2 REQUEST FOR PROPOSAL FOR A REALTOR TO MARKET North Bend School District Property Purpose of Request for Proposal The purpose of this Request for Proposal (RFP) is to identify a real estate broker who demonstrates the experience and capability in marketing property of this type for sale. Administrative Guidance This RFP is designed to provide interested respondents with basic information to submit a proposal that will meet the minimum requirements. It is not intended to limit a proposal s content or exclude any relevant or essential data. Respondents are encouraged to expand upon the minimum requirements of the RFP. However, the propos al should not exceed ten (10) pages. Property Description Newmark Lakeside Vacant land parcel, 8.09 acres North side of Newmark Street, approximately 700± feet west of Brussells Avenue In the city of North Bend, Oregon Map and Tax Lot 25S 13W 22BA 2100 Zoned for residential uses Vacant land parcel, acres North side of Rachel Road Lakeside, Oregon Map and Tax Lot 23S 12W 18BA 100 Zoned for residential uses Parcel A Parcel B A lot line adjustment of 25 ft by ft (the north edge) of the total property; Section 7, Township 23 S, Range 12 West of the Willamette Meridian, Coos County, Oregon. Tax lot 100 Remainder of said property Sunnyhill North Bay Drive Located in or near the rural community of Hauser, about 5 miles north of the city limits of North Bend, Oregon Parcel A acres, Map and Tax Lot 24S 13W 23AB 700 Parcel B acres, Map and Tax Lot 24S 13W 23AB 1000 The property comprises two sections on the south and north sides of North Bay Drive. There is a good potential for the separate marketing of the two sections. Problems of the common usage of electrical power and shared water source would have to be worked out if the two sections were to be separated. The subject property is improved with an overall average quality and generally average condition 15,911± square foot school structure that has elements with both good quality and condition. The primary original structure, with 3,959± square feet, was constructed in There have been several major expansions in 1949, 1953 and in The school was utilized more or less continuously as an elementary and multi-grade school until about 3½ years ago. It has been basically vacant since then. An additional double classroom building was constructed in 1958, slightly to the west by northwest. This onestory building has 2,757± square feet, for a total school classroom area of 18,668± square feet. The gymnasium building in the north section was built in 1956, and it has a 2
3 total area of 8,890± square feet, including an estimate for the mezzanine area. A fire station was constructed at the southwest corner of the portion of the site that lies north of North Bay Drive. The District leases the fire station and the underlying land to the North Bay Rural Fire Protection District under the terms of a lease agreement ending on July 31, The primary southern parcel, which includes the school building improvements, has 7.95 acres and the northern parcel with the gymnasium and fire station has a listed 3.44 acres. All of the land area is zoned RR-2 Rural Residential zone, except for the west portion of the main property section, with 2.32± acres, which is located in an F, Forest zone. Bangor 2121 Madrona Street, North Bend, Oregon Parcel A.33 acres, Map and Tax Lot 25S 13W 16AA 9800 and 9900 Parcel B 5.72 acres, Map and Tax Lot 25S 13W 16AD 100 Parcel C.43 acres, Map and Tax Lot 25S 13W 16AD 1000 The original school building was constructed in and there has been some expansion and remodeling to the original structure over the early years. The northern R- M zoned parcel was acquired in The Bangor Elementary School was closed as of end of term The building was expanded with six new classrooms in The western wing was elongated to the south. The northwest section of the building was originally developed with a loading dock. In 1973 a music room was built atop the loading dock. In 1974, there was a lighting and power plan upgrade. In 1991 the playground area was upgraded. The roof was rebuilt in Most of the site is zoned R-7, Residential. The northern vacant parcel that was formerly a residence is zoned R-M, also a residential zone. The subject property has the potential for a rezone to a commercial zone for the frontage along Broadway Street, possibly including the school building, and for a rezone to R-M zone for the balance of the main site. Scope of Real Estate Marketing Respondents should review the attached Request for Proposals (Attachment 1). This document will guide potential bidders for the property in developing a proposal and will be used by the District in evaluating individual proposals. The information contained in this RFP should be incorporated in all marketing efforts by the Realtor. The Realtor will be judged and selected based upon recent, relevant past experience in marketing for sale properties of this type. The respondent should have demonstrated ability in standard real estate practice and will provide written evidence of success in marketing properties of this type. It is expected that a regional marketing effort will be necessary, which will include contacts beyond the boundaries of the State of Oregon. However, if this is not successful, a national marketing effort may be required. A respondent submitting a proposal that limits marketing efforts to Oregon will be considered only if the respondent can demonstrate success in past efforts for properties of this type. The respondent should explain specifically how the properties will be marketed. This marketing plan will be given considerable weight in the selection of the Realtor. Creativity as well as use of standard marketing real estate practices will be judged. Creative marketing may be necessary in order to find a successful purchaser. The proposal should include a proposed compensation package and a sales contract that specifies the agreement proposed between the Realtor and District. This compensation package will be an important factor in determining the successful respondent. Respondents should have demonstrated excellent personal skills and expertise. 3
