we advance funds from your Overdraft Protection Line Credit to cover an overdraft, you agree that you will be responsible for any liability arising under Overdraft Protection Line Credit regardless which owner applied for Overdraft Protection Line Credit or caused overdraft to occur. Processing Order We may establish different processing orders for checks and or items. We process deposit and or credit transactions prior to withdrawals and or debit transactions. Payments may not be processed in order received. We typically, as described below, process first by category and n within each category by dollar amount. We process low dollar transactions up to high dollar transactions. If re are not enough available funds to cover all checks and or items processed on any given day, our processing orders typically results in fewer unavailable funds items and fewer fees than may have resulted if we had used a high-to-low processing order. Credits are processed first Debits - In person payments and withdrawals (Cape Cod Five Online, Automated Telephone Banking and In Branch payment orders) - Previously authorized withdrawals (Loan payment, Bill payment, Safe Deposit Box payment, ATM and/or Check Card withdrawals) - Inclearing transactions (Checks, ACH and or electronic payments) - Scheduled transfers - Service charges We may in our sole discretion change our priorities, categories, or payment orders at any time without notice to you. STOP PAYMENTS - Unless orwise provided, rules in this section cover stopping payment items such as checks and drafts. Rules for stopping payment or types transfers funds, such as consumer electronic fund transfers, may be established by law or our policy. If we have not disclosed se rules to you elsewhere, you may ask us about those rules. We may accept an order to stop payment on any item from any one you. You must make any stop-payment order in manner required by law and we must receive it in time to give us a reasonable opportunity to act on it before our stoppayment cutf time. When you place your stop-payment order we will tell you what information we need to stop payment. This information must be exact since stop-payment orders are handled by computers. If your information is not exact your order will not be effective and we will not be responsible for failure to stop payment. You may stop payment on any item drawn on your account wher you sign item or not. Generally, if your stop-payment order is given to us in writing it is effective for six months. Your order will lapse after that time if you do not renew order in writing before end six-month period. We are not obligated to notify you when a stop-payment order expires. A release stop-payment request may be made only by person who initiated stop-payment order. If you stop payment on an item and we incur any damages or expenses because stop payment, you agree to indemnify us for those damages or expenses, including attorneys fees. You assign to us all rights against payee or any or holder item. You agree to cooperate with us in any legal actions that we may take against such persons. You should be aware that anyone holding item may be entitled to enforce payment against you despite stop-payment order. TRANSFER LIMITATIONS - Transfers from statement savings and money market accounts to anor account or to third parties by preauthorized, automatic, electronic, telephone transfer, check, draft or similar order are limited to six per statement cycle. We may not allow se item numbers to be exceeded. Federal regulations require compliance with se restrictions. We may be required to close your account, take away any ability to transfer and write checks, or convert account to a checking or or transaction account, if se restrictions are violated. A preauthorized transfer includes any arrangement with us to pay a third party from your account at (i) a predetermined time; (ii) on a fixed schedule or (iii) upon oral or written orders including orders received through automated clearing house (ACH). If transfer or withdrawal is initiated in person, by mail, or at an ATM n re is no limit on number payments that may be made directly to you, directly to us for amounts you owe us, or transfers to or accounts you have with us. Withdrawals by phone are also unlimited if you are requesting that a check be mailed to you. AMENDMENTS AND TERMINATION - We may change any term this agreement. Rules governing changes in interest rates are provided separately in Truth-in- Savings disclosure or in anor document. For or changes, we will give you reasonable notice in writing or by any or method permitted by law. We may also close this account at any time upon reasonable notice to you and tender account balance personally or by mail. Items presented for payment after account is closed may be dishonored. When you close your account, you are responsible for leaving enough money in account to cover any outstanding items to be paid from account. 18 31 Important Documents and Disclosures in some cases such as when we cannot verify your identity or we suspect fraud, it might be reasonable for us to give you notice after change or account closure becomes effective. For instance, if we suspect fraudulent activity with respect to your account, we might immediately freeze or close your account and n give you notice. You agree to keep us informed your current address at all times. Notice from us to any one you is notice to all you. If we have notified you a change in any term your account and you continue to have your account after effective date change, you have agreed to new term(s). STATEMENTS - Your duty to report unauthorized signatures, alterations and forgeries - You must examine your statement account with reasonable promptness. If you discover (or reasonably should have discovered) any unauthorized signatures or alterations, you must promptly notify us relevant facts. As between you and us, if you fail to do eir se duties, you will have to eir share loss with us, or bear loss entirely yourself (depending on wher we used ordinary care and, if not, wher we substantially contributed to loss). The loss could be not only with respect to items on statement but or items with unauthorized signatures or alterations by same wrongdoer. You agree that time you have to examine your statement and report to us will depend on circumstances, but will not, in any circumstance, exceed a total 30 days from when statement is first sent or made available to you. You furr agree that if you fail to report any unauthorized signatures, alterations or forgeries in your account within 60 days when we first send or make statement available, you cannot assert a claim against us on any items in that statement, and as between you and us loss will be entirely yours. This 60-day limitation is without regard to wher we used ordinary care. The limitation in this paragraph is in addition to that contained in first paragraph this section. Your duty to report or errors - In addition to your duty to review your statements for unauthorized signatures, alterations and forgeries, you agree to examine your statement with reasonable promptness for any or error - such as an encoding error. You agree that time you have to examine your statement and report to us will depend on circumstances. However, such time period shall not exceed 60 days. Failure to examine your statement and report any such errors to us within 60 days when we first send or make statement available precludes you from asserting a claim against us for any such errors on items identified in that statement and as between you and us loss will be entirely yours. ACCOUNT TRANSFER - This account may not be transferred or assigned without our prior written consent. DIRECT DEPOSITS - If we are required for any reason to reimburse federal government for all or any portion a benefit payment that was directly deposited into your account, you authorize us to deduct amount our liability to federal government from account or from any or account you have with us, without prior notice and at any time, except as prohibited by law. We may also use any or legal remedy to recover amount our liability. SETOFF - We may (without prior notice and when permitted by law) set f funds in this account against any due and payable debt you owe us now or in future, by any you having right withdrawal, to extent such persons or legal entity s right to withdraw. If debt arises from a note, any due and payable debt includes total amount