4 Section 79 BACKGROUND In 1964, Section 79 was added to the Internal Revenue Code IRS Revenue Procedures and provide safe harbors to determine the fair market value of an insurance policy. By 2006, several insurance companies revisited Section 79 and engineered specialized insurance products to correspond to the new IRS guidance.
