2 Family Day Care Australia was formed in 1988 to provide effective advocacy and promotion of the family day care sector nationally. We are the national peak body which supports, enhances and resources family day care services. From lobbying government and partnering with leading academics on ground breaking research projects to promoting and positioning the sector as the option of choice in early childhood education, to sourcing and delivering essential member services, we are a not for profit organisation dedicated to the needs of our members.

For new educators just getting started we offer 3 and 6 month kick start packages. The following pages are a summary of our recommended packages for family day care, in home care and out of home care. Family Day Care Australia 3

4 Family Day Care package (also suitable for educators who provide family day care PLUS in home care) Out of Home Care package (suitable for educators who provide family day care PLUS out of home care) The Family Day Care package is for educators who run a traditional family day care, that is, the provision of early childhood education and care for children in their home/ residence. This package is also suitable for educators who run family day care AND in home care. To meet the needs of family day care educators this package includes the mandatory Public Liability Insurance in addition to Personal Accident Insurance for Children in the event of an accident and, Educator Management Liability Insurance (Statutory Liability) in the event of an infringement notice for a breach of the new National Regulations. For full details of each of the policies included refer to pages 7-10 of this booklet. The Family Day Care Recommended Package includes: Family Day Care Australia Membership Public Liability Insurance Personal Accident Insurance for Children Educator Management Liability Insurance (Statutory Liability) Also available as a 3 or 6 month kick start package for new educators. See page 6 for package pricing details. The Out of Home Care Package includes the same policies as the Family Day Care package however the Public Liability Insurance has a specific extension to cover the provision of out of home care (OOHC). OOHC refers to the provision of care through your family day care service, on a fee for service basis for children placed by a private or government agency which holds legal guardianship of the child, and where the care is for periods greater than 12 continuous hours. It does not apply to those providing regular family day care for children placed by their parents, nor does it apply to those who provide foster care on an individual private basis, arranged outside of their family day care service. The policy extension acknowledges and accounts for the specific needs of children and young people in OOHC creating a different child protection environment with additional perceived risk to children and educators engaged in OOHC. This package is the recommended package for anyone providing OOHC and is suitable for educators who provide family day care AND out of home care. 5 In Home Care package (for in home care only) The In Home Care package is specifically designed for educators who provide approved care in the child s home only, commonly known as in home care. The package includes the mandatory Public Liability Insurance in addition to Personal Accident Insurance for Children in the event of an accident. The In Home Care Package does not include Educator Management Liability Insurance (Statutory Liability) as in home care does not currently fall under the new National Regulations. 6 Package Pricing Detailed below are our new member package pricing rates. To know which package is best for you, read the package information on pages 4-5. Please note that prices vary slightly between states and territories due to jurisdictional taxes and charges. The prices below are member package rates, individual products and/or customised packaging is available, as are non member rates, however both incur additional surcharges. If you advise us in writing within 14 days of the inception date of the policy and no care has taken place, we will refund the full premiums of certain products less a cancellation fee of $ Beyond this 14 day term, Membership, Telephone Legal Advice, Personal Accident for Children and Kick Start Packages are non refundable. A proportion of your Public Liability Insurance may be eligible for refund beyond the 14 day term, less fees, commissions and government charges. 7 About Our Insurances Public Liability Insurance Public Liability Insurance is mandatory for all family day educators, in home carers and out of home care providers. It protects you in the event that you are held liable for third party property damage, injury to children in care or injury to any member of the general public that arises from the provision of the service. Without public liability insurance you could be personally liable for damages and/or compensation in the event of an injury to a child, a 3rd party or for property damage. 3. $10 million Landlord s Liability Indemnifies property owners and/or body corporate of rented properties from which the child care is conducted provided that such an indemnity only extends for claims arising out of the child care business. 4. $10 million Products Liability Covers civil liability for bodily injury or damage to property involving the use of products supplied by your family day care and/or in home care business (subject to terms and conditions). Public Liability Insurance Key benefits of our Public Liability Insurance 1. Protection A public liability claim can be made against you even after a child has left your care and potentially up to the age of 21. Our policy offers what is referred to as claims occurring cover (as opposed to claims made cover). When comparing policies this is an important benefit! 