which we are entitled to demand payment under terms note at time we set f, including any balance due date for which we properly accelerate under note. This right setf does not apply to this account if prohibited by law. For example, right setf does not apply to this account if: (a) it is an Individual Retirement Account or similar tax-deferred account, or (b) debt is created by a consumer credit transaction under a credit card plan (but this does not affect our rights under any consensual security interest), or (c) debtor s right withdrawal only arises in a representative capacity. We will not be liable for dishonor any check when dishonor occurs because we set f a debt against this account. You agree to hold us harmless from any claim arising as a result our exercise our right setf. RESTRICTIVE LEGENDS - The automated processing large volume checks we receive prevents us from inspecting or looking for special instructions or restrictive legends on every check. Examples restrictive legends placed on checks are must be presented within 90 days or not valid for more than $1, For this reason, we are not required to honor any restrictive legend placed on checks you write unless we have agreed in writing to restriction. We are not responsible for any losses, claims, damages, or expenses that result from your placement se or or special instructions on your checks. CREDIT VERIFICATION - You agree that we may verify credit and employment history by any necessary means, including preparation a credit report by a credit reporting agency. CHECK PROCESSING - We process items mechanically by relying solely on information encoded in magnetic ink along bottom items. This means that we do not individually examine all your items to determine if item is properly completed, signed and indorsed or to determine if it contains any information or than what is encoded in magnetic ink. You agree that we have not failed to exercise ordinary care solely because we use our automated system to process items and do not inspect all items processed in such a manner. Using an automated process helps us keep costs down for you and all account holders. CHECK CASHING - We may charge a fee for anyone that does not have an account with us who is cashing a check, draft or or instrument written on your account. We may also require reasonable identification to cash such a check, draft or or instrument. We can decide what identification is reasonable under circumstances and such identification may be documentary or physical and may include collecting a thumbprint or fingerprint. EARLY WITHDRAWAL PENALTIES (and involuntary withdrawals) - We may impose early withdrawal penalties on a withdrawal from a time account even if you don t initiate withdrawal. For instance, early withdrawal penalty may be imposed if withdrawal is caused by our setf against funds in account or as a result an attachment or or legal process. We may close your account and impose early withdrawal penalty on entire account balance in event a partial early withdrawal. See your notice penalty for early withdrawals for additional information. WAIVER OF NOTICES - You waive any notice non-payment, dishonor or protest regarding any items credited to or charged against your account. ACH AND WIRE TRANSFERS - This agreement is subject to Article 4A Uniform Commercial Code - Fund Transfers as adopted in state in which you have your account with us. If you originate a fund transfer and you identify by name and number a beneficiary financial institution, an intermediary financial institution or a beneficiary, we and every receiving or beneficiary financial institution may rely on identifying number to make payment. We may rely on number even if it identifies a financial institution, person or account or than one named. You agree to be bound by automated clearing house association rules. These rules provide, among or things, that payments made to you, or originated by you, are provisional until final settlement is made through a Federal Reserve Bank or payment is orwise made as provided in Article 4A-403(a) Uniform Commercial Code. If we do not receive such payment, we are entitled to a refund from you in amount credited to your account and party originating such payment will not be considered to have paid amount so credited. If we receive a payment order to credit an account you have with us by wire or ACH, we are not required to give you any notice payment order or credit. FACSIMILE SIGNATURES - Unless you make advance arrangements with us, we have no obligation to honor facsimile signatures on your checks or or orders. If we do agree to honor items containing facsimile signatures, you authorize us, at any time, to charge you for all checks, drafts, or or orders, for payment money, that are drawn on us. You give us this authority regardless by whom or by what means facsimile signature(s) may have been affixed so long as y resemble facsimile signature specimen filed with us, and contain required number signatures for this purpose. You must notify us at once if you suspect that your facsimile signature is being or has been misused. PLEDGES - Each owner this account may pledge all or any part funds in it for any purpose to which we agree. Any pledge this account must first be satisfied before rights any surviving account owner or account beneficiary become effective. For example, if an account has two owners and one owners pledges account (i.e., uses it to secure a debt) and n dies, (1) surviving owner s rights in this account do not take effect until debt has been satisfied, and (2) debt may be satisfied with funds in this account. POWER OF ATTORNEY - You may wish to appoint an agent to conduct transactions on your behalf. (We, however, have no duty or agreement whatsoever to monitor or insure that acts agent are for your benefit.) This may be done by allowing your agent to sign in that capacity on signature card or by separate form, such as a power attorney. A power attorney continues until your death or death person given power. If power attorney is not durable, it is revoked when you become incompetent. We may continue to honor transactions agent until: (a) we have received written notice or have actual knowledge termination authority or death an owner, and (b) we have had a reasonable opportunity to act on that notice or knowledge. You agree not to hold us responsible for any loss or damage you may incur as a result our following instructions given by an agent acting under a valid power attorney. STALE-DATED CHECKS - We are not obligated to, but may at our option, pay a check, or than a certified check, presented for payment more than six months after its date. If you do not want us to pay a stale-dated check, you must place a stop-payment order on check in manner we have described elsewhere. FDIC INSURANCE - Funds in your account(s) with us are insured by Federal Deposit Insurance Corporation (FDIC) and backed by full faith and credit United States. The amount insurance coverage you have depends on number accounts you have with us that are different ownership. An individual account is one unique form ownership ; a joint account, a pay-ondeath account, and a self directed qualified retirement account (e.g., an IRA) are examples some ors. Deposit insurance for a person s self directed qualified retirement account is up to $250,000. (An IRA is a self directed qualified retirement account as is any account where owner decides where and how to invest balance.) Funds are insured to $250,000 per depositor for total funds combined in all your or insured accounts with us. The link includes detailed contact information as well as a deposit insurance estimator. INDORSEMENTS - We may accept for deposit any item payable to you or your order, even if y are not indorsed by you. We may give cash back to any one you. We may supply any missing indorsement(s) for any item we accept for deposit or collection, and you warrant that all indorsements are genuine. To ensure that your check or share draft is processed without delay, you must indorse it (sign it on back) in a specific area. Your entire indorsement (wher a signature or a stamp) along with any or indorsement information (e.g. additional indorsements, ID information, driver s license number, etc.) must fall within 11/2 trailing edge a check. Indorsements must be made in blue or black ink, so that y are readable by automated check processing equipment. As you look at front a check, trailing edge is left edge. When