2 Equestrian Sports Psychology, Rider Fitness Seminar & Pressure Proof Clinic Presented by Former USEF Coach, Author, and International clinician Daniel Stewart Daniel Stewart has been a successful international trainer and instructor for over 25 years. In addition to the US, he s trained riders in Spain, Portugal, Canada, Mexico, Belgium, United Arab Emirates, Greece and the West Indies. From 1999 to 2007 he coached riders on several US Equestrian Teams to success at World Championships, World Equestrian Games and Olympics. 4 HORSE RIDING AGREEMENT AND LIABILITY RELEASE FORM This form must be completed by and for each participant. PREMISES OWNERS NAME IS Robert M and Georgia B. Compton, Ada C. and Gary R. Holley, and SunTrust Bank as Trustee for Mrs. Ada S. Brown under the will of Ernest M. Brown, and Robert and Georgia Compton hereinafter known as Compton/Holley Farm. LOCATION OR ADDRESS: 7806 and 7928 Kelly Bridge Road, Dawsonville, GA PLEASE READ CAREFULLY BEFORE SIGNING SERIOUS INJURY MAY RESULT FROM YOUR PARTICIPATION IN THIS ACTIVITY. Compton/Holley Farm DOES NOT GUARANTEE YOUR SAFETY OR THAT OF YOUR HORSE. IT IS HEREBY AGREED TO AS FOLLOWS THAT: A. REGISTRATION OF RIDERS AND AGREEMENT PURPOSE I, the following individual hereinafter known as the RIDER, and the parents or legal guardians thereof if a minor, do hereby voluntarily request and agree to participate in horse riding on premises Compton/Holley Farm and that this RIDER will ride his/her own horse or one borrowed or leased by RIDER S own arrangement today and on all future dates: RIDER NAME & AGE (if under 21): B. AGREEMENT SCOPE AND TERRITORY AND DEFINITIONS This agreement shall be legally binding upon me the registered RIDER, and the parents or legal guardians thereof if a minor, my heirs, estate, assigns, including all minor children, and personal representatives; and it shall be interpreted according to the laws of the state of Georgia and Dawson County. Any disputes by the RIDER shall be litigated in and venue shall be the state of Georgia and Dawson County. The term HORSE herein shall refer to all equine species. The term HORSEBACK RIDING or RIDING herein shall refer to riding or otherwise handling of horses, ponies, mules, or donkeys, whether from the ground or mounted. The term RIDER shall herein refer to a person who rides a horse mounted or otherwise handles or comes near a horse from the ground. The terms I, me, my shall herein refer to the above registered rider and the parents or legal guardians thereof if a minor. C. ACTIVITY RISK CLASSIFICATION Horseback riding is classified as RUGGED ADVENTURE RECREATIONAL SPORT ACTIVITY, and that there are numerous obvious and non-obvious inherent risks always present in such activity despite all safety precautions. According to NEISS (National Electronic Injury Surveillance Systems of United States Consumer Products) horse activities rank 64th among the activities of people relative to injuries that result in a stay at U.S. hospitals. Related injuries can be severe, requiring more hospital days and resulting in more lasting residual effects than injuries in other activities. D. NATURE OF RIDING HORSES No horse is a completely safe horse. Horses are 5 to 15 times larger, 20 to 40 times more powerful, and 3 to 4 times faster than a human. If a rider falls from a horse to ground it will generally be at a distance of from 31/2 to 51/2 feet, and the impact may result in injury to the rider. Horseback riding is the only sport where on much smaller, weaker predator animal (human) tries to impose its will on, and become on unit of movement with, another much larger, stronger prey animal with a mind of its own (horse) and each has a limited understanding of the other. If a horse is frightened or provoked it may divert from its training and act according to its natural survival instincts which may include, but are not limited to: stopping short, changing directions or speed at will; shifting its weight; bucking; rearing; kicking; biting; or running from danger. E. RIDER RESPONSIBILITY Upon mounting a horse and taking up the reins, the RIDER is in primary control of the horse. The RIDER S safety largely depends upon his/her ability to carry out simple instructions, and his/her ability to remain balanced aboard the moving animal. The RIDER shall be responsible for his/her own safety.

