Please check the web site frequently for updated information The National Commission for Certifying Agencies (NCCA) has granted accreditation to the NALA Certified Paralegal program for demonstrating compliance with the NCCA Standards for the Accreditation of Certification Programs. Accreditation is effective through April 30, To maintain accreditation, NCCA requires annual reports of all 0 certification programs. Re-accreditation is required every five years.

4 Policies for Certified Paralegals Requirements for Maintaining Certification Purpose The Certified Paralegal credential is valid for a period of five (5) years. Certified Paralegals may renew their certification upon submission of proof of participation in 50 clock hours of continuing legal education (CLE) programs, including a minimum of 5 hours of legal ethics, which provide instruction of a substantive nature on various practice areas of law, rules of procedure, or skills that are relevant to the work of paralegals; and a signed affidavit that the Certified Paralegal has not been convicted of a felony during the five year period, along with the $125 recertification fee. The recertification requirements are as important to the certification procedure as the examination itself in the award and continued use of the CP credential. As with most professions and occupations, the daily work requirements and laws governing legal practice change, sometimes rapidly. The recertification requirements of the CP credential recognize that change is a part of professional life and career growth. To maintain a successful career as a paralegal, and a credential relevant to employers and consumers of paralegal services, participation in CLE programs is required. Rationale for 5 year recertification period The five year period is enforced based on the rapid changes in law or procedures that are expected routinely in the legal field. Rationale for Recertification Requirements Continuing Education Hours. The Certifying Board will accept most requests for CLE hours based on attendance of programs that are either pre-approved by NALA or offered by reputable companies or associations. Credit for attending bar association programs may be accepted, provided the course subject must be relevant to the work of paralegals. Programs offered by paralegal associations may be accepted provided that any courses on substantive practice areas include attorneys as part of the faculty. The Board will also accept requests for CLE hours for teaching, publication of a scholarly article, attendance of classes at a community college, college or university. Hours are awarded for live programs, as well as web-based live and web-based self-study programs, and audio tapes. If there is any question as to relevance or proof of participation, the Board may request further information from the Certified Paralegal, including an employer s attestation as proof of participation. Ethical Standards. In addition, the Board is concerned that the ethical standards which govern paralegals in their daily work are followed. A condition for removal of the CP credential includes a felony conviction, as well as proof the Certified Paralegal has violated the Code of Ethics and Professional Responsibility of NALA. If a paralegal has been accused of a violation of the NALA Code of Ethics and Professional Responsibility, this information is automatically submitted to the Certifying Board. A felony conviction is not usually known to the Certifying Board. For this reason, as a condition of renewal, all Certified Paralegals must sign an affidavit that they have not been convicted of a felony during the five year period. The affidavit is provided to Certified Paralegals with renewal information (Recertification Audit Verification Form). 3

5 Recertification Procedures Continuing Education Hours Classifications of hours, number of hours required and maximum limits Certified Paralegals may renew their certificate upon submission of proof of participation in 50 clock hours of continuing legal education (CLE). The clock hours must include: Ethics: 5 of the 50 hours of CLE credit must be on the subject of legal ethics Non-Substantive Law Subjects: No more than 10 hours of the 50 hours of CLE credit may be recorded for participation in seminars or classes in non-substantive law subjects. Examples of non-substantive law subjects include law office management, computer program instruction, communications, and office technology. Non-substantive subjects are subjects that are related to the work of a paralegal, but are not in specific law practice areas. Maximums (further definitions of categories and relevancy appear below): o No more than 20 hours may be recorded per request for: Special Experiences Successful completion of an Advanced Paralegal Certification course or state specialty examination Completion of a for-credit college course with a grade C or better o No more than 10 hours may be recorded per request for: Auditing a college course Continuing Education Hours Timing of Hours Awarded and Certification Period Timing Eligible Hours: Hours may be awarded for participation in events, classes or special experiences that occur after the initial certification or recertification date. Hours applied to subsequent five-year periods: If more than 50 hours are recorded during a five year period, excess hours may not be applied to a subsequent period. Hours for programs taken during probationary period: Hours for CLE programs taken during a probationary period will be first applied to the previous period until the hours and course requirements are met. Then, the hours will be applied to the next/current five year period. Continuing Education Hours general procedures and definitions Reports of CLE hours recorded Certified paralegals may request a report of the number of CLE hours recorded at any time. This information is also available to Certified Paralegals via an on-line portal. A Certified Paralegal receives notification from NALA Headquarters each time hours are recorded on his/her file, with the number of hours and date the hours were recorded. Hours recorded labeled Confirmed 4

