3 Introduction to ECDC The European Centre for Disease prevention and Control (ECDC) is an agency of the European Union, established by the European Parliament and Council Regulation 851/2004 of 21 April Its purpose is to identify, assess and communicate current and emerging threats to human health from communicable disease. Within this broad mission statement, the main technical tasks of the Centre fall into the following four categories: The publication of independent scientific opinions, bringing together technical expertise in specific fields through its various EU-wide networks and via ad hoc scientific panels; The provision of technical assistance to EU member states, communication of the Centre s activities and results and dissemination of information tailored to different audiences; The development of epidemiological surveillance at the European level and the maintenance of networks of reference laboratories; and Early Warning and Response based on round the clock availability of specialists in communicable diseases. Further information about the Centre can be found on the ECDC website The tender process The purpose of competitive tendering for awarding contracts is two-fold: to ensure the transparency of operations; to obtain the desired quality of services, supplies and works at the best possible price. The applicable regulations, namely directives 92/50/EEC, 93/36/EEC and 93/37/EEC, oblige the ECDC to guarantee the widest possible participation, on equal terms in tender procedures and contracts.

4 1. IT consultancy for advice, studies, and software development and software maintenance Overview of this tender 1.1 Description of the contract The services required by ECDC are described in the terms of reference in section 2 of the present tender specifications. In drawing up a tender, tenderers should bear in mind the provisions of the draft contract in Annex I. In particular, the draft contract indicates the method and the conditions for payments to the contractor. Tenderers are expected to examine carefully and respect all instructions and standard formats contained in these specifications and the invitation to tender. Tenderers must not be in any situation of exclusion under the exclusion criteria indicated in section 3.1 of these tender specifications and must have the legal capacity to allow them to participate in this tender procedure (see section 3.2.1). Please note that any attempt by a tenderer to obtain confidential information, enter into unlawful agreements with competitors or influence the evaluation committee or ECDC during the process of examining, clarifying, evaluating and comparing tenders will lead to the rejection of his tender and may result in administrative penalties. 5 1.4 Participation of consortia A consortium may submit a tender on condition that it complies with the rules of competition. A consortium may be a permanent, legally-established grouping or a grouping which has been constituted informally for a specific tender procedure. Such grouping (or consortium) must specify the company or person heading the project (the leader) and must also submit a copy of the document authorising this company or person to submit a tender. All members of a consortium (i.e., the leader and all other members) are jointly and severally liable to ECDC. In addition, each member of the consortium must provide the required evidence for the exclusion and selection criteria (see section 3 of these tender specifications). Concerning the selection criteria technical and professional capacity, the evidence provided by each member of the consortium will be checked to ensure that the consortium as a whole fulfils the criteria. The participation of an ineligible person will result in the automatic exclusion of that person. In particular, if that ineligible person belongs to a consortium, the whole consortium will be excluded. 1.5 Subcontracting If subcontracting is envisaged, the tenderer must clearly indicate in the tender which parts of the work will be subcontracted. The total value of the subcontracted part of the services cannot represent the total value of the contract value. Subcontractors must satisfy the eligibility criteria applicable to the award of the contract. One-person companies (or freelancers) may be authorised as subcontractor and added to the list of subcontractors at any time during the execution of the contract. If the identity of the subcontractor is not known at the time of submitting the tender, the tenderer who is awarded the contract will have to seek ECDC s prior written authorisation before entering into a subcontract. Where no subcontractor is given, the work will be assumed to be carried out directly by the tenderer. 1.6 Presentation of the tender Tenders must comply with the following conditions: Double envelope system Offers must be submitted in accordance with the double envelope system: The outer envelope or parcel should be sealed with adhesive tape and signed across the seal and carry the following information: the project title IT consultancy for advice and studies and software development and maintenance Framework service contract (OJ/25/06/2014-PROC/2014/023); the name of the tenderer; the indication Offer - Not to be opened by the internal mail service ; the address for submission of offers (as indicated in the invitation to tender letter) the date of posting (if applicable) should be legible on the outer envelope The outer envelope must contain three inner envelopes, namely, Envelopes A, B and C. The content of each of these envelopes shall be as follows: Page 5