you flip check over, be sure to keep all indorsement information within 11/2 that edge. It is important that you confine indorsement information to this area since remaining blank space will be used by ors in processing check to place additional needed indorsements and information. You agree that you will indemnify, defend, and hold us harmless for any loss, liability, damage or expense that occurs because your indorsement, anor indorsement or information you have printed on back check obscures our indorsement. These indorsement guidelines apply to both personal and business checks. UNCLAIMED PROPERTY - The law establishes procedures under which unclaimed property must be surrendered to state. (We may have our own rules regarding dormant accounts, and if we charge a fee for dormant accounts it will be disclosed to you elsewhere.) Generally, funds in your account are considered unclaimed if you have not had any activity or communication with us regarding your account over a period years. Ask us if you want furr information about period time or type activity that will prevent your account from being unclaimed. If your funds are surrendered to state, you may be able to reclaim m, but your claim must be presented to state. Once your funds are surrendered, we no longer have any liability or responsibility with respect to funds. DEATH OR INCOMPETENCE - You agree to notify us promptly if any person with a right to withdraw funds from your account(s) dies or becomes legally incompetent. We may continue to honor your checks, items, and instructions until: (a) we know your death or incompetence, and (b) we have had a reasonable opportunity to act on that knowledge. You agree that we may pay or certify checks drawn on or before date death or legal incompetence for up to ten (10) days after your death or legal incompetence unless ordered to stop payment by someone claiming an interest in account. UTMA ACCOUNTS - Under Uniform Transfers to Minors Act, funds in account are owned by child who has unconditional use account when he or she reaches age majority. Before that time, account may be accessed only by custodian (or successor custodian), and funds must be used for benefit child. We, however, have no duty or agreement whatsoever to monitor or insure that acts custodian (or successor custodian) are for child s benefit. For this type account, child s SSN/TIN is used for Backup Withholding Certification. FIDUCIARY ACCOUNTS - Accounts may be opened by a person acting in a fiduciary capacity. A fiduciary is someone who is appointed to act on behalf and for benefit anor. The appropriate TINs for various or types accounts are: Account type - TIN Individual - SSN individual. Joint Account - SSN owner named first on account. Uniform Gift/Transfer to Minor - SSN minor. Informal (Revocable) Trust - SSN owner. In some circumstances, federal law requires us to withhold and pay to IRS a percentage interest that is earned on funds in your accounts. This is known as backup withholding. We will not have to withhold interest payments when you open your account if you certify your TIN and certify that you are not subject to backup withholding due to underreporting interest. We may subsequently be required to begin backup withholding if IRS informs us that you supplied an incorrect TIN or that you underreported your interest income. If you do not have a TIN, we may defer backup withholding if you certify that you do not have a TIN but have applied for one. However, we must begin backup withholding if you do not supply us with a certified TIN within 60 days. If you do not have a TIN because you are a foreign person (eir an individual who is a nonresident alien or a foreign organization) you must certify your foreign status. If you are an exempt payee (receiver interest payments), you do not need to certify your TIN, but you will have to certify your exempt status and supply us with your TIN. If you do not supply us with appropriate TIN, we may refuse to open your account. CHANGING ACCOUNT PRODUCTS - We may change your account to anor product fered by us at any time by giving you notice that your account will be changed to anor product on a specified date. If your account is a time account, change will not occur before next maturity date your account. If you do not close your account before date specified in notice, we may change your account to that or product on date specified in notice. LEGAL ACTIONS AFFECTING YOUR ACCOUNT - If we are served with a subpoena, restraining order, writ attachment or execution, levy, garnishment, search warrant, or similar order relating to your account (termed legal action in this section), we will comply with that legal action. Or, in our discretion, we may freeze assets in account and not allow any payments out account until a final court determination regarding legal action. We may do se things even if legal action involves less than all you. In se cases, we will not have any liability to you if re are insufficient funds to pay your items because we have withdrawn funds from your account or in any way restricted access to your funds in accordance with legal action. Any fees or expenses we incur in responding to any legal action (including, without limitation, attorneys fees and our internal expenses) may be charged against your account. The list fees applicable to your account(s) provided elsewhere may specify additional fees that we may charge for certain legal actions. CHECK STORAGE AND COPIES - You agree that if you do not receive your canceled checks, we will store your canceled checks or copies m for a reasonable retention period. You may request copies from us in manner we require. TRUNCATION, SUBSTITUTE CHECKS, AND OTHER CHECK IMAGES - If you truncate an original check and create a substitute check, or or paper or electronic image original check, you warrant that no one will be asked to make payment on original check, a substitute check or any or electronic Terms and Conditions Your Account in some cases such as when we cannot verify your identity or we suspect fraud, it might be reasonable for us to give you notice after change or account closure becomes effective. For instance, if we suspect fraudulent activity with respect to your account, we might immediately freeze or close your account and n give you notice. You agree to keep us informed your current address at all times. Notice from us to any one you is notice to all you. If we have notified you a change in any term your account and you continue to have your account after effective date change, you have agreed to new term(s). STATEMENTS - Your duty to report unauthorized signatures, alterations and forgeries - You must examine your statement account with reasonable promptness. If you discover (or reasonably should have discovered) any unauthorized signatures or alterations, you must promptly notify us relevant facts. As between you and us, if you fail to do eir se duties, you will have to eir share loss with us, or bear loss entirely yourself (depending on wher we used ordinary care and, if not, wher we substantially contributed to loss). The loss could be not only with respect to items on statement but or items with unauthorized signatures or alterations by same wrongdoer. You agree that time you have to examine your statement and report to us will depend on circumstances, but will not, in any circumstance, exceed a total 30 days from when statement is first sent or made available to you. You furr agree that if you fail to report any unauthorized signatures, alterations or forgeries in your account within 60 days when we first send or make statement available, you cannot assert a claim against us on any items in that statement, and as between you and us loss will be entirely yours. This 60-day limitation is without regard to wher we used ordinary care. The limitation in this paragraph is in addition to that contained in first paragraph this section. Your duty to report or errors - In addition to your duty to review your statements for unauthorized signatures, alterations and forgeries, you agree to examine your statement with reasonable promptness for any or error - such as an encoding error. You agree that time you have to examine your statement and report to us will depend on circumstances. However, such time period shall not exceed 60 days. Failure to examine your statement and report any such errors to us within 60 days when we first send or make statement available precludes you from