2 Basic Principles of Employee Referral Business at Public Employment Service Offices Roles and Significance of Public Employment Service Offices The Constitution of Japan guarantees the people the freedom to choose their occupation and the right to work. In order to ensure these freedoms and rights, it is necessary to provide free employment referral services, thus enabling all job seekers access to fair and open employment referrals as part of the labor market safety net, the provision of which is an obligation of the national government. Basic Principles Basic principles have been put into place in order to allow for the fair and open operation of business tasks as part of the labor market safety net. (Refer to the next page for details.) Implementation System As of April 1, 2009, 550 public Employment Service offices have been established in order to provide services to citizens nationwide.
3 Basic Principles of Employment Referral Principle of Freedom Job seekers to whom job openings have been introduced shall not be pressured to work at said jobs. Employers to whom job seekers have been referred shall likewise not be pressured to employ said job seekers. Principle of the Common Good Employment referral shall be carried out such that benefits and profits do not redound solely to either job seekers or to employers. Principle of Referral of Eligible Job Seekers/Employers Job seekers shall be referred to jobs suited to their abilities, while employers shall be referred to job seekers in conformity with conditions of employment. Principle of Equal Treatment It shall be prohibited to discriminate against any job seekers or employers for any reason* except on the basis of labor ability. *Such as race, nationality, religious belief, gender, social status, family origin, former condition of employment, membership in a labor union, etc. Principle of Neutrality A neutral stance shall be maintained towards both laborers and employers. *Employment referrals shall not be carried out for places of business currently engaged in labor disputes. Principle of Clearly Posting Labor Conditions and Other Information Working details, wages, working hours, and other labor conditions shall be clearly posted for job seekers to see.
4 Flow of Services for Job Seekers Job-seeking Application Career Counseling Provide Information on Job Openings Employment Referral All job-seeking applications shall be accepted, except for those in violation of the law. The job-seeking application is to be filled out by providing job seekers' employment histories, as well as desired industries of employment, wages, working hours and working locations. This information will be registered in the Hello Work business system. Consultation regarding methods for seeking employment, suitable jobs, etc. Provide job-opening information *Nationwide job openings can be researched at any Hello Work location *Touch-panel job-opening search modules are in place to allow job seekers to easily search through job-opening information. Confirm labor conditions Hello Work staff contact the potential employer and set up interview dates, etc. If necessary, Hello Work staff request that employment conditions be eased Selection by Businesses
5 Flow of Services for Owners of Business Seeking Employees Job-opening Application Consultation Regarding Employment Conditions Post Job Listing Employment Referral Selection by Businesses All job-opening applications shall be accepted, except for those in violation of the law. The job-opening application is to be filled out with information on job details, wages, working hours, working locations and required experience, necessary qualifications, etc. This information will be registered in the Hello Work business system. Confirmation is made regarding whether employment conditions are in accordance with the status of the labor market. Advice is given to adjust employment conditions to make it easier to find suitable employees. In principle, job listings are publicly posted (on the Internet, and on the search system for job seekers in place at Hello Work locations). As needed, carry out job seeking interview events (wherein selection takes place by gathering owners of businesses seeking employees together in the same venue with job seekers aspiring to work at those businesses) and request referrals (wherein Hello Work, in accordance with the wishes of owners of businesses seeking employees, plays the main role in referring job seekers who meet the employment conditions to the owners of businesses seeking employees).
6 Example of Services for Owners of Businesses Seeking Employees (Supplement) When job openings are accepted, confirmation is made as to whether there are any violations of the law. Particularly exacting confirmation is made concerning potential violations of the labor laws. If there are any violations, then strict guidance is carried out. (Major confirmation items) Do working hours (including overtime hours), break times, wages, and other labor conditions satisfy minimum standards? (Labor Standards Act, Minimum Wage Act) If a mandatory retirement age system is in place, are unemployment insurance measures (raising the retirement age, continued employment, abolishing the retirement age) in place which are effective up to the age of sixty-five? (Laws pertaining to employment stability for the elderly, etc.) Are equal application opportunities provided regardless of age? (Employment Measures Act) Are equal application opportunities provided regardless of gender? (Equal Opportunity Employment Act for Men and Women) Furthermore, is usage being made by business owners of all available aid funds in an effort to employ those having difficulties in finding work? (Major aid funds) Job Development Fund for Specified Job Seekers Funds for businesses employing the elderly (those between 60 and 64 years of age), those with disabilities, single mothers, etc. Trial Employment Incentives Aid funds for businesses that employ younger workers (those under forty years of age), those with disabilities, single mothers, etc., in accordance with limited labor contracts for, in principle, three months. (These funds are disbursed in the expectation that regular employment will follow after the initial three-month period.) Special Incentives for Providing Full-Time Employment to Young People Aid funds for businesses that employ those who have worked extensively at part-time jobs (those between the ages of 25 and 39), who often experience difficulties in finding work.
