1 SHAMOKIN DAM BOROUGH COUNCIL COUNCIL MEETING AUGUST 6, 2012 The regular monthly meeting of the Shamokin Dam Borough Council was held on Monday, in the municipal building located at 42 W. 8 th Avenue, Shamokin Dam beginning at 7:00 P.M. Council President Donald Musser presided. MEMBERS PRESENT: Malcolm Fleming, Mark Benner, Rue Rothermel, David Herbert, and Don Musser were present. MEMBERS ABSENT: Andrew Bickhart and David Smeltz were absent. OTHERS PRESENT: Mayor Joseph McGranaghan, Manager Ed Hovenstine, Solicitor Robert Slivinski, Police Chief Timothy Bremigen, Secretary LaDawn Leitzel, Borough Residents (June Stark, Virginia Mendler, and Joshua Herb), John Whitmer (ESCRA), and Fire Chief Brad Aurand were present. The meeting was opened with the Pledge of Allegiance. PREVIOUS MEETING MINUTES: A motion was made by Councilman Benner to approve the minutes of the July 2, 2012 meeting of Council as presented, seconded by Councilman Herbert, approved by all. VISITORS: Borough s appointee to Eastern Snyder County Regional Authority (ESCRA) John Whitmer stated that sewer permits issued prior to June 15, 2012 would be permitted, however previously sewer modules are not allowed without a sewer permit issued prior to June 15, ESCRA and Selinsgrove Borough are involved in litigation due to the fact that ESCRA passed a surcharge onto Selinsgrove Borough, which Selinsgrove Borough refused to pay to ESCRA. The surcharge has been included in the litigation procedure, but Mr. Whitmer could not elaborate on the case at this time. John Whitmer mentioned that businesses in Selinsgrove Borough are sending waste to ESCRA to process which in turn use up the capacity of the ESCRA plant. Mr. Whitmer requested that the Shamokin Dam Council members express concerns to Selinsgrove Borough Council members regarding resolving the issues and the litigation. Fire Chief Brad Aurand reviewed the June 2012 fire department call report. The Fire Chief stated that Engine 9-1 will be fixed in house due to leak in the pipes. Fire Chief Brad Aurand mentioned that the Shamokin Dam Fire Company would be applying for a federal grant in the amount of $97,000 to replace air packs. The Shamokin Dam Fire Services Task Force will meet on Wednesday, August 8, COMMUNICATIONS: Manager Hovenstine attended a meeting that discussed the replacement of bag #2 in the Fabri Dam with an estimated start date of August 20, 2012 and an estimated completion date of
2 Shamokin Dam Borough Council Page 2 September 30, DCNR will be building a causeway, and will be using the Fabri Dam Park for access to the Fabri Dam. Correspondence - Mayor McGranaghan In accordance with the new PA Borough Code, effective July 16, 2012 the Mayor would be notifying Borough Council of intention to perform weddings, which requires Mayor McGranaghan to provide Borough Council with quarterly reports stating who was married, where the wedding took place, and amount of fee up to $ if any is charged. MAYORS REPORT: New Borough Code/Obligations/Mayors Conference Mayor McGranaghan discussed that Act 13-Marcellus Shale issues would be subject to the PA state regulations not the Shamokin Dam Borough Zoning Ordinance. The Shamokin Dam Borough Zoning Ordinance must be modified to reflect Act 13 and the PUC would be responsible to enforce that the changes have been made. The Mayor mentioned that next year the Shamokin Dam police department may possibly use a radar device for speeding violators. Mayor McGranaghan reviewed topics of the new Borough Code that were discussed at the Mayors Conference such as: Pension reform, not allowing a resolution of legislative character, and the responsibilities of Mayor/law enforcement, which will be reviewed by the Mayor and the Police Chief. Mayor McGranaghan suggested that Solicitor Slivinski review the new Borough Code so that any obligations would be met due to the new Borough Code. The Mayor mailed the Economic Development Survey to seventy-three businesses conducting business within Shamokin Dam Borough and to two businesses conducting business outside the Shamokin Dam Borough. Police Chief Bremigen reviewed the police report and reported that July was a higher criminal month. OLD BUSINESS: Youth Ministries owns a small piece of property next to the proposed dog park location. Chad Shaffer inquired about the Borough leasing the property, but Youth Ministries declined the offer. Manager Hovenstine stated that the Borough would proceed as planned. MANAGERS REPORT: Final Streets Overview Manager Hovenstine reviewed the 2012 Streets Project Summary with a budgeted total of $110, and an actual total of $108,371.95, which included the grading and stone work and additional paving on Miller Drive. Water Distribution Issues The Manager mentioned that the water distribution line had some issues with fluctuating water pressure. The Borough would use the six inch pressure reducing valve while the three inch pressure reducing valve is being factory rebuilt. John Whitmer left at this time.
