Frequently Asked Questions When Does My Coverage Begin and How Long Does it Last? Coverage for the buyer begins at the close of sale and lasts for one year. If you re selling your home, coverage lasts during the home s listing period up to a maximum of 180 days. * Buyer s coverage for new construction homes starts one year after the close of sale and continues for three years from that date. * Seller s coverage not available for all home types. How Do I Pay for My Plan? The payment for your home warranty is collected at closing if you are selling or buying your home. You may pay with Visa, Master Card, check or money order. This is the nominal fee, applicable to your plan, that you pay to the service contractor who goes to your home to fix the problem. Will I be covered for Unknown Conditions? As you apply for the home warranty, you must list all covered items that have known defects or are otherwise not in good working order at the time of the application. Your home warranty plan only covers problems that arise after the time the home warranty goes into effect. 6 Alliance Sample Contract A. Definitions The following terms have the meaning in this Contract indicated below: AHW means Alliance Home Warranty. Contract means all the terms and conditions contained herein and include; Definitions, The Agreement, Conditions, Duties of the Homeowner, Payment & Contract Term, Termination, Service Calls, Service Call Fee, Limitations, Standard Coverage, Optional Coverage For Buyer, and Assignment of Contract. Covered Item means the Standard Coverage described in Section J and Optional Coverage For Buyer in Section K selected by the Homeowner and includes payment to AHW of the appropriate contract fee for the coverage selected. Home means the dwelling listed in the Covered Address section of this Contract and includes any attached garage. Homeowner means the person listed as Contract Holder in this Contract. Malfunction means the mechanical failure of a system, component, or appliance to perform the function for which the manufacturer designed it. B. The Agreement In consideration of the terms and conditions set forth in this Contract and payment of the appropriate contract fee, AHW will repair or replace Malfunctioning Covered Items reported during the term of the Contract. C. Conditions Covered Items must be installed for diagnosis and located within the perimeter of the foundation of the Home (except Pool and Spa, Air Conditioning, Well Pump, and Septic Tank Pumping) and must be in good, safe working condition at the beginning of the Contract. This Contract provides coverage at the time coverage begins for Malfunction of Covered Items from unknown conditions if the Malfunction would not have been detectable to the Homeowner, seller, or agent through a visual inspection or simple mechanical test. This contract provides coverage for systems and appliances which malfunction due to lack of maintenance, rust or corrosion, or chemical or sedimentary build-up. The Homeowner must call AHW for service prior to the expiration of this Contract. AHW will not reimburse the Homeowner for repairs without AHW s prior approval. This Contract covers only the items mentioned as covered and excludes all others. D. Duties of the Homeowner To maintain coverage, the Homeowner must do the following: (i) Protect appliances/systems from further damage should a failure occur; (ii) Report claims promptly to AHW on the toll free number given in this Contract; (iii) Install all appliances/systems in accordance with the manufacturer s specifications, (iv) Maintain all appliances/systems in accordance with the manufacturer s specifications including performing normal routine maintenance. E. Payment & Contract Term The appropriate contract fee shall be paid by the Homeowner for the coverage selected. This contract fee shall be due at the closing of a sale of the Home. Lease option coverage (available for lessee only) begins upon receipt of application and contract fee by AHW and continues for one year. Seller s Coverage starts upon receipt of application or confirmation number by AHW and continues until expiration of the initial listing period not to exceed 180 days or until close of sale or listing cancellation (whichever is first). Seller s coverage may be extended at the discretion of AHW. Buyer s Coverage starts upon close of sale and payment of contract fee, and continues for one year. Buyer s Coverage for new construction starts one year after the close of sale and continues for three years from that date. Payment is due at the close of sale and must be received by AHW within 30 days of close of sale. Offer of future coverage is at the option of AHW. If AHW elects not to renew coverage, the Homeowner will receive