It s the responsibility of dealers and salespeople to understand the requirements under the Act and to ensure compliance in all aspects of the business. 75 dealers were charged in April alone; another 36 have been charged since that time. 2 Your Advertising Checklist About the Dealer Does your ad include the dealership s: Name (as registered with OMVIC) Phone number Previous Use If applicable, does the ad indicate in a clear, comprehensible and prominent manner if the vehicle was previously: A daily rental (not required if subsequently owned by a consumer) A police cruiser or emergency services vehicle A taxi or limousine Current or Previous Model Year If the advertised vehicle is of the current or previous model year, does the ad disclose whether the vehicle is new or used Extended Warranties If an extended warranty is offered, does the ad include: The term of warranty The maximum claim limits (if any) All-In Price Does the vehicle price in your ad include: All charges related to the sale of the vehicle (e.g., freight and inspection charges, administrative fees, other fees, levies, taxes, etc.) If HST is not included, does your ad state in a clear, comprehensible and prominent manner that HST is not included in the price If two or more dealers are placing the ad, does the ad: State the actual price may be lower State any variable extra-cost items that have been excluded from the all-in price, a description of these items and the range of cost of each item Vehicle Availability If your ad has a price, have you ensured that the vehicle is available at that price If there is a limited number of vehicles available at the price advertised, does your ad indicate the number of vehicles available Disclosure Have you ensured disclosure statements are clear, comprehensible and prominent Dealer Principals Please ensure anyone who mounts advertising campaigns on behalf of your dealership fully understands all advertising requirements. Otherwise you run the risk of being charged, being the subject of a cease and desist order, or facing an order requiring all ads be pre-approved. Dealer Boards and Marketing Associations If you are part of a dealer board or marketing association, please ensure your fellow members, your manufacturer and your marketing firm understand the requirements. Where a fee or cost varies from dealer to dealer in a marketing group, the purpose and amount of the fee/cost (or range of the fee/cost) must be clearly and prominently stated.
3 A Detailed Look Ensure Your Business Name is Registered Registration of a business name with the Companies Branch of the Ministry of Services expires every five years. Operating with an expired certificate is an offence under the Business Names Act [Section 2(1)]. OMVIC s investigations have identified several areas in which compliance is often lacking. Failing to comply with regulations in these areas can lead to charges. When a dealer chooses to include a price in a vehicle advertisement, that price must include all charges a customer is required to pay (freight, pre-delivery costs, administration fees, etc.). If a dealer intends to include extra-cost items as mandatory, then the cost must be bundled into the advertised price. To be clear: the advertised price must be the Disclosure in fine print is not considered clear, comprehensible and prominent. sum total of all mandatory fees. The only exception may be MTO licensing. If taxes (HST) are not included in the advertised price, the ad must clearly, comprehensibly and prominently state so. If the vehicle is a previous daily rental that has not been subsequently owned by a consumer, an emergency service vehicle or a limousine, this fact must also be clearly, comprehensibly and prominently stated. Dealers are also reminded to review the Standards of Business Practice, 2010, available at: Your Guide to Credit and Leasing Disclosure Credit Advertising When advertising credit offers, the Protection Act, 2002 (CPA) requires dealers to disclose: The annual percentage rate for the credit agreement ( APR ) this figure must be disclosed as prominently as the advertised monthly, bi-weekly or weekly payments The length of the term of the credit agreement The cash price of the vehicle The cost of borrowing What if I m advertising a variety of credit offers? If an advertisement refers to various credit offers, you may use a representative example: Vehicle cost: $20,000 Credit offer: 60 5% Cost of borrowing: $2,645 Monthly payment: $377 PAge 2
