2 Letter of Invitation Ladies and Gentlemen: We are pleased to invite your proposal to serve as the Roofing contractor for our 2011 roofing maintenance and repair project at the historic Starlight Theatre complex. The following pages will provide you with the details of the project, as well as the information required to submit a proposal. Presenting Broadway entertainment since 1951, the non-profit Starlight Theatre Association is Kansas City s oldest and largest performing arts organization. The Association operates, programs and maintains the largest stage in the United States, as well as the 16-acre Starlight Theatre complex. While assuming all annual operating costs for the complex, the Association also raises funds for capital improvements and a variety of programs, including national Broadway musical performances, concerts, community outreach and education. Since 2000, the Association has contributed more than $25 million of privately funded improvements to the Kansas City, Mo.-owned Starlight Theatre. Each Broadway season, Starlight donates more than 11,000 tickets to its performances to regional non-profit organizations serving the disadvantaged. In 2010, Starlight Theatre was again selected as the Favorite Performing Arts Venue or Organization in the Kansas City Convention & Visitors Association s Visitors Choice Awards program. In 2010, Starlight also received a Gold Award for Best Performing Arts Venue and Silver Award for Best Theater in Ingram s 2010 Best of Business Kansas City Awards, as well as the award for Best Live Theater Venue in the KC Magazine City s Best 2010 competition. The theatre seats approximately 8,000 and is located in Swope Park. As a progressive not-for-profit organization, it is imperative that all of our activities and efforts incorporate a focused approach to maximizing returns on our investments of time and funding, including an unprecedented level of customer service and attention to detail. 3 Project Information and Requirements The Starlight Theatre Association of Kansas City, Inc. is seeking a roofing contractor to furnish and install all necessary labor and materials, as covered in the attached Scope of Work, as part of our 2011 Deferred Maintenance program. The necessary information for bidding is contained in the Scope of Work in this RFP dated 21 March The proposed schedule for this project tentatively arranges for the Work to begin immediately and finish as soon as possible (currently scheduled are two public concerts on April 20 and 29, our annual Benefit Gala on May 21, and our Blue Star Awards program on May 26). Through the process outlined in this document, Starlight Theatre intends to select the qualified firm best able to provide appropriate services for this project at the best and lowest price. This Request for Proposal (RFP) asks for a detailed price to furnish and install the work in its entirety. Responses from all qualified firms will be carefully considered. 4 Scope of Work Starlight Theatre is seeking a qualified Roofing contractor to provide the work necessary in accordance with our 2011 Deferred Maintenance program as referenced on the attached documents: Memo dated 16 March 2011 re: Roof Repair and Replacement (Scope of Work) Color Coded roof scope site plan Spec section Spec section Spec section Spec section As Starlight Theatre is a 501(c)(3) not-for-profit organization, all bids shall be placed with no sales tax included. 5 Selection Schedule and Coordination 1. Starlight Theatre re-issues the RFP on Tuesday 5 April Candidates shall schedule a prebid walkthrough by contacting Justin White at Starlight Theatre, 4600 Starlight Road, KC MO, (phone: ) 3. Candidates submit response to Starlight by 3:00 p.m. on 13 April 2011 by delivering their written proposal to Justin D. White, Director of Theatre Plant, 4600 Starlight Road, Kansas City, Missouri, The Theatre Plant Committee and/or Starlight Management will review submittals and determine which candidate (or candidates) will be selected for the project. 5. Selection of a Contractor(s) will then be made and it is anticipated that contract(s) will be awarded within 3 days of the bid date. 6. It is the current goal of Starlight Theatre to complete this work as quickly as possible. It is understood that lead times for ordering of supplies and materials may impact this schedule. As indicated in the submittal requirements, please provide an anticipated work schedule (beginning and ending dates) with each proposal. Evaluation Criteria 1. Qualifications a. Applicable Experience; Successful completion of similar projects, both on time and within budget. b. Availability to begin work. c. Inclusion of all requested items in Project Requirements 2. 