a notice of intent to not renew no later than 30 days prior to the expiration of the Contract. If AHW elects to renew coverage, an offer will be mailed containing the appropriate contract fee and terms and conditions no later than 30 days prior to the expiration of the current Contract. F. Termination A home service contract in effect for at least 70 days is noncancellable by AHW before the expiration of the agreed term or one (1) year after the effective date of this Contract, except on any of the following grounds: (a) Failure by the Homeowner to pay any amount when due; (b) Conviction of the Homeowner of a crime, which results in an increase in the service required under this Contract; (c) Discovery of fraud or material misrepresentation by the Homeowner in obtaining this Contract, or in presenting a claim for service thereunder; (d) Discovery of: (1) An act or omission by the Homeowner; or (2) A violation by the Homeowner of any condition of this Contract, which occurred after the effective date of this Contract and which substantially and materially increases the service required under this Contract; or (e) A material change in the nature or extent of the required service or repair which occurs after the effective date of this Contract and which causes the required service or repair to be substantially and materially increased beyond that contemplated at the time that this Contract was issued or sold. The cancellation of this Contract will become effective 15 days after the notice of cancellation is mailed to the Homeowner. If AHW cancels this Contract, AHW shall refund the portion of the purchase price that is unearned. AHW will deduct any outstanding balance on the account from the purchase price that is unearned when calculating the amount of refund. If the Homeowner cancels this Contract, the request must be in writing. AHW will refund the portion of the purchase price that is unearned, as well as charge an administrative fee of $ This Contract is void and AHW shall refund to the Homeowner the purchase price of the service contract if the Homeowner has not made a claim under this Contract and the Homeowner returns this Contract to AHW: (a) Within 20 days after the date AHW mails a copy of this Contract to the Homeowner; (b) Within 10 days after the purchaser receives a copy of this Contract if AHW furnishes the Homeowner with the copy at the time this Contract is purchased; or (c) Within a longer period specified in this Contract. G. Service Calls 1. As soon as a Malfunction of a Covered Item is discovered, the Homeowner must notify AHW by calling or by placing a claim at AHW will accept service calls at this number 24 hours a day, 7 days a week. All calls including weekends and holidays are dispatched within 48 hours. If an emergency involving loss of heating or cooling, loss of plumbing, or substantial loss of electrical service occurs which renders the covered dwelling unfit for a person to live in because of defects that immediately endanger the health and safety of the occupants of the covered dwelling, service will commence within 24 hours after the claim is reported and will be completed as soon as reasonably practicable thereafter. When the Homeowner s coverage is confirmed, AHW will dispatch the Homeowner s request to an AHW qualified contractor. The contractor will call the Homeowner to schedule a mutually convenient appointment time. If the Homeowner should request AHW to perform non-emergency service outside of normal business hours, the Homeowner will be responsible for payment of additional fees, including overtime charges. 2. AHW has the sole right to select the service contractor to perform services with respect to a Covered Item. 3. Sometimes there are problems and delays in securing parts or equipment. When the items are secured, they will be installed promptly without any further service charge. 4. The Homeowner and AHW may agree on payment of cash in lieu of repair or replacement. Payment will be based on AHW s negotiated rates with its suppliers, which may be less than retail. 5. If a repair or replacement made under this Contract should fail within 30 days with respect to parts and labor, AHW will provide a courtesy recall to the Homeowner without an additional Service Call Fee. If the item fails outside of this time period, an additional Service Call Fee will be charged. H. Service Call Fee For each separate trade call under this Contract, the Homeowner shall pay a Service Call Fee in the amount of $ Trade call means each visit by an AHW approved contractor, unless multiple visits are required to remedy the same problem. The Service Call Fee is payable to the service contractor dispatched by AHW at the time the service is performed. A Service Call Fee of $60.00 will be charged for failure to keep a service contractor s scheduled appointment. Failure to pay the Service Call Fee may delay processing of future claims. I. Limitations 1. If this Contract applies to a multi-unit dwelling, condominium or mobile home, AHW shall be obligated only with respect to repairs or replacements which can be performed within the confines of the units covered by this Contract, and AHW shall have no obligation with respect to common areas and facilities. 