CONDITIONS OF NATURE Compton/Holley Farm is NOT responsible for total or partial acts, occurrences, or elements of nature that can scare a horse, cause it to fall, or react in some other unsafe way. SOME EXAMPLES ARE: thunder, lightening, rain, wind, wild and domestic animals, insects, reptiles, which may walk, run, fly near, bite and/or sting a horse or person; and irregular footing on out-ofdoor groomed or wild land which is subject to constant change in condition according to weather, temperature, and natural and man-made changes in landscape. G. INPSECTION OF PREMISES RIDER has inspected Compton/Holley Farm facilities and trails and is satisfied that all premises conditions are reasonably safe for RIDER S intended purpose, usage and presence upon the Compton/Holley Farm premises. H. ACCIDENT/MEDICAL AND PERSONAL LIABILITY INSURANCE Should medical treatment be required, I and/or my own accident/medical insurance company shall pay for all such incurred expenses. My accident/medical insurance company is and my policy number is. Should my actions or that of my horse cause injury or damage of any kind, I and/or my own personal liability shall pay for such damages. My personal liability insurance company is and my policy number is. I. PROTECTIVE HEADGEAR WARNING I have been fully warned and advised by Compton/Holley Farm that the RIDER should purchase and wear protective headgear (riding helmet), and that the wearing of such headgear while mounting, riding, dismounting, and otherwise being around horses, may prevent or reduce severity of some head injuries and even prevent death from happening as the result of a fall or other occurrence. Minors 16 and under are required to wear protective headgear. J. LIABILITY RELEASE In consideration of Compton/Holley Farm allowing my participation in this activity, under the terms set forth herein, I, the RIDER, and the parent or guardian thereof if a minor, do agree to hold harmless and release Compton/Holley Farm its owners, agents, employees, officers, members, premises owners, insurers, and affiliated organizations from legal liability due to Compton/Holley Farm ordinary negligence; and I do further agree that except in the event of Compton/Holley Farm gross negligence and willful and wanton misconduct, I shall not bring any claims, demand, legal actions and causes of action, against Compton/Holley Farm and/or its associates, for any economic and non-economic losses due to bodily injury, death, property damage, sustained by me and/or my minor child or legal ward in relation to the premises and operations of Compton/Holley Farm to include while riding, handling, or otherwise being near horses owned by or in the care, custody and control of Compton/Holley Farm All Riders and Parents or Legal Guardians must sign below after reading this entire document: SIGNER STATEMENT OF AWARENESS I/WE, THE UNDERSIGNED, HAVE READ AND DO UNDERSTAND THE FOREGOING AGREEMENT, WARNINGS, RELEASE AND ASSUMPTION OF RISK. 6 THE UNITED STATES PONY CLUBS, INC. RELEASE, ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT FOR USPC NON-MEMBERS This document waives important legal rights. Read it carefully before signing. I AGREE for myself, and/or my child, my/our administrators and assigns, in consideration for my, and/or my child s, participation in this United States Pony Clubs, Inc. (USPC) activity to the following: I AGREE that I choose to participate voluntarily in an USPC activity, as a rider, driver, handler, lessee, owner, agent, spectator, volunteer, and/or trainer. I am fully aware and acknowledge that horse sports and USPC activities involve inherent dangerous risks of accident, loss, and serious bodily injury including, but not limited to, broken bones, head injuries, trauma, pain, suffering or death ( Harm ). I fully understand that this release covers, but is not limited to, inherent risks of an equine activity which mean a danger or condition that is an integral part of an equine activity, including but not limited to, any of the following: The propensity of an equine to behave in ways that may result in injury, death, or loss to persons on or around the equine; The unpredictability of an equine s reaction to sounds, sudden movement, unfamiliar objects, persons, or other animals; Hazards, including, but not limited to, surface or subsurface conditions; A collision with another equine, another animal, a person, or an object; The potential of an equine activity instructor to act in a negligent manner that may contribute to injury, death, or loss to the person of the participant or to other persons, including but not limited to, failing to maintain control over an equine or failing to act within the ability of the participant. I AGREE to release the USPC, its successors or assigns, officials, officers, directors, employees, agents, personnel, volunteers and affiliated organizations from all claims including, but not limited to, claims for money or property, disability, covenants, actions, suits, causes or action, obligations, debts, costs, expenses, attorneys fees, judgments, orders and liabilities of whatsoever kind or nature in law, equity or otherwise, whether now known or unknown, suspected or unsuspected, and whether concealed or hidden, including but not limited to any state or federal statutory or common law claim or remedy of any kind whatsoever arising out of or in any way connected with any Harm to me or my horse and for any Harm caused by me or my horse to others, even if the Harm resulted, directly or indirectly, from the negligence of the USPC or the USPC activity. I AGREE to expressly assume all risks of Harm to me or my horse, including Harm resulting from the negligence of the USPC or the USPC activity, and specifically agree to the applicable state statute/law regarding equine/farm animal activity liability and signed posting (if any), in any state in which I or my child participates in a USPC activity. A list of state statues and select portions of those statues believed to be in effect at the time of the execution of this agreement is attached hereto. I AGREE to review and understand the full applicable state statutes. I AGREE to indemnify (that is, to pay any losses, damages, or costs incurred by) the USPC and the USPC activity and to hold them harmless with respect to