6 Submittal Requirements Required Response Items - 1. Name, address, and telephone number of the firm including the location of the office that will be performing the work. 2. Name and current workload of the Project Foreman. 3. Availability of contractor to start job upon awarding of contract. 4. Anticipated schedule of the Work. 5. Previous experience working at this facility, if any. 6. List at least two references where similar work was performed. 7. Price for the work, and any alternates or unit prices as noted in the attached documents. 8. The contractor selected must agree to comply with typical City of Kansas City, Missouri contract requirements, if any, including prevailing wage rate, providing certified wages, MBE/WBE goals, and EEO and ADA goals for a project of this nature. 9. Please ensure that Starlight Theatre s tax-exempt status, specifically sales tax, is taken into account when calculating cost estimates. Selected contractor will receive a Missouri Project Exemption Certificate from Starlight Theatre once the project is awarded. Starlight Theatre is a 501(C)3 organization exempt from Missouri Sales Tax. Submitting the Documents No later than 3:00 p.m. on 13 April 2011, deliver 2 copies of your proposal to: Mr. Justin D. White, Director of Theatre Plant Starlight Theatre 4600 Starlight Road Kansas City, Missouri (816) Fax (816) Should a proposal be received after the deadline, Starlight Theatre will use its discretion on whether the proposal will be opened. Starlight Theatre will review and evaluate all sealed proposals. Selection will be based on the lowest, best and most responsive proposal. Starlight Theatre may award contract with or without discussions or negotiations with prospective contractors. Starlight Theatre may request additional information from any of the prospective contractors. The Theatre reserves the right to amend the scope of the project for which these services are described, to contract for more or less services than described, or to award no contract and seek further proposals. A performance bond of 100% of the project and certificate of insurance for workers compensation, liability insurance and auto insurance shall be provided to Starlight Theatre Association before work may begin. The certificate of insurance shall cover Starlight Theatre Association of Kansas City, Inc., Kansas City, Missouri Parks and Recreation Department, Epic Entertainment, Inc. and the City of Kansas City, Missouri from any and all claims and liabilities resulting from injuries or death of persons, or damage to property caused by alleged negligent acts or omissions by the Contractor or Subcontractor or any of their agents or employees arising Starlight Theatre Association of Kansas City, Inc. 7 from the work on the above project. Contractor s insurance shall be the primary and noncontributory; all other insurance carried by the Owner shall be considered excess insurance. Contractor shall procure and maintain in effect throughout the duration of this project, insurance coverage not less than the types and amounts specified below: (a) Commercial General Liability Insurance: with the limits of $1,000, per occurrence and $2,000, aggregate, written on an occurrence basis. The policy shall be written of endorsed to include the following provisions: (1) Severability of Interests Coverage applying to Additional Insured s Contractor Liability (2) No Contractual Liability Limitation Endorsement (3) Additional Insured Endorsement, ISO form CG20 10, current edition, or its equivalent. (b) Workers Compensation Insurance/Employers Liability: Workers Compensation Employer s Liability: Statutory $1,000, each accident $1,000, disease-policy limit $1,000, disease-each employee (c) Commercial Automobile Liability Insurance: with a limit of $1,000, per occurrence, covering owned, hired, and non-owned automobiles. Coverage provided shall be on an any auto basis and written on an occurrence basis. This insurance will be written on a Commercial Business Auto form, or acceptable equivalent, and will protect against claims arising out of the operation of motor vehicles, as to acts done in connection with this project, by the Contractor. (d) Umbrella Liability: with a limit of $3,000,000 each occurrence and $5,000,000 aggregate. (e) Crime/Fidelity: with a policy limit of $50,000. Contractor shall protect Starlight Theatre, Epic Entertainment, and the City of Kansas City, Missouri from any and all liens that may be levied against Contractor or Subcontractor in conjunction to this project.