2. $10 million Public Liability* Protects educators where they are held liable for third party property damage, injury to children in care or injury to persons where the injury occurs in connection with the provision of family day care or in home care. *$20 million cover is available if required please contact FDCA for details. 5. $10 million Educator Errors and Omissions (Professional Indemnity) Covers civil liability for any claim arising from a negligent act or omission made in the course of providing family day care and/ or in home care. 6. $50,000 Criminal Defence Insurance This covers legal costs associated with the defence of a successful criminal prosecution brought in relation to your child care business. 8 Personal Accident Insurance for Children Personal Accident Insurance for Children It s a fact of life that children have accidents. Fortunately, most accidents amount to little more than a scrape or a knock. But if it s a little bit more serious, and when a child is injured in your care, the parent may very well ask you to help pay the bills. Medical and out of pocket expenses incurred by the child s parents are typical of the types of costs incurred when a child is injured. Without Personal Accident Insurance for Children you may be personally liable for costs associated with the injury of a child in your care. Your Public Liability policy will only respond to negligent claims for which you are held liable. Key benefits of our Personal Accident for Children Insurance 1. Medical expenses cover The policy will cover you for expenses incurred by parents as a result of an injury to children in your care up to a maximum of $2,000 for any one claim. 2. Capital benefits cover The policy will provide for a lump sum payment to parents for certain injuries that occur to children while in your care up to a maximum of $10,000. Product Disclosure Statement (PDS) Group Personal Accident Policy - FDCA Personal Accident Insurance for Children Accident & Health International Underwriting Pty Limited, ABN , AFS Licence no , is an underwriting agency specifically created to provide Personal Accident, Medical and Travel insurance. They have been in operation since March 1998 and act on behalf of CGU Insurance Limited, ABN , AFS Licence no , with full authority to quote and issue contracts of insurance, collect premiums and pay claims. If you have any queries about this policy you should contact A & H International. Their contact details are in this document. The Insurer The Insurer of the Policy is CGU Insurance Limited. What is a Product Disclosure Statement This Product Disclosure Statement (PDS) contains information about the policy including the benefits and conditions, your rights as a client and other things you need to know to assist you to make an informed decision when choosing your insurance. In this PDS: we, our or us means CGU Insurance Limited. you means the person who will be named in the policy schedule as the insured and any person nominated by you from time to time for the insurance cover selected by you and for which the premium has been paid. The type of cover chosen will be set out on the policy schedule. Key Features of the Policy We will pay you up to $10,000 for Death & Capital Benefits and $2,000 towards incidental expenses and Non-Medicare costs incurred by a child in your care or the child s family for a claim resulting from an accident during the currency of the policy. The accident must occur to a child while under the care of a registered Family Day Care or In-Home carer, and the expenses must arise within twelve (12) calendar months from the date of the accident. The Most We Will Pay The most we will pay for all claims under this Policy during any period of insurance is set out under the Limit of Liability in the policy schedule. Once the Limit of Liability has been paid, you will need to pay us further premium to reinstate the policy cover. What You Are Not Covered For There are certain times when there is no cover under the Group Personal Accident policy which means we may refuse to pay your claim. Specific Exclusions are listed in the Policy Wording. The Cost of Your Policy and Paying For Your Insurance The cost of your policy will be shown on the quotation provided, once all required information has been received. The cost of your policy is calculated based on number of persons involved, claims experience and other information relative to the particular risk. The cost of the policy is made up of premium, government taxes such as Goods & Services Tax (GST) and stamp duty, where applicable and fees. Your Duty of Disclosure When you apply for insurance you need to tell us certain information which would affect our decision to insure you. If you do not give us this information it may affect your policy. The duty of disclosure appears in full below; please ensure you read this duty. The duty of disclosure notice will also appear on your renewal invitation and the duty of disclosure also applies to any endorsements or variations you ask for. Before you enter into a contract of general insurance with an insurer, you have a duty, under the Insurance Contracts Act 1984, to disclose to the insurer every matter that you know, or could reasonably be expected to know, is relevant to the insurer s decision 8 EDUCaTOR InSURanCE FOR family day care, in home care and out of home care