2. This Contract covers only single family residential-use resale and new construction property, less than 5,000 square feet, unless amended by AHW. Resale and new construction homes over 5,000 square feet, multiple units, mother-in-law units, guest houses, and other structures are covered if the appropriate fee is paid. This coverage is for owned or rented residential property, not for commercial property or premises converted into a business, including but not limited to, nursing/care homes, fraternity/sorority houses or day care centers. 3. Malfunction of a Covered Item caused by any of the following are not covered: 3.1. Fire, flood, smoke, storms, accidents, mud, riots, theft, misuse, abuse, structural changes, freezing, electrical failure or surges, water damage, lightning, earthquake, vandalism, war, pest damage or acts of God Improper installation, including but not limited to: missing parts, improper design, incorrect installation, alteration or modification outside of the manufacturer s specifications, or inadequate or lack of capacity of any component in the home. 4. AHW shall have no obligation with respect to: 4.1. Any utility lines, sewer or piping outside the Home, including lawn sprinkling systems, power lines, underground wiring, water lines or natural gas lines to the Home, 4.2. Collapse of piping, 4.3. Light bulbs, filters, pulleys, belts,

7 4.4. Burglar or fire alarms, 4.5. Electronic, computerized, pneumatic and manual system management and zone controllers. 5. AHW will not be responsible for the following: 5.1. Any corrections, repairs, replacements, upgrades, inspections or other additional costs required by utility regulations, zoning or building codes to comply with local, state, or federal laws. The Homeowner is responsible for making all corrections required by such provisions of law. AHW shall have no obligation to perform services until the necessary corrections have been made Paying any costs relating to permits, haul away fees, construction, carpentry and relocation of equipment. Paying any costs related to other modifications made necessary by existing equipment or installing different equipment, except where noted in the Air Conditioning/Evaporative Cooler section of this contract Cosmetic defects and consequential, incidental and/or secondary damage or loss resulting from the malfunction of any covered item, or a Service Contractor s delay or neglect in providing, or failing to provide, repair or replacement of a covered item, including, but not limited to, personal and/or property damage, food spoilage, additional living expenses, utility bills, loss of income Effecting service involving hazardous or toxic materials, including asbestos or any other contaminants. AHW is not responsible for any claim arising out of any pathogenic organism regardless of any event of cause that contributed in any sequence to damage or injury. Pathogenic organism means any bacteria, yeasts, mildew, virus, fungi, mold or their spores, mycotoxins or other metabolic products Effecting repairs or replacement arising from manufacturer s recall of Covered Items, manufacturer s defects or for items covered under an existing manufacturer s, distributor s or in-home warranty. The covered items must be domestic or commercial grade and specified by the manufacturer for residential use. 6. AHW reserves the right to: 6.1. Obtain a second opinion, at its own expense, with respect to any Malfunction of a Covered Item Have a component or part rebuilt or to replace a component or part with a rebuilt component or part. 7. AHW will not alter structure to effect repair or replacement, nor refinish or replace cabinets, countertops, tile, paint, wall, or floor coverings, or the like. 8. At times, it is necessary to open walls, floors, or ceilings to perform a covered service. AHW will close opening to a rough finish. This does not apply to Central Vacuum Coverage. 9. AHW will determine replacement unit or effect repair at its option. When replacing any appliance, AHW will not consider any failures that do not contribute to the appliance s primary function including, without limitation, TVs or radios in the kitchen refrigerator. Replacement equipment will be similar in features, efficiency, and capacity but may not match color, brand, or dimensions. 