2 Know the bilingual code! The district board of education shall establish language services whenever there are one or more, but fewer than 10 LEP students establish an ESL program that provides up to two periods of ESL instruction whenever there are 10 or more LEP students Establish bilingual education programs whenever there are 20 or more LEP students in any one language classification (although a district may request a waiver)

4 ESL Certification & the Highly Qualified Teacher Initiative It is entirely appropriate for ELL students who are receiving language arts literacy instruction from certified ESL teachers to receive English Language Arts Literacy credit toward graduation for that coursework.

5 World Language Graduation Requirements for High School ELLs Study of English- Limited English Proficient (LEP) students who take an additional English or English as a Second Language (ESL) class may use that second English class to fulfill the world languages requirement. Students Native Language - LEP students may use their native language to satisfy the requirement when entering the ninth grade or at subsequent grade levels as newly arrived students from their native country. Students that have been speaking their native language since a very young age and throughout their prior educational experience will satisfy the world languages requirement. Districts may do proficiency testing, if desired.

11 Annual Measurable Achievement Objectives AMAO 1 (student progress) 60 % of students will increase 0.5 composite proficiency level or more on the ACCESS for ELLs test. AMAO 2 (students attaining proficiency) AMAO 3 (district subgroup) 5% of students in language assistance programs for less than one year through four years will attain a 4.5 composite score on the ACCESS for ELLs test. 50% of students in language assistance programs for 5 years or more will attain a 4.5 composite score on the ACCESS for ELLs test. Includes district progress target for LEP subgroup in math, LAL and participation rate in each of those assessments. It also includes an additional indicator of attendance or graduation rate. 19 SEAL OF BILITERACY Biliteracy is the ability to speak, read, and write in two or more languages at a proficient level. The Seal of Biliteracy honors graduating seniors who have attained multiple language proficiencies and signals this achievement to colleges and potential employers. New Jersey and several other states are piloting the Seal as they seek legislative support and approval. Students who qualify for the New Jersey Seal of Biliteracy receive a certificate with a seal as well as an annotation on their high school transcript. The design of New Jersey's Seal, the embossing of seals and printing of certificates are being funded by NJTESOL/NJBE and FLENJ. Approximately 250 graduating New Jersey students became the first to receive the Seal in June NJ Assemblyman Fuentes is sponsoring the bill and a draft has been handed into the Office of Legislation!