9 whether to accept the risk of the insurance and, if so, on what terms. You have the same duty to disclose those matters to the insurer before you renew, extend, vary or reinstate a contract of general insurance. Your duty however does not require disclosure of matter: that diminishes the risk to be undertaken by the insurer; that is of common knowledge; that your insurer knows or, in the ordinary course of his business, ought to know; as to which compliance with your duty is waived by the insurer. Non disclosure If you fail to comply with your duty of disclosure, the insurer may be entitled to reduce his liability under the contract in respect of a claim or may cancel the contract. If your nondisclosure is fraudulent, the insurer may also have the option of avoiding the contract from its beginning. Making A Claim and Your Franchise Amount A franchise amount applies if you make a claim under this policy. A franchise means that any claims under the franchise amount will not be paid, but if the claim is greater than the franchise amount, the entire claim will be paid. The franchise amount is stated in the Schedule. If you need to make a claim please send a written notice of claim to A & H International within 30 days of the date of the Injury occurring. A & H International will send you a copy of their claim form which will need to be fully completed. We will not be responsible for any payments under the policy unless this form is fully completed and returned. Any costs involved in the collection of information for the form are your responsibility. If you are not happy with any decision and it relates to a claim, you may take your complaint to the Financial Ombudsman Service Limited (FOS), an independent and external dispute resolution body subject to eligibility. Access to the FOS process is free of charge to you. We use the information you provide us to quote on your application for a policy, to provide the insurance, administer the policy and assess and manage any claims. We only provide personal information to our underwriters and reinsurers (and their representatives) and those we appoint to assist us with claims under your policy. If you do not provide us with full information, we cannot properly quote for your insurance and we cannot insure you. You can check the personal information we hold about you at any time. Such application should be directed to A & H International in writing where it will be considered by their internal Privacy Disputes Department. If you provide us with personal information about anyone else, we rely on you to have their consent if you will be providing their information to us, and that you have told them to whom we may provide it, the purposes for which we will use it and that they can access it. If the information is sensitive, we rely on you to have obtained their consent on these matters. For more information about our Privacy Policy, please visit our website to obtain a copy: Personal Accident Insurance for Children Cooling-Off If you decide that you do not want the policy, you have a cooling off period of 21 days from the date the policy was issued to cancel the policy. You must tell us in writing that you wish to cancel the policy and we will repay the full amount of premium to you. You cannot use this cooling-off period if the policy has already expired or if you have made a claim under it. Dispute Resolution We and A & H International will do everything possible to provide a quality service to you. 10 Educator Management Liability Insurance Educator Management Liability Insurance (Statutory Liability) The introduction of the new National Quality Framework brings with it significant changes to the early childhood education and care sector, many of which have significant impact on being an educator. One such change is that under the new National Law and National Regulations, a new legal framework exists whereby Regulatory Authorities will monitor education and care services. The National Law provides Regulatory Authorities with a broad range of options to enable appropriate and proportionate enforcement responses to non compliance with the regulations, including the issuing of fines. In short, educators are exposed to the risk of fines for non compliance with the new regulations. To protect and alleviate the concerns of our members, Family Day Care Australia has sourced and included as part of our recommended package of insurance cover, a new and unique Educator Management Liability Insurance (Statutory Liability) policy. How much am I covered for? Your policy provides up to $2,500 cover, in total, for each 12 month policy term. Infringement notices can be issued for an amount of up to 10% of the maximum penalty that can be imposed for breaches and infringements. For educators penalties will most often range between $1,000 and $20,000, therefore the policy will cover a 10% infringement notice being issued on high range infringements. Obviously cover is always subject to the terms and conditions of the policy. How much is the excess? There is no excess. Key benefits and frequently asked questions about Educator Management Liability Insurance What is Statutory Liability and why do I need insurance? Statutory liability is a legal term that relates to being held responsible for your actions in relation to breaches of the law. Businesses often insure themselves against certain fines and penalties that result from an accidental breach of civil law. You cannot insure criminal fines and penalties. How does FDCA s Educator Management Liability Insurance protect me? This policy provides peace of mind protection in the event that you are subject to a fine or penalty for non compliance under the Education and Care Services National Law Act 2010 and the National Regulations. Isn t Educator Management Liability (Statutory Liability) covered as part of my Public Liability Insurance policy? Most Public Liability Insurance policies (including FDCA s) do include a form of statutory liability cover. However, in order to make a claim under the Public Liability policy the fine or penalty must be linked to a public liability claim against you, meaning that the claim must be a third party claim for bodily injury or property damage. In many cases the Public Liability policy will not protect you for penalties under the new regulations as infringements are unlikely to be associated with a public liability claim. 10 EDUCaTOR InSURanCE FOR family day care, in home care and out of home care

