1 Insurance Policy & Risk Management Explanation (Updated August 2008) INSURANCE SUMMARY HUGH O'BRIAN YOUTH LEADERSHIP Prepared 1990 by JBL&K/Beecher Carlson The following is a brief description of the Liability Policies provided to Hugh O'Brian Youth Leadership through JBL&K/Beecher Carlson Insurance. Your diligent adherence to the LOSS PREVENTION AND RISK REDUCTION POLICY has allowed the insurance committee to negotiate favorably on your behalf. Please remember that this is possible not only through the skills of your insurance committee, but also through your proactive employment of the LOSS PREVENTION AND RISK REDUCTION POLICY. I. NAME INSURED The broad "named insured" wording under the policy includes all organizations and Chapters, but the primary content of the expanded wording is to cover the following: A. Hugh O'Brian Youth Leadership B. Hugh O'Brian Youth Leadership Alumni C. Volunteers as additional insureds, except Automobile Liability All State Corporations & Seminar Affiliates, All State Alumni Chapters and Clubs, and All Community Leadership Workshops, since they are programs of HOBY, are automatically covered. The policies are annual policies and cover all activities of the above during the year including committee meetings, trips, board of trustee meetings, advisory board meetings, etc. II. POLICY COVERAGE PARTS: With the exception of the Directors & Officers policy, which is "claims made," the policies are written on an "occurrence" basis. "Claims made" policies only cover those incidents that occur during the policy period and a claim is made during the policy period. An "Occurrence" policy provides coverage for those events that occur during the policy period, the claim need not be made during the policy period in order for the policy to respond. There are five (5) basic coverage parts under the general liability policy. These coverage parts are: Commercial General Liability, Products & Completed Operations Liability, Personal Injury & Advertising Liability, Fire Legal Liability, and Premises Medical Payments. The following is a brief summary of each of these coverage parts: 1 of 8

2 A. Commercial General Liability: The limit for this coverage section is $10,000,000 Per Occurrence/$11,000,000 Aggregate. This section provides the premises liability for accidents and occurrences that happen during meetings, such as Leadership Seminars, the WLC, CLEWs, Alumni functions, committee meetings, district meetings, and also day-to-day activities. It also picks up the extended liability areas such as contractual liability with various facilities or vendors, where they require you to hold them harmless in case of a lawsuit due to your negligence; incidental malpractice, which includes giving aid or the failure to give first aid, and other areas provided in the policy not outlined in other sections. Example: An ambassador at a Seminar falls down the back stairs of the hotel facility due to poor lighting and a loose tread. The Ambassador sues the hotel for failure to maintain proper facilities and he sues HOBY for failure to ensure safe conditions at the facility before contracting with the hotel. B. Products & Completed Operations: The limit for this coverage section is $10,000,000 Per Occurrence/$11,000,000 Aggregate. This section provides the liability coverage for accidents or occurrences that happened away from premises and usually involve a product sold or an occurrence that happens after the seminar or meeting has been completed. Example: One of the WLC Ambassadors becomes violently ill after returning home. It is determined that he or she has food poisoning from eating all of the box lunches during the seminar. A suit is filed. This is the section that provides coverage. C. Personal Injury & Advertising Liability: The limit for this section is $10,000,000 Per Occurrence / $11,000,000 Aggregate. With the words "Personal Injury," this section is sometimes misleading. However, this section provides coverage for lawsuits arising out of slander, libel, defamation of character, and infringement on advertising ideas, copyrights, titles, slogans, etc. Example: During one of the fund raising events, one of the committee members makes an untrue & slanderous remark pertaining to one of the corporate sponsors. As a result of the statement, which was heard by many clients of the corporation, a loss of revenue is directly attributed. A lawsuit is filed against HOBY and the committee member. This is the section that provides coverage. D. Fire Damage Liability: This section provides coverage for lawsuits arising out of damage to property due to fire which was caused by negligence of the insured - us. This coverage is excess over any other collectible fire insurance by the facilities we use. Example: This section is probably self-explanatory. In most cases the facilities we use have fire insurance. 2 of 8