Envelope A Administrative documents One original and one copy of: The signed, dated and duly completed Tender Submission Checklist using the template in Annex IX; The duly filled in, signed and dated Exclusion Criteria and Non-Conflict of Interest Declaration(s) as requested in section 3.1 and using the standard template in Annex II; The duly filled in, signed and dated Legal Entity Form(s) as requested in section and using the standard template in Annex III as well as the requested accompanying documents; The duly filled in, signed and dated Financial Identification Form 1 using the template in Annex IV; Financial and economic capacity documents as requested in section 3.2.2; The technical and professional capacity documents as requested in section 3.2.3; A statement containing the name and position of the tenderer s authorised signatory; and In case of consortia, a consortium agreement duly signed and dated by each of the consortium members specifying the company or person heading the project and authorised to submit a tender on behalf of the consortium (please see section 1.4 of these tender specifications). 2. Envelope B Technical proposal One original (unbound, signed and clearly marked as Original ) and one electronic copy on CD-ROM or DVD-ROM of the Technical Proposal, providing all information requested in section 4. All documents in electronic copy should be either Adobe Portable Document format (.pdf) or in standard Microsoft Office 2007/2010 format (i.e. doc and.xls) 3. Envelope C Financial proposal One signed original and four copies of the Financial Proposal, based on the format in found in Annex VII. Tenderers are welcome to submit in an environmentally friendly way, e.g., by choosing a simple and clear structure (list of contents and consecutive page numbering), double-sided printing, limiting attachments to what is required in the technical specifications (no additional material) and avoiding plastic folders or binders. This will not affect the evaluation of the tender Language Offers must be submitted in one of the official languages of the European Union. ECDC prefers, however, to receive documentation in English. Nonetheless, the choice of language will be not play any role in the consideration of the tender. 1 In the case of a consortium, only one Financial Identification Form for the whole consortium shall be submitted, nominating the bank account into which payments are to be made under the contract in the event that the respective tender is successful. 7 1.7 IT consultancy for advice, studies, and software development and software maintenance Confirmation of offer submission In order to keep track of offers due to arrive, tenderers who do not hand deliver their offers are requested to complete and return the form found Annex VIII. 1.8 Contacts between ECDC and the tenderers Contacts between ECDC and tenderers are prohibited throughout the procedure, except in the following circumstances: Written clarification before the deadline for submission of offers Requests for clarification regarding this procurement procedure or the nature of the contract should be done in writing only and should be sent by mail, fax or to: ECDC Attn: Procurement Office Stockholm, Sweden Fax: procurement@ecdc.europa.eu Each request for clarification sent to ECDC should indicate the publication reference and the title of the tender. The deadline for clarification requests is indicated in the timetable under section 1.2. Requests for clarification received after the deadline will not be processed. At the request of the tenderer, ECDC may provide any additional information or clarification resulting from the request for a clarification on the ECDC Procurement webpage: ECDC may, on its own initiative, inform interested parties of any error, inaccuracy, omission or other clerical error in the text of the contract notice or in the tender specifications by publishing a corrigendum on its website. Tenderers should regularly check the ECDC website for updates After the closing date for submission of tenders If, after the tenders have been opened, some clarification is required in connection with a tender, or if obvious clerical errors in the submitted tender must be corrected, the ECDC may contact the tenderer, although such contact may not lead to any alternation of the terms of the submitted tender Visits to ECDC premises No site visits at ECDC s premises are deemed necessary for this procedure Interviews No interviews are foreseen. 8 1.9 Division into Lots This tender is not divided into lots. The tenderer must be in a position to provide all the services requested Variants Not applicable 1.11 Confidentiality and public access to documents All documents presented by the tenderer become the property of the ECDC and are deemed confidential. In the general implementation of its activities and for the processing of tendering procedures in particular, ECDC observes the following EU regulations: Council Regulation (EC) No. 1049/2001 of 30 May 2001 regarding public access to European Parliament, Council and Commission documents; and Council Regulation (EC) No. 45/2001 of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. The tender process will involve the recording and processing of personal data (such as a tenderer s name, address and CV). Such data will be processed pursuant to Regulation (EC) No. 45/2001. Unless indicated otherwise, a tenderer s replies to questions and any personal data requested by ECDC are required to evaluate the tender in accordance with the tender specifications and will be processed solely for that purpose by ECDC. A tenderer is entitled to obtain access to their personal data on request and to