Division People and Business Division comprises four directorates: Investment Services, Information Services, Customer Experience and People and Performance. Role Overview The Regulatory Compliance Officer (Road) is accountable to the Team Leader, Compliance Unit for: a range of activities associated with the conduct of vehicle inspections, in accordance with Agency guidelines ensuring that restricted access vehicles and other vehicles operating under exemption are roadworthy and comply with permit, code of practice and gazette notice conditions/specifications enforcement and deterrent action where vehicles are operating in breach of relevant legislation, in accordance with Agency policies, procedures and guidelines may be required to undertake compliance duties in other regulatory fields, including marine which contributes to the operational safety of all vehicles on road in South Australia, protection of the community, the environment and the State s transport system. Key Outcomes of the Role The Regulatory Compliance Officer is responsible for undertaking a wide range of activities which may include all or any of the following: The role is responsible for:- Collaboration within other Units within Risk and Assurance to contribute to the strategic development of the Section s objectives Contributing to the Agency s compliance and enforcement objectives relating to road freight transport by: a) Undertaking a range of activities associated with the conduct of vehicle inspections, in accordance with Agency guidelines, to assess vehicle roadworthiness and compliance with legislation, Design Rules and relevant Codes of Practice including: Checking regulatory compliance with legislation at random and fixed checking sites. Establishing liability for causing or permitting offences. Establishing liability for offences within the chain of responsibility. Interviewing offenders and witnesses and compiling records of interview. b) Conducting vehicle inspections in accordance with Agency guidelines and legislative requirements to ensure that all vehicles, including restricted access vehicles and other non conforming vehicles operating under exemption, are roadworthy and comply with permit, code of practice, gazette notice conditions and specifications. 2

3 c) Undertaking enforcement and deterrent action in relation to vehicles operating in breach of relevant legislation and guidelines, in accordance with Agency policies, procedures and guidelines including: Issuing verbal and formal warnings, expiation notices and defect notices. Reporting offences where an expiation notice or formal warning is not appropriate. Inspecting repaired vehicles and clearing minor defect notices. Adhering to legally and technically valid methods of using fixed and portable weighing instruments. Issuing written directions to adjust mass, dimension and load restraint. Providing verbal directions for the control and management of traffic. Issuing prohibition notices to drivers who breach driving hour s regulations. Conducting follow up investigations with responsible entities in the chain of responsibility. d) Undertaking a range of activities relating to prosecution, including: Obtaining and organising evidence for prosecutions including collating and analysing data to prepare accurate reports of a high standard. Locating defendants and debtors in order to serve summonses and court documents. Attending court as a Prosecutor or witness on behalf of the Department as the complainant. e) Monitoring and ensuring the receipt of payment for vehicle inspections not conducted at the Regency Park Complex, including determining fees, taking payments, issuing receipts and paying all fees to the Registration and Licensing Cashier. f) Multi skilling in all modes of transport compliance and education activities encompassing Heavy Vehicles. Contributing to road freight safety in South Australia by: a) Conducting mandatory auditing of private enterprise bus operators and their maintenance schedules and reporting on offences that are detected. b) Undertaking special vehicle weighing tasks including preparing statements and providing evidence for SAPOL s major crash unit investigations. c) Providing transport operators with accurate and timely information on vehicle regulatory compliance regulations. d) Identifying potential and actual breaches against regulatory compliance legislation and advising of, or undertaking, appropriate necessary action to prevent continuance. e) Responding to major transport emergencies including hazardous material spill situations within State waters, where required. f) Assisting and providing specialist advice to SAPOL members at heavy vehicle accident sites and at joint operations. g) Participating in specialised training in spill response procedures and in the effective use of associated plant and equipment. h) Rendering appropriate and timely assistance to road users, where appropriate. 3