6 The label confirmed for entries of CLE hours that are recorded on a Certified Paralegal s file means that documentation verifying the program and attendance has been received by Certifying Board staff. No further documentation is required. Hours recorded labeled Unconfirmed The label unconfirmed for entries of CLE hours that are recorded on a Certified Paralegal s file means that documentation verifying the program and attendance has not been received by Certifying Board staff. This entry is subject to audit by the Certifying Board. It generally applies to entries filed via use of the on-line form. Hours recorded labeled Recorded The label recorded for entries of CLE hours that are recorded on a Certified Paralegal s file means that the CLE hours previously labeled unconfirmed have been recorded and are no longer subject to audit by the Certifying Board. Pre-Approval of CLE Events Pre-Approval of requests by Certified Paralegals: Certified Paralegals may contact NALA Headquarters in advance of a program to seek information about these requirements and to determine whether participation in a CLE program would meet the Certifying Board s requirements. Pre-Approval of programs by seminar providers: Seminar providers may complete a Request for Approval of Credit of Continuing Legal Educational Programs for Certified Paralegals form which is on the NALA web-site. Upon receipt of the form, NALA will advise the program sponsor if the program is approved and the maximum number of CLE hours that may be awarded. Return of Documentation Documentation submitted to substantiate requests for CLE hours is not returned to the Certified Paralegal. Relevancy In review of all requests for continuing education hours, the Certifying Board s first concern is whether the program is relevant to the work of paralegals. In instances where this is unclear, the board may request further information, or request an employer s attestation. Requirements for Emeritus Status of Certified Paralegals Any CP who has been certified for more than five (5) years, is 55 years of age or older, and who withdraws from employment as a paralegal may submit a request to NALA that he/she be placed into an Emeritus status and be relieved from meeting further requirements for continuing legal education. 5

7 No CP who is partially retired will be permitted the Emeritus CP designation. Any CP who becomes permanently disabled and stops working as a legal assistant, may submit medical proof of disability and, upon approval of the Certifying Board, be granted the Emeritus CP designation. Any CP who returns to full time employment, will no longer retain the Emeritus designation and will be required to meet the same requirements as all other CPs; with a five year period for submitting continuing legal education accruals, beginning with the date of reemployment. Should the CP have any units of education accrued to his/her benefit, they may be carried over, provided, however, the CP has not been in an Emeritus CP designation for more than two and one half years. Types of CLE Programs and Hours Hours for participation in seminars, workshops, conferences for paralegals and attorneys Sponsors: The Certifying Board approves programs for CLE hours on a per-program basis. Pre-approval of all programs offered by a particular sponsor is not available. Sponsors for CLE events include paralegal education providers, bar associations, attorney organizations and law firms, and paralegal associations. Speakers: To qualify for CLE hours, programs which provide analysis and interpretation of the law are required to feature an attorney as the presenter or an attorney as a part of a team of presenters. Minimum length of course: A program or seminar that offers a minimum of 50 minutes of instruction qualifies for one hour of education. Types of programs: Hours may be awarded for participation in live CLE programs, including in-house employer programs or training. Online programs may qualify, including web-based live programs, and web-based self-study programs. In addition, hours may also be awarded for self-study of audio or video recordings of CLE events. Hours are not available for reading articles or books. See below Special Experiences for information about requests for completing training for volunteer programs such as CASA and Guardian Ad Litem programs. CLE hours calculation: The number of hours of education that are completed by the Certified Paralegal are counted to determine the number recorded. Hours are not awarded for session breaks or lunch breaks. If a luncheon includes an educational component, credit is awarded on the basis of ½ of the allotted time for the luncheon provided the subject qualifies. A partial-hour may be recorded provided the Certified Paralegal participates in at least 50 minutes of instruction. For requests for hours to meet the Ethics CLE requirements, the sponsor s program must state the seminar program included an ethics component and the number of hours of ethics instruction. 6