rectify any such data that is inaccurate or incomplete. If you have any queries concerning the processing of your personal data, you may address them to the ECDC Data Protection Officer dpo@ecdc.europa.eu. You also have the right of recourse at any time to the European Data Protection Supervisor for matters relating to the processing of your personal data 1.12 Contractual details Draft contract is attached to these technical specifications as Annex I. The terms and conditions of the draft contracts cannot be modified. Tenderers must confirm acceptance of these draft contracts and terms and conditions of the tender as part of their tender response. It is strongly recommended that Tenderers have the draft contracts checked and passed by their legal section before committing to submitting an offer. ECDC wishes to conclude multiple framework contracts with reopening of competition with a minimum of 3 and a maximum of 5 economic operators providing consultancy services for ICT for an initial period of two years, with two possible extensions of one year each, giving a maximum possible duration of four years. A framework contracts will establish the terms governing specific contracts to be awarded during a given period; in particular, with regard to price. Signature of the framework contract imposes no obligation on the Centre to order services. Only the implementation of the framework contract through specific contracts is binding for ECDC. Multiple FWCs with reopening of competition are awarded on the basis of offers and without any priority amongst contractors. The offers will be considered as maximum prices for the reopening of competition. For each specific project ECDC will send a request for services to all contractors on the list. A specific contract will be signed with the awarded contractor after evaluation of the best offer according to the award criteria in section 4. The framework contract will be implemented via specific contracts on a time and means (TM) basis. Page 8

9 Each specific contract will contain details of deliverables and timelines for particular services to be provided Contract volume The volume of the contract shall not exceed EUR 20 Million (twenty million euro) for a maximum period of four years Additional information By virtue of article 134(1)(f) and article 134(3) of the Rules of Application of the Financial Regulation, ECDC reserves the option to launch further negotiated procedure, with the contractor chosen as a result of the present call for tender, for new services consisting in the repetition of similar services during the three years following the signature of the original contract. IT consultancy for advice, studies, and software development and software maintenance Terms of reference The terms of reference will become an integral part of the contract that may be awarded as a result of this tender procedure. 2.1 Introduction: IT in ECDC The Unit is providing equipment to users, software services by in or outsourced means, hosting, maintenance and support services. IT assets in ECDC are since June 2012 centralised in a unit of circa 35 staff plus equivalent number of in-house consultants. ECDC uses innovative and leading edge technologies to provide effective and secure information access, business supporting applications and computing services to support ECDC in its mission to identify, assess and communicate current and emerging threats to human health posed by infectious diseases. 2.2 The technology standards ECDC hosts and develops several applications for internal and external use. For methodological approach to the development and life cycle management of Information Systems several methodologies mainly Agile and unified process, are used. The supporting tools and documentations are based on UML. The recommended Web based architecture is layered and relies on well recognised Object-oriented Analysis and Design (OOAD) and Object-oriented Programming (OOP) best practices and techniques. 2.3 The environments The presentation tier, in the client, is built on HTML pages; The business tier relies on an application server. This application server is either a SharePoint application server, or an ASP.NET server; The persistence tier consists in MS SQL servers; The development environment is based on Microsoft Visual Studio and Microsoft Team Foundation server. 2.4 The information systems ECDC hosts a number of administrative applications as well as business critical operational applications. The current systems are listed in section New systems are anticipated TESSy (The European Surveillance System) The European Surveillance System (TESSy) is a highly flexible metadata-driven system for collection, validation, cleaning, analysis and dissemination of data. Its key aims are data analysis and production of outputs for public health action. All EU Member States (28) and EEA countries (3) report their available data on communicable diseases (49) as described in Decision No 2119/98/EC to the system. Apart from routine surveillance, TESSy has replaced the data collection systems in place for the Dedicated Surveillance Networks (DSNs) to provide experts with a one-stop-shop for EU surveillance data. Prior to May 2005 when ECDC was established, there were 17 DSNs that collected data on a variety of diseases. All Member States submitted data individually to every DSN, using different file specifications. With TESSy the ECDC aims at: With TESSy the ECDC aims at: Standardisation of data collection on infectious diseases surveillance; One single point of reporting and retrieving data; Standardisation of reports based on surveillance data; Providing