asserting a claim against us for any such errors on items identified in that statement and as between you and us loss will be entirely yours. ACCOUNT TRANSFER - This account may not be transferred or assigned without our prior written consent. DIRECT DEPOSITS - If we are required for any reason to reimburse federal government for all or any portion a benefit payment that was directly deposited into your account, you authorize us to deduct amount our liability to federal government from account or from any or account you have with us, without prior notice and at any time, except as prohibited by law. We may also use any or legal remedy to recover amount our liability. SETOFF - We may (without prior notice and when permitted by law) set f funds in this account against any due and payable debt you owe us now or in future, by any you having right withdrawal, to extent such persons or legal entity s right to withdraw. If debt arises from a note, any due and payable debt includes total amount which we are entitled to demand payment under terms note at time we set f, including any balance due date for which we properly accelerate under note. This right setf does not apply to this account if prohibited by law. For example, right setf does not apply to this account if: (a) it is an Individual Retirement Account or similar tax-deferred account, or (b) debt is created by a consumer credit transaction under a credit card plan (but this does not affect our rights under any consensual security interest), or (c) debtor s right withdrawal only arises in a representative capacity. You agree to hold us harmless from any claim arising as a result our exercise our right setf. RESTRICTIVE LEGENDS - The automated processing large volume checks we receive prevents us from inspecting or looking for special instructions or restrictive legends on every check. Examples restrictive legends placed on checks are must be presented within 90 days or not valid for more than $1, For this reason, we are not required to honor any restrictive legend placed on checks you write unless we have agreed in writing to restriction. We are not responsible for any losses, claims, damages, or expenses that result from your placement se or or special instructions on your checks. CREDIT VERIFICATION - You agree that we may verify credit and employment history by any necessary means, including preparation a credit report by a credit reporting agency. CHECK PROCESSING - We process items mechanically by relying solely on information encoded in magnetic ink along bottom items. This means that we do not individually examine all your items to determine if item is properly completed, signed and indorsed or to determine if it contains any information or than what is encoded in magnetic ink. You agree that we have not failed to exercise ordinary care solely because we use our automated system to process items and do not inspect all items processed in such a manner. Using an automated process helps us keep costs down for you and all account holders. CHECK CASHING - We may charge a fee for anyone that does not have an account with us who is cashing a check, draft or or instrument written on your account. We may also require reasonable identification to cash such a check, draft or or instrument. We can decide what identification is reasonable under circumstances and such identification may be documentary or physical and may include collecting a thumbprint or fingerprint. EARLY WITHDRAWAL PENALTIES (and involuntary withdrawals) - We may impose early withdrawal penalties on a withdrawal from a time account even if you don t initiate withdrawal. For instance, early withdrawal penalty may be imposed if withdrawal is caused by our setf against funds in account or as a result an attachment or or legal process. We may close your account and impose early withdrawal penalty on entire account balance in event a partial early withdrawal. See your notice penalty for early withdrawals for additional information. WAIVER OF NOTICES - You waive any notice non-payment, dishonor or protest regarding any items credited to or charged against your account. ACH AND WIRE TRANSFERS - This agreement is subject to Article 4A Uniform Commercial Code - Fund Transfers as adopted in state in which you have your account with us. If you originate a fund transfer and you identify by name and number a beneficiary financial institution, an intermediary financial institution or a beneficiary, we and every receiving or beneficiary financial institution may rely on identifying number to make payment. We may rely on number even if it identifies a financial institution, person or account or than one named. You agree to be bound by automated clearing house association rules. These rules provide, among or things, that payments made to you, or originated by you, are provisional until final settlement is made through a Federal Reserve Bank or payment is orwise made as provided in Article 4A-403(a) Uniform Commercial Code. If we do not receive such payment, we are entitled to a refund from you in amount credited to your account and party originating such payment will not be considered to have paid amount so credited. If we receive a payment order to credit an account you have with us by wire or ACH, we are not required to give you any notice payment order or credit. FACSIMILE SIGNATURES - Unless you make advance arrangements with us, we have no obligation to honor facsimile signatures on your checks or or orders. If we do agree to honor items containing facsimile signatures, you authorize us, at any time, to charge you for all checks, drafts, or or orders, for payment money, that are drawn on us. You give us this authority regardless by whom or by what means facsimile signature(s) may have been affixed so long as y resemble facsimile signature specimen filed with us, and contain required number signatures for this purpose. You must notify us at once if you suspect that your facsimile signature is being or has been misused. PLEDGES - Each owner this account may pledge all or any part funds in it for any purpose to which we agree. Any pledge this account must first be satisfied before rights any surviving account owner or account beneficiary become effective. For example, if an account has two owners and one owners pledges account (i.e., uses it to secure a debt) and n dies, (1) surviving owner s rights in this account do not take effect until debt has been satisfied, and (2) debt may be satisfied with funds in this account. POWER OF ATTORNEY - You may wish to appoint an agent to conduct transactions on your behalf. If you do not want us to pay a stale-dated check, you must place a stop-payment order on check in manner we have described elsewhere. FDIC INSURANCE - Funds in your account(s) with us are insured by Federal Deposit Insurance Corporation (FDIC) and backed by full faith and credit United States. The amount insurance coverage you have depends on number accounts you have with us that are different ownership. An individual account is one unique form ownership ; a joint account, a pay-ondeath account, and a self directed qualified retirement account (e.g., an IRA) are examples some ors. Deposit insurance for a person s self directed qualified retirement account is up to $250,000. (An IRA is a self directed qualified retirement account as is any account where owner decides where and how to invest balance.) Funds are insured to $250,000 per depositor for total funds combined in all your or insured accounts with us. INDORSEMENTS - We may accept for deposit any item payable to you or your order, even if y are not indorsed by you. We may give cash back to any one you. We may supply any missing indorsement(s) for any item we accept for deposit or collection, and you warrant that all indorsements are genuine. To ensure that your check or share draft is processed without delay, you must indorse it (sign it on back) in a specific area. Your entire indorsement (wher a signature or a stamp) along with any or indorsement information (e.g. additional indorsements, ID information, driver s license number, etc.) must fall within 11/2 trailing edge a check. Indorsements must be made in blue or black ink, so that y are readable by automated check processing equipment. As you look at front a check, trailing edge is left edge. When you flip check over, be sure to keep all indorsement information within 11/2 that edge. It is important that you confine indorsement information to this area