3 A- DEFINITIONS Terms and phrases used in this Undertaking shall have the following meanings, provided that they comply with and unless there is a separate definition within the scope of the Law numbered 5070 on Electronic Signature and related legislation. Definitions set forth in the Law numbered 5070 on Electronic Signature and related legislation shall be valid for any terms and phrases, which are not defined herein. ELECTRONIC SIGNATURE LEGISLATION All legislation on the subject including the Law numbered 5070 on Electronic Signature, Regulation on the Principles and Procedures Regarding Application of the Electronic Signature, Communiqué on Processes and Technical Criteria Regarding Electronic Signatures, ELECTRONIC CERTIFICATE SERVICE PROVIDER (Referred hereinafter as ECSP ) Elektronik Bilgi Güvenliği A.Ş., who provides services with regard to electronic certificates, time stamps and electronic signatures, within the scope of the Electronic Signature Legislation, ACCESS DATA PIN and PUK information which provide to control the Access to the signature creation data which belongs to QEC owner, QUALIFIED ELECTRONIC CERTIFICATE PRINCIPLE FOR GENERAL USE (Referred hereinafter as QECPFGU ) the publicly available documents which determine the necessities that the parties shall concur with in order to realize the ECSP operations, explain the practices and procedures. Those documents shall be published and updated from by ECSP. ELECTRONIC SIGNATURE means an electronic signature which is created by a electronic signature creation tool, is uniquely linked to the signatory, is capable of identifying the signatory, is linked to the data to which it relates in such manner that any subsequent change of the data is detectable. ELECTRONIC SIGNATURE CREATION TOOL means a device which hosts signature creation data with QEC, holds the technical features for the security and privacy of the signature creation data. SIGNATURE CREATION DATA means unique data, such as codes or private cryptographic keys, which are used by the signatory to create an electronic signature. SIGNATURE VERIFICATION DATA means data, such as codes or public cryptographic keys, which are used for the purpose of verifying an electronic signature. QUALIFIED ELECTRONIC CERTIFICATE (Referred hereinafter as QEC ) Electronic certificate, content and specifications of which is set forth in article 9 of the Law numbered on Electronic Signature and other related legislation, QEC OWNER The real person, who is issued a QEC by the ECSP, based on the application of the Corporate Application Owner, and who is also a party to this Undertaking, E-GÜVEN E-SIGNATURE SERVICE the services and equipment provided by the ECSP to the QEC owner constituted from QEC and e-signature Law numbered 5070.

4 B OBLIGATIONS OF QEC OWNERS I accept, declare and undertake the following; 1. I, as a QEC owner, applied to ECSP for the preparation of QEC on my behalf, that I demand from ECSP the e-guven e-signature service set forth in the APPLICATION FORM in ANNEX-1 and that e-signature has the same legal consequences as a handwritten signature, 2. I shall comply with all obligations set forth within the scope of QECPFGU, and I declare that all information set forth in the APPLICATION FORM in ANNEX-1, that I have filled out to be included in the QEC, are correct, full and true and that the said information is based on the documents set forth in QECPFGU, and a face-to-face identification was carried out based on such information and documents, in the event that there are any erased, deleted parts or parts which raise suspicions of forgery in the information I have listed in the APPLICATION FORM in ANNEX-1, that I have filled out to be included in the QEC, or the valid official documents I have submitted in advance, or in the event that such information and/or data has been evaluated as suspicious before by the ECSP ; in which case I shall not raise any compensation claims against the ECSP, shall compensate any damages that may be incurred by the ECSP and/or third parties, 3. I shall generate the secure electronic signature, which has the same legal consequences as physical signature, and the data which generates and verifies electronic signatures by means of the signature creation data and signature confirmation data provided by ECSP, and I shall use the data which generates and verifies electronic signatures only for the purposes of generating and verifying secure electronic signatures, 4. I shall exclusively use the electronic signature creation tool, shall ensure confidentiality and security of the electronic signature generating data on the electronic signature creation tool, as well as the password that activates such data, and shall not allow others to use it under any conditions or disclose information that allows use to third parties, 5. I shall immediately notify ECSP Call Center ( ) in the event that the Electronic signature creation tool, QEC, Access data, signature creation data and signature confirmation data are lost, stolen or obtained by a third party or for any doubt for these actions, I understand that the ECSP shall not be liable for any damages that may be incurred until the said notification is made, I shall control the information inside the QEC issued to my name and immediately notify ECSP, by contacting its call center (.), in the event that I detect a deficiency and/or mistake in such information or there is a change to any such information, I understand that the ECSP shall not be liable for any damages that may be incurred until the said notification is made, and that I shall not use the QEC for any transactions if such circumstances occur,

I shall exclusively and independently use the QEC, issued to my name, for purposes of generation and verification of electronic signature, in accordance with the related legislation, I understand that the password which activates the access data shall be blocked in the event that I enter the wrong password three consecutive times and QEC issued to my name shall be cancelled. In the event of cancellation, I shall reapply for the QEC and pay the QEC cost, 7. I shall not make any claims from the ECSP, based on full or partial failure to carry out the services due to force majeure events affecting ECSP or third party, maintenance and repair works, interruptions by authorized agencies, shutting down or temporary suspension of activities by ECSP, I accept that the intellectual property rights belong to ECSP related to the QEC issued to my name, 8. I shall not use the QEC issued to my name, for any reason, after expiration of its validity period or in cases of its cancellation or suspension, I understand that the ECSP shall not be liable for damages arising from my failure to carry out or breach of my obligations hereunder and that I shall compensate any damages incurred by the ECSP and/or third parties due to this reason, 9. I shall take e-guven e-signature service on the day stated by ECSP; I accept that the delivery service shall be reapplied in the event that I m not found in the mentioned address at the mentioned time and installation service cost shall be repaid and a new delivery time shall be determined. In the event that I m not found for a second time in the mentioned address at the redetermined time, my QEC request shall be declined, the paid amount apart from the installation service cost and. TL (Turkish Liras) will be refunded within 10 (ten) business days, and I accept that ECSP may change the delivery address and/ or time for security reasons only if the change is notified to me, 10. I shall not transfer my rights and obligations hereunder to third party real persons or legal entities without obtaining prior written permission from ECSP, shall not include other real persons or legal entities to my obligations arising from this Undertaking and related legislation for any reason, and shall not transfer or assign my rights and receivables from the ECSP to third parties, 11. I understand that my and/or the ECSP s books, documents, records and computer records shall be deemed as valid, binding and final evidence in all disputes arising from the performance of this Undertaking, that I shall refrain from resorting to other evidence, that I hold the ECSP from oath tendering and that this provision is a written contract of evidence, in the meaning of article 193 of the Legal Procedural Law, 12. I declare that my address set forth herein is a valid notification address and that all notifications sent to this address shall be legally valid, unless a change thereto is notified to the ECSP in writing,

6 13. I understand that the İstanbul courts and execution offices shall have jurisdiction in disputes arising from this Undertaking. I, as the QEC Owner, hereby accept, declare and undertake that I have read and understood all of the foregoing terms, and that I shall comply with all of my above mentioned obligations.