10. AHW will not perform routine maintenance. The contract holder is responsible for cleaning and routine maintenance as specified by the manufacturer of the equipment. 11. In no event shall AHW be obligated for costs or expenses (including, without limitation, the cost of equipment, parts and labor) in excess of $5,000 per service request, and in no event shall AHW be obligated under this Contract for costs or expenses in excess of $20,000 in the aggregate. J. Standard Coverage The following items are covered by this Contract. We show examples of items not covered to assist the Homeowner s understanding of the Contract. It is also important to review Limitations. Note For Seller: AHW will pay up to a combined maximum limit of $1,500 during the seller s coverage period for Air Conditioning/Evaporative Cooler, Central Heating System, and Ductwork. 1. Air Conditioning/Evaporative Cooler COVERED: Electric forced central air conditioning system or primary electric evaporative cooler unit, primary wall air conditioning unit, heat pumps. NOT COVERED: All parts and components for gas air conditioning systems (except those using freon), window or portable air conditioning units, registers, grills, filters and exterior freon lines, freon evacuation, freon recovery, freon recharging, humidifiers, electrostatic air cleaners, underground or outside lines and components for geothermal and/or water source heat pumps, roof damage related to repairs to roof mounted units or landscaping damage related to repairs to units located in landscaped areas. Note: Programmable thermostat systems are covered under this contract to a maximum of $100 in the aggregate, less applicable Service Call Fee. AHW will pay up to a maximum of $1,500 in the aggregate under this Contract for diagnosis, access, and repair or replacement of any glycol, hot water, steam circulating, electric baseboards, or boiler/water heater system. If AHW determines that the air conditioning unit must be replaced, AHW will replace the unit with a unit that meets current federal, state and/or local government efficiency standards and replace any covered component, as well as the plenum, indoor electrical, air handling transition, and duct connections necessary to maintain compatibility with the replacement unit, including the installation of thermostatic valves. 2. Central Heating System COVERED: Gas, oil or electric central heating units, accessible ductwork, space or area-type heating units where there is not a central heating system, heat pumps. NOT COVERED: Registers, grills, insulation, fireplaces, portable heating units, humidifiers, electronic air cleaners and solar heating systems, underground or outside lines and components for geothermal and/or water source heat pumps, flues and vents, cable heat (in ceiling), grain, pellet, or wood heating units (even if only source of heating). Note: Programmable thermostat systems are covered under this contract to a maximum of $100 in the aggregate, less applicable service call fee. Coverage for diagnosis, access, repair or replacement of heating, plumbing, electrical and ductwork below a concrete slab and encased in or covered by concrete is limited under this Contract to a maximum of $500 in the aggregate. AHW will pay up to a maximum of $1,500 in the aggregate under this Contract for diagnosis, access, and repair or replacement of any glycol, hot water, steam circulating, electric baseboards, or boiler/water heater system. 3. Ductwork COVERED: Ductwork from the heating unit to the connection at register or grill. NOT COVERED: Grills and registers, insulation, dampers, ductwork where asbestos is present. Note: Coverage for diagnosis, access, repair or replacement of heating, plumbing, electrical and ductwork below a concrete slab and encased in or covered by concrete is limited under this Contract to a maximum of $500 in the aggregate. 4. Interior Plumbing System COVERED: Leaks and breaks of interior water, waste, gas, drain and vent lines, faucets, shower and tub and diverter valves, toilet tanks, bowls and mechanisms (replaced with white builders standard as necessary), and permanently installed sump pump. NOT COVERED: Fixtures, angle stop and gate valves, shower arm, shower head, shower enclosures, shower doors and base pans, sauna and steam rooms, tile, grouting and caulking, pressure regulators, insufficient or excessive water pressure, freezing, problems associated with water purification (odor, taste, and color), and fire suppression systems. Note: AHW will pay up to a maximum of $1,500 in the aggregate under this Contract for diagnosis, access, and repair or replacement of any glycol, hot water, steam circulating, electric baseboards, or boiler/water heater system. Coverage for diagnosis, access, repair or replacement of heating, plumbing, electrical and ductwork below a concrete slab and encased in or covered by concrete is limited under this Contract to a maximum of $500 in the aggregate. 