since remaining blank space will be used by ors in processing check to place additional needed indorsements and information. You agree that you will indemnify, defend, and hold us harmless for any loss, liability, damage or expense that occurs because your indorsement, anor indorsement or information you have printed on back check obscures our indorsement. These indorsement guidelines apply to both personal and business checks. UNCLAIMED PROPERTY - The law establishes procedures under which unclaimed property must be surrendered to state. (We may have our own rules regarding dormant accounts, and if we charge a fee for dormant accounts it will be disclosed to you elsewhere.) Generally, funds in your account are considered unclaimed if you have not had any activity or communication with us regarding your account over a period years. Ask us if you want furr information about period time or type activity that will prevent your account from being unclaimed. If your funds are surrendered to state, you may be able to reclaim m, but your claim must be presented to state. Once your funds are surrendered, we no longer have any liability or responsibility with respect to funds. DEATH OR INCOMPETENCE - You agree to notify us promptly if any person with a right to withdraw funds from your account(s) dies or becomes legally incompetent. UTMA ACCOUNTS - Under Uniform Transfers to Minors Act, funds in account are owned by child who has unconditional use account when he or she reaches age majority. Before that time, account may be accessed only by custodian (or successor custodian), and funds must be used for benefit child. We, however, have no duty or agreement whatsoever to monitor or insure that acts custodian (or successor custodian) are for child s benefit. You agree to indemnify us for any loss we may incur as a result any truncated check transaction you initiate. We can refuse to accept substitute checks that have not previously been warranted by a bank or or financial institution in conformance with Check 21 Act. Unless specifically stated in a separate agreement between you and us, we do not have to accept any or electronic or paper image an original check. SECURITY - It is your responsibility to protect account numbers and electronic access devices (e.g., an ATM card) we provide you for your account(s). Do not discuss, compare, or share information about your account number(s) with anyone unless you are willing to give m full use your money. An account number can be used by thieves to encode your number on a false demand draft which looks like and functions like an authorized check. If you furnish your access device and grant actual authority to make transfers to anor person (a family member or coworker, for example) who n exceeds that authority, you are liable for transfers unless we have been notified that transfers by that person are no longer authorized. Your account number can also be used to electronically remove money from your account. If you provide your account number in response to a telephone solicitation for purpose making a transfer (to purchase a service or merchandise, for example), payment can be made from your account even though you did not contact us directly and order payment. You must also take precaution in safeguarding your blank checks. Notify us at once if you believe your checks have been lost or stolen. As between you and us, if you are negligent in safeguarding your checks, you must bear loss entirely yourself or share loss with us (we may have to share some loss if we failed to use ordinary care and if we substantially contributed to loss). You agree that if we fer you services appropriate for your account to help identify and limit fraud or or unauthorized transactions against your account, such as positive pay or commercially reasonable security procedures, and you reject those services, you will be responsible for any fraudulent or unauthorized transactions which could have been prevented by services we fered, unless we acted in bad faith or to extent our negligence contributed to loss. TELEPHONIC INSTRUCTIONS - Unless required by law or we have agreed orwise in writing, we are not required to act upon instructions you give us via facsimile transmission or leave by voice mail or on a telephone answering machine. CLAIM OF LOSS - If you claim a credit or refund because a forgery, alteration, or any or unauthorized withdrawal, you agree to cooperate with us in investigation loss, including giving us an affidavit containing whatever reasonable information we require concerning your account, transaction, and circumstances surrounding loss. You will notify law enforcement authorities any criminal act related to claim lost, missing, or stolen checks or unauthorized withdrawals. We will have a reasonable period time to investigate facts and circumstances surrounding any claim loss. Unless we have acted in bad faith, we will not be liable for special or consequential damages, including loss prits or opportunity, or for attorneys fees incurred by you. You agree that you will not waive any rights you have to recover your loss against anyone who is obligated to repay, insure, or orwise reimburse you for your loss. You will pursue your rights or, at our option, assign m to us so that we may pursue m. Our liability will be reduced by amount you recover or are entitled to recover from se or sources. ADDRESS OR NAME CHANGES - You are responsible for notifying us any change in your address or your name. Unless we agree orwise, change address or name must be made in writing by at least one account holders. Informing us your address or name change on a check reorder form is not sufficient. We will attempt to communicate with you only by use most recent address you have provided to us. If provided elsewhere, we may impose a service fee if we attempt to locate you. RESOLVING ACCOUNT DISPUTES - We may place an administrative hold on funds in your account (refuse payment or withdrawal funds) if it becomes subject to a claim adverse to (1) your own interest; (2) by ors claiming an interest as survivors or beneficiaries your account; or (3) a claim arising by operation law. The hold may be placed for such period time as we believe reasonably necessary to allow a legal proceeding to determine merits claim or until we receive evidence satisfactory to us that dispute has been resolved. We will not be liable for any items that are dishonored as a consequence placing a hold on funds in your account for se reasons. INTEREST CHECKING AND NON-INTEREST CHECKING ACCOUNTS WITH SUBACCOUNTS - For regulatory accounting purposes, your account is divided into two subaccounts: a checking subaccount and a money market subaccount. These subaccounts are treated as a single account for purposes interest payments, if applicable, minimum balance requirements, fees and charges and your account access. Your account statement and or records your account activity (e.g. ATM receipts) will reflect this account as a single account and will not reflect subaccounts or transfers between subaccounts in any way. Both subaccounts pay an identical interest rate and annual percentage yield on account balances. Although you will have no direct access to money market subaccount, you may access this subaccount only indirectly through transactions on your checking subaccounts, as described below. At various times during each statement cycle or calendar month, if your checking subaccount balance exceeds a threshold amount, we may transfer all funds in excess that amount into money market subaccount. As transactions posted against checking subaccount reduce checking subaccount below a predetermined level, we will transfer funds back into checking subaccount from money market subaccount. We may make up to six transfers from money market subaccount into checking subaccount per statement cycle or calendar month. Upon sixth such transfer in a month, we will transfer entire balance money market subaccount to checking subaccount. We may repeat this process each statement cycle or calendar month. We set balance threshold and may change it at any time at our discretion. The transfers between subaccounts will occur only on our books and will not affect balance, interest, fees, or features your account. Or than as described above, Deposit Account Agreement controls your account as if re were nosubaccounts. REMOTELY CREATED CHECKS - Like any standard check or draft, a remotely created check (sometimes called a