4 Listing contract will be for an initial term of six (6) months with renewal at the option of the District. Exclusion: The District, as part of the agreement, reserves the right to exclude one potential buyer for any piece of property, or any portion of the properties to be marketed, from the terms of the agreement. The potential buyer will be disclosed upon finalization of an agreement with the selected realtor. If the District and undisclosed potential buyer reach an agreement to sell during the term of the listing contract the District will pay an alternative commission to the selected realtor at a rate of ½ of 1% times the number of months the property has been listed with the realtor up to a maximum of 2.5%. Response Date Four copies of the proposal must be received by North Bend School District, 1913 Meade Street, OR The deadline for receipt of proposals is November 3, 2004 at 4 p.m. Late proposals will not be accepted or read. It is the responsibility of the proposer to ensure that their proposal is received at the correct location on time. Any proposal may be withdrawn or modified prior to acceptance. After the deadline for receipt of proposals, a proposer may neither withdraw or modify its proposal. However, notwithstanding the above, the District reserves the right, at the sole discretion of the District, to request additional information and permit modifications of proposals if the District believes that such modifications will be in the best interest of the District and that competition will not be substantially altered. Bidders may request a tour of the properties by calling to schedule an appointment with Jessica Walser, District office at , between the hours of 8 a.m. and 5 p.m. Monday through Friday. If bidders request a tour of the properties, the tour must be requested and held before the deadline for receipt of proposals. Reservation of District Rights The Board of Directors of the North Bend School District No. 13 hereby expressly reserve the following rights: 1. To award a contract based upon the proposals received, without further discussion of such proposals; 2. To hold a personal interview with the agent(s) who would be assigned to market the District s property; 3. In the District s full discretion, to reject any or all proposals; 4. To cancel this request for proposals at any time; 5. To make the award based upon its best judgment as to which proposal best meets the District s needs and expectations; 6. To make such changes or corrections in this RFP as the District may deem necessary or desirable prior to the deadline for receipt of proposals. Proposers will be notified of any such changes in writing by addenda mailed to the responsible person designated by each proposer. All proposers must insure that the District has the name, address, phone, and fax number of the responsible person for their firm to receive addenda. 7. The District reserves the right, at the sole discretion of the District, to waive minor irregularities during the proposal process or in the response to the RFP submitted by any proposer. Failure to meet the deadline for submitting proposals will not be waived. 4
5 Required Submittals Respondents should submit the following documentation: (A) A proposal following the format in Exhibit A Request-for-Proposal Required Format (B) Any additional information the respondent feels will strengthen the proposal. Evaluation Criteria Each respondent should follow the attached required format. The evaluation of proposers will be made by those parties selected by the North Bend School District. The evaluation will include a complete review of all documents submitted and may include a meeting with selected agents to review their proposals. The Board of Directors of North Bend School District No. 13 will make the final decision on hiring a proposer. All proposals will be carefully considered by the North Bend School District and will be rated according to the following criteria: Recent, relevant past experience in marketing land/facilities of this type (10 points) Creative marketing plan (10 points) Compensation being requested (20 points) Experience in dealing with public entities and/or local government (10 points) Total possible points = 50 In those cases where it is felt that a clearer understanding of the proposal is in order, the District reserves the right to invite one or more proposers to present their proposals, in person, to either those parties selected by the North Bend School District to evaluate the proposals or to the Board of Directors of the North Bend School District. THE DISTRICT ACKNOWLEDGES THAT THERE MAY BE SOME SUBJECTIVITY IN EVALUATION OF THE LISTED CRITERIA. EVERY EFFORT WILL BE MADE BY THE DISTRICT TO BE IMPARTIAL AND FAIR IN THE EVALUATION PROCESS. THE DISTRICT RESERVES THE RIGHT TO REJECT ANY OR ALL PROPOSALS. 5
