Overview Direct Award Solicitation Recovery Act Justice Assistance Grant (JAG) #09-11 (GR) Multi-jurisdictional Drug Task Forces New subgrantees must register online at at least five (5) days prior to submitting the online application. Proposal Deadline: June 26, 2009 Project Dates: July 1, 2009, to June 30, 2010 The stated purposes of the American Recovery and Reinvestment Act are to preserve and create jobs and promote economic recovery; to assist those most impacted by the recession; to provide investments needed to increase economic efficiency by spurring technological advances in science and health; to invest in transportation, environmental protection, and other infrastructure that will provide long-term economic benefits and to stabilize State and local government budgets, in order to minimize and avoid reductions in essential services and counter-productive State and local tax increases. The Recovery Act places great emphasis on accountability and transparency in the use of taxpayer dollars. Among other things, it creates a new Recovery, Accountability and Transparency requirement and a new website at to provide information to the public, including access to detailed information on grants and contracts made with the Recovery Act funds. The MBCC requires that all applicants submit a written and signed certification to assure and certify that they are able to meet the strenuous reporting requirements, before they will be eligible to receive Recovery Act Justice Assistance Grant program awarded funds (Refer to Attachment B). 1

2 *** NOTE *** SPECIAL ACCOUNTING REQUIREMENTS Separate Tracking and Reporting of Recovery Act Funds and Outcomes It is essential that all funds from a Recovery Act grant be tracked, accounted for, and reported on separately from all other funds (including funds from non-recovery Act grants awarded for the same or similar purposes or programs). Quarterly financial, programmatic, and performance measures reporting will be due within five (5) calendar days after the end of each calendar quarter. No exceptions or waivers will be allowed for non-compliance of the strict reporting requirements mandated under the Recovery Act. Recipients must also be prepared to track and report on the specific outcomes and benefits attributable to use of Recovery Act funds. The accounting systems of sub grantees must ensure funds from any award under this Recovery Act solicitation are not commingled with funds from any other source. The MBCC will convene a special meeting with all subgrantees to discuss the specific reporting expectations and mechanics. ** NOTE ** MANDATED REPORTING REQUIREMENTS The Recovery Act Justice Assistance Grant Program mandates timely quarterly reporting requirements. Sub grantee recipients failing to meet the reporting requirements may be subject to numerous actions up to and including: funding restrictions on current and future MBCC awards, eligibility restrictions for other MBCC awards, and suspension or termination of the Recovery Act award. All applicants must agree to the following five (5) Recovery Act reports to be submitted by the due date: 1. MBCC Quarterly Progress Report 2. MBCC Quarterly Fiscal Report 3. 3 II. Eligibility Eligibility applies to local agencies that already receive funding from the MBCC for multi-jurisdictional drug task forces and wish to continue their program. Expenditures made under the Edward Byrnes and Omnibus JAG programs are eligible under the Recovery Act JAG grant. If the State Administering Agency (SAA) wishes to fund a project that will be administered by the state but benefits local governments, then this project may be considered part of the pass-through amount if each local jurisdiction that benefits voluntarily signs a waiver. This waiver must be signed by a budget authority such as a county commissioner or mayor and should certify that the local jurisdiction understands that the funds in question are set aside for local government use, believes that this program is for local benefit, and understands funding at the state level is a convenience to local government. Multi-jurisdictional Drug Task Forces must be comprised of law enforcement representatives from five or more counties. A reservation will count as a county. A county or reservation may belong to more than one jurisdiction. The drug task forces must enter into a written, annual, inter-local agreement with all participants. Law enforcement from incorporated cities within the regional boundaries must document their knowledge of the task force if they are not active participants. The Federal Funding Accountability and Transparency Act of 2006 (Transparency Act) took effect January 1, Applicants for federal awards are required to have a DUNS number and to maintain a current registration in CCR. To obtain a DUNS number online, go to or call the Dun & Bradstreet hotline at The DUNS number is required as part of registration with CCR. To register with CCR, go to call or with any questions. Note: You must renew the CCR registration once a year. If applicants fail to renew their CCR registration, the grant application may not be submitted. All applicants under this solicitation must include a DUNS number in their application and a certification that they maintain a current registration in the CCR database. Applications without a DUNS number or CCR certification are incomplete. III. Application Deadline The due date and time for applying for funding under this solicitation is June 26, 2009 at 5:00 pm MST, and must be strictly adhered to by applicants. Late Applications Any late applications submitted under this solicitation will not be considered under the application review and will require appearance before the MBCC to request consideration. A request for late application consideration must be made in writing to the Executive Director of the MBCC at least 10 days prior to the Board meeting. A representative must appear before the Board at the next meeting. 3

