3 What is a CDFA? How do CDFAs help divorcing people? The role of the CDFA is to assist the client and his/her lawyer to understand how the financial decisions he/she makes today will impact the client s financial future. After his divorce, David went to a financial advisor to determine how to best position his assets. Together, David and his planner decided to do a total financial plan for him. During the planning session, it became apparent that during his marriage his wife had done all of the investing. She chose all the investments, made all the decisions, and invested all the money. At the time of their divorce she said, Let s just split everything 50/50. You take this half of the assets and I will take that half. Is that OK? David answered, Well, I guess that sounds pretty fair. That s OK with me. Unfortunately, there was something he neither knew nor understood; neither did his lawyer, and neither did the judge. They didn t realize that David would have to pay taxes on his half of the assets when he tried to access them. His ex-wife, on the other hand, could access her half of the assets tax-free. His 50/50 split cost him an additional $18,000 in taxes. Had David met with a CDFA before the divorce was finalized, he would have been in a better position to ask for a more equitable settlement. This parable has an unfortunate ending, but pre-divorce financial counseling can help people going through a divorce arrive at a settlement that is fully understood by all involved. Who do people turn to for such assistance? When people think about getting a divorce, the first professional that comes to mind is an attorney. Typically a financial advisor whether it is a CPA, CFP, or a CDFA is not considered until later in the divorce process or even until after the divorce is final. Financial problems can tear a marriage apart, and are often the primary factor that leads to divorce. Once a decision to separate or divorce has been reached, all sorts of questions bubble to the surface. These questions are often clouded by wounded emotions and accompanied by mutual accusations, which comes as no surprise. If a couple cannot solve their financial difficulties while the marriage was underway, it is unlikely that they will be able to agree on pressing financial issues when it has fallen apart. Many divorcing couples have questions such as: How do we value our property? What tax issues must we be concerned with? How do we divide retirement funds and pensions? How will the lower-earning spouse survive financially? What additional financial support does that person need? Who gets the house? These are the questions that divorce lawyers face with each divorce case. Many lawyers struggle with the intricate financial details that concern tax issues, CRA rulings, capital gains, dividing pensions, and so on. Lawyers attend law school to become experts in the law, not to become financial experts. This is why more and more lawyers have seen the virtue of bringing a financial expert into the divorce process at the very start. Solid information and expert analysis are important resources in their search for the best possible resolutions for their clients. Fortunately, with the advent of Certified Divorce Financial Analysts and Divorce Settlement Analyst Software, help is on the way. CDFA s Responsibilities and the Team Approach The role of the CDFA is to help both client and lawyer understand how the financial decisions made today will impact the client s financial future, based on certain assumptions. A CDFA is someone who comes from a financial planning, accounting or legal background and goes through an intensive training program to become skilled in analyzing and providing expertise related to the financial issues of divorce. The CDFA : Becomes part of the divorce team, providing litigation support for the lawyer and client, or becomes a member of a Collaborative Law team. In either event, the CDFA will be responsible for: Identifying the short-term and long-term effects of dividing property. Integrating tax issues. Analyzing pension and retirement plan issues. Determining if the client can afford the matrimonial home and if not, what might be an affordable alternative. Evaluating the client s insurance needs. Establishing assumptions for projecting inflation and rates of return. Bringing an innovative and creative approach to settling cases. The Certified Divorce Financial Analyst also provides the client and lawyer with data that shows the financial effect of any given divorce settlement; is familiar with tax issues that apply to divorce; has background knowledge of the legal issues in divorce; and is trained to interview clients so as to collect financial and expense data, help client s identify their future financial goals, develop a budget, set retirement objectives, determine how much risk they are willing to take with their investments, identify what kind of life style they want, and determine the costs of their children s education. I have a Bachelor of Science degree in Social Work, Cum Laude, from Florida State University, and earned my law degree with honors from the University of Arkansas at Little Rock. I began my legal career as an attorney at the Department of Children and Families in Daytona Beach in September of 2004, where I litigated civil juvenile dependency cases until leaving DCF to join the Florida Guardian ad Litem Program in May of I remained at the GAL Program as a Senior Program Attorney for the next six years. I went into private practice after I married my husband, Donald B. Dempsey, Jr. I currently handle family law cases and civil cases, including evictions, ejectment and tax deed interpleader actions. I work with my husband as well, and have assisted him on many of his criminal and family cases. My husband and I have an eighteen month old son, Grayson, and we are active members of our church, First Assembly in DeLand. I have practiced in different areas of the law for almost ten years (as of Sept.) I have experienced many different judges, opponents, courtroom situations and clients. I know what it is like to represent a child who has been in and out of 5 foster homes, or more, and who feels like she has no voice in the outcome of her own life. I know what it's like to represent a landlord who has bent over backwards for a tenant, and just wants what is lawfully theirs, possession