1 FBA Labor and Employment Law Section Board Meeting Minutes May 21, 2015 FEDERAL BAR ASSOCIATION LABOR AND EMPLOYMENT LAW SECTION Board Meeting (via Conference Call) Thursday, May 21, 2015 MINUTES The following Board and Committee members participated in the call: Donna Currault, Deputy Chair Kathryn Knight, Treasurer Corie Tarara, Secretary Whitney Sedwick Meister Nancy Bloodgood Lucy Sanders Tim Bliss Joel Schroeder Absent: Craig Cowart, Karleen Green, Jim Hammerschmidt, Danielle Brewer Jones, Allison Moore, Steve Griffith, Jose Gonzales-Nogueras, James Noel, Danuta Panich, Chris Parker, Rashni Senevinatne, Courtney Thomlinson, Scott Oswald Additional participants in the call were: Jane Zaretskie and Marcellus Howard (national). I. Introduction and Call to Order Deputy Chair Donna Currault called the meeting to order at 2:00 p.m. EST in Mr. Cowart s absence. II. Approval of Minutes Given the lack of a quorum, the April 16, 2015 meeting minutes will be approved at the next Board meeting. III. Treasurer s Report Ms. Knight Ms. Knight reported that for the month ending April 30, 2015, the Section had revenue of $1,440 and expenses of $3,278 (bank fees and speakers dinner associated with the biennial conference). Our ending fund balance for the month was a negative $1,838, with an ending fund balance of $103,937 for the seven months of our fiscal year. Ms. Knight also reported that she inquired of National regarding the Section s share of net profits (approximately $5,950) from the 1

2 biennial conference and was advised that the funds are being transferred this week and will be reflected in the June financials. IV. Chair's Report Passed. V. Report from FBA National Ms. Zaretskie Ms. Zaretski is filling in on an interim basis. Remember the awards deadline for national program is June 1. Consider submitting for section awards. In early June the bids will be solicited for 2019 national convention more for chapters. The deadline is June 2. There is a Women in the Law conference (second annual) on June 6; please try to get as many to attend as possible. VI. Committee Reports A. Committee on Publications and Public Relations Ms. Tarara Ms. Tarara reported that we have, thanks to Mr. Hammerschmdit, secured a 7 th Circuit author, David Hasse with Littler, for the monthly circuit updates. Mr. Hammerschmidt also agreed to author the DC Circuit updates. The April circuit update went out on May 18 with the 4 th, 5 th, 6 th, 8 th, 9 th, and 10 th Circuits reporting. We are getting ready for the June 1 issue of The Labouring Oar and have secured four articles, all of which are in the second draft stage at this point. If your committee wants to submit an update or article for the issue, please send it to Ms. Tarara no later than Tuesday, May 27 for inclusion. Ms. Tarara also reported that the September 1 issue of The Federal Lawyer is including the Section s L&E Corner. The topic is Spotlight On: District of Utah. The last issue of this year is the December issue which is a general issue, and will have a September 1 deadline for the article. Ms. Currault mentioned that the website does not contain any of our circuit updates since July Also, the L&E Corner entries, we get a link those are missing since The Labouring Oar should be updated also. Mr. Howard stated that the web manager should be doing that and Ms. Zaretskie said she would follow up. B. Committee on Programming and CLE Ms. Currault 1. Biennial Conference. We made a profit. Overall, we $36,300 in revenue, of that, $11,300 was in registration and $25,000 was in sponsorships. We had $24,000 in expenses, which left us a $11,900 profit. Our section will receive $5,950 and national will get $5,950. We had 75 attendees. The reviews and evaluation were very complimentary. We received a lot of good ideas for future topics for our next program in

3 2. Webinar. There is a webinar the 3 rd week of July from our Legislation and Congressional Relations Committee. 3. Joint Presentation with Veteran s Rights. We will have two L&E Section members and two Veteran s Section members give the presentation on Veteran s Rights at the 2015 annual conference. The L&E topic is USERRA and ADA issues as well as what to do when veterans get called up to duty. 4. Award Recommendation. submitted to Karleen for author of the year. 5. Traveling CLE Program. Not able to get off the ground this year spent time on Biennial instead. Washington DC Chapter would like to participate with us have us do Employment Law 101. Also the Heath Law Section and Arbitration and Mediation Section interested in doing things with us. C. Standing Committee on Finance & Expenditures Ms. Knight & Ms. Bloodgood. Nothing to report. D. Standing Committee on Membership & Chapter Relations Ms. Brewer Jones. In Ms. Brewer Jones absence, Ms. Currault reported we have 1,420 members, 24 new members, 8 from San Diego, 88 past due members, 22 non-renewing members, and 1308 active members. E. Standing Committee on Legislation and Congressional Relations - Ms. Currault in Mr. Griffith s Absence. The section has an article for submission to Ms. Tarara regarding a possible legislative gap in protection for pregnant employees, and have pinned down with national the details of the immigration CLE to occur in July. They continue to monitor legislative and executive developments, and welcome input from the rest of the Board about ways they can assist any other committees. F. Standing Committee on Executive Agency Outreach Ms. Currault Ms. Currault is unsure if Mr. Cowart reached out to Kathleen McKinney, Regional Director of New Orleans Office of NLRB to join the Board and attend the meeting. H. Special Committee on Awards Ms. Currault in Ms. Green s absence. Ms. Green will be submitting some section activities for national awards. 3

5 VI. Other Business / Adjournment Passed further discussion pending quorum. There being no further business for the Board, the meeting was adjourned at 2:28 p.m. EST, on motion of Ms. Knight, seconded by Mr. Schroeder. The next Board meeting will occur on June 18, 2015 at 2:00 EST. 5