a consistent overview of the current situation in the EU. 11 Technologies: ASP.Net, C#, MS SQL, SSRS, SSIS, AppliedMaths BioNumerics Epidemic Intelligence EPIS The Epidemic Intelligence Information System (EPIS) is a communication platform for the exchange of non-structured and semi-structured information regarding current or emerging public health treats with a potential impact for the EU. It aims to ensure coordination and to strengthen collaboration among the various national public health authorities regarding the early detection and timely response to communicable disease related health threats. Existing functionality of current EPIS installations includes: Urgent Inquiries discussion forums both Ad-Hoc and permanent; Alerts and announcements HelicsWin Technologies: SharePoint, C# HelicsWin.Net is a tool for surveillance of healthcare-associated infections (HAI) in Intensive Care Units (ICUs). The tool will be used by hospital/icu surveillance staff to enter, export and analyse data collected following according to the ECDC HAIICU protocol and an optional validation dataset. HelicsWin.Net is a free standalone software (freeware distributed on ECDC website), which can be translated and customised using user variables. Technologies: WinForms, C#, MS Access Document Management System (DMS) ECDC Portal ECDC Intranet ECDC Extranet The document management system (DMS) is a secure central repository for all its official documents. The system will automatically manage versions of the documents, control access based on user permissions, and monitor any changes to the document status. Technologies: SharePoint, C# ECDC portal is the corporate web portal of ECDC. Technologies: SharePoint, C# Intranet is both the communication tool for ECDC staff but also the platform for collaborative workspaces for internal use. Technologies: SharePoint, C# The ECDC extranet is a platform for external collaborative workspaces for ECDC. ECDC extranet provides basic tools for collaboration like discussion forum, announcements, common calendar, alerts and document sharing. Technologies: SharePoint, C# Page 11

12 2.4.8 TS (Terminology Server) IT consultancy for advice, studies, and software development and software maintenance TS (Terminology Server) the goal of ECDC TS is to support / ensure semantic interoperability among ECDC ICT applications. ECDC TS application provides terminology data (terms, their attributes and their semantic relations) in six ECDC relevant shared domains (as e.g. diseases, pathogen organisms, etc.) and application specific value sets. The TS is a bespoke application that has human and machine user interface, communicating via standard web services. Applications querying the TS will get well formed XML files in standard SKOS format. This application is in production. Technologies: ASP.Net, C#, MS SQL Knowledge Navigation & Enterprise Search (KN&ES) The KN&ES is a Microsoft SharePoint FAST search engine implementation that retrieves information in parallel from several ECDC content providing applications, using semantic support by rich content describing metadata. Technologies: SharePoint, FAST, C#, Managed Metadata Service EULabServe EU Lab directory which an online directory of laboratories and their specialisation in microbiology tests, the project scope is create an online form that can completed by 500 plus laboratories to document their specialisation in microbiology Technologies: ASP.Net, C#, MS SQL MIS (Management Information System) The Management Information System (MIS) is an application that gives an overview of ECDC activities as described in its Annual Working Programme, in compliance with ECDC Multi-annual Strategy. It enables to view, plan and monitor activities in a user-friendly way. Technologies: Silverlight, C#, MS SQL CRM (Customer management system) CRM stands for Customer Relationship Management but at ECDC the term customer could be replaced by stakeholders The central component of the CRM solution is the creation of a single shared stakeholder database allowing information to be collected once but used many times Project s goal is to set CRM to be the primary business system: across the whole of ECDC, for maintaining details of contacts with which the organisation engages in which the relationships with these contacts are managed to provide a view of the entirety of the nature of the relationships that ECDC has with this broad range of contacts, in order to add business context to the core contact information - and for CRM to represent a complete, consistent & contextrich view of these relationships Page 12

13 Technologies: MS Dynamics, SharePoint, MS Forefront Identity Management SARMS SARMS (Scientific Advice Repository and Management System) is a tool to manage scientific advice Requests directed to ECDC. ECDC Intranet is based on SharePoint Technologies: SharePoint, C# 2.5 Description of the services & scope of the contract The services expected consist of the provision of skilled individuals to participate in project teams to contribute in delivering IT services to the Centre (IT consultancy for advice, studies, software development and software maintenance). These services will be subject to conditions that are set out in a form of service level agreement (SLA). A model of the SLA is in Annex X Practicalities for service delivery Personnel It is the Tenderer s responsibility to propose an adequate team organisation (including structure, responsibility allocation and reporting lines), the necessary set of profiles and team size to perform the activities and deliver the required services. The contractor shall nominate an Account