of their property back. I have represented parents accused of being drug addicts and alleged neglectful parents, who just want their day in court. I have represented the government, and I have represented the people. I have been in front of many different types of judges, and have seen the different ways in which they rule their courtrooms. I will preside with impartiality to all people, and all matters. I will be professional, respectful, and faithfully and impartially uphold the law. I believe that a judge needs to have these different experiences, and that is why I believe I will be a good judge. Contact Information: morfinger@uww-adr.com Over the last few months, the question I have been asked most often is, Why do you want to be a judge? Some may think that I simply want to follow in my father s and brother s footsteps, but that answer would at best be incomplete. A more accurate answer is that after years of watching those two profoundly influential role models, as well as so many other mentors who have become judges, I know the bench is where I can best serve the citizenry and the legal profession. The extraordinary number of judicial retirements this year means that next January, six of the 27 Circuit Judges of the Seventh Circuit will either be brand new to the bench or served less than one year. Many businesses would stagger or fail under the weight of such high turnover, but courts do not have that option. The incoming generation of judges must be committed to upholding the standards of excellence and integrity the citizens of our circuit deserve. I share that commitment, and I want to be part of that next judicial generation. My experience makes me uniquely qualified to serve as a judge. Over the last 25 years, I have been not only a litigator, but a mediator and arbitrator as well. I have represented individuals and businesses in the courtroom on a variety of legal issues. As a mediator, I help the parties find solutions to their legal problems. When I serve as an arbitrator or hearing officer, I decide cases on their merits as a judge would do. My service as a neutral for over 12 years has been invaluable training for a career as a judge. I have consistently demonstrated my commitment to ethics and integrity in our profession. In the past, I have served on and chaired a Grievance Committee. Since 2011, I have served The Florida Bar as a voluntary fee arbitrator, helping lawyers avoid potential grievances by dissatisfied clients. I also teach CLE courses on ethical negotiation for lawyers and mediators alike. Without a commitment to ethics, the judiciary cannot maintain the respect of the public. That respect is vital to the judicial system, a fact of which I will always be mindful. It would be my honor to earn your vote for Circuit Judge on August 26 th.

8 Karen Adams Foxman Circuit 7 Group 18 Admitted to the Florida Bar in 1996 Practice Areas: Criminal and Family Law Contact Information karenfoxmanforjudge@gmail.com Karen Adams Foxman began her legal career in 1996, serving as a young prosecutor in Volusia County after obtaining her undergraduate degree from University of North Carolina-Chapel Hill and law degree from Campbell University. Foxman quickly became a very successful prosecutor. She handled successful prosecutions, spanning all levels, including juvenile, misdemeanor and felony. Mrs. Foxman has tried hundreds of cases. For her performance in jury trials, she was recognized by receiving the State Attorney Top Gun award in After a successful career as a prosecutor, Mrs. Foxman joined a local law firm where she established herself as a prominent Family Law attorney. In this capacity, Foxman obtained valuable civil trial experience, but also witnessed firsthand the extreme emotional turmoil from clients facing family separation and child custody battles. These experiences motivated her to reach out to the less fortunate, and since have been recognized for her extensive Pro Bono volunteer hours for families that cannot afford an advocate for children by serving as a volunteer guardian ad litem. In 2011, Mrs. Foxman returned to the Office of the State Attorney, where she serves as Director of Operations for Volusia County, the largest county in the circuit. She currently supervises over 45 career prosecutors as well as supervising other staff members. Foxman has also been passionate about improving the quality of legal services in Volusia County. She was selected by her peers to serve as President of both the Volusia County Bar Association and the Volusia/ Flagler Association of Women Lawyers. In her spare time, Karen enjoys spending time with her husband Matt, of 12 years, and their four-year-old son, Caden. In addition to precious time with family, Karen s hobbies include reading and running.

I graduated from DeLand High School and attended Tufts University in Boston, MA where I graduated summa cum laude with a degree in Psychology. I attended UF Law School and graduated in 1987 with honors. I was a member of the UF Law Review. Early in my career, I was an Assistant State Attorney in Jacksonville. In 1992, I returned to Volusia County and joined the law firm of Sands White & Sands, where I am currently the managing partner. I am a recent past President of the Volusia County Civil Trial Attorneys Association and have served as an officer or director of several non-profit Volusia County organizations, including the House Next Door, Inc., DeLand Breakfast Rotary and the Sands Theatre Center, Inc, which operates the historic Athens Theatre for the benefit of the West Volusia Community. I ve made the decision to run for Circuit Judge because I believe I have the knowledge, experience and temperament to do the job well. I know the pressures faced by the working lawyer and small business owner. If I have the privilege of serving, I promise to be accessible and accommodating to everyone who appears before me. A judge should be a facilitator rather than a dictator. As a Circuit Judge, I would endeavor to make my courtroom a place where parties can litigate their disputes in an efficient and cost-effective manner and where the attorneys are appreciated as indispensable officers of the court. A judge s demeanor should reflect these goals. We are fortunate that we have so many good judges in the 7 th Circuit who believe as I do. I would be honored to be one of them.