Who we are and who we act for Family Day Care Australia Limited (FDCA) ABN AFSL is the national association for family day care. As an insurance broker we act on your behalf. FDCA has appointed Imalia CareCover Pty Ltd (Imalia CareCover) to act as our authorised representative (AR ). Imalia Care- Cover acts on behalf of FDCA, and therefore also acts on your behalf. 2. Types of services we provide We can provide general product advice and arrange general insurance products. Imalia CareCover is authorised to provide general advice on, and (deal) in, Public Liability Insurance, Management Liability Insurance, Personal Accident Insurance for Children and Carers, Property and Motor Insurance. Imalia CareCover carries out the day to day policy administration and management activities on behalf of FDCA. Any advice we provide is general in nature and we do not take into account your personal needs or financial objectives. Before you decide to purchase general insurance products from us you need to consider if the advice and relevant product is right for your circumstances as we have not done this. We act as a referrer only for Income Protection and Superannuation. In making any referral we do not advise or represent that their products and services are right for you and take no responsibility for the products and services they may provide to you. You need to make your own decision based on the information they provide. Premium funding is available for certain FDCA products and enables you to spread your payment over instalments rather than pay it in a lump sum; however you will have to pay a fee to the premium funder. When we offer you premium funding we act on behalf of the premium funder, not you. We do not provide personal advice or represent that any of the funder s products and services are right for you or that they are the most appropriate. You need to make your own decision based on the information provided. 3. Your Duty of disclosure Before you enter into a contract of general insurance with an Insurer, you have a duty under the Insurance Contracts Act 1984, to disclose to the Insurer every matter that you know, or could reasonably be expected to know, is relevant to the Insurer s decision whether to accept the risk of the insurance and, if so, on what terms. You have the same duty to disclose those matters to the Insurer before you renew, vary or reinstate a contract of general insurance. Your duty however does not require disclosure of any matter that diminishes the risk to be undertaken by the Insurer, that is of common knowledge, that your insurer knows or, in the course of their business ought to know, as which compliance with your duty is waived by the insurer. NON-DISCLOSURE AND MISREPRESENTATION If you fail to disclose any matter, which you were under a duty to disclose to the insurer or you made a misrepresentation to the insurer before this Policy was entered into, the Insurer may be entitled to reduce its liability under the Contract in respect of a claim or may cancel the contract. If your non disclosure is fraudulent, the Insurer may also have the option of voiding the contract from its beginning. Contracts of Insurance are subject to the doctrine of utmost good faith. Failure to adhere to this may prejudice any claim. 4. Product Disclosure Statement If you ask us to arrange personal accident insurance for carers or children, motor vehicle or home and contents insurance we will provide you with a Product Disclosure Statement (PDS) unless you already have an up to date version. It is prepared by the insurer and is designed to help you make an informed decision about the financial product. 5. Insuring the interest of other parties If you require the interest of a party other than the named insured to be covered, you MUST request this. Most Policy conditions will exclude indemnity to other parties. 6. Change of risk or circumstances It is important that you advise us of any location changes, business activities or any departure from your normal form of business. 7. Terms of the insurance contract By taking out this insurance you agreed that: a) You have read and understood FDCA s Financial Services Guide and Duty of Disclosure, Privacy Policy and the relevant Product Disclosure Statements if Personal Accident for Children or Carers, Motor Vehicle and Home & Contents insurances have been selected. b) You have read and understood the Payment and Instalment Plan Terms and Conditions and you agree to be bound by these Terms and Conditions. c) You authorise FDCA (ABN ) to give to or obtain from any relevant authority any information relating to the status of the insurances you have selected. d) You understand that: i) any statement made in the application will be treated by us as a statement made by all the people insured ii) the insurance/s and membership are only valid if you are registered with an Australian Government Funded Family Day Care scheme or In-Home Care service e) If you are a FDCA member, you agree to be bound by the constitution and by-laws of FDCA f) The insurance/s and membership are non-transferable g) FDCA may retain up to $30.00 (inc. GST) for administration fees, cancellation expenses, policy variation and/or dishonour fees.