3 E. Medical Payments: The total medical expense limit is $15,000 per person. Medical payments coverage is provided for emergency first aid treatment. We require signed consent & acknowledgment of risk forms for all activities. In most cases medical insurance is available from parents, participants, or other sources. A separate accident policy has been purchased to allow for limited physical activity, since injuries that happen during athletic participation are not covered under the policy. We must be extremely cautious in this area so that we do not abuse the broad coverage under both policies. Our medical payments are secondary to other collectable insurance. III. LIMITED COVERAGE AREAS: A. Special Risk Accident Insurance Limited coverage for payments for injuries occurring while participation in sporting type events is provided up to $5,000 per person. This will allow for some physical activity during the seminars and other events. FOLLOW YOUR LOSS PREVENTION AND RISK REDUCTION POLICY GUIDELINES. C. Directors & Officers Liability The Hugh O'Brian Youth Leadership is operated for the benefit of the participating students. These students, together with employees, creditors, customers, members, state regulators, and others, are all potential plaintiffs against the Directors & Officers of Hugh O'Brian Youth Leadership. For example, the corporation could lose its tax-exempt status if its earnings were to privately insure to the benefit of any individual. Any number of individuals could be harmed, and possibly bring suit. This is the type of suit to which Directors & Officers coverage is designed to respond. IV. DEDUCTIBLE Please understand that the Directors & Officers coverage has a significant deductible. Please follow the LOSS PREVENTION AND RISK REDUCTION POLICY! CONCLUSION The insurance committee has worked diligently to provide you with this protection. Please be aware that to your benefit, those insured under the Directors & Officers policy include HOBY International and "...any person who has been, now is, or shall become a duly elected director or trustee, a duly elected or appointed officer, an employee, or committee member, whether or not they are salaried, and any other person acting on behalf of Hugh O Brian Youth Leadership or at the direction of an officer or board of directors of Hugh O Brian Youth Leadership." 4 Loss Prevention, Risk Reduction, And Insurance POLICIES ARE NOT INTENDED TO HAMPER THE PROGRAM ACTIVITIES BUT RATHER, TO SAFEGUARD HOBY. THE POLICIES WERE DEVELOPED OVER THE YEARS BY VARIOUS SUBCOMMITTEES OF FIELD OPERATIONS AND PROGRAM, COMPRISED OF MANY HOBY FIELD VOLUNTEERS. LOSS PREVENTION AND RISK Increasing concerns within the youth serving community at large regarding health and safety, allegation of sexual misconduct/abuse, and the rising cost of insurance have generated great interest in loss prevention and risk reduction. Although HOBY has not experienced any of these problems, it is essential that professional staff and volunteers are experts in strategy and execution of plans which ensure physical and mental well being. It is imperative that all levels of the HOBY organization plan carefully to reduce the risk of injury, illness and liability for real or alleged actions and inaction that could lead to liability claims. The HOBY Trustees purchase annual general liability insurance coverage to ensure that all activities run in HOBY's name are adequately covered. The purpose of this coverage is to indemnify against loss, injury or illness occurring during the planning or execution of any authorized HOBY event for which staff might be considered responsible or negligent. Reasonable and prudent study has resulted in the following policies that apply to all HOBY operations. Policy Regarding Sports and High Risk Activities As the result of extensive study, the following activities are not permitted as part of the HOBY program: organized competitive team sports, contact sports and high risk activities including, but not limited to scuba, skiing, surfing, use of guns or other weapons, horseback riding or hang gliding. Transportation Policy Volunteers are NOT covered while driving their personal vehicles on behalf of HOBY at ANY time. HOBY is NOT RESPONSIBLE for the transportation of students or volunteers to / from any HOBY sanctioned events including, but not limited to, seminars, CLEWS, Alumni Activities, WLC and TI. It is the policy of HOBY that common carriers including buses, airplanes, trains and watercraft (cruise ships, ferry boats, river cruise boats) are to be used for all transportation. These carriers should be licensed and fully insured. If using any of the above methods of transportation, you must obtain a certificate of insurance indicating limits of insurance coverage not less than $5,000,000 for general liability and automobile liability. HOBY should be named as an additional insured on the certificate. It is the policy of HOBY that no private aircraft may be used for transportation. 4 of 8

5 Chartered Bus Transportation The following criteria should be used in selection of a chartered bus company: 1. Ask each company to show you a copy of its Department of Transportation Safety Rating. Never use a company with an unsatisfactory rating. 2. What are driver s duty hours? The maximum standard time is 10 hours per day, and no more that 15 hours on duty which includes driving. 3. What is the age of the bus? Eight or fewer years is best. 4. Can the company provide a certificate of insurance in the amount of $5,000,000? Federal law requires this as a minimum amount. Swimming It is the policy of HOBY that students are allowed the use of the host facility swimming pool during a leadership seminar weekend. Since most HOBY activities take place in hotels or on university campuses, permission for the use of the swimming pool must be secured. Appropriate safeguards are required, (i.e. certified lifeguards on duty). Swimming alone is prohibited at all times. Swimming in pairs is required. Although HOBY has never experienced a drowning, we are reminded that the lack of responsible and informed adult leadership is a contributing factor in most of the accidents that take place through group activity. Supervision It is the policy of HOBY that no adult leader, including HOBY staff or Junior Staff, may be alone with a student. Further, no male adult or female adult is permitted to enter sleeping rooms of under age students alone. If a sleeping room is to be entered, two adults are required, at least one of which must be the same sex as the students whose room is entered. Alcoholic Beverage Use All HOBY staff and volunteers are role models for the students who take part in HOBY programs. In determining whether, and to what extent, alcoholic beverages should be available at any HOBY event, the event sponsors always must bear in mind the following commitments: 1. To protect the safety of the students (who are HOBY's reason for being); 2. To provide an example of appropriate behavior for HOBY student participants; 5 of 8

