3 Use of Application of Heat Fire Precautions This policy excludes liability arising from or caused by the use or application of heat away from the Insured s premises unless the Insured a) When using oxyacetylene, electric arc or similar welding and cutting equipment takes all reasonable precautions to prevent Damage. Where the use of such equipment is subcontracted the insured shall require the subcontractor to also take all reasonable precautions. The term reasonable precautions in relation to the use of such equipment shall include but not be limited to the following i) Before Starting Work ii) iii) I) A person shall be made responsible for fire safety and for ensuring that reasonable precautions are taken II) III) All persons shall be made aware of the location of the site s fire alarms and fire fighting equipment The responsible person shall examine all property within a radius of six metres from where the heat is being applied and where possible remove all combustible materials or otherwise cover and protect by overlapping sheets or screens of non-combustible material During the Process of Work I) A person shall work alongside the operator of the equipment to look out for an outbreak of fire and there shall be available for immediate use II) III) a) at least two buckets of dry sand b) a hose connected to the nearest hydrant with water turned on and controllable at the nozzle of the hose. If water is not available or unsuitable then two fully charged fire extinguishers must be available. The lighting of equipment shall be in accordance with manufacturers instructions and no piece of lighted equipment shall be left unattended Gas cylinders not required for immediate use shall be kept at least six metres from where the heat is being applied After Ceasing Work a continuous examination for thirty minutes shall be made of the area within a radius of six metres from where the heat has been applied to ensure that there is no risk of fire b) when using or applying heat in any other way takes all reasonable precautions to prevent damage

5 Collateral Warranties Extension The provisions of this extension apply only to claims made in respect of Deeds of Collateral Warranty, Duty of Care Agreements or similar agreements executed by you prior to 28 February This policy is extended to include liability assumed by you under any Collateral Warranties, Duty of Care Agreements or similar agreements subject to the following exclusions:- a) Any Warranty or Agreement which provides greater or longer lasting benefit than that given to the party with whom you originally contracted. b) Any express guarantee, contractual penalty or liquidated damages. c) Any Warranty or Agreement or Assignment thereof which provides benefit to:- a b c d More than three party subsequent to each initial purchaser. More than three party subsequent to each initial tenant. For the purpose of this sub clause each initial tenant shall be deemed to include the first tenant of each unit of a building which is let having been initially in owner occupancy. More than three parties subsequent to the Employer. Where Fitness for Purpose or any phrase which imposes the same duty upon you appears as an express item within any collateral warranty, cover will only apply provided the use or purpose is specifically stated and cover is only in respect of claims arising from Fitness for Purpose as a result of breach of professional duty. A quarterly bordereau of warranties signed containing Fitness for Purpose to be provided for calculation of any additional premiums that may be required. Furthermore Underwriters may extend this policy to include increased liability assumed by you under any Warranty or Agreement which goes beyond the above exclusions, subject to any additional information as may be required and at terms and conditions to be agreed by Underwriters. Nevertheless, in the event that you give a Warranty or Agreement beyond the above exclusions, Indemnity hereunder shall be limited to the extent of such exclusions. None of the foregoing limitations or exclusions shall apply to liability which would be attached to you in the absence of any such Warranties or Agreements
