1 ORDINANCE NO 758 AN ORDINANCE TO REVISE THE RATES FOR ELECTRIC SERVICE IN THE VILLAGE OF HEMINGFORD, RULES AND REGULATIONS GOVERNING DISCONTINUANCE OF ELECTRIC ENERGY AND SERVICE, REPEALING ALL OTHER ORDINANCES IN CONFLICT WITH THIS ORDINANCE BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF HEIMIINGFORD, NEBRASKA. The charges hereinafter provided for an electric energy and service furnished by the Municipal Utilities of the Village of Hemingford, Nebraska, shall be based on meter rates for monthly consumption and is hereby established as follows: SUMMER: The summer rate shall apply to the Customer's prorated use from May 15 through September 15. WINTER: The winter rate shall apply to the Customer's prorated use from September 16 through May 14. RESIDENTIAL SERVICE RATE #1 APPLICABLE: To single-family residences and individually metered apartments for all domestic purposes when all service is supplied through a single meter, provided ratings of individual single-phase motors do not exceed five (5) horsepower. CHARACTER OF SERVICE: AC, 60 cycles, single-phase, 120 volt, two-wire; or 120/240 volt, threewire. 2 GENERAL SERVICE RATE #2 APPLICABLE: To small-medium commercial and nonresidential accounts that operate normally during peak hours only for lighting, heating, and power purposes where all services is taken through a single meter at one location, and where the Customer's peak demand does not exceed 50 kw in any three consecutive months and to apartments and multiple dwellings buildings where two or more services are measured by one meter. The rating of individual single-phase motors and other single-phase power and heating units served under this schedule shall not exceed five (5) horsepower or five (5) kw. Where the Village does not have threephase, but has single-phase service available; single- phase motors not to exceed ten horsepower (10 HP) rating may be connected under this schedule. NOTE: The Irrigation Service Rate is frozen to new accounts and is discontinued after September 31, 2012 with accounts to be moved to General Service Demand Rate #3. Where the nameplate of the motor is not available, the horsepower connected will be determined Page 4 of 7
5 by an actual measurement of horsepower input to the motor operating under maximum load conditions. The Village reserves the right at any time to check the customer's load for recalculation of the minimum bill. Power Cost Adjustment (PCA) #9 Applicability: The PCA may be determined from time to time and when approved shall be applied to monthly kwh sales of all rates classes of the Village for a period of not more than 12 months. The PCA calculations will be based on the FY projected and actual 12 months includable expenses and the current Budget actual and projected sales subject to the PCA. The City may invoke the PCA when unexpected increases in the cost of power such the pass through of a similar adjustment charge from one or more of the Village s Wholesale Power Suppliers or other emergencies expenses are estimated to be greater than a 10% deviation in FY power costs budgeted. At the end of any PCA application period, any under or over collected revenues may be added to the next FY estimate of power costs to determine if another PCA is necessary for the next 12 months or shorter period. 6 RULES AND REGULATIONS GOVERNING DISCONTINUANCE ELEC'T'RIC ENERGY AND SERVICE'. If any customer desires discontinuance of any electrical energy and service at any location, notice shall be given at the Utilities Office of the Village. Customer will be responsible for all electric energy and service furnished until such notice is given and sufficient time, not exceeding forty-eight (48) hours, is allowed for final reading of meters. Meter readings shall be made on or about the fifteenth (15th) of the month. One and one-half (1.5%) percent per month shall be charged on all unpaid balances after the due date. Said bill shall become delinquent on the sixteenth (16th) day of each month, at which time the customer will receive a courtesy notice. If the bill remains delinquent the following month and no special permissible arrangements are made with the Utilities Office, the Village Clerk shall given customers written notice that electric service will be discontinued after seven (7) days from the date of notice. When service shall have been discontinued for nonpayment of bills, a charge of ten dollars ($10.00) shall be made to cover the cost of reconnection, Non Business Hours fifty dollars ($50.00). Service may be discontinued if customer shall fail to maintain his wiring equipment in good and safe conditions and comply with all the laws, ordinances and regulations applicable thereto. Service may be discontinued if customer shall fail to comply with the Village s rules and regulations after due notice of thirty (30) days maximum, is allowed to comply with said rules and regulations. Immediate discontinuance of service without notice shall be made if in the opinion of the Village a dangerous condition makes such action imperative. Service shall be discontinued immediately without notice if lights or appliances are connected so that the electric energy used by the said lights or appliances cannot actuate the meters, or if Village s meter wires or other equipment have been tampered with or interfered with preventing the Village s meter from registering correctly the energy used. In such event the Village shall estimate the amount due for electricity consumered but not registered and make a charge of the $10.00 for disconnecting and $10.00 for reconnecting service, Non Business hours $50.00, which amounts shall be due and payable without deduction. In addition, the customer shall pay the cost of installing an outdoor type of meter wit such protection included as the Villae may require to prevent further diversions of electricity. All Ordinances or parts of Ordinances inconsistent with this Ordinance be and the same are hereby repealed. That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