6 3. To maintain HOBY's good reputation and high ideals. Decisions regarding the circumstances under which alcoholic beverages may be made available at various HOBY-related events and activities are left to the discretion of the persons responsible for the event. Those individuals should consider all relevant factors, including the nature and constituency of the activity or event and the prevailing social customs and attitudes in the area in which the activity will take place. In all events, the following minimum standards must be observed: 1. Staff and facilitators should ALWAYS abstain from using alcoholic beverage during any HOBY seminar or youth program / activity. A seminar or activity begins with your arrival and ends with your departure from the site of the event. 2. Alcohol must NEVER be served to a person who has not attained the legal drinking age. 3. Alcohol must NEVER be served to any person who already is obviously intoxicated. 4. All other laws regarding alcoholic beverage consumption must ALWAYS be followed strictly. 5. There must ALWAYS be present at least one adult designated non-drinker attending any HOBY event or activity where alcoholic beverages are being served. General Policies Contracts and Agreements It is important that all contracts and agreements related to your HOBY activities be reviewed by your HOBY Corporation's legal counsel. If your HOBY Corporation's legal counsel feels such contracts or agreements could expose the HOBY International Corporations to potential risk, please send a copy to HOBY International for review. When signing contracts, sign them as an official representative of HOBY. Be sure that your HOBY title is listed next to your name and signature. Travel Activity Plan A HOBY Travel Activity Plan Form must be filed with your Corporation President at least 7 days prior to the beginning of an activity. 6 of 8

7 Certificate of Insurance If you need a certificate of general liability insurance, please feel free to contact Cindy Mohr at cindy.mohr@beechercarlson.com and or Melodie Hight at melodie.hight@beechercarlson.com and , at Beecher Carlson Insurance, , at least two weeks prior to a HOBY activity. See also the Insurance Certificate Request Form. Parental Consent and Acknowledgment of Risk Form All participants in a HOBY event must complete and have signed a HOBY International approved Consent and Acknowledgment of Risk form prior to an event. These forms are provided annually to all HOBY Leadership Seminar Chairpersons, Corporation Presidents and Alumni Advisors on our website and in our program manuals. All Consent forms should be kept at the activity site so that they may be presented to a hospital or physician as necessary. Consent forms should list the beginning and ending time of the event. Medical Treatment Log A Medical Treatment Log must be used in relation to all HOBY activities where records of any and all first aid or medical treatment administered during an activity are maintained. This record must be forwarded to HOBY International s Program Department. Emergency Procedures A firm plan of emergency procedures must be developed before seminars or events take place. HOBY Corporations are advised to ensure that the Seminar Chairpersons, Alumni Advisors and CLEW Chairpersons develop a relationship with a medical facility near the location of all events and activities in advance of the event or activity (excluding committee meetings). A person of authority at the medical facility (hospital or emergency care center) should be consulted regarding emergency and admitting procedures and authorization procedures for treatment of minors. The HOBY Consent and Acknowledgment of Risk form should be reviewed by the representative of the medical facility and their pre-approval of its acceptance as consent for treatment should be acknowledged by them. Filing of Serious or Fatal Accident Reports We hope it never happens, but in the event of a serious or fatal accident the following steps must be followed. 1. Of utmost importance is the proper care of the injured individual. Immediately contact the paramedics to supervise the care and/or transportation of the injured party (trained first-aid people should use their skills and resources to deal with the immediate life threatening situation such as lack of breathing, heart attack, severe bleeding, or internal poisoning). Check your state's "Good Samaritan" law regarding emergency procedures. 7 of 8

8 2. As quickly as possible, parents or next of kin should be notified. 3. Notify your Corporation President immediately. Also, contact the President and Chief Executive HOBY (310/ ) or your Director of National Programs and HOBY will contact Beecher Carlson Insurance, (Cindy Mohr or Melodie Hight) Gather factual data such as who, what, when, where, how witnesses, photographs, etc. to aid in the reporting process. Do not admit liability or responsibility for the injury. Do NOT take photos of the injured or deceased person. 5. News media inquiries should be referred to the Corporation President or an Officer of HOBY International. Health Histories Health history of each participant is required and is the responsibility of the individual or his or her parent or guardian. Medical forms, as long as current, can be used for one year after being filed with the Chapter. Buddy System On tours or activities the Buddy System must be used. Record Maintenance All consent forms, medical forms and other records associated with an Ambassador s participation in HOBY should be kept for a minimum of seven years after participation occurred.
