5 As directed by the Order to Mediate from the Court, we will discuss all the issues before the court and we will faithfully work towards a Mediated Agreement. UThis means that your Mediated Agreement will be used to direct the Final Orders of the court and the successful mediation will stand in place of the trial and the parties avoid potentially protracted and costly litigationu. A few things that I always wish to inform the parties UYou are a active participate in the mediation and the decisions.u UThe only persons in the mediation session will be the parties, the attorneys, and the mediator.u No other persons are allowed. In 1987 the legislature of the State of Texas passed and established the Alternative Dispute Resolution Act. The ADR Act of 1987 allows parties to Umediate a Mediation Agreement that is irrevocable. What to bring to mediation? NOTE: I cannot express to you the importance of accurate information and documentation. It is expected that you will come prepared with accurate information and documentation.