5. Plumbing Stoppages COVERED: Clearing of sewer stoppages in drain, vent and sewer lines to 125 feet of point of access where accessible ground level cleanout exists. NOT COVERED: Stoppages caused by roots, collapsed or broken lines outside the main foundation, access to drain or sewer lines from vent, removal of water closets, costs to locate, access or install a ground level cleanout, and water seepage due to outside flow. Note: AHW is responsible for only one sewer stoppage clearing per each separate main sewer line, secondary waste line, or toilet. 6. Water Heater (includes tankless water heaters) COVERED: Gas or electric water heaters. NOT COVERED: Solar water heaters, flues and vents, holding, expansion, or storage tanks. Interior Electrical System COVERED: Interior wiring, fuse and breaker panels, doorbell, electrical switches, receptacles, and built-in exhaust fans. NOT COVERED: Light fixtures, bathroom heaters, alarm systems, intercoms, telephone systems, computer equipment, in-home sound and theater systems, electrical wiring systems outside the home, power failure, power surge related problems, problems caused by overloading or code violations, fans (including ceiling, attic, and paddle fans), audio/video/computer/intercom/alarm or security cable or wiring. Note: Coverage for diagnosis, access, repair or replacement of heating, plumbing, electrical and ductwork below a concrete slab and encased in or covered by concrete is limited under this Contract to a maximum of $500 in the aggregate. 8. Appliances COVERED (ONE UNIT OF EACH): Range, oven, cook top, garbage disposal, trash compactor, built-in dishwasher, built-in microwave oven and instant hot water dispenser. NOT COVERED: Knobs, dials, racks, rotisserie, removable trays and baskets, door glass, shelves, interior lining, lights, handles, meat probe assemblies, removable buckets, and rollers. Note: Timers and clocks are covered under this Contract to a maximum $200 in the aggregate, less applicable service call fee. 9. Septic Tank Pumping COVERED: One time pumping per Contract if the stoppage is due to septic tank backup. NOT COVERED: Septic tanks, leach lines, cesspool, mechanical pump or systems, cost of locating or to gain access to the septic tank, cost of hook-ups, disposal of waste, chemical treatment of the septic tank and/or sewer lines.

8 10. Garage Door Opener COVERED (UP TO 2 UNITS): Garage door opener parts and components, including transmitters and receiving units. NOT COVERED: Garage door, track and spring systems, garage door systems without automatic safety return device, and garage door system adjustments. 11. Built-in Whirlpool Bathtub Equipment COVERED: Equipment including circulation system, lines, wiring, motor, electrical controls and air switch assemblies. NOT COVERED: Gaining access. 12. Multiple Systems UNDER 5,000 SQUARE FEET COVERED: Multiple water heaters, heating systems and air conditioning systems. For homes over 5,000 square feet or multiple units, please call for a quote. NOT COVERED: Exclusions described under Standard Coverage Section J or Optional Coverage For Buyer Section K under each such Covered Item. K. Optional Coverage Optional Coverage for Buyer & Sellerr The seller must agree to additional payment at close of sale in order to receive the following optional coverage(s). The buyer is covered for the following optional coverage(s) when additional payment has been made at closing. NOTE FOR BUYER: The home buyer may purchase optional coverage up to 60 days from the effective date. B / S 4 4 Plumbing: Toilets (replaced with like quality up to $300 per occurrence), pressure regulators, shower heads, and shower arms. 4 4 Attic Fans. 4 4 Ceiling Fans. u NA Kitchen Refrigerator: Ice maker. 4 4 Range/Oven/Cooktop: Rotisseries, racks, knobs, dials, handles, lights, interior lining, and meat probe assemblies. 4 4 Trash Compactor: Removable buckets. 4 4 Built-in Dishwasher: Racks, baskets, rollers. 4 4 Built-in Microwave: Interior lining, door glass and shelves. 4 4 AHW will cover fees associated with the use of cranes or other lifting equipment required to service roof-top air conditioning or heating units. 4 4 Where local building permits are required prior to commencing replacement of appliances, systems, or components, AHW will pay up to $250 per occurrence for such local building permits. AHW will not be responsible for replacement service when permits cannot be obtained. 