9 INTRODUCTION This report, submitted to the Governor, the Legislature, and the Advisory Council on Domestic Violence pursuant to N.J.S.A. 2C: 25-33, covers the period from January 1, 2013 through December 31, The New Jersey Administrative Office of the Courts prepared this statistical report on the operation of the Prevention of Domestic Violence Act, N.J.S.A. 2C: to 2C: It reflects data gathered from case management systems that are monitored by the Family Practice Division, the Criminal Practice Division and the Municipal Court Services Division. The collection and analysis of accurate data regarding trends in domestic violence proceedings serves as an essential resource for governmental agencies and service providers with regard to funding, report writing, grants, legislation, and policy recommendations. The format of this report follows in line with what has been produced in prior years although the presentation of that information has been changed. Data regarding domestic violence filings, dispositions of restraining orders, and forms of relief sought and granted are still contained in this report. This report includes data on nonindictable contempt charges, which are processed in Family Court (N.J.S.A. 2C:29.9b) and data on violations of non-contact orders or other offenses requiring arrest and criminal charges, which are processed in the Criminal Practice Division. Municipal figures, for cases containing aspects of Domestic Violence, have been included in this report for the first time, as well. Calendar Year DV Complainte filed in the Family Court 37,588 38,644 36,416 34,445 33,146 The total number of Domestic Violence Complaints filed in the Family Court in 2013 was 33,146 which is a reduction of 1,299 cases from the prior calendar year ( 34,445 ). The New Jersey Judiciary continues to implement policies and procedures to enhance the protective process for victims of domestic violence and their families. The 'STOP Violence Against Women Act'(STOP VAWA) supports judicial efforts to improve the court process for victims of domestic violence through improved coordination and the training of judges and domestic violence court staff. Through STOP VAWA funding, training administered by the Family Practice Division of the Administrative Office of the Courts, is provided to Judges, Family Court staff, Probation Officers who have a domestic violence caseload, court volunteers and others. The New Jersey Judiciary endeavors to continuously promote uniform procedures, best practices and to provide a clear and concise understanding of the dynamics of domestic violence and the Prevention of Domestic Violence Act to all Judiciary staff and court volunteers. A Domestic Violence Conference, requiring mandatory participation, is conducted each year for all Family Division judges and domestic violence staff statewide. The Domestic Violence Team Leaders, Domestic Violence Hearing Officers, and the Backup Domestic Violence Hearing Officers also receive training throughout the year. All new Judiciary employees receive training on the dynamics of Domestic Violence and the Prevention of Domestic Violence Act prior to their work assignment. The Family Practice Division also coordinates with the Municipal Court Services Division to train Municipal Court Judges and Municipal Court Administrators regarding domestic violence processes and procedures. Without grant funding, much of this training would not be possible.
10 A video library is available to staff assigned to the domestic violence docket type. This library makes the mandatory domestic violence training accessible to new employees, current staff and volunteers when training cannot be immediately scheduled or is not locally available. Advanced training on cultural issues and barriers to protection continue to be provided by the court through networking with the victim services community. The Statewide Domestic Violence Central Registry (DVCR), remains a vital informational tool available to law enforcement agencies as well as to the Family Courts. The DVCR is used to facilitate the enforcement of Temporary Restraining Orders (TROs) and Final Restraining Orders (FROs), thereby enhancing protection for victims, even when they relocate between municipalities and counties within the state. It contains up-to-date information on all Restraining Orders entered into the Family Automated Case Tracking System, including registered out-of-state restraining orders and information regarding violations of those restraining orders. The DVCR also provides vital information to law enforcement as part of the screening process for individuals who apply for firearms licensing. The DVCR was made possible through federal STOP VAWA funding and through inter-agency cooperation among the New Jersey Judiciary, the Attorney General's Office, local law enforcement agencies and the New Jersey State Police. The New Jersey Judiciary, working with the New Jersey State Police, has completed the national requirement for New Jersey to become part of the National Criminal History Information Processing (NCHIP) database. The Protection Order File process enables local police and federal authorities across the nation to receive timely and accurate information on active protective orders, as well as historical crime records. The national crime database provides information regarding the existence and terms of a protection order issued in other states, and supports the identification of persons prohibited by federal or state law from purchasing a firearm. The Domestic Violence Hearing Officer (DVHO) Program is a mainstay of the Judiciary's effort to deliver an efficient court process to potential victims. The availability of the DVHO reduces the wait time for victims due to other calendar matters before a judge. Extensive training continues to be the center of the DVHO program. The New Jersey Judiciary is committed to ensure the highest quality service to domestic violence victims and the public in general. The New Jersey Judiciary will continue to strive to improve the overall quality of services it provides to all. The New Jersey Judiciary will maintain effective communication and interaction between internal and external organizations to ensure standardized practices throughout the state. System improvement in combination with the continued training of judges and staff remain a critical component of our efforts in addressing domestic violence. Glenn A. Grant, J.A.D. Acting Administrative Director of the Courts