8 Filing requests for CLE hours Certified Paralegals may submit requests for CLE hours anytime during the five year period. Requests for hours for participation in seminars, workshops or conferences must contain the following: Certified Paralegal contact information Type of Event Date of Event Name of Event Location of Event Event Sponsor Sponsor contact information Event program for calculation of CLE hours Certified paralegals may submit this information on a Certificate of Attendance Form provided by NALA, or complete the on-line CLE request form on the NALA web site, or submit a letter with the required documentation. See below Procedures for use of on-line CLE Reporting Form for additional information about using this form. Verification of attendance submitted on behalf of Certified Paralegals by third parties The Certifying Board Staff will accept verifications of attendance of a CLE event submitted by an event sponsor. The description of the event should include the items listed above, plus a typewritten list of names of the Certified Paralegals who attended the event. Sign-in sheets and handwritten names are discouraged. If a name is unreadable, hours will not be recorded. Hours for participation in college courses Sponsor or school: Hours may be awarded for completion of a course offered by a school that is accredited by a nationally recognized accrediting agency. For courses taken through a program that is not nationally accredited, CLE hours will be awarded as if the program taken was a seminar, conference or workshop, to a maximum of 20 hours. Types of programs: Ethics courses or courses in specific practice areas as part of a paralegal studies curriculum or law school curriculum. Some business courses may qualify for non-substantive hours. Length of course: To qualify, a for-credit course must offer at least 3 quarter hours or 2 semester hours of credit upon completion. 7

9 For courses taken through nationally accredited programs that do not offer credits based on semester or quarter hours, the classroom or work-hours equivalent must meet or exceed 20 hours. CLE hours calculation: 20 hours for completion of a course with a grade C or better; 10 hours for auditing a course or completing a course that offers less than 3 quarter hours or 2 semester hours of credit upon completion. Filing requests for CLE hours Request for hours for participating in college courses should contain the following: Certified paralegal contact information Course description Length of course If the course was taken for credit, a transcript showing completion with a grade C or above and the number of hours/credits awarded If the course was audited, documentation showing the course was completed. This would include an instructor s verification if not shown on the transcript. Requests should be submitted in writing with the required documentation. Advanced Paralegal Certification and state specialty certification Sponsors: The Certifying Board will award CLE hours to Certified Paralegals upon successful completion of an advanced professional certification program for paralegals. To qualify, the program must be administered by a national organization for paralegals, or a state paralegal organization working alone or together with a state bar association, and which includes completion of a written examination. Product or software certification programs do not qualify under this category; instead, they qualify under the provisions above for in-house training programs, or seminars, workshops, conferences. CLE hours calculation: 20 hours are awarded for successful completion an Advanced Paralegal Certification course offered by NALA; or successful completion of a state specialty program for paralegals. Filing requests for hours Requests for hours for successful completion of an Advanced Paralegal Certification program or state specialty paralegal certification program should include: Certified paralegal contact information Description of certification program Sponsor of certification program 8

10 Copy of the certificate or other record of the governing body of the certification program confirming the award of certification Requests should be submitted in writing with the required documentation. Special Experience The Certifying Board will consider award of CLE hours for special experiences. Examples include: Teaching a legal course in a paralegal program on a subject of substantive law or procedure Presentation of a seminar or workshop on a subject of substantive law or procedure related to the work of a paralegal Extensive research on a subject of substantive law or procedure related to the work of a paralegal which results in publication of an article in a legal publication Training sessions involved in volunteer activities such as CASA and Guardian Ad Litem programs which involve the review, study and application of state or federal governmental regulations, guidelines and procedures, or court rules. CLE hours cannot be awarded for: Work required activities (paid or unpaid) such as trial preparation, witness interviewing, or research of a case related subject Service on the NALA Certifying Board or Advanced Paralegal Certification Board Volunteer service CLE Hours Calculation: Presentation of course/seminars: The board will consider the time involved in research in preparation of a course or seminar for paralegals to a maximum of 3 hours per every 1 hour of instruction. In addition, hours are awarded for the time of instruction for the presentation. Time spent editing or proofreading will not be considered in the calculation of hours. The maximum allowed hours for instruction of a for-credit course in a paralegal curriculum is 20 hours. If a course or seminar is repeated during the five year period, hours as an instructor for the course or seminar is awarded once per five year period. However, hours may be available for the time of instruction for the repeated presentation. Hours may be awarded to a Certified Paralegal as an instructor of a course or seminar that is repeated in a subsequent five year period. 9