10 Steven N. delaroche Circuit 7 Group 20 Admitted to the Florida Bar in 1989 Practice Areas: Criminal Trial, Family Law, Business Law, Labor and Employment Law Contact Information: or cell Stevendelaroche@aol.com I have chosen to run for Circuit Court Judge because I truly believe I can improve our system of justice. Our present court system suffers from overcrowding, and sluggish docket movement. The hallmarks of my previous tenure on the bench were efficiency and humanity. I created several time-saving systems that allowed my docket to offer more useable hearing time during the average week than many of my colleagues. My courtroom was known as a place where everyone was listened to, and their opinion considered before rendering a decision. Too often in our current court system, judges treat the people before them as if what they have to say is not important, or they do not have the time to hear them. I look forward to building on my past experience as a leader (Chief Administrative County Judge-elected ) in not only improving my assigned docket, but working with other judges to find ways to improve the system as a whole. I am the only candidate running in my race with prior judicial experience. As a twice-elected County Court judge in Volusia County, I presided over a total of 32,600 cases, both civil and criminal. I have made the tough decisions regarding guilt or innocence, liability, and punishment. I am a graduate of both the National Judicial College in Nevada, and the Florida Judicial College. I have tried over 200 cases as an attorney, both as prosecutor and defense attorney, and civilly as plaintiff's and defendant's counsel. My overwhelming experience compared to my opponents makes me the clear choice for Circuit Judge in this race. When I was on the bench I had a reputation for fairness and efficiency. Attorneys practicing in my courtroom always knew that their clients would get my full consideration, that my decisions would be well reasoned and full explained. The most important issue facing courts in the state of Florida is docket overcrowding. The legislature has refused to allocate more judicial positions despite rising caseloads due to population increase and the foreclosure crisis. People find that it takes longer to resolve their court cases because dockets are overcrowded, and hearing time is limited. This situation leads to gross injustice in both civil and criminal cases as the court system cannot provide a quick resolution to problems. This is not unlike the current Veterans Administration crisis, with Vets dying because they cannot receive care in a timely basis. My proven record for efficiency and orderly management of case dockets demonstrates that I am the proper person to solve this problem. As the old adage says, "Justice delayed is justice denied."

11 Adam Warren Circuit 7 Group 20 Admitted to the Florida Bar in 2004 Practice Areas: Criminal, Civil and Family Law Contact Information: adamwarrenforjudge@gmail.com My father, Dan Warren, was a former State Attorney, and my mother, Stasia Warren, was a county judge for more than twenty-two years. My legal education effectively began thirty-three years ago when my mother started taking me to court to watch jury trials. My parents taught me at an early age what was important in life: personal character, professional ethics, and a commitment to public service. I have carried these lessons with me throughout my life and career. I started my legal career as an Assistant State Attorney for the Seventh Judicial Circuit in Saint Augustine. I prosecuted everything from driving under the influence to capital murder. I performed legal research; interviewed witnesses and victims; made filing decisions; prepared charging documents, motions, discovery exhibits, legal memoranda, proposed orders, and responses to motions for postconviction relief; conducted discovery depositions; attended court hearings; advised law enforcement officers on criminal proceedings and legal issues; reviewed and prepared applications and affidavits for arrest warrants, search warrants, cell phone records, and the installation of mobile tracking devices; prepared subpoenas duces tecum for investigations; and represented the State in the Saint Johns County Adult Drug Court Treatment Program. Several of criminal cases were covered by the Saint Augustine Record. In November 2012, I started working as a Career Attorney/Law Clerk for the Honorable Wendy Berger at the Fifth District Court of Appeals. My clerkship required me to review appellate briefs, records and case files; perform legal research; analyze legal issues; prepare legal memoranda; and make recommendations to affirm or reverse circuit court decisions in diverse areas of law: Family, Criminal, Dependency, Administrative, Education, Contracts, Probate, Insurance, and Personal Injury. I graduated from Stetson University College of Law, where I worked as a Teaching Fellow for Dean Darby Dickerson, who was then the Director of the Legal Research and Writing Program. I received a couple awards for legal writing and made honor roll three semesters. I was a Brief Writer for the National Appellate Advocacy Competition of the American Bar Association. I completed my undergraduate work at Stetson University in DeLand, Florida, earning a Bachelor of Arts in Psychology and making the Dean's List four consecutive semesters. I also won an award for outstanding research in psychology. I believe that the integrity of judges is the foundation of the judicial system. I will bring the highest level of professional ethics and commitment to follow the law.