44 SECTION FOUR POST-DISPOSITIONAL RELIEFS Enforcement of Domestic Violence Temporary Restraining Orders (TROs) or Final Restraining Orders (FROs) can be pursued either through the criminal contempt process, N.J.S.A.2C:29-9b or N.J.S.A.2C:25-30, or the civil enforcement of litigant's rights under Rule 1:10-3. Under the criminal statute, violations of any restraints and certain reliefs and conditions of a restraining order require mandatory arrest and criminal prosecution. Violations of other reliefs and conditions are enforceable by the court pursuant to applicable court rules. The Family Division has jurisdiction over disorderly person's domestic violence contempt actions pursuant to N.J.S.A. 2C: 29-2b. This includes contempt charges that were initially indictable but have been downgraded by the Prosecutor's Office in the county of venue. The following section reports the data on those cases. It does not cover indictable contempts of the fourth degree and above, which are handled in the Criminal Division. ////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// DOMESTIC VIOLENCE CRIMINAL CONTEMPT FILINGS AS RECORDED IN FACTS (during Calendar Year 2013) Filings 5,613 Types of Filings New DV Contempt Cases % Downgrade (Previously Indictable) 1, % New Indictable Cases 2, % Transferred From Other Counties 15.3 % Motions to Vacate Dismissal 11.2 % ReOpened to Modify and Review % ReOpened - Successful Appeal 0.0 % Transferred Case Returned 6.1 % Cases ReActivated (Warrant Satisfied) % SOURCE:fv_annual_report/dvfile_FO_dvc ////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// DOMESTIC VIOLENCE CRIMINAL CONTEMPT DISPOSITIONS AS RECORDED IN FACTS (during Calendar Year 2013) Dispositions 5,596 Types of Dispositions Pled Guilty and Sentenced 1, % Pled NG / Contempt Dismissed / Charges Dismissed 2, % Pled NG / Contempt Dismissed / Charges Transferred 10.2 % Pled NG / Contempt Dismissed / Charges Disposed % No Plea / Found Guilty And Sentenced 52.9 % No Plea / Found NG / Contempt Charge Dismissed 24.4 % Contempt Case Disposed / Charges Transferred 1.0 % Cases Transferred To Another County % Cases Transferred To Another Court 53.9 % Cases Inactivated 1, % NOTE: NG = Not Guilty SOURCE:fv_annual_report/dvterm_FO_dvc //////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////

49 SECTION FIVE DOMESTIC VIOLENCE STATISTICS Criminal Practices Cases Filings & Dispositions A. Statewide Figures [ 2013 ]
50 SECTION FIVE Criminal Practice Cases - Filings & Dispositions A criminal case is identified as involving domestic violence when there is a charge of contempt for violating a domestic violence restraining order (N.J.S.A. 2C:29-9B) entered on the case or the case has been flagged by the Prosecutor as a case involving domestic violence. Filings include initial complaints, direct indictments and direct accusations. Indictments resulting from complaints are counted as a filing when they first enter the system as initial complaints. A disposition is the final resolution of a case. Pre-Trial Intervention (PTI) admissions are also included in these statistics. The category 'Transfer to Family' are those contempt cases that were initially identified as indictable, but have been downgraded to Disorderly Person's domestic violence contempt cases by the Prosecutor's Office in the county of venue. The Family Division has jurisdiction over Disorderly Person's (DP) contempt actions pursuant to N.J.S.A. 2C:29-2b. The category 'Transfer to Other' are those cases transferred to another jurisdiction, transferred to the Attorney General or sent to Casino Prosecution. The number of filings and dispositions are based on the FILING date and DISPOSITION date, respectively, and are independent of one another for the time period listed. ////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// DOMESTIC VIOLENCE STATISTICS AS RECORDED IN PROMIS/GAVEL (during Calendar Year 2013) Filings 12,690 Dispositions 13,935 Types of Dispositions Downgrades/Remands 5, % Dismissals 1, % No Bills % Transfers (Other) % Transfers to Family 3, % Plea to Disorderly % Pre-Trial Intervention (PTI) Admissions % Guilty Pleas 2, % Acquittal (Insane) 5.04 % Acquittal (Trials) % Guilty Trials % SOURCE: Criminal PROMIS/GAVEL data current through the end of December, 2013 //////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////

55 SECTION SIX DOMESTIC VIOLENCE STATISTICS Municipal Court Services Complaints Filings & Dispositions A. Statewide Figures [ 2013 ]
56 SECTION SIX Municipal Court Services Complaints - Filings & Dispositions The following tables provide information regarding the number of domestic violence complaints processed by the municipal courts. A complaint, which may include more than one charge, is designated a domestic violence complaint if at least one charge constitutes a domestic violence offense under N.J.S.A. 2C:25-19a. For the present analysis, a 'filed' domestic violence complaint is one that falls within the initial jurisdiction of the municipal court. This includes most domestic violence related disorderly persons and petty disorderly persons offenses. Domestic violence complaints that include indictable and other charges that statutorily fall within the jurisdiction of the Superior Court, even if filed in municipal court, are not counted. Those filings are properly reflected in the criminal section of this report. The disposition information includes all domestic violence complaints adjudicated by a municipal court. This includes all cases falling within the initial jurisdiction of a municipal court as well as cases downgraded and remanded back to municipal court by the County Prosecutor. The number of filings and dispositions are based on the FILING date and DISPOSITION date, respectively, and are independent of one another for the time period listed. ////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// DOMESTIC VIOLENCE STATISTICS AS RECORDED IN ACS (during Calendar Year 2013) Filings 24,174 Dispositions 32,690 Types of Dispositions Guilty / Merged 5, % Not Guilty % Dismissed 26, % Conditional Discharge 65.20% SOURCE: ACS Database chas/ah_family_dvreport_page1 //////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////