11 Written/publication of an article: Hours will be calculated based on estimated number of hours of research for preparation of the article. Time spent editing or proofreading will not be considered in the calculation of hours. Training for volunteer service: Hours will be calculated based on the hours of training. Filing requests for hours for special experiences: Requests for hours for special experiences based on teaching should include the following: Certified paralegal contact information Description of course/seminar topic Length and dates of the course/seminar Sponsor of course/seminar program with contact information Estimate of the number of hours required in preparation Requests for hours for special experiences based on authoring an article which results in publication should include: Certified paralegal contact information Copy of the publication with the article Estimate of the number of hours required in research and preparation of the article Requests for special training for volunteer service should include: Certified Paralegal contact information Name of Training and Sponsor Date(s) and time (s) of training sessions completed Sponsor contact information Event program for calculation of CLE hours, or details stating the total number of hours of instruction for training Verification of completion of training, such as certificate or sponsor signature. Certified paralegals may submit this information on a Certificate of Attendance Form provided by NALA, or by completing the on-line CLE request form on the NALA web site, or by submitting a letter with the required documentation. Procedures for use of on-line CLE reporting form Certified Paralegals may submit requests for CLE hours via an online form on the NALA website. The following procedures apply to those submitting requests via this form. Generally, the form is submitted for requests for hours for attendance of CLE programs for paralegals. The online form may be found at under Certification/For Certified Paralegals. 10

12 When to file Request for CLE hours may be filed at any time during a five year period or probationary period. Documentation The form is submitted electronically to NALA Headquarters. Documentation is not required to be submitted with the form. Documentation to support all requests for CLE hours via use of the on-line form may be required by the NALA Certifying Board at any time within one year from the date the hours were entered on the record of the Certified Paralegal. Hours recorded - Unconfirmed Requests for CLE hours will be reviewed by the Certifying Board staff to verify hours awarded, sponsor information, and relevancy. Once reviewed, the hours will be recorded on the Certified Paralegal s record with the notation unconfirmed to indicate that the request was filed via the on-line form and documentation was not received with the request. Random audit of CLE requests via on-line form Periodically, the Certifying Board will select for audit any hours that are labeled unconfirmed and are for Certified Paralegals in a current five year period. Selections are randomly generated. Notice of audit of CLE records for request submitted via on-line form Certifying Board staff will send notifications to all Certified Paralegals whose records have been selected for audit. The notification will provide what is required as documentation of the request for completion of CLE hours, a deadline date for response, and where documentation should be submitted. The required documentation includes: Certified Paralegal contact information Type of Event Date of Event Name of Event Location of Event Event Sponsor Sponsor contact information Event program for calculation of CLE hours The response is due within 60 days from the date of the notice. Documentation may be submitted via mail, or fax. Confirmation of hours acceptance of documentation If the documentation is received in a timely manner and meets the requirements stated in the notice, and of the Certifying Board for CLE programs, it will be accepted by the Certifying Board. On the Certified Paralegal s record, hours recorded for the entry will be labeled confirmed. 11

