2 PROPOSAL August 31, 2015 PROJECT: Westchase District Monument Signs Replacement of vinyl and acrylic sections at 41locations Westchase District BID TO: Richmond Ave., Suite 1175 Houston, Texas The undersigned, in compliance with your proposal solicitation for the replacement of the vinyl and acrylic for 41 Westchase District monument signs, having examined the specifications with related documents and having carefully read same and having visited the sites locality, and all local conditions and laws and regulations that in any manner may affect cost, progress, performance of furnishing of the Work. hereby proposes to furnish all labor, hauling, materials, apparatus, machinery, tools, and supplies, and to construct the project in accordance with the contract documents within the time stated herein and at the prices stated below: SUBMITTED BY: TITLE: COMPANY: ADDRESS: TELEPHONE: DATE: BASE BID: proposed to all furnish all labor costs, mobilization, materials, construction equipment, tools, construction facilities, and temporary controls, and other services necessary for the construction, accomplishment and completion of the Project in a workmanlike manner, in accordance with the Contract Documents, in the Lump Sum amount of: Dollars Amount written In Words (This Governs) ($ ) Amount in Numbers A bid bond or cashier s check in the amount of 5% of the total bid amount must accompany each bid. Bids without a bid bond or cashier s check will not be accepted. The successful bidder will be required to provide a payment bond as outlined in Exhibit B for the full amount of the contract only if the bid including any alternates exceeds $25,000. The selected contractor should carry insurance limits as outlined in Exhibit C.

No bid shall be withdrawn within ninety (90) days after opening of bids without consent of the Owner. The Owner reserves the right to reject any bids and to waive any informalities in bidding. The owner does not bind itself to accept the lowest Bid or any part thereof, and reserves the right to ask for new Bids for the whole or parts. The competency and responsibility of the Bidders will be considered in making an award. A decision concerning award of Contract will be made public as soon as practicable. Bids will be privately opened. No bids will be considered after the designated Bid Time. In submitting this bid, it is understood that the right is reserved by the Owner to reject any and all bids.

THE CONDITIONS OF THIS OBLIGATION ARE SUCH THAT: WHEREAS, the Contractor has on or about this day executed a contract in writing with Westchase District dated day of, 2015 for, all of such work to be done as set out in full in said Contract Documents therein referred to and made part of this instrument as fully and completely as if set out in full herein. NOW THEREFORE, if the said Contractor shall pay all claimants supplying labor and materials to him or a subcontractor in the prosecution of the Work provided for in the Contract, then, this obligation shall be void; otherwise the same is to remain in full force and effect; PROVIDED HOWEVER, that this bond is executed pursuant to the provisions of Article 5160 of the Revised Civil Statutes of Texas, as amended, and all liabilities on this bond shall be determined in accordance with the provisions of said Article to the same extent as if it were copied at length herein. Surety Companies executing bonds must have a rating of at least B+ in the current Best Key Rating Guide or appear on the Treasury Department s most current list (Circular 570 as amended) and be authorized to transact business in the State of Texas. If the amount of the bond exceeds $100,000, the Surety must also: (1) hold a certificate of authority from the United States Secretary of the Treasury to qualify as a surety on obligations permitted or required under federal law; or (2) have obtained reinsurance for any liability in excess of $100,000 from a re-insurer that is authorized and admitted as a re-insurer in this state and is the holder of a certificate of authority from the United States Secretary of the Treasury to qualify as a surety or re-insure on obligations permitted or required under federal law. 6 Exhibit C Contractor Insurance Requirements 1) Commercial General Liability a) Commercial General Liability with limits of insurance of not less than $1,000,000 Each Occurrence, $2,000,000 Products/Completed Operations Aggregate, $1,000,000 Personal & Advertising Injury, $100,000 Fire Damage Limit (any one fire), $5,000 Medical Expense (any one person) and $2,000,000 General Aggregate. b) Commercial General Liability coverage shall cover liability arising from premises, operations, independent contractors, products-completed operations, and personal and advertising injury. c) Owner shall be included as additional insured on the Commercial General Liability. This insurance for the additional insured shall be as broad as the coverage provided for the named insured Contractor. It shall apply as primary and non-contributory insurance before any other insurance or self-insurance, including any deductible, maintained by, or provided to, the additional insured. d) Contractor shall maintain Commercial General Liability coverage for itself and Owner for the duration of the project and maintain Completed Operations and Products Liability coverage for itself and each additional insured for at least 2 years after completion of the Work. 2) Automobile Liability a) Business Auto Liability with limits of at least $1,000,000, Bodily Injury and Property Damage each accident Combined Single Limit. b) Business Auto coverage must include coverage for liability arising out of all owned, leased, hired and non-owned automobiles. c) Owner shall be included as additional insured on the auto policy. This insurance for the additional insured shall be as broad as the coverage for the named insured Contractor. 3) Commercial Umbrella/Excess Liability a) Umbrella limits must be at least $1,000,000 each occurrence, and $1,000,000 Aggregate. b) Umbrella coverage must include Owner as additional insured on the Commercial General Liability and the Auto Liability. c) Umbrella coverage for such additional insured shall apply as primary and non-contributory insurance before any other insurance or self-insurance, including any deductible, maintained by, or provided to, the additional insured other than the Commercial General Liability and Auto Liability coverages maintained by the Contractor. 4) Workers Compensation and Employer Liability a) Workers Compensation with statutory limits for state in which work is performed. b) Employers Liability Insurance limits of at least $500,000 each accident for bodily injury by accident and $500,000 each employee for bodily injury by disease. c) Where applicable, U.S. Longshore and Harbor Works Compensation Act Endorsement shall be attached to the policy. d) Where applicable, the Maritime Coverage Endorsement shall be attached to the policy. 5) Waiver of Subrogation Contractor s Commercial General Liability, Automobile Liability, Umbrella Liability and Workers Compensation policies shall be endorsed to waive all rights against Owner and its agents, officers, directors and employees for recovery of damages to the extent these damages are covered by commercial general liability, commercial umbrella liability, business auto liability or workers compensation and employers liability insurance. 6) Notification of Cancellation, Non-Renewal or Material Change in Coverage

Attached to each certificate of insurance shall be a copy of the Additional Insured Endorsement that is part of the Contractor s Commercial General Liability Policy, Auto Liability Policy and Umbrella/Excess Liability Policy.
