5 Bylaw Definitions and Applications Sports Wagering Sports wagering includes placing, accepting or soliciting iti a wager (on a staff member's or student t athlete's own behalf or on the behalf of others) of anytype with anyindividual or organization on any intercollegiate, amateur or professional team or contest.
6 Bylaw Definitions and Applications Some Examples of Sports Wagering Use of a bookmaker or parlay card; Internet sports wagering; Auctions in which bids are placed on teams, individuals or contests; and Pools or fantasy leagues in which an entry fee is required andthere isan opportunity to wina prize.
7 Wager Bylaw Definitions and Applications A wager is any agreement in which an individual or entity agrees to give up an item of value (e.g., cash, shirt, dinner) in exchange for the possibility of gaining another item of value.
8 Bylaw 10.3 Sports Wagering Activities 10.3 Sports Wagering Activities The following individuals shall not knowingly participate in sports wagering activities or provide information to individuals involved in or associated with any type of sports wagering activities concerning intercollegiate, amateur, or professional athletics competition: Staff members of an institution s athletics department Nonathletics department staff members who have responsibilities within or over the athletics department E.g., Chancellor or president, FAR Staff membersof a conference office; and Student athletes
9 Bylaw Sanctions The following sanctions for violations of Bylaw 10.3 shall apply: A student athlete who engages in activities designed to influence the outcome of an intercollegiate contest or in an effort to affect win loss margins (i.e., "point shaving") or who participates in any sports wagering activity involving the student athlete's institution shall permanently lose all remaining regular season and postseason eligibility in all sports. A student athlete who participates in any sports wagering activity through the Internet, a bookmaker or a parlay card shall be ineligible for all regular season and postseason competition for a minimum period of one year from the date of the institution's determination that a violation occurred and shall hllbe charged with ihthe loss of a minimum i of one season of eligibility. If the student athlete is determined to have been involved in a violation of any portion of Bylaw 10.3, the student athlete shall permanently lose allremaining regular season andpostseason eligibility in all sports.

11 Secondary infraction cases Bylaw 10.3 Sports Wagering Activities Case #1 Men's soccer student athlete participated in online fantasy football league with seven of his friends from high school, who were not SAs. SA indicated that each person paid a $20 entry fee to a friend and then chose players and had ESPN.com manage the league players and keep the statistics during fall SA indicated at the end of the season, his friend would give the $160 winnings to the winner of the league. SA did not check with anyone at the institution, given he did not think it was impermissible until he read the rules. SA indicated he sought counseling through Gamblers Anonymous February 17, 2008, and continues to receive counseling to assist him in avoiding gambling. Institutional Action: Institution withheld SA from two exhibition contests and is requiring SA to prepare an educational program on the affects of gambling on a student athlete for local schools, volunteer participation on college wide gambling task force, and work with NCAA CHAMPS leadership team to make a presentation to other SAs. SA will be required to continue counseling.
12 Secondary infraction cases Bylaw 10.3 Sports Wagering Activities Case #2 A men's baseball student athlete wagered $10 to $20 on the outcomes of approximately six to eight professional football contests with a teammate who was also SA's friend. Specifically, SA placed wagers of nominal amounts with his friend and teammate for the purpose of entertainment. No money ever exchanged hands as SA never gave nor received any money. Based on information submitted by the institution, membership services determined SA's activities did not trigger the sanctions in NCAA Bylaw Institutional Action: Institution has withheld SA from the first 14 baseball contests of the season. SA was suspended from all team activities including four weeks of practice from January 10 through February 12, A gambling presentation to the baseball team was conducted January Compliance staff created a comprehensive plan to address gambling education with SAs and staff throughout the academic year.
13 Secondary infraction cases Bylaw 10.3 Sports Wagering Activities Case #3 Head baseball coach encouraged the entire baseball squad to wager on the outcome of a three game intrasquad scrimmage at the conclusion of the 2007 fall nonchampionship segment of the baseball season. SAs agreed that the losing team would pay for the winning team's dinner to take place at the head coach's home subsequent to the scrimmage. Most of the student athletes on the losing team gave $20 to head coach to contribute $10 for themselves and $10 for a member of the winning team. Institutional Action: Institution's compliance office will continue education on NCAA gambling legislation and will immediately incorporate specific scenarios regarding impermissible practice activities into its existing education program regarding sports wagering for SAs and coaches. Compliance office will add information to its regularly distributed newsletter regarding the impermissibility of any type of wager during practices or scrimmages. Additionally, institution required each SA to donate $10 to a charity.
14 Secondary infraction cases Bylaw 10.3 Sports Wagering Activities Case #4 The head rowing coach participated in an online gambling pool involving professional sports. Specifically, on September 7, 2008, the coach paid $20 to enter an online gambling pool involving a professional sports league through his local Lion's Club. He terminated his involvement with the online gambling pool on September 14, 2008, when he realized this activity might be contrary to NCAAlegislation. The coach self reported his involvement to the institution's compliance office. Institutional Action: The coach will receive a letter of reprimand from the director of athletics and will donate twenty dollars to a charity of his choice.
15 Major infraction/federal cases Bylaw 10.3 Sports Wagering Activities Washington football The former head football coach violated NCAA gambling legislation through his participation in an auction involving the NCAA's Division I Men's Basketball Tournament. However, the committee did not make a finding that he knowingly violated NCAA gambling legislation. The committee made this conclusion because of erroneous guidance provided by an athletics department staff member with regard to the permissibility of participating in pools outside of the athletics department as well as a lack of clarity in the information as to what constituted a pool. The committee was troubled, however by the former head coach's initial lack of truthfulness when he was first questioned about his participation in the auction.
16 Major infraction/federal cases Bylaw 10.3 Sports Wagering Activities Arizona State basketball In 1994, Arizona State campus bookie Benny Silman approched Sun Devil players Steven Smith and Isaac Burton about shaving points. Smith was paid $20,000 per game for a total of $80,000 and Burton was compensated $4,300 for two games. Burton and Smith both served jail time and Silman served 46 months in prison. the 25 biggest scandals in ncaa history

It preceded the most memorable season in Northwestern Football history. Football starters Dion Lee and Dewey Williams and starting running back Dennis Lundy were accused in separate incidents of bookmaking and point shaving. the 25 biggest scandals in ncaa history
18 Major infraction/federal cases Bylaw 10.3 Sports Wagering Activities Boston College basketball During the basketball season, Boston College was the latest team scandalized by a point shaving scheme involving the New York mob. It would not be discovered until a year later. BC basketball players Rick Kuhn, Jim Sweeney and Joe Streater all conspired to shave points from selected Eagles games. BC s star at the time, Ernie Cobb joined the scheme for the last five games. Only six of the nine games selected to shave point succeeded. Kuhnwas the only player that served prison time. the 25 biggest scandals in ncaa history
19 Bylaw 10.3 Sports Wagering Activities Major infraction/federal cases Tulane basketball Ned Fowler arrived at Tulane in 1981 after the Green Wave suffered through five straight losing seasons. Four years later after leading to Tulane to a record, the program was dropped after allegations of point shaving arose. The case involved former player John Hot Rod Williams. Even though Williams was acquitted on all five counts, Tulane president Eamonn Kelly decided to drop the Tulane basketball program because NCAA violations emerged during the investigation. The program would not be reinstated until the season. the 25 biggest scandals in ncaa history