telecheck, preauthorized draft or demand draft) is a check or draft that can be used to withdraw money from an account. Unlike a typical check or draft, however, a remotely created check is not issued by paying bank and does not contain signature account owner (or a signature purported to be signature account owner). In place a signature, check usually has a statement that owner authorized check or has owner s name typed or printed on signature line. For example, if a person provides an account number in response to a telephone solicitation, telephone solicitor can use account number to issue a remotely created check to withdraw money from that account. You warrant and agree to following for every remotely created check we receive from you for deposit or collection: (1) you have received express and verifiable authorization to create check in amount and to payee that appears on check; (2) you will maintain pro authorization for at least 2 years from date authorization, and supply us pro if we ask; and (3) if a check is returned you owe us amount check, regardless when check is returned. We may take funds from your account to pay amount you owe us, and if re are insufficient funds in your account, you still owe us remaining balance. ELECTRONIC FUND TRANSFERS YOUR RIGHTS AND RESPONSIBILITIES Indicated below are types Electronic Fund Transfers we are capable handling, some which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for transactions listed. Please also see Limitations on frequency transfers section regarding additional limitations that may apply to transactions as described below. You should keep this notice for future reference. Electronic Fund Transfers Initiated By Third Parties. You may authorize a third party to initiate electronic fund transfers between your account and third party s account. These transfers to make or receive payment may be onetime occurrences or may recur as directed by you. These transfers may use Automated Clearing House (ACH) or or payments network. Your authorization to third party to make se transfers can occur in a number ways. For example, your authorization to convert a check to an electronic fund transfer or to electronically pay a returned check charge can occur when a merchant provides you with notice and you go forward with transaction (typically, at point purchase, a merchant will post a sign and print notice on a receipt). In all cases, se third party transfers will require you to provide third party with your account number and bank information. This information can be found on your check as well as on a deposit or withdrawal slip. Thus, you should only provide your bank and account information (wher over phone, Internet, or via some or method) to trusted third parties whom you have authorized to initiate se electronic fund transfers. You may authorize a merchant or or payee to make a one-time electronic payment from your checking account using information from your check to pay for purchases or pay bills. Electronic returned check charge. You may authorize a merchant or or payee to initiate an electronic funds transfer to collect a charge in event a check is returned for insufficient funds. Telephone Banking Services You may access your account(s) by telephone using your personal identification number, a touch tone phone, and your account numbers to: - Obtain balance and transaction information on your deposit and loan account(s). - Transfer funds between accounts, including certain loan accounts (you may not transfer out any passbook savings, certificate deposit (CD) or loan accounts). Internet and Mobile Banking Services You may access your account(s) by our Internet and/or Mobile Banking Product using your computer or mobile device, user identification number and password to: - Obtain balance and transaction information on your deposit and loan account(s). - Transfer funds between accounts, including certain loan payments (you may not transfer out any passbook savings, certificate deposit (CD) or loan accounts). - Initiate payments to third parties from your account using our Cape Cod Five BillPay Service. - Transfer funds from your deposit accounts to accounts you have at anor financial institution. - Deposit checks remotely using mobile deposit service available through Mobile Banking (refer to separate mobile deposit agreement for additional information). We reserve right to disable internet and/or mobile device access to your banking account(s) if you have not logged in for a period 6 months. Should your account be disabled and you require access, please contact us by phone at so that we may assist you with reactivation. If you have not logged in for a period 13 months, we reserve right to delete your access. Should your account be deleted, you can re-enroll by visiting us at ATM Card and Visa Check Card Services ATM (Cash) Transactions: You may access your, Statement Savings or Money Market account(s) linked to your ATM or Visa Check Card by entering your Personal Identification Number (PIN) to: - Make deposits (only available through a Cape Cod Five ATM). - Withdraw cash. - Transfer funds (between accounts linked to your card). - Obtain Account balance(s). Some se services may not be available at all terminals. POS (Purchase) Transactions: Visa Check Card: Using your Visa Check Card you may access your account to purchase goods, pay for services (in person, by phone, fax, mail or internet) or get cash from a merchant, if merchant permits, or from a participating financial institution. You may use your Visa Check Card anywhere Visa Debit Cards are accepted. Non-Visa Debit Transaction Processing - We have enabled non-visa debit transaction processing. This means you may use your Visa Check Card on a PIN Debit Network* (a non-visa network) without using a PIN. The non-visa debit network(s) for which such transactions are enabled are: NYCE Network. Examples types actions that you may be required to make to initiate a Visa transaction on your Visa Check Card include signing a receipt, providing a card number over phone or via Internet, or swiping card through a point-sale terminal. Examples types actions you may be required to make to initiate a transaction on a PIN-Debit Network include initiating a payment directly with biller (possibly via telephone, Internet, or kiosk locations), responding to a logo displayed at a payment site and choosing to direct payment through that network, and having your identity verified using known information derived from an existing relationship with you instead through use a PIN. The provisions your agreement with us relating only to Visa transactions are not applicable to non- Visa transactions. For example, additional limits on liability (sometimes referred to as Visa s zero-liability program) and streamlined error resolution procedures fered on Visa debit card transactions are not applicable to transactions processed on a PIN-Debit Network. *Visa Rules generally define PIN-Debit Network as a non-visa debit network that typically aunticates transactions by use a personal identification number (PIN) but that is not generally known for having a card program. Standard Daily Transaction Limits ATM Card: You generally may make up to 10 transactions per day, and may withdraw up to $ in cash (inclusive fees and surcharges) per day. Visa Check Card: You generally may make up to 25 transactions per day, and may withdraw up to $ in cash (inclusive fees and surcharges) and purchase up to $1, in goods or services per day. You have option to limit your withdrawals and purchases to $50.00 per day, provided you ask us to do so. VISA Currency Conversion and International Transactions. When you use your Check Card at a merchant or terminal that settles in currency or than US dollars, charge will be converted into US dollar amount. The currency conversion rate used to determine transaction amount in US dollars is eir a rate selected by Visa from range rates available in wholesale currency markets for applicable central processing date, which rate may vary from rate Visa itself receives, or government-mandated rate in effect for applicable central processing date. The conversion rate in effect on processing date may differ from rate in effect on transaction date or posting date. Visa USA charges us a.8% International Service Assessment on all international transactions, regardless wher re is a currency conversion. If re is a currency conversion, International Service Assessment is 1% transaction. In