2 As an employer, you re responsible for providing injury cover for your employees. So it s reassuring to know that ACC WorkPlace Cover automatically gives both you and your employees eligibility for no-fault cover for workplace personal injuries. Your employees are eligible for cover for workplace injuries. If they re injured at work it doesn t matter whose fault it is or when or how it happens. ACC WorkPlace Cover gives your employees access to a full range of medical and rehabilitation benefits, and assistance with the financial impacts so they can return to work as quickly as possible. At a glance 2 All employees are eligible. Cover is for workplace injuries and some work-related diseases. Injured employees have access to a full range of medical and rehabilitation benefits. As an employer you must cover at least 80% of your employee s salary or wages lost during the first week, if they require any time off work as a result of their work injury. After that, ACC will pay up to 80% of your employee s lost earnings. ACC will work with you and your employee to help them get back to work.
3 ACC has injury prevention programmes that can help you to reduce workplace injuries, and injury management resources and services to help you to manage injured employees return to work. Visit our website to find out more information. Taking care of business Having a key staff member away with an injury can be inconvenient and costly. For your sake and theirs, ACC has a strong focus on returning people to work. As well as medical treatment and compensation for time off work, depending on the nature of their injury ACC may also assist by providing work-based rehabilitation and advice. Together with you, your employee and their treatment provider, we ll do our best to reduce the impact on your business. Your responsibilities For workplace injuries, you must pay at least 80% of your employee s earnings for the first week following their injury. You can opt to pay more if you prefer. From the second week ACC will pay up to 80% of their average weekly earnings within certain limits. We just need you to provide us with their earnings information so your employee can be paid the right amount. You are also required by legislation to take all practical steps to help your staff member get back to work after an injury. Our claims management team will provide you with information and expert assistance to get the best possible result for your employee, and meet your obligations. 3
4 What if they re injured outside work? While you re not responsible for what your employees get up to outside work, it s reassuring to know that they re still eligible for ACC cover and we ll still work with you to minimise the impact of their injuries on your business. The ACC Earner levy covers your employees for non-workrelated injuries such as sports injuries. This levy is paid by employees through the PAYE system. Time off work If time off work is required due to the injury, your employee must provide us with a medical certificate to indicate their injury status. You have a right to be involved in your employee s return to work whether they were injured at work or elsewhere. If you have any questions about your role, please contact ACC. 4
5 Your employee s entitlements Under ACC WorkPlace Cover, some or all of the following entitlements may be payable depending on the nature of your employee s injury and their individual needs. Medical treatment ACC will help pay for most of the costs associated with treating your employee s injury, however some treatment providers charge an additional fee. Tell them to keep their receipts as ACC may refund some or all of the costs if the claim is accepted. Rehabilitation and support Types of assistance available include home help, attendant care, childcare, transport, training for independence, aids and modifications. If possible, ACC will work with you and your employee to get them back to work. We can provide workplace-based rehabilitation, occupational assessments, workplace modifications and advice. Attendance costs If your employee has to travel for assessments, ACC can help with transport and accommodation costs. This may also include assistance for their support people. 5
6 Grants and payments If an injury has a serious long-term effect through a permanent impairment, lump-sum payments may be available. If your employee dies as a result of an injury, allowances and grants may also be available to their family. This includes financial assistance to help with funeral costs and ongoing childcare payments, as well as compensation for lost income. 7 Experience rating Making ACC work account levies fairer for individual businesses On 1 April 2011 ACC introduced experience rating, a system of modifying a business s ACC Work levy based on its claims history. Experience rating recognises and rewards business owners (including self-employed people) with good claims experience, and encourages a focus on improving workplace safety and making New Zealand businesses better places to work. 8 What do the different parts of my levy cover? ACC WorkPlace Cover levy Covers medical, rehabilitation and weekly compensation costs for injuries to employees that happen at work. The amount you pay is based on how much you pay in wages (liable payroll) and what type of work you do (your classification unit). Working Safer levy ACC collects this levy on behalf of the Worksafe New Zealand. It is used to help fund workplace health and safety. This is a flat rate that all businesses pay. 9 Special circumstances Employees who are also non-paye shareholders and not on the general payroll will be covered by ACC WorkPlace Cover but will be invoiced separately from the rest of your staff. Employees who are paid withholding payments are considered self-employed by ACC and will receive separate invoices. 9
10 Useful information The ACC cover year is from 1 April to 31 March. Invoicing for small to medium-sized enterprises usually begins in July each year, and uses information from your monthly payroll schedules sent to Inland Revenue. You can choose to be invoiced at any time during your first year of business, which helps to spread the cost. To do this, call the ACC Business Customer Contact on As work levies are based on the business industry description you give to Inland Revenue, it s important to select the most appropriate description. The levy payment due date will be shown on your invoice. Flexible payment options are available, including credit card, cheque, internet banking, direct debit and automatic payment. 12 Additional product options Be safe and save If you re self-employed or a business and you employ 10 or fewer employees, you could be eligible for an ACC Workplace Safety Discount. This recognises the health and safety systems implemented in and around your workplace, and you ll receive a 10% reduction on your work levy for three years.