4 Contributing to meeting the Section s obligation in respect to community education, public relations and the encouragement of industry self-regulation by: a) Participating in and contributing to the development, implementation and evaluation of, customised, specialised and community based education programs and media campaigns that relate to vehicle roadworthiness and compliance. b) Addressing identified client groups and the general public in relation to vehicle roadworthiness and compliance matters. c) Participating in the development, delivery and evaluation of public exhibits and promotional material for vehicle roadworthiness and regulatory compliance. d) Liaising with strategic partner organisations on regulatory compliance matters including providing specialist technical advice and information to the general public, other areas of DPTI, SAPOL, Safework SA and Local and State Government agencies. Facilitating the effective and efficient management of the Compliance Unit by: a) Liaising with the Team Leader, Compliance Unit to identify and provide staff support including: Assisting in the mentoring, development and training of Regulatory Compliance Officers. Providing site supervision of small teams in the field as required. b) Providing regulatory compliance training and assistance with complex vehicle inspections. c) Providing a range of services, as specified in Memorandum of Understandings, for strategic partner organisations including enacting cross-authorisation powers, as required. d) Undertaking the appropriate application and interpretation of Agency procedures, processes and policies. e) Controlling and ensuring the timely and efficient maintenance and availability of equipment. f) Providing assistance in reviewing operational processes and procedures, identifying areas for improvement, implementing continuous improvement initiatives and maintaining quality systems. g) Participating in section forums, meetings and working parties, as required. h) Actively participating in unit, section and corporate risk management processes and strategic planning activities. Coordinating and supporting large operational or technical work programs, services and projects that are consistent with agency strategies, policies and priorities and deliver the Section s objectives. Supervising and training staff, coordinating resources, field-work or assets, and ensuring the standard of work quality and/or compliance with regulations, codes, and specifications. Understanding investigations, maintaining records and systems and contributing to the planning of operational work programs, services and projects and the development of reports and performance benchmarking. Providing operational advice and delivering a high level of technical or operational skills that supports the delivery of programs. 4

5 Liaising and negotiating with internal and external operational or technical stakeholders, suppliers and service providers, to support the performance of large and complex operational or technical work programs, services and projects. Supporting the development and implementation of relevant and effective policies, strategies, standards, guidelines and procedures to meet program or section goals and objectives. Ensure that a safe and healthy work environment, free from discrimination is provided for employees by: i. taking a leadership role in implementing a range of section workforce initiatives for aboriginal recruitment and retention, women in leadership, and workers compensation. ii. modelling and implementing DPTI s and the public sector s social and ethical values and standards that comply with legislative requirements and lead community expectations. iii. ensuring that respect amongst staff and colleagues is modelled, understood and that workplace diversity is embraced. iv. implementing departmental human resource policies. v. ensuring that the principles of Equal Employment Opportunity, WHS, Customer Service and Ethical Conduct are a normal part of doing business. vi. managing industrial relations issues appropriately as they arise. vii. managing industrial relations issues appropriately as they arise. Special Conditions and Essential Requirements This role has been classified as a position of trust. The incumbent is subject to a satisfactory criminal history / record check in line with departmental policies and procedures. Work outside normal hours and inter/intrastate travel necessitating overnight absences will be involved. Irregular shift work over seven day working week will be required. The location is either: Adelaide, Berri, Port Augusta, Ceduna, Mount Gambier or Yamba. Operational responsiveness necessitates work around the State. Occasional intrastate travel and work outside of normal hours, at weekends and public holidays will be required. Hours of work are 152 hours over a four week period, which may be worked on an irregular shift basis over the 24 hour day, seven days per week including public holidays. Must wear Agency uniform when required. Must be suitable to be appointed as an Authorised Officer under relevant Acts and Commonwealth Acts. A current driver s licence is essential. Qualifications / Licences Certificate 4 in Government (Statutory Compliance) or equivalent 5

6 Person Capabilities a) Demonstrated experience in contributing to a range of expert operational or technical skills to support the delivery of large and complex operational programs, services, projects and functions. b) Proven ability to work under general direction, including coordinating or contributing to large trade of field based work programs or operations, supporting operational performance outcomes and setting priorities to achieve objectives. c) Proven expert skills and knowledge in a specific complex operational or technical area, including the capacity to delivery relevant and responsive advice and information which supports the delivery of a large field-based work program. d) Experience in supervising and training operational staff, management of resources and planning and coordinating work activities to ensure satisfaction of operational performance goals and objectives. e) Well-developed communication skills, including the ability to liaise effectively at all levels, listen to staff, service providers and customers, resolve conflict, contribute to successful and positive negotiations, and formulate solutions to operational problems. f) Knowledge of the quality and risk management requirements and functions of a technical services or operational program, including an understanding of the relevant legislation and regulations that impact on the functions of the role and the Agency. g) Demonstrated ability to work respectfully and effectively with Aboriginal and Torres Strait Islander people and an understanding of Aboriginal cultural values and social issues and ensuring programs and services are accessible and meet Aboriginal community needs. a) Demonstrated commitment to the principles and practices of equal employment opportunity, customer service, ethical conduct, and an understanding of, experience in, and ability to manage to the spirit and principles of the Premier s Safety and Wellbeing Declaration and the legislative requirements of the Work Health and Safety Act 2012, utilising AS/NZS ISO31000:2009 Risk Management, or to an equivalent set of standards. b) Demonstrated commitment and ability to facilitate culture change through implementation of the Public Sector code of ethics and Professional Conduct Standards within that code, and the DPTI Values.