4 IV. How to Apply Go to and select Grants, then Online Application. Log in and choose an RFP or solicitation by selecting File a New Application. Select the RFP or solicitation for which you are applying. The majority of the application can be submitted online; however the following must be mailed by the deadline of June 26, 2009 at 5:00 p.m. 1. Inter-local agreements with signatures, 2. 5 V. Budget and Match All Federal allocations under the Recovery Act program are considered to be one-time funds. Upon the condition that the grant application is approved, any pre-agreement costs within the scope of the grant dating back to July 1, 2009, will be considered by the MBCC for reimbursement from the requesting agency s award allocations. VI. Measures Recovery Act JAG Measures To assist in fulfilling the accountability objectives of the Recovery Act, as well as the Department of Justice, Office of Justice Program, Bureau of Justice Assistance s responsibilities under the Government and Results Act of 1993 (GPRA), Public Law , applicants who receive funding under this solicitation must provide data that measure the results of their work. In addition, applicants must discuss their data collection methods in the application. 5

Note: Under the Recovery Act, positions that are considered to be retained for the purpose of the Recovery Act must provide documentation. (ie: If the position would have been cut to a half time position or eliminated completely, documentation from an Executive Order, minutes from a council meeting, reduction in force (RIF), etc. must be provided in addition to the position description that will be maintained because of Recovery Act dollars). Recovery Act JAG Programmatic Measures As required by the Recovery Act, JAG sub grantees will report quarterly on additional programmatic performance measures; only those applicable to their grant and funded by 6

7 Recovery Act dollars. Refer to (Attachment C), the BJA Justice Assistance Grant Program attachment included with this solicitation. VII. Program-Specific Information 1. The project begins July 1, 2009, and concludes June 30, Upon receiving an award notification, all sub grantees will receive a copy of the Recovery Act JAG Special Conditions. The sub grantees must read the special conditions, and provide their original signature that they understand and will comply with the conditions. 3. Quarterly progress, fiscal and performance measures reporting on use of funds are due to the MBCC five days after the end of each calendar quarter. The reporting of programmatic performance measures will be completed quarterly with a due date by the 15 th of the following month. Written certification with an original signature, verifying that applicants will comply with reporting requirements is required prior to sub grantees receiving their awards (Refer to Attachment B). No exceptions or waivers will be allowed for non-compliance of the strict reporting requirements mandated under the Recovery Act. 4. It is essential that all funds from a Recovery Act grant be tracked, accounted for, and reported on separately from all other funds (including funds from non- Recovery Act grants awarded for the same or similar purposes or programs). Comingling of Recovery Act funds with funds from any other source is strictly prohibited. VIII. Application Requirements All successful applicants for grant award funds from MBCC must adhere to the following: 1. Continue to submit traditional quarterly narrative, data, performance measures and financial reports in the prescribed format according to MBCC time frames, as reported in FY 2009 (July 1, 2008 through June 30, 2009) Omnibus JAG grant program. Quarterly reports also mean reporting all, income, asset seizures and forfeitures, and buy money expenditures regardless of the source of the buy money. 2. Submit all Recovery Act JAG quarterly progress, fiscal, performance measures, and programmatic performance measures in the prescribed format according to MBCC time frames. 3. Submit an annual report. 7