13 Certified Paralegals will be provided notice of acceptance of the documentation and hours recorded. Rejection of hours - denial of documentation, fraudulent forms If the requested documentation is not received, or is not submitted within the required time period, the Certifying Board may refuse to record hours for the submission. Certified Paralegals who file fraudulent forms, falsely represent the program, hours of instruction, or course description may be subject to discipline as set forth in the Rules for Disciplinary Proceedings. Procedure for Notice of Revocation of Certified Paralegal Credential for Failure to Meet CLE Requirements Notwithstanding anything in these rules to the contrary, the procedure for revocation of certification and use of the CP designation for failure to meet continuing education requirements shall be: Notice by mail of expiration of the Certified Paralegal designation. Said notice provides an automatic probation period of one year in order to submit the required number of continuing legal education units. Upon expiration of the one year probation period, if the required continuing legal education units have not been submitted, a notice of revocation is mailed to the individual advising that the certification has been revoked and further use of the CP designation is prohibited. Appeal of Revocation of Certified Paralegal Credential for Failure to Meet Recertification Requirements A Certified Paralegal may appeal in writing to the Certifying Board for review of the Board s actions concerning the continuing legal education credit requests. These appeals could claim that requests for CLE credit were lost in transit (via mail or electronically); the CLE programs were attended but evidence of attendance was destroyed, lost or misplaced; CLE credit was rejected but is believed to be within the published guidelines. Such appeal must include any and all relevant documentation to be considered and must be received at NALA Headquarters thirty (30) days prior to the next regularly scheduled meeting of the Certifying Board. Such appeal shall be reviewed by an Appeals Committee which shall be composed of the chair plus two members of the Certifying Board. Each member of the Appeals Committee shall have served a minimum of one year on the Certifying Board. The Certified Paralegal shall be provided with notice of the time and place of the meeting of the Appeals Committee. The Certified Paralegal shall have the opportunity to appear in person and/or to be represented by counsel and to present any defense or explanation before the Appeals Committee. 12

14 The Certified Paralegal will bear his or her own costs of attendance and/or representation. No adverse inference shall be drawn from the failure or inability of the Certified Paralegal to attend the meeting of the Appeals Committee. After consideration of the matter under appeal, the Appeals Committee shall submit its recommendation for action to the Certifying Board. The Appeals Committee recommendation may include suggestions for the Board s consideration such as those listed in the policy Appeal of Cancellation of Certified Paralegal Credential Based on Hardship or Extreme Circumstances. A majority vote of the Certifying Board members present shall be final in the matter under appellate review. Appeal of Cancellation of Certified Paralegal Credential Based on Hardship or Extreme Circumstances An appeal of the revocation of the Certified Paralegal credential based on hardship or extreme circumstances will be considered under the following conditions: the five year certification period, plus the one-year extension has expired; and the Certified Paralegal is on active military or active military reserve duty; or the Certified Paralegal has extenuating personal challenges which could include long term unemployment or severe medical issues hampering one s ability to work or engage in activities outside of work for a period of one year or more. If any such appeal is submitted, the Certifying Board Chair will investigate to determine (a) whether the reason is a hardship or extreme circumstance and (b) if sufficient information has been submitted to substantiate the claim. If the Chair finds the claim meets the conditions above, a committee of the Chair plus two Certifying Board members will review the file. If the committee members agree to a recommendation, the paralegal will be advised. If the committee members are unable to come to an agreement, the request will be forwarded to the Certifying Board for review and decision. A response to the appeal will be provided to the paralegal no later than ten business days after receipt by NALA Headquarters. The Certified Paralegal credential will be designated inactive and may not be used or claimed by a paralegal. During the period the Certified Paralegal credential is considered inactive, the paralegal may list the credential on a resume or job application as long as the inactive status is clear. The names of those whose Certified Paralegal credential is considered inactive will not appear in the Certified Paralegal directory on the NALA web site. The following options will be available to the paralegal: The paralegal may retake the Certified Paralegal examination as a new candidate for certification. In consideration of the hardship, the committee may recommend or the 13

15 board may approve a waiver of the examination application fee, and the paralegal would not be required to submit another application form. The committee may apply a time deadline for the waiver of the fee during which the examinee must retake the Certified Paralegal examination; or The paralegal may be awarded more time to complete the CLE requirements. The time period may not exceed one year. o With this option, the requirements for recertification are the same as for all Certified Paralegals. The one year probation period plus the extension of up to one year will apply against the ensuring five year renewal period. The expiration date of the Certified Paralegal credential will not be adjusted forward to accommodate the extended time. o The Chair may consider waiver of the re-certification fee. The re-certification fee may be waived only once for Certified Paralegals. o The Certified Paralegal must submit requests for CLE hours in writing and not via an on-line form. o If the requirements are not met within the extended time period, the certification will be revoked as it is for all others. -end- 14

Of the 50 hours, 5 hours must be in legal ethics, and no more than 10 hours may be recorded in non-substantive areas. If attending a non-nala sponsored educational event, this certificate should be completed and submitted with relevant documentation for the event.
