1 Long Term Care & Treatment and ODE's Role Mitch Kruska, Director, ODE Sam Ko, Educational Specialist, ODE Educational Programs Unit : Mitch Kruska, Director The Educational Program Unit is within the Student Services branch of the Oregon Department of Education and provides educational funding to the following programs: Hospitals Program Juvenile Detention Education Program (JDEP) Long Term Care and Treatment (LTCT) Youth Corrections Education Program (YCEP) 1

2 Who do these programs serve? Hospitals Program Students in hospitals (state and private) Juvenile Detention Education Program (JDEP) Students in county juvenile detention facilities (11 sites) Youth Corrections Education Program (YCEP) Students in OYA close custody facilities (10 sites) What is the purpose of LTCT? Originally the purpose was for the State of Oregon to pay for the educational services of State Agency placed students (Department of Human Services, Oregon Health Authority, and Oregon Youth Authority) in eligible day and residential treatment facilities In 2011, the Legislature changed the law making ODE responsible to pay for the educational services of all students placed in these programs (privately, parentally, and school district placed students). 2

3 ORS (3)(a) The school district in which an eligible day treatment program or eligible residential treatment program is located is responsible for providing the education of a student... (1)(b) Eligible day treatment program means a day treatment program with which the OHA contracts for long term care or treatment.. (1)(c) Eligible residential treatment program means a public or private residential program with which the OHA, DHS, or OYA contracts for long term care or treatment ORS Cont. (2) The department of education shall be responsible for payment of the costs of education of students in eligible day treatment programs and eligible residential treatment programs by contracting with the school district in which the eligible program is located. The cost of education does not include transportation, care, treatment, or medical expenses. 3

4 What is an eligible LTCT program? One of 47 original facilities that applied for funding in 1991 when the LTCT funding list was first created and came to be known as the Christie List because the Christie School program was the first name on the list. Prior and current LTCT funding is based upon the slot counts in these 47 sites. OAR Prior to the 2015 legislative session, LTCT funding was based upon the following: (2) The Department shall use the following formula for distribution of funding: (Service Level Factors) x [(the contracting district s NOE) x (state agency slots)] x 2 (3) If the total state funding available for all LTCT programs is less than the total state funding needed to fully fund each LTCT contract, the amount of state funding will be prorated. 4

5 HB 5016 Budget Note The following budget note was included in ODE s funding bill: The Oregon Department of Education is instructed to base the allocation of funding for long term care and treatment programs under ORS [Receipt of amount from State School Fund for children enrolled in certain programs] on a minimum staffing standard based on best practices instead of a per student basis. The minimum standard should be based on a ratio of staff to students approximately equal to: One teacher and two instructional assistants for up to 10 students or classroom; or One teacher and three instructional assistants per 15 students. The intention of the legislature was to assure that students in LTCT programs received equitable educational services to students in regular educational behavioral programs, i.e.: One teacher and two instructional assistants for up to 10 students or classroom; or One teacher and three instructional assistants per 15 students. 5

6 What are the LTCT funding sources? Federal Funds $2,596,556 7% LTCT Funding General Fund $15,813,867 45% State School Funds $17,333,132 48% Total $35,743,555 Who is served in LTCT? Many factors go into placement and treatment decisions for these students, and those decisions determine the length of a child s stay. Children can be placed into these programs by a public entity such as a school district, the Oregon Youth Authority, Department of Human Services, a private entity, or a parent. Placement had been for between a few weeks to over a year. However, with recent changes in children s mental health services, the average stay has been reduced to days. 6

7 What are the challenges facing LTCT? Insufficient funding to fully implement the MSL model and the 220 day calendar LTCT sites must meet the same educational standards and regulations as neighborhood schools, including Highly Qualified Teachers (HQT) Having appropriate students placed into the LTCT programs in a timely manner Issues with inadequate funding for the mental health services and the impact this is having on the individual facilities. What is the future of the LTCT programs? Given current funding available for LTCT there is no capacity to increase the number of programs sponsored by ODE. Given the budget note and the substantial changes to the LTCT funding model, ODE expects a $9.3 million deficit for the biennium unless the legislature provides the additional funding ODE s efforts to provide online educational courses available to all LTCT programs so that students can access HQ teachers and accredited classes to achieve graduation. 7

8 What is the future of the LTCT programs? (cont.) ODE intends to increase the school calendar from the current day school year to a 220 day school year given additional funding is provided by the legislature. ODE funds online pre and post assessments for all LTCT sites and access to remedial courses for students who are identified. ODE provides funding to LTCT teachers for professional development around utilizing assessment results to inform instruction. Questions??? 8