3 Shamokin Dam Borough Council Page 3 Raw Water Station Bid Review A motion was made by Councilman Herbert to accept the Raw Water Station Electrical Construction Project to the low bidder Paige Electric in the amount of $7,300.00, seconded by Councilman Benner, and approved by all. A motion was made by Councilman Herbert to accept the Raw Water Station General Construction Project to the low bidder Robert Feaster Corp. in the amount of $66,400.00, seconded by Vice President Fleming, and approved by all. RAW WATER STATION ELECTRICAL CONSTRUCTION BID: Six bids were received for the Electrical Construction: Paige Electric $ 7, Cipriani Electric $ 9, George J Hayden Inc $ 9, Tra Electric $11, JB Electric Corp $14, SRS Electric LLC $15, RAW WATER STATION GENERAL CONSTRUCTION BID: Six bids were received for the General Construction: Robert Feaster Corp. $ 66, Hepco Construction $ 87, Bognet, Inc. $ 95, Kevin E. Raker Construction LLC $ 99, Derstine Company $103, Zartman Construction $104, Underwater Screen Project - The Borough received a quote from Underwater Screening for removal and replacement of the traveling screen in the amount of $16, Solicitor Slivinski recommended that the Manager receive telephone bids from possible competitors. A motion was made by Councilman Herbert to accept bid from Underwater Screening for removal and replacement of the traveling screen in the amount of $16, subject to Manager Hovenstine contacting local municipalities to receive contact information and contacting possible competitors to quote project less that Underwater Screening s quote, seconded by Councilman Benner, and approved by all. The Solicitor suggested that this motion should be reapproved with the results listed at the next Council meeting. Reservoir Roof Estimates Manager Hovenstine mentioned that a new rubber roof at the reservoir would cost approximately $60,000-$70,000. The Manager received quotes from Eagle Ridge, a masonry restoration company to refurbish the roof similar to the existing situation, which includes removal and resealing of the existing joint between the precast decking. First quote in the amount of $7, would be to clean out old material and prep and the second quote in the amount of $9, would be to reseal the joints. The Borough crew would wash and check liner and coat with the actual precast decking with a high performance, anticarbonation crack building coating known as Sikagard 550W Elastocolor with an approximate cost of $5, A motion was made by Councilman Herbert to accept bid from Eagle Ridge
4 Shamokin Dam Borough Council Page 4 Contracting Inc. to clean out old material and prep the reservoir in the amount of $7,785.00, seconded by Councilman Rothermel, and approved by all. A motion was made by Councilman Herbert to accept the bid from Eagle Ridge Contracting Inc. to reseal the joints with an option to upgrade to the silicone caulk in the amount of $9,915.00, seconded by Councilman Rothermel, and approved by all. Debt Refinance Results The current debt for the Elevated Tank is through a Penn Vest Loan until 2021 in the amount of $394,457 as of December 2011 at a fixed rate of 3.768%. Also the current debt for the Old Trail Water/Sewer Project is through a FNB Loan until 2026 in the amount of $541,737 as of December 2011 at an adjustable (readjusts every five years, based on the five year treasury, maximum change of 1.4%) rate of 3.39%. The refinance loan amount would be approximately $900, for a term of ten years, no early payment penalty except possibly with FNB, no prepayment penalties, no bond council, and Solicitor Slivinski would create the loan agreement. The Solicitor mentioned that the process for the agreement would be adoption through an ordinance, which would be advertised before and after adoption, accompanied with a debt statement and borrowing base certificate sent to DECD for approval after the proof of publication would be received approximately around September 17, Councilman Rothermel requested that the Borough obtain a firm commitment letter from Northumberland National Bank based on their proposal. Council authorized Solicitor Slivinski to continue with the process to refinance the debt. REFINANCE PROPOSAL: Six proposals were received for the refinance of debt: Northumberland National Bank 2.25% Swineford National Bank 2.49% Mifflinburg Bank & Trust 2.89% FNB 2.98% Susquehanna Bank 3.30% Mid-Penn Bank 3.39% Grant Opportunity to Clean Riverfront SEDA-COG would be offering a grant due by August 20, 2012 with an opportunity to clean the riverfront area with a fifty-fifty match up to $10, with the Borough. Mayor McGranaghan mentioned that SEDA-COG with outside resources would be interested in pursuing the Nestlerode Property in reference to the Susquehanna Valley River Sports Park. Councilman Rothermel recommended utilizing man power through community service organizations. A motion was made by Vice President Fleming the Mayor and the Manager to pursue both options: SEDA-COG s grant opportunity to clean the riverfront area and the Nestlerode Property in reference to the Susquehanna Valley River Sports Park, seconded by Councilman Herbert, and approved by all. Workmen s Compensation Insurance Manager Hovenstine mentioned that after quotes were received for workmen s compensation insurance from EMC Insurance in the amount of $15, and Shaffer Insurance in the amount of $9, the workmen s compensation insurance policy has been switched from EMC Insurance to Erie Insurance though Shaffer Insurance Agency.
5 Shamokin Dam Borough Council Page 5 Borough Picnic A total of 248 residents signed up for the picnic with a total of 198 attending the Borough picnic. Councilman Rothermel mentioned that the Manager, the Mayor, the Secretary, the Borough Crew, Barb Moyer and Elaine Herbert should be thanked for the work needed to provide the Borough picnic. COMMITTEE MINUTES: Water/Sewer Committee meeting was held on Thursday, July 26, 2012 at 7:00 PM to discuss bid opening of the raw water station bid. The Finance Committee met following the Water/Sewer Committee to discuss the possibility to refinance debt. PLANNING COMMISSION: Vice President Fleming reported that no Planning Commission meeting would be scheduled in August. PAYMENT OF BILLS: General Fund bills in the amount of $57,224.28, Water and Sewer Fund bills in the amount of $18,607.22, Motor Fund in the amount of $39,300.00, and Local Service Tax Fund in the amount of $26, A motion was made by Councilman Herbert to pay the bills as presented, seconded by Vice President Fleming, and approved by all.
