3 1.0 Introduction Freelancers, for the purpose of this code of practice, are considered to be a component of the Metro Broadcast Ltd workforce. Where a Freelancer is clearly working under the direction of the employers or employer s agent, they are employees for the purpose of health and safety. Where a Freelancer is clearly not working under this direction, but is responsible for organising or scheduling their own work/equipment, and is taking a business risk, they are not likely to be an employee for health and safety purposes. Metro Broadcast Ltd will comply with all the statutory obligations, which apply to Freelancers and the self employed working on fixed or temporary contracts that are providing services in a personal capacity. 2.0 Method Statements Metro Broadcast Ltd has issued / will issue Generic method statement to all Freelance staff that describes the methods and work practices used for the safe and efficient installation operations of Metro Broadcast Ltd. These method statements will be also be made available to clients. 3.0 Risk Assessments Metro Broadcast Ltd has issued / will issue a risk assessment to all clients that describes the hazards, risks and subsequent control measures used for the safe and efficient installation operations of Metro Broadcast Ltd. This risk assessment will be made available to Freelance staff. Metro Broadcast Ltd have conducted a series of Generic, task based risk assessments, copies of which shall be made available to all freelance crew upon joining the company. The risk assessments have identified generic tasks that crew are likely to carry out at the majority of Metro Broadcast Ltd venues / sites and the hazards associated with them. The subsequent control measures implemented to reduce the likelihood of these hazards producing risk of injury are the preferred systems of work that Metro Broadcast Ltd expect staff and crew to adopt. Specific risk assessments are conducted for tasks or activities that are not covered in the generic risk assessments. If a venue / site / location pose additional risks to those risks covered in the generic risk assessments, then control measures to reduce risk shall be included in a specific risk assessment. In all cases, Freelance staff shall be expected to read, understand and implement the findings of all risk assessments produced by Metro Broadcast Ltd. Failure to do so may result is the Company refusing to use Freelance contracted staff.
4 4.0 Responsibilities Metro Broadcast Ltd Responsibilities Metro Broadcast Ltd Project Managers/Lead Technicians will have overall responsibility for liaising with client representatives and venue/location staff. Metro Broadcast Ltd Project Manager/Lead Technicians will have overall responsibility for ensuring site specific health, safety and environmental procedures are followed. Freelance Staff Responsibilities Freelance staff will be expected to demonstrate a level of knowledge and experience that enables them to work in a safe manner while unsupervised. Freelance staff will: Take reasonable care of themselves and others who may be affected by what they do. Co-operate and co-ordinate their activities with the Project Manager/Lead Technician. Work within the limits of their competence and experience. Raise any Health and Safety concerns with the Project Manager/Lead Technician or site Supervisor. Ensure that they are aware of all site rules and production safety procedures and are able to follow them. Ensure that the significant findings of any risk assessment and associated control measures are understood and followed as appropriate. Use machinery, tools and equipment in a safe manner and do not use any unauthorised equipment on site. Inform the Project Manager/Lead Technician of any accidents or near misses as soon as possible. 5.0 Safe Systems of Work Freelance staff, when working on a company site / venue / location shall: Weigh up whether the satisfactory control measure identified within a risk assessment in place are adequate. Plan work in advance. Work within their capabilities.
5 Pass on any information to the Project Manager/Lead Technician that may affect the health and safety of site personnel. The hazards that are expected to be experienced during installation and operation works will include, but are not limited to the following: Electric shock Falling from a height Falling objects Manual lifting Driving vans Control Measures Freelance staff will abide by the various control methods available to minimise the risks arising from installation and operation works. The control methods include, but are not limited to the following: Each Freelancer will be responsible for ensuring that they have had adequate rest (11hrs is standard practice) to competently undertake work at metro or drive a vehicle. (for clarity do not undertake to drive on behalf of Metro if you have not had an adequate nights sleep) Only suitable trained personnel are allowed to work on electrical installations. Ladders to be correctly sized and used according to accepted practice. Ladders are to be supported by a second person footing the ladder. Areas below overhead work will be physically demarcated, creating an exclusion zone where necessary. Lighting and spotlights will be secured with safety bonds. Safe methods of lifting including team lifting will be used. Personal protective equipment will be worn according to the requirements of the work. Vehicles will be loaded/unloaded and driven in a safe manner and copies of a current driver s license must be provided. 6.0 Insurance Freelancers will carry the sufficient public liability insurance (preferably with cover to
6 7.0 Experience / Qualifications Freelancers will provide information as required regarding: Previous work for clients / other organisations Membership of trade associations Evidence of training undertaken 8.0 Standards Freelancers will agree to observe the following standards: 1. Identification must be worn or carried that clearly identifies personnel as Metro associates. 2. Staff will be polite and courteous at all times. 3. The consumption of alcohol is prohibited during work hours. 4. Smoking is not permitted in any work areas. 5. Suitable clothing will be worn as appropriate (show blacks or suit). 6. No visible body piecing(s)/tattoos other than single rings or studs. 7. Ensure work area is left clean and tidy upon completion of work. 9.0 Declaration To be signed and returned by the Freelancer.
