1 Desert Community College District Employment Agreement For Off-Campus Employers This Agreement is between Deseli Community College District, hereafter known as the "DCCD," and, hereafter known as the "EMPLOYER" for the purpose of employing the following CalWORKs "STUDENT". j(' I vdsa K LA The Term of this Agreement is from Del 1. )OiS through_~m~av!..-".3"",1,~2,,,o,,"16,,-, GENERAL PROVISIONS The Employer agrees: I. To comply with all requirements of the CalWORKS Work Study Program with all related Laws, Regulations and Policies. 2. To be responsible for workers' compensation insurance and all employer taxes, i.e., FICA, unemployment. 3. To comply with Titles IV and VII oftbe Civil Rights Act of 1964 (PL ) which prohibits discrimination on the grounds of race, age, handicap, color, national origin, sex, political affiliation or beliefs. 4. To invoice DCCD for reimbursement of STUDENT'S earnings on a monthly basis, providing DCCD copies of STUDENT'S pay stubs and timesheets, and EMPLOYER'S earnings records for STUDENT. 5. To maintain commercial general liability insurance, auto liability insurance and/or garage liability insurance, as appropriate, to cover any claims damages, losses, causes of action or demands, or any other liability in connection with or in any manner arising out of the EMPLOYER'S performance oftbe work contemplated by this Agreement. EMPLOYER will provide certificates of insurance upon the request of DCCD. 6. To defend, indemnify and hold DCCD and its officers, employees and agents, individually and collectively, from all claims, damages, losses, causes of action and demands, or any other liability in connection with or any manner arising out of or in connection with the EMPLOYER'S performance of the work contemplated by this Agreement. 7. To not employ the STUDENT in the construction, operation or maintenance of any part of any facility which is used for religious instruction, worship or political activities. 8. To provide STUDENT a safe work environment which is neither high risk or hazardous. 9. To compensate STUDENT at such rates, including periodic increases, as are reasonable considering such factors as industry, geographic region and STUDENT proficiency. In no event shall the rate be less than the highest oftbe following: (a) the minimum wage rate specified in Section 6(a)(1) oftbe Fair Labor Standards Acts (b) minimum wage rate prescribed by applicable state or local law (c) the CalWORKS Work Study Program agreement 10. To cover Student in EMPLOYER'S grievance procedure, when applicable. 11. To allow DCCD and authorized representatives of appropriate County, State, and Federal agencies tbe rigbt to observe and monitor conditions and activities involved in the performance of this Agreement and tbe right to verify data submitted with respect to this Agreement by examining relevant records and documents during the EMPLOYER'S normal business hours. 2 DCCD agrees: I. To pay EMPLOYER an amount not to exceed 50%. of wages to a maximum of $5,000 in accordance with the Payment Schedule contained in attachment A. 2. To reimburse EMPLOYER a percentage share of work study on-the-job training as agreed to in Attachment A. The reimbursement shall not include payment for payroll taxes, vacation time, holiday pay, sick leave, union dues, jury duty, etc. Both Parties Agree: I. No alteration or variation of the terms of this Agreement shall be valid and/or binding unless made in writing and signed by the parities hereto. There are no oral understandings or agreements incorporated herein. 2. EMPLOYER, and agents and employees of EMPLOYER in the performance ofthis Agreement, shall act in an independent capacity and not as officers, employees or agents of DC CD. 3. Should the STUDENT drop enrollment at DCCD, this Agreement will terminate. Termination of Agreement I. All records pertinent to the program including payroll records, shall be maintained for a period of five (5) years from the expiration date of this Agreement. Records pertaining to unresolved audit findings must be maintained until final resolution of the audit. 2. This agreement may be terminated or funds suspended in whole or in part for cause, including failure of the EMPLOYER to comply with the terms or conditions of this Agreement or any other related CalWORKS Work Study Program agreement. 3. Either party may terminate this agreement, without cause, upon ten (I 0) days prior written notice to the other party. DCCD may immediately terminate this agreement at such time as funds are not made available through the State of California for the purpose of carrying out this Agreement or due to any CalWORKS funding short falls. 3 Addendum B The Student Agrees: 1. To adhere to the employer's work schedule, policies and procedures. 2. To assume personal and professional responsibilities for actions and activities. 3. Use a courteous, enthusiastic, and professional approach to policies and procedures within the employer's organization. 4. To work effectively with peers and supervisors. 5. To promptly notify EMPLOYER of any circumstances that would prohibit adherence to work the agreed upon work schedule. 6. Work with employer each month to submit the 50% reimbursement for payment by the 3 rd day of each month to be paid on the 20 th of the month. I have read the above employer guidelines and agree to abide with these agreements.

4 Addendum C College of the Desert CalWORKS agrees: 1. To refer only eligible students to the Employer. 2. To notify Employer of any changes that may affect a student's continued eligibility. 3. To review with the Employer and Student the terms of the program. 4. To prepare student for employment process. 5. To review student's progress on a monthly basis with the Employer and the Student. 5 Addendum D The Off-Campus Employer agrees: 1. To review with the Student the terms of employment. 2. To notify COD if the Student is no longer working. 3. To submit the 50% reimbursement for payment by the 3 rd day of each month to be paid on the 20 th of the month (refer to payment schedule). Failure to submit reimbursement on time will result in non-payment. Pay stubs and timesheets need to be attached to the reimbursement invoice.