4 at Advertising What if I m advertising credit offers on radio or billboards, where there are time or space limitations? When advertising a credit offer through a medium with limited space, a cost of borrowing example is not necessary. The APR, term and cash price of the vehicle are still required. Lease Advertising When advertising lease offers, the CPA requires dealers to disclose: That the offer is a lease The monthly, bi-weekly or weekly payment amounts The term The annual percentage rate for the lease this figure must be disclosed as prominently as the advertised monthly, bi-weekly or weekly payment amounts The amount of each payment to be made by the lessee before or at the beginning of the lease (e.g., down payment and security deposit) The amount of any other payment the lessee will be required to make in connection with the lease (e.g., end of lease obligations). If this amount cannot be determined, then dealers must disclose how this amount will be determined For leases with kilometre allowances of less than 20,000 km per year, the excess kilometre costs (e.g., 18,000 km/year, $0.20/km for excess) What if I m advertising a variety of lease offers? If an advertisement refers to various lease offers, you may use a representative example. What if I m advertising lease offers on radio or billboards, where there are time or space limitations? When advertising a lease offer through a medium with limited space, the following information is required as long as consumers are directed to another source * for the remaining details: That the offer is a lease The monthly, bi-weekly or weekly payment amounts Down payment and/or security deposit Contract Disclosure The new MVDA obligates dealers to ensure the person who is providing vehicle financing to a consumer provides that consumer with complete cost of borrowing information as required by the CPA. The key disclosure items required in both lease and finance agreements are: 1. The annual percentage rate ( APR ) 2. Monthly payment amounts 3. The term 4. The cost of borrowing for financing or implicit finance charge for leases 5. The total amount of all payments the borrower or lessee is required to make, as well as the timing and amount of each payment, including: Down payment Deposit Balloon payments Final payment Guaranteed residual value (open-end leases) 6. The cash price of the vehicle This list has been provided as a general guideline. Dealers should refer to Section 63 (for a finance agreement) and Section 74 (for a lease) of the CPA for the specific information required in either agreement. *Examples of acceptable sources include: dealer website, toll-free phone number with a pre-recorded message, advertisement in a local paper (this applies only to term and interest rate). See dealer for details is not an acceptable source; however, you may include a toll-free number and ask that the consumer call for details. PAge 3
5 .on.ca Understanding Auction Exemptions under the MVDA Although wholesale auctions do not require registration under the new MVDA, they must meet certain requirements to maintain exemption. Dealers should anticipate the following rules when visiting the auction: Auctions are required to control who gains access to the bidding floor. Only registrants are allowed in the bidding area; friends, spouses, mechanics and other guests are prohibited All those in the bidding area must wear visible photo identification Electronic or online auctions must be kept secure. Only registrants may gain access Sellers must provide all required vehicle disclosures (including collision history, accurate mileage and previous use, etc.). Auctions must use their best efforts to make sure disclosures are made by the seller. If the auction cannot arbitrate a serious non-disclosure concern about a transaction, dealers can still contact OMVIC with their concerns If requested by OMVIC, auctions must provide: Documents about any trade Records regarding persons allowed into the bidding area (in person and electronically) OMVIC will continue to monitor auctions to ensure compliance. A Note on APR and Cost of Borrowing/ Implicit Finance Charge Calculations The APR and cost of borrowing/ implicit finance charge must be calculated based on the cash price of the vehicle. This means that any costs that a lessee or a financing consumer is required to pay that are not required to be paid by a cash-paying consumer must be factored into the APR and the cost of borrowing/implicit finance charge, unless such cost has been specifically excluded by the CPA regulations (e.g., PPSA registration and search fees). Examples include: Vehicle price increases that are the result of the contract being sold from one dealer to another for the purpose of obtaining financing for the consumer Monthly administration fees (typically charged on wholesale and/or subprime lease contracts) Rebates, which are available only to cash-paying customers Administration fees charged by the dealer or the lender EXAMPLE: If the cash price of the vehicle is $10,000, but the finance/lease price is $12,000, then the $2,000 difference must be reflected in the cost of borrowing/implicit finance charge and APR.