12 Kathy Weston Circuit 7 Group 20 Admitted to the Florida Bar in 2004; Illinois 1999 Practice Areas: Civil Litigation, Family Law and Tax Controversies. Board Certified in Business Litigation Contact Information: kathy.weston@cobbcole.com I was raised in Volusia County, attended Taylor High School in Pierson, and graduated from Seabreeze High School. While attending Stetson University and working toward a degree in accounting, I worked as a Daytona Beach Police Officer, a dispatcher, and a records clerk. These experiences taught me to work with all types of people, to deal with stressful situations, and to always treat others fairly and respectfully. I attended the University of Notre Dame Law School, graduating with honors. Afterwards, I worked in the Chicago Office of Baker & McKenzie, the world's largest law firm, where I handled tax controversies and received extensive litigation training. In 2004, I moved home to Ormond Beach with my four young children, where I reinvented myself as a general civil law practitioner. I joined the Smith Hood Perkins law firm, practicing primarily in the areas of civil and business law for two years. In 2006, I joined Cobb Cole. I am Board Certified in Business Litigation and have an AV Preeminent rating. I am the only candidate in my race with those qualifications. I am also pursuing my certification as a Circuit Civil Mediator. Over the past couple of years, my practice again evolved to now include family law and guardianship work. My ability to quickly learn new areas of law will be helpful in serving as a Circuit Judge. I am very involved in, and committed to, the community. I have coached girls' soccer for many years and am involved in my children's scouting organizations. I volunteer at my children's schools, have served as a PTA Board Member and President, and served on the Seabreeze High School Advisory Committee until my daughter graduated last month. I am also a member of the Daytona Beach Rotary Club. I am Past-President of the Volusia County Bar Association, a member of the Dunn-Blount Inn of Court, and a member of the Volusia County Civil Trial Lawyers Association. I have served for several years as a Director of the Florida Bar Foundation. I am legal counsel (pro-bono) for the Ormond Beach Historical Society, the current President of the Tiger Bay Club of Volusia County, and I serve on the Budget Advisory Board for the City of Ormond Beach. The Volusia-Flagler Association for Women Lawyers named me Woman of the Year in My work ethic and my ability to balance many competing demands will allow me to be an effective and efficient Circuit Judge.

Portuallo has over 27 years of legal experience. He was appointed by the Governor to the Seventh Judicial Circuit in 2012 and currently hears dependency cases at the City Island Annex in Daytona Beach. He is running to retain his position. Immediately prior to his appointment to the Circuit Court, Judge Portuallo was a Judge of Compensation Claims for over 16 years and presided over all workers compensation cases in Volusia and Flagler Counties. He was first appointed as a Judge of Compensation Claims by the Governor in 1996, and then re-appointed by each Governor in the years 2000, 2004, 2008, and He is a former president of the Statewide Conference of Judges of Compensation Claims and former member of the Statewide Rules Committee for Workers Compensation. Judge Portuallo is a 1983 graduate of the University of Florida. He received his J.D. from Stetson University College of Law in 1986 where he was a member of Law Review. Over the years, Judge Portuallo has been a Florida Bar panelist at numerous legal forums and seminars, with emphasis in the areas ethics and professionalism. Judge Portuallo s prior experience in dependency law includes 9 years as a Guardian Ad Litem. He worked as a GAL on a voluntary basis, while simultaneously maintaining a successful practice of law. Judge Portuallo performed voluntary service for the Volusia County Teen Court Program from 1997 through He has been recognized by the Florida Supreme Court for volunteer legal service in 2008 and by the Volusia County Teen Court Program on numerous occasions since Judge Portuallo has been married for 17 years to Denise Portuallo, home health nurse, and has two children, Christina (15) and Anthony (13). I believe that one of the best qualities you can have as a judge is an ability to listen and pay attention to what is being said. If you cannot do that, you should not be a judge. Without hearing what people are trying to tell you, you will not be able to rule fairly as you have not grasped the full content of what is being put in front of you. How can you decide how the law applies to a case if you only paid attention to part of it? There is certainly a fine balance between time constraints, the court s case load and the individual case in front of you. As a sole practitioner, I believe that time management is an essential skill I have learned that will relieve the frustrations of those who have been through the legal system and the time it takes to accomplish things. My courtroom experience will help me to better manage the case loads and minimize time wasted on continuing cases again and again, to the extent practicable. I believe rulings should be delivered in a timely manner and litigants should have some finality to their cases without having to come to court over and over again.