Insurer s rights following a claim Under the policy the insurer is entitled on the happening of any accident, injury, loss or damage to undertake in your name and on your behalf the conduct, control and settlement of any proceedings and to take proceedings at their own expense and for their own benefit but in your name to recover property or secure indemnity or contribution in respect of anything insured in this Policy. 9. Insurers Your Insurances are only arranged with Insurers that are authorised under the Insurance Act 1973 to conduct insurance business in Australia. Although the insurers are subject to the supervision of the Australian Prudential Regulation Authority (APRA), we are not in a position to guarantee that any insurer will at all times be in a position to pay claims as and when they occur and we disclaim any liability for losses that you may not be able to recover from your insurer/s. 10. Access to your information and privacy We maintain a client record which includes information about insurance policies that we have arranged for you. We are committed to protecting your privacy and only use your personal information for insurance services or ancillary member services. We only provide personal information to our insurers or those providing claims services, your family day care coordination unit, the premium funder and your landlord (if applicable). We will not trade, rent or sell your information. A full copy of FDCA s privacy policy is located on our website If you wish to examine your file or have a copy of FDCA s privacy policy mailed to you, please ask us. We require all instructions from you in writing by letter, or fax. 11. Payment for our services When we place insurance for you we receive commission from the insurer (including renewals and some variations to the policy). The commission is a percentage of the insurer s base premium (i.e. excluding stamp duty, fire services levy, GST or any other government charges, taxes, fees or levies). The commission rate varies between 0-30%. Different insurers can agree to pay us different commission rates for the same type of products. The rates also vary for each product type. FDCA pays to Imalia CareCover a fee of 30% for the policy administration and management services it provides to us. We receive between 0-30% commission from Income Protection and Superannuation referrals. The commission does not represent our profit margin as it also reimburses us for administrative and other expenses we incur in providing our services. The commission is included in the premium amount detailed on your invoice and we receive it when you pay the premium or at a later time as agreed with the insurer. You may cancel your policy at any time and under certain circumstances, you may be eligible for a refund. If you advise us in writing within 14 days of the inception date of the policy and no care has taken place, we will refund the full premiums of certain products less a cancellation fee of $ Beyond this 14 day term, Membership, Telephone Legal Advice, Personal Accident for Children and Kick Start Packages are non refundable. A proportion of your Public Liability Insurance may be eligible for refund beyond the 14 day term, less fees, commissions and government charges. No refunds are available on the Educator Management Liability Insurance Policy. We also have standard administration/policy handling fees which are charged in addition to the premium for the insurance to cover the cost of services for preparation and distribution of FDCA documentation and other services we provide to our members. The FDCA fee ranges between $0-$300 per policy and is noted in the documentation we send you. They are non-refundable. If you pay annually and cancel or vary your insurance package mid-term, FDCA will retain $25 (including GST) for our expenses in relation to If we have an agreement from you to direct debit your account and the agreed payment dishonours, we will charge you $30 (including GST) for our expenses in relation to the dishonour. If you are not a member of FDCA we will charge you a non-member fee of $ to arrange your insurance packages. All commission and fees assist to support the work of FDCA. When you pay us your premium it will be banked into our trust account. We retain the commission from the premium you pay us and remit the balance to the insurer. We may earn interest on the premium while it is in our trust account and retain any interest earned on the premium. If we arrange premium funding for you we are paid a commission of between 0-3% of the funded premium. From time to time FDCA provide sponsorship and/or financial support to various Associations and co-ordination units of up to 10% of the annual premium. 12. Cooling off period A cooling off period may apply to an insurance policy issued to you as a retail client. During the period you may return the policy. If a cooling off period applies to your policy the details of your rights are included in the relevant Product Disclosure Statement. 13. Potential Conflicts of Interest FDCA and its staff may also receive soft dollar benefits from insurers and other service providers and can include entertainment or small gifts. There are no other associations or relationships with insurers which may influence us in providing our services. 