8 Online Application Process This section is to be used as a guide throughout the online application process. All applications should include the following: 1. Face Sheet: The face sheet is automatically generated in the online application system. The face page identifies the applicant, the Online Subgrant Application System (OSAS) ID, the project director and agency budget representative, the project title, the date the application was received, the project duration dates, and the project budget. 2. Executive Summary: Briefly summarize the scope of the project, state the problem or need, goals, objectives and outcomes to be gained, and the total cost of the project. 3. Project Budget: Applicants must provide a budget that is complete, allowable, and cost-effective in relation to the proposed activities. The applicant must also show the cost calculations to demonstrate how the applicant arrived at the total amount requested. 4. Budget Narrative: The applicant must provide a brief narrative to link costs with project activities. The narrative should demonstrate that all costs are reasonable. 5. Program Narrative and Needs Statement: Applicants must submit a program narrative that describes the proposed program activities for the one year grant. The narrative must also include a needs statement outlining the needs in the multi-jurisdictional area for drug enforcement and the services that the task force provides. Include the following in the Narrative Report and Needs Statement: Provide a progress report for the FY 2009 (July 1, 2008 June 30, 2009) project Goals and Objectives. a. Provide an update of the 2009 threat assessment and indicate how the task force plans to respond the threats outlined in the assessment. b. Provide a report on the number of cases the task force has worked with HIDTA, other drug task forces, prosecutors, tribes, and other state and federal agencies. In the report provide specific examples of the outcomes and successes of this interagency coordination and the results of each case. c. Provide the number of cases the drug task force has referred to federal prosecutors and the number accepted for federal prosecution. If the case was rejected explain the reasons why. 8

9 d. Provide a description of the impact that the drug task force has had on drug availability, deterrence and public awareness in the area of operations and statewide. e. Provide a complete disclosure of all federal, state, local and private sources of funds including forfeiture, seizure and potential future funds. f. Provide a copy of the policy on expenditure of forfeiture funds. g. Report on active cases and cases closed in State Fiscal Year 2008 (July 1, 2007 through June 30, 2008) the following information: 1. Cases referred for prosecution to state and local courts and which office they were referred to, 2. Other crimes charged and referred for prosecution related to the drug charge, 3. Cases that resulted in prosecution in the above courts and the outcomes, i.e., conviction and sentencing information on each case, 4. The drug amounts involved in each case, 5. If a seizure occurred, what assets were seized and the value(s). If a forfeiture occurred, what assets were forfeited and the value(s), 6. The number of cases where weapons were seized relative to the investigation, 7. The number of drug-endangered children involved in the cases and their disposition. 8. Provide letters of support from the local officials (example; schools, city and county) in the area where the task force operates. The letters should address the impact and outcomes of the task force in the effected community or county. 9. Sustainability plan each Multi-jurisdictional Drug Task Force must report progress toward implementing the sustainability plan. List potential alternate sources of funding/services or provide assurances that the task force will become part of the parent government budget. Special Assurances and Conditions. The subgrant application contains a list of Special Assurances and Conditions that are part of the contract between MBCC and the subgrantee upon award. The signature page binds the applicant to the Special Assurances and Conditions. 9