4 4 AHW will pay costs related to freon evacuation, freon recovery, freon recharging, and the removal of an appliance, system, or component when AHW is replacing a covered appliance, system, or component. 4 4 AHW will repair or replace a system or appliance that was improperly installed, modified or repaired, or was not properly matched in size or efficiency at any time prior to or during the term of this contract provided the system is not undersized relative to the square footage of area being cooled or heated. In the event that a covered mismatched system or improper installation, modification or repair is in violation of a code requirement, Limited Code Upgrade* applies. 4 4 Limited Code Upgrade*: AHW will pay up to $250 in the aggregate under this contract to correct code violations when effecting approved repairs or replacements. AHW may, at its option, pay the contract holder in lieu of performing the work. Optional Coverage For Buyer The buyer is covered for the following items when additional payment is made at closing. NOTE FOR BUYER: The home buyer may purchase optional coverage up to 60 days from the effective date. Note: May only be purchased when Kitchen Refrigerator or Built-in Kitchen Refrigerator (dual compressor) option is purchased. 4. Clothes Washer and Dryer COVERED (ONE OF EACH): All parts and components, except; NOT COVERED: Soap dispensers and filter screens, lint screens, venting, knobs and dials, and damage to clothing. 5. Central Vacuum System COVERED (ONE UNIT): All components and parts, accessible ductwork, lines and vents, except; NOT COVERED: Ductwork and lines below a concrete slab and items encased in or covered by concrete. Note: AHW is not responsible for gaining access or closing access to floors, walls or ceilings to locate the malfunction or to effect repair or replacement. 6. Well Pump (Limited to one well pump per home) COVERED: All parts and components of well pump utilized for main residence only (maximum coverage of $500, less applicable Service Call Fee). NOT COVERED: Pressure and storage tanks, well casings, exterior electrical lines, piping, access to repair well pump systems, pulling pump and redrilling of wells. 7. Swimming Pool or Spa Equipment COVERED: Both pool and spa equipment are covered if they utilize common equipment. If they do not utilize common equipment, then only one or the other is covered, unless an additional coverage fee is paid. Only components and parts of the heating, pumping and filtration systems are covered. NOT COVERED: Underground plumbing, gas and electrical lines, items below a concrete slab, items encased in or covered by concrete, structural defects, lights, liners, jets, pool sweeps, cleaning equipment, pool covers, solar heaters, code violations, disposable filtration mediums, chlorinators, ozonators and other water chemistry control equipment and materials, waterfalls, ornamental fountains and their pumping systems, heat pumps. 8. Limited Roof Leak Coverage COVERED: Leaks caused by rain to tar and gravel, tile, shingle, shake and composition roofs over occupied living areas will be repaired as long as leaks are caused by normal wear and tear and the roof was in good, water tight condition at the start of coverage. NOT COVERED: ROOF LEAKS CAUSED BY OR RESULTING FROM: ROOF MOUNTED INSTALLATIONS, METAL ROOFS, IMPROPER CONSTRUCTION OR REPAIR, MISSING OR BROKEN MATERIALS, SKYLIGHTS, PATIO COVERS, GUT- TERS, DRAINS, DOWNSPOUTS, SCUPPERS, CHIMNEYS, AND DEFECTS IN BALCONY OR DECK SERVING AS A ROOF. ROUTINE PERIODIC MAINTENANCE IS NOT COVERED BY THIS CONTRACT. AHW will direct a technician to contact the Homeowner for an appointment or, at its option, may authorize the Homeowner to contact a technician directly. If the Homeowner is authorized to contact a technician directly, the Homeowner will be given a spending limit established by AHW. Note: Service delays frequently occur during the first rains of the season or in heavy storms. While AHW will make every effort to expedite service, no guarantees can be made. AHW will pay up to a maximum of $250 per occurrence and $1,000 in the aggregate per Contract for the repair of specific leaks. If replacement of the existing roof, in whole or in part, is necessary, AHW s liability is limited to the estimated cost of repair of the leaking area only, as if the repair of that area were possible. Secondary or consequential water damage is not covered by this Contract. Limited Roof Leak Coverage is not renewable. Limited Roof Leak Coverage is not available for new construction. L. Assignment of Contract If the Home is sold during the term of this Contract, the Homeowner must notify AHW of the change in ownership and must submit the name of the new owner by phoning in order to transfer this Contract to the new owner.