14. Complaints Policy FDCA have developed a Complaints and Dispute Resolution Process which is fair, efficient and accessible to all our clients. If you would like to make a complaint about the services provided by FDCA or Imalia CareCover you should telephone FDCA on freecall If we are unable to resolve your complaint they will request that you put your complaint in writing for referral to the Complaints Officer. The Complaints Officer will respond to your complaint in writing no later than 10 business days, provided we have all the information necessary to deal with your complaint. If the complaint is not resolved to your satisfaction you can refer the matter to the Financial Ombudsman Service Limited (FOS) which is a national scheme for consumers. Limited (ABN ) to offer business loans to its member educators and coordination units to assist in the payment of annual insurance and membership packages. When choosing to pay by monthly instalments through Premier Funding Services you are entering into a business loan agreement. Upon receipt of this application form, Premier Funding Services will set up a loan for the amount you indicate below and will then pay the full annual amount of the insurance and membership package to Family Day Care Australia. The loan is then repaid by you over 10 monthly instalments. Premier Funding Services will charge an initial set up fee of $15 and collection fees of $6 per month over ten months. 18 DIRECT DEBIT REQUEST SERVICE AGREEMENT (Payment Plan) TERMS AND CONDITIONS December The Direct Debit Request Service Agreement (the Payment Plan) is provided by Premier Funding Service Pty. Limited (PFS) ABN Monthly repayment amounts set out in the Payment Plan Schedule include a $15 loan establishment fee and a monthly transaction fee of $6 charged by PFS. 3. Monthly repayments made on VISA or Mastercard will attract a 1.5% credit card surcharge for each transaction. 4. PFS will pay your membership and insurance package (the Package) in full on your behalf to Family Day Care Australia and will take security over the Package including any refund of premium payable in the event of loan default. 5. By entering into this Payment Plan you have agreed to pay PFS all monthly repayments in their entirety as and when they fall due. 6. The first due date for debit will occur on the date specified on the Payment Plan Schedule. A debit date that falls on a weekend or a public holiday in metropolitan Victoria will be debited on the next working day. 7. You are responsible to ensure that sufficient cleared funds are available for the direct debit transaction or that sufficient credit is available on your credit card for the Payment Plan transaction. 8. If the Payment Plan transaction fails due to insufficient funds, account closure, incorrect account number or other such fault that you have not advised PFS about, we will attempt to re-draw the outstanding amount 3 business days after the initial attempt to draw payment. In addition to re-drawing the outstanding amount you will be charged a dishonour fee of $25 each time. This is in addition to any fees your bank may charge you. 9. A dishonoured payment or a payment in arrears constitutes a default event under this Payment Plan. Your payments must be kept in advance at all times. PFS will only tolerate two dishonoured payments throughout the period of the Payment Plan before taking steps to cancel the Package. 10. In the event of a default PFS, as holder of the rights to the Package, can cancel the Package and receive any applicable refund to service your debt. Where applicable the cancellation of the Package may be backdated to ensure a sufficient refund is payable for the outstanding debt. 11. In the event of a default PFS will notify you in writing of their intent to cancel the Package, allowing seven days from the date of notification for you to remedy the situation. 12. Should you no longer require this Package you may request to cancel the Package in writing with Family Day Care Australia. Your letter must state your full name, address, client code, the Package you are cancelling and the effective date of cancellation which will usually be your last day of service. Send the cancellation letter to Family Day Care Australia, PO Box 571, Gosford NSW Family Day Care Australia will advise PFS of the date of cancellation. 13. There are certain non-refundable components within your Package. If your Package is cancelled for any reason Premier Finance Services will continue to debit your financial institution or credit card until the non-refundable charges, plus your public liability insurance for the policy period and all PFS charges have been paid in full. Any refund following cancellation is payable to PFS and these funds may reduce or cease the monthly repayments. 14. In the event of cancellation a fee may be charged by PFS which will be no greater than $30. A cancellation refund amount of less than $20 will not be refunded to you. 15. PFS will disburse the funds as outlined in the insurance schedule to Family Day Care Australia within their agreed credit terms. 1.5% commission is payable by PFS to Family Day Care Australia in relation to this payment plan. 16.