eir case, we pass this international transaction fee on to you. An international transaction is a transaction where country merchant is outside USA. MasterCard/Cirrus Currency Conversion and Cross-Border Transaction Fees. If you effect a transaction at a Cirrus terminal using your Check Card or ATM card and that transaction is in a currency or than US Dollars, MasterCard will convert charge into a US Dollar amount. The MasterCard currency conversion procedure includes use eir a government-mandated exchange rate, or a wholesale rate selected by MasterCard. The exchange rate MasterCard uses will be a rate in effect on day transaction is processed. This rate may differ from rate in effect on date purchase or date transaction was posted to your account. MasterCard charges us a Currency Conversion Assessment 20 basis points (.2% transaction) for performing currency conversion. In addition, MasterCard charges us an Issuer Cross-Border Assessment 90 basis points (.9% transaction) on all cross-border transactions regardless wher re is a currency conversion. As a result, we charge you a Currency Conversion fee.2% and a Cross-Border Transaction fee.9%. The Cross-Border Transaction fee is charged on all cross-border transactions regardless wher re is a currency conversion. A crossborder transaction is a transaction processed through Global Clearing Management System or MasterCard Debit Switch in which country merchant is different than country cardholder. Advisory Against Illegal Use. You agree not to use your card(s) for illegal gambling or or illegal purpose. Display a payment card logo by, for example, an online merchant does not necessarily mean that transactions are lawful in all jurisdictions in which cardholder may be located. Limitations on frequency transfers. In addition to those limitations on transfers elsewhere described, if any, following limitations apply: Transfers from a savings or money market account to anor account or to third parties by preauthorized, automatic, electronic, or telephone transfer or by check, draft, or similar order to third parties are limited to six per month. Termination - You may terminate electronic fund transfer agreement by notifying third party and Bank in writing. We may terminate electronic fund transfer agreement by written notice to you. Minimum account balance - We do not require you to maintain a minimum balance in any account as a condition using an access device (card or code) to accomplish a transfer. FEES Please refer to our Fee Schedule. Fees are subject to change. Transactions may be subject to overdraft fees. There may be fees associated with performing certain transactions (for example you may be charged a fee for a balance inquiry even if you do not complete a fund transfer) at ATMs or POS terminals not owned or operated by Bank. These or fees are not assessed by us and will not be waived. A fee may be charged to replace a lost card. DOCUMENTATION Terminal transfers. You can get a receipt at time you make a transfer to or from your account using an automated teller machine or point--sale terminal. However, you may not get a receipt if amount transfer is $15 or less. Preauthorized credits. If you have arranged to have direct deposits made to your account at least once every 60 days from same person or company, you can call us at to find out wher or not deposit has been made. Periodic statements. You will get a monthly account statement from us for your checking, statement savings, and money market accounts. You will receive a monthly statement whenever your consumer passbook account receives an electronic deposit. You may bring your passbook to us and we will record any electronic deposits that were made since last time you brought in your Terms and Conditions Your Account Important Documents and Disclosures or paper image, if payment obligation relating to original check has already been paid. You also warrant that any substitute check you create conforms to legal requirements and generally accepted specifications for substitute checks. You agree to retain original check in conformance with our internal policy for retaining original checks. You agree to indemnify us for any loss we may incur as a result any truncated check transaction you initiate. We can refuse to accept substitute checks that have not previously been warranted by a bank or or financial institution in conformance with Check 21 Act. Unless specifically stated in a separate agreement between you and us, we do not have to accept any or electronic or paper image an original check. SECURITY - It is your responsibility to protect account numbers and electronic access devices (e.g., an ATM card) we provide you for your account(s). Do not discuss, compare, or share information about your account number(s) with anyone unless you are willing to give m full use your money. An account number can be used by thieves to encode your number on a false demand draft which looks like and functions like an authorized check. If you furnish your access device and grant actual authority to make transfers to anor person (a family member or coworker, for example) who n exceeds that authority, you are liable for transfers unless we have been notified that transfers by that person are no longer authorized. Your account number can also be used to electronically remove money from your account. If you provide your account number in response to a telephone solicitation for purpose making a transfer (to purchase a service or merchandise, for example), payment can be made from your account even though you did not contact us directly and order payment. You must also take precaution in safeguarding your blank checks. Notify us at once if you believe your checks have been lost or stolen. As between you and us, if you are negligent in safeguarding your checks, you must bear loss entirely yourself or share loss with us (we may have to share some loss if we failed to use ordinary care and if we substantially contributed to loss). You agree that if we fer you services appropriate for your account to help identify and limit fraud or or unauthorized transactions against your account, such as positive pay or commercially reasonable security procedures, and you reject those services, you will be responsible for any fraudulent or unauthorized transactions which could have been prevented by services we fered, unless we acted in bad faith or to extent our negligence contributed to loss. TELEPHONIC INSTRUCTIONS - Unless required by law or we have agreed orwise in writing, we are not required to act upon instructions you give us via facsimile transmission or leave by voice mail or on a telephone answering machine. CLAIM OF LOSS - If you claim a credit or refund because a forgery, alteration, or any or unauthorized withdrawal, you agree to cooperate with us in investigation loss, including giving us an affidavit containing whatever reasonable information we require concerning your account, transaction, and circumstances surrounding loss. You will notify law enforcement authorities any criminal act related to claim lost, missing, or stolen checks or unauthorized withdrawals. We will have a reasonable period time to investigate facts and circumstances surrounding any claim loss. Unless we have acted in bad faith, we will not be liable for special or consequential damages, including loss prits or opportunity, or for attorneys fees incurred by you. You agree that you will not waive any rights you have to recover your loss against anyone who is obligated to repay, insure, or orwise reimburse you for your loss. You will pursue your rights or, at our option, assign m to us so that we may pursue m. Our liability will be reduced by amount you recover or are entitled to recover from se or sources. ADDRESS OR NAME CHANGES - You are responsible for notifying us any change in your address or your name. Unless we agree orwise, change address or name must be made in writing by at least one account holders. Informing us your address or name change on a check reorder form is not sufficient. We will attempt to communicate with you only by use most recent address you have provided to us. If provided elsewhere, we may impose a service fee if we attempt to locate you. RESOLVING ACCOUNT DISPUTES - We may place an administrative hold on funds in your account (refuse payment or withdrawal funds) if it becomes subject to a claim adverse to (1) your own interest; (2) by ors claiming an interest as survivors or beneficiaries