claims for Harm to me or my horse, and for claims made by others for any Harm caused by me or my horse in the USPC activity. I AGREE that neither I, nor any one claiming through me, will hereafter bring, commence, prosecute or maintain, or cause or permit to be brought, commenced, prosecuted or maintained, any suit or action, either at law or in equity, in any court in the United States or in any state thereof, or elsewhere, against the USPC, its successors or assigns, for, on account of, arising out of, or in any way connected with any Harm to me or my horse, and that neither I, nor any one claiming though me, will enforce, prosecute, or recover upon, or attempt to enforce, prosecute, or recover upon, any claim or right of action whatsoever, which I, or any one claiming though me, may now have or hereafter assert, in any way connected with claims for Harm to me or my horse, and for claims made by others for any Harms caused by me or my horse at the USPC activity. I AGREE this Agreement is the entire agreement of the parties, and supersedes all prior oral and written understandings and agreements. This Agreement may be modified only by a written amendment signed by both parties. I AGREE that if any provision of the Agreement is found to be invalid or illegal by a court of competent jurisdiction, the remaining provisions shall be construed as if the affected provision had not been included in order to effectuate the intent of the parties. In the event this form is signed by the parent/guardian of a child, then all representations and acknowledgements herein are expressly made by, for, and on behalf of the parent/guardian and child. By signing below, I AGREE to be bound by all applicable USPC rules and all terms and provisions of the USPC activity. I acknowledge that I enter into this release after having read the same, and place my signature hereto of my own free voluntary act and deed. By signing below, I represent to the USPC that I fully understand its contents, that I do not need any further explanation, and I waive any further explanation. 7 COMPETITOR ACTIVITY/ RALLY RELEASE Name of Competitor I AGREE for myself, and/or my child, my/our administrators and assigns, in consideration for my, and/or my child s, participation in all United States Pony Clubs, Inc. (USPC) activities (Club, Center, Regional or National) to the following: (1) I have executed a valid Release, Assumption of Risk, Waiver of Liability, and Indemnity Agreement that was submitted as a precondition to my membership in USPC. I understand and agree that Release, Assumption of Risk, Waiver of Liability, and Indemnity Agreement applies to this Rally and all other USPC events and activities, (2) I agree the acceptance of competitor as a participant in the Activity by the USPC does not constitute a determination of any nature by the USPC, its affiliates, employees and agents that the Activity is suitable, safe or otherwise appropriate, for Competitor, by reason of Competitor having attained any specific USPC Rating Level or otherwise, and that USPC makes no determinations, evaluation, representation or warranty to any such effect, (3) I understand the Activity and the jumps, courses and equestrian performances, competitions and activities (mounted or unmounted) constituting the Activity, any and all of which may, in fact, be more difficult and different than those constituting the jumps, courses and equestrian performances, competition and activities (mounted or un-mounted) used in establishing, testing for and assigning or awarding any USPC (or other organization s) Certification Level, (4) I understand that equestrian activities such as the Activity are inherently dangerous and that they accept the inherent risks involved therein (including, without limitation, the risk of injury, death and damage or destruction to or of horses and other property), (5) The decision to participate in this and all other USPC Activities, and any evaluation of the Competitor s ability to safely and competently participate therein, has been made at the sole and absolute discretion of the Competitor and Parent(s) and Competitor and Parent(s) accept complete responsibility for such decision and such participation, (6) Competitor and Parent(s) have read and understand the policies and regulations governing the United States Pony Clubs, Inc., participation in activities sponsored or operated by it, and specifically the rules of the Activity, and each agree to abide by such rules, as now in effect, and as amended and in effect from time to time hereafter, (7) Competitor and Parent(s) understand that failure to adhere to the code of conduct and/or policies and regulations may result in dismissal from the competition or other such action as deemed necessary by the officials of the competition. (8) Competitor and Parent(s) each hereby release and agree to hold harmless USPC, its officers, agents, representatives as well as the land owner, his heirs, estate, etc. from and against any claims and causes or action, Competitor or Parent(s) (or their respective successors, representatives, heirs or assigns) may have as a result of Competitor s participation in above stated Activity, (9) Participation in a USPC Activity/Rally is a privilege, not a right, and entry and/or participation may be refused at any time, with or without cause, for any reason, in the sole and absolute discretion of the Regional Supervisor/ Organizer, including but not limited to the determination that the entry and/or continued participation might obstruct the activity and/or reflect adversely on the USPC, (10) I expressly assume all risks of harm to competitor or competitor s mount, including harm resulting from negligence of the USPC or the USPC activity, and specifically agree to the applicable state statute/law regarding equine/farm animal activity liability and signed posting (if any), in any state in which competitor participates in a USPC activity. A true copy of the state statues in effect at the time of the execution of this agreement is included and incorporated herein, (11) I agree that that a facsimile of my signature provided to USPC may serve as an original signature showing my agreement to all terms herein and may be used for all purposes otherwise allowed for an original signature on file.