10 Signature Pages Required. Original signatures are required; mail original copies of the signature page, current letters of support, inter-local agreements, reporting requirements certification, and position retention documentation to MBCC. When awarded, the application forms a contract between the applicant and MBCC. The signatures are binding. Duplicate responsibilities are not allowed. No single person can sign as Agency Representative and Project Director. The official budget representative must be a person with budget-setting authority, generally a mayor, chairperson, department director, etc. IX. Special Requirements Crime Data Reporting If the grant is for a law enforcement agency, the law enforcement agency must report crime data to the MBCC. The crime data must be compliant with the Montana Incident- Based Reporting (MTIBR) standards and policy. If an agency is not yet compliant and has plans to become compliant, the agency may submit a Memorandum of Understanding (MOU), and the MBCC will decide if the MOU justifies a waiver until the agency becomes compliant. Strategic Planning All subgrantees must agree to attend an annual joint strategic planning meeting with MBCC representatives, to develop an on-going statewide anti-drug strategy. Special Conditions Each of the Multi-jurisdictional Drug Task Forces will insure that it complies with the terms of the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Award Continuation Sheet, Special Condition mitigation measures. Special Condition Mitigation Measures Mitigation of health, safety and environmental risks: This special condition facilitates compliance with the provision of the National Environmental Policy Act (NEPA) relating to clandestine methamphetamine laboratory operations, including the identification, seizure, or closure of clandestine methamphetamine laboratories (hereinafter, meth lab operations ). No monies from this award may be obligated to support meth lab operations unless the Grantee implements these special conditions. 1. Provide medical screening of personnel assigned or to be assigned by the grantee to the seizure or closure of clandestine methamphetamine laboratories; 2. Provide Occupational Safety and Health Administration (OSHA) required initial and refresher training for law enforcement officials and all other personnel assigned to either the seizure or closure of clandestine methamphetamine laboratories; 10

11 3. As determined by their specific duties, equip the personnel with OSHA required protective wear and other required safety equipment; 4. Assign properly trained personnel to prepare a comprehensive contamination report on each seized/closed laboratory; 5. Utilize qualified disposal personnel to remove all chemicals and associated glassware, equipment, and contaminated materials and wastes from the site(s) of each seized laboratory; 6. Dispose of the chemicals, equipment, and contaminated materials and wastes at properly licensed disposable facilities or, when allowable, at properly licensed recycling facilities; 7. Monitor the transport, disposal, and recycling components of subparagraphs numbered 5 and 6 immediately above in order to ensure proper compliance; 8. Have in place and implement a written agreement with the responsible State environmental agency. The Agreement must provide that the responsible State environmental agency agrees to (a) timely evaluate the environmental conditions at and around the site of a closed clandestine laboratory and (b) coordinate with the responsible party, property owner, or others to ensure that any residual contamination is remediated, if determined necessary by the state environmental agency, and in accordance with existing State and federal requirements; and 9. Have in place and implement a written agreement with the responsible state or local service agencies to properly respond to any minor, as defined by state law, at the site. This agreement must ensure immediate response by qualified personnel who can (a) respond to the potential health needs of any minor at the site; (b) take that minor into protective custody unless the minor is criminally involved in the meth lab activities or is subject to arrest for other criminal violations; (c) ensure immediate medical testing for methamphetamine toxicity; and (d) arrange for any follow-up medical tests, examinations, or health care made necessary as a result of methamphetamine toxicity. The Board has developed the Montana Board of Crime Control Multi-jurisdictional Drug Task Forces Clandestine Methamphetamine Laboratories Mitigation Plan to address this Special Condition. This plan will go into effect at the beginning of the state fiscal year after all parties have reviewed and signed an update to this plan. X. Limitations and Fund Use Review the following list carefully. If you have any questions, call prior to submitting your proposal. 1) Purchase of equipment must be incidental, integral, and necessary for the project. 2) Construction, in general, is prohibited. 3) Land acquisition is prohibited. 4) Supplanting is prohibited (Refer to [Attachment A] Supplanting Definition). 5) Consultant costs are limited to $450 per 8-hour day without additional approval or bidding. 6) State rates are to be used for calculating mileage, per diem and lodging. 11