your account; or (3) a claim arising by operation law. The hold may be placed for such period time as we believe reasonably necessary to allow a legal proceeding to determine merits claim or until we receive evidence satisfactory to us that dispute has been resolved. We will not be liable for any items that are dishonored as a consequence placing a hold on funds in your account for se reasons. INTEREST CHECKING AND NON-INTEREST CHECKING ACCOUNTS WITH SUBACCOUNTS - For regulatory accounting purposes, your account is divided into two subaccounts: a checking subaccount and a money market subaccount. These subaccounts are treated as a single account for purposes interest payments, if applicable, minimum balance requirements, fees and charges and your account access. Your account statement and or records your account activity (e.g. ATM receipts) will reflect this account as a single account and will not reflect subaccounts or transfers between subaccounts in any way. Both subaccounts pay an identical interest rate and annual percentage yield on account balances. Although you will have no direct access to money market subaccount, you may access this subaccount only indirectly through transactions on your checking subaccounts, as described below. At various times during each statement cycle or calendar month, if your checking subaccount balance exceeds a threshold amount, we may transfer all funds in excess that amount into money market subaccount. As transactions posted against checking subaccount reduce checking subaccount below a predetermined level, we will transfer funds back into checking subaccount from money market subaccount. We may make up to six transfers from money market subaccount into checking subaccount per statement cycle or calendar month. Upon sixth such transfer in a month, we will transfer entire balance money market subaccount to checking subaccount. We may repeat this process each statement cycle or calendar month. We set balance threshold and may change it at any time at our discretion. The transfers between subaccounts will occur only on our books and will not affect balance, interest, fees, or features your account. Or than as described above, Deposit Account Agreement controls your account as if re were nosubaccounts. REMOTELY CREATED CHECKS - Like any standard check or draft, a remotely created check (sometimes called a telecheck, preauthorized draft or demand draft) is a check or draft that can be used to withdraw money from an account. Unlike a typical check or draft, however, a remotely created check is not issued by paying bank and does not contain signature account owner (or a signature purported to be signature account owner). In place a signature, check usually has a statement that owner authorized check or has owner s name typed or printed on signature line. For example, if a person provides an account number in response to a telephone solicitation, telephone solicitor can use account number to issue a remotely created check to withdraw money from that account. You warrant and agree to following for every remotely created check we receive from you for deposit or collection: (1) you have received express and verifiable authorization to create check in amount and to payee that appears on check; (2) you will maintain pro authorization for at least 2 years from date authorization, and supply us pro if we ask; and (3) if a check is returned you owe us amount check, regardless when check is returned. We may take funds from your account to pay amount you owe us, and if re are insufficient funds in your account, you still owe us remaining balance. ELECTRONIC FUND TRANSFERS YOUR RIGHTS AND RESPONSIBILITIES Indicated below are types Electronic Fund Transfers we are capable handling, some which may not apply to your account. Please read this disclosure carefully because it tells you your rights and obligations for transactions listed. Please also see Limitations on frequency transfers section regarding additional limitations that may apply to transactions as described below. You should keep this notice for future reference. Electronic Fund Transfers Initiated By Third Parties. You may authorize a third party to initiate electronic fund transfers between your account and third party s account. These transfers to make or receive payment may be onetime occurrences or may recur as directed by you. These transfers may use Automated Clearing House (ACH) or or payments network. Your authorization to third party to make se transfers can occur in a number ways. For example, your authorization to convert a check to an electronic fund transfer or to electronically pay a returned check charge can occur when a merchant provides you with notice and you go forward with transaction (typically, at point purchase, a merchant will post a sign and print notice on a receipt). In all cases, se third party transfers will require you to provide third party with your account number and bank information. This information can be found on your check as well as on a deposit or withdrawal slip. Thus, you should only provide your bank and account information (wher over phone, Internet, or via some or method) to trusted third parties whom you have authorized to initiate se electronic fund transfers. If you have made arrangements in advance to make regular payments out your checking, statement savings or money market account(s), you may stop any se payments. Here is how: Call or write us (within time frames defined below) at telephone number or address listed in this brochure. If you call we may require you to put your request in writing and get it to us within 14 days after you call. For fees associated with Stop Payment Orders, please refer to our Fee Schedule. Fees are subject to change. Time Frames. Preauthorized Payment (Recurring): We must receive your request to stop payment three (3) business days or more before payment schedule date. Preauthorized Payment (Single Occurrence) and Electronic Check Conversion. We must receive your request to stop payment in such a time or manner that allows us a reasonable opportunity to act on stop payment order prior to acting on payment entry. Notice varying amounts. If se regular payments may vary in amount, person you are going to pay will tell you, 10 days before each payment, when it will be made and how much it will be. (You may 14 choose instead to get this notice only when payment would differ by more than a certain amount from previous payment, or when amount would fall outside certain limits that you set.) Liability for failure to stop payment preauthorized transfer. If you order us to stop payment on one se payments within time frames specified above, and we do not do so, we will be liable for your losses or damages. ADDITIONAL INFORMATION REQUIRED BY MASSACHUSETTS LAW (1) Any documentation provided to you which indicates that an electronic fund transfer was made to anor person shall be admissible as evidence transfer and shall constitute prima-facie pro that transfer was made. (2) The initiation by you certain electronic fund transfers from your account will, except as orwise provided in agreement, effectively eliminate your ability to stop payment transfer. Unless orwise provided in this agreement, you ( consumer) may not stop payment electronic fund transfers, refore you should not employ electronic access for purchases or services unless you are satisfied that you will not need to stop payment. FINANCIAL INSTITUTION S LIABILITY If we do not complete a transfer to or from your account on time or in correct amount according to our agreement with you, we will be liable for your losses or damages. However, re are some exceptions. We will not be liable, for instance: (1) If, through no fault ours, you do not have enough money in your account to make transfer. (2) If you have an overdraft line and transfer would go over credit limit. (3) If automated teller machine where you are making transfer does not have enough cash. (4) If terminal or system was not working properly and you knew about breakdown when you started transfer. (5) If circumstances beyond our control (such as fire or flood) prevent transfer, despite reasonable precautions that we have taken. (6) If funds are subject to legal process or or encumbrance restricting such transfer. (7) If we have reason to believe that you or someone else is attempting to make a transfer for a fraudulent or illegal purpose. (8) There may be or exceptions stated in our agreement with you.