Manager, who will be the point of contact for technical and operational issues related to the provision of the services. This Account Manager shall be in charge of: Human resources management of the contractor's personnel; Quality management and reporting; Financial management; Organisation of follow-up meetings. This Account Manager should have experience of at least 3 years in the fields listed above. The working language (written and spoken) is English. The Account Manager must be reachable during the normal working hours of ECDC that is between 08:00 until 18:00 CET Service prices Service prices shall include all general expenses as well as expenses directly related to the provision of the services such as company management costs, social security costs, and travel and office expenses. The offered prices in the framework contract are considered as maximum prices. The contractor may choose to offer lower prices in the specific reopening of competition Languages Fluent working knowledge of English is required for all profiles Training As a rule, ECDC will not take charge of the training of the contractor s consultant. The contractor needs to plan at least 5 days training course per year for its consultant. Page 13

14 On the other hand if ECDC asks the contractor s consultant to follow a training necessary for the work (e.g. Business procedures or application functionalities), it is considered as a normal working day paid by ECDC Declaration of absence of interest and confidentiality undertaking A declaration of absence of interest and undertaking of confidentiality signed by each consultant will be asked before starting a new assignment at ECDC. A model declaration is in Annex XII Replacement of consultant (staff or freelancer) and notification of illness The contractor must ensure a high degree of stability of the consultant providing services and a high degree of service quality. These requirements will be followed up through performance monitoring in regular meeting with the chosen contractor. It shall be the contractor s responsibility to manage the replacement of personnel to ensure that knowledge and information are transferred without an interruption of the services and that a high level of service quality is maintained at all times. At ECDC s demand, the contractor must replace personnel who prove incapable of carrying out the specified tasks to the required standards. The contractor shall give at least one month s written notice to ECDC for request of any personnel change. In case of replacement of consultant, the contractor is in charge of maintaining the continuity of the services. Regardless of the cause of the consultant replacement, ECDC cannot be charged for any extra cost (including hand-over activities and training) owing to consultant replacement. The replacement personnel will be given sufficient training during an adequate handover period, so that he/she may be immediately operational when the original candidate is withdrawn. Any such replacement and training, if required, will be carried out at no additional cost to ECDC. In case of 'force majeure', if the original personnel is no longer able to carry out the work, the contractor is obliged to inform ECDC, immediately provide a competent replacement personnel and arrange sufficient training (during an adequate handover period where possible) to guarantee continuity of the service provided to ECDC. Any such replacement will be effected at no additional cost to ECDC. In case of replacement of consultant, the handover period must be 10 working days, free of charge for ECDC. If no handover is possible and additional training is needed for the replacement person, 15 working days must be performed free of charge for ECDC by the replacement person. In case of replacement of consultant, the contractor must propose a minimum of two replacement persons with the required qualifications and experience for the profile. If the contractor does not propose suitable replacement, ECDC may terminate the specific contract according to II If a consultant designated by the Contractor to undertake the performance of specific contract is taken ill and is unable to come to the office, the Contractor shall notify the ECDC contract manager before on the first day of suspension of the provision of services and shall indicate when services will resume. The consultant in question should also notify the project manager directly Working hours For times and means delivery, a normal working day corresponds to 8 hours (40 hours per week). The daily working time frame is between 8:00 CET and 18:00 CET and the presence Page 14

15 is normally required between 9:00 CET and 12:00 CET and between 14:00 CET and 16:00 CET (15:30 CET on Fridays). In exceptional cases of extended services (e.g., continuous support service between 8:00 CET and 18:00 CET), specific times can be requested by ECDC (e.g. 8:00 CET to 16:00 CET or from 10:00 to 18:00) Stand by duty service Upon request stand by duty service may be required. The conditions and prices offered for the stand by duty service should be described in the offer. The consultants would be on weekly basis rotation taken in stand by duty mode one each week. During outside office hours (between 18:00 CET and 8:00 CET), weekends (Friday 18:00 CET until Monday 8:00 CET) and ECDC holidays (between 18:00 CET and 8:00 CET) the consultant will be provided with a phone and laptop and should be available to perform work in requested by ECDC. Primary the stand by duty service will be provided via remote access off site, but in case of need the consultant should be available on site within 1 hour.