12 7) Indirect costs are not allowed. 8) Rental costs are limited to fair market value for similar facilities in your locality. Rental rates in excess of this amount will need special approval. 9) General salaries and personnel costs are allowable; overtime cannot exceed 10 percent of the personnel budget. 10) Funds may not be expended or obligated prior to July 1, ) Purchase or lease of vehicles is not permitted. Mileage will be allowed at the current approved state rate. 12) Uniform allowances will not be permitted. 13) Buy money, Purchase of Evidence/Purchase of Information (referred to as PEPI or Confidential funds) no longer have a limit, but any increase over the FY 2008 award must come from within your budget. A line-item transfer can be requested during the project year from within your existing budget in order to increase PEPI funds. In addition, confidential funds must follow certain federal and state accounting guidelines. Any activity using buy money must comply with federal and state guidelines, regardless of the source of the buy money and must be reported quarterly to the MBCC. 14) If your agency receives less than $500,000 per year in total federal assistance, you will not be required to arrange for an audit and may not charge audit costs to your grant. (Note: Agencies receiving $500,000/yr or more in total federal assistance will be required to have an audit performed in accordance with federal circular A Costs for such an audit should be charged proportionately to all programs being audited.) Note: Food and beverage items may be allowable if costs meet these guidelines: 1) the food and beverage are incidental to a work-related event; 2) the costs are documented and reasonable; and 3) food and beverages are not directly related to amusement and/or social events. MBCC will approve such items only if the applicant justifies the expense as a clear benefit to the grant project. The federal Office of Justice Programs discourages approval of expenses for "working lunches;" therefore, we would recommend that you not include such items in a request. All food and beverage items must receive prior approval from MBCC. 15) Funds usage must be accounted for and outcomes reported in the quarterly performance measures (refer to section VI). XI. Awards The Anti-Drug Committee and the full Board have already approved the allocation of Recovery Act JAG award funds for the seven Multi-jurisdictional Drug Task Forces. MBCC staff will conduct a screening of the application to check for completeness. The fiscal staff and program manager will review the applications and summarize the grant and technical information. 12

14 Attachment A Recovery Act JAG Solicitation Supplanting Definitions Supplanting (Final Draft 3/14/03): Grant funds, which include matching funds, may not be used to replace state or local funds that would, in the absence of federal assistance, be available or forthcoming for law enforcement. Instead, grant funds must be used to increase the total amount of such other funds the grantee agency uses. A grant recipient may not use federal grant funds to defray any costs that the recipient is already obligated to pay. For example, if a grantee, prior to applying to participate in the grant program, had committed to purchase 10 new computers for crime analysis, that the grantee must purchase those 10 computers in addition to any computers requested for the grant program. (Edward Byrne Memorial State and Local Law Enforcement Assistance Program; Formula Grant Program; Chapter 2(e)) Supplanting vs. Supplementing State Funds Block grant program design dictates the effectiveness of federal funds. To strengthen the impact of federal grant dollars, state and local governments must be motivated to use federal funds as a supplement, rather than as a replacement to their own spending. In designing block grant programs, the federal government seeks to use its funding to boost state efforts in particular program areas of nation interest, instead of replacing state funding with federal funding. When states use specific purpose federal funds to free their spending for other priorities such as state programs or tax relief, the federal monies end up as a substitute for state spending, undermining the effectiveness of federal efforts to boost spending beyond current levels. One feature of block grant programs designed to avoid this supplanting of state funds with federal monies is a maintenance-of effort requirement to ensure continued state participation. It forces states to continue spending at a given level as a condition of receiving federal funds. If this type of requirement is tied to program growth and the rate of inflation, state spending levels can be maintained over time. But imposing maintenance-of-effort restrictions requires balancing a state s need for flexibility in program planning and implementation against the federal interest in boosting program spending overall. Another block grant design feature ties matching state funds which are proportionate to state spending. To date, only about half of the largest grants require state matching, and federal participation is frequently set at 70 percent or 80 percent. 14

Initiatives may improve a program, service or system. Initiatives also include the implementation of a new program to meet an identified need of a population. Planned activities may also include a campaign to counteract criminal activity in a variety of settings.
