I want you to read this first, before you read the remainder of my materials for a personal reason. I truly want to help you change your life. I ve rarely given out information like this in the past, but I feel that it s essential to bring this to your attention. You have just taken a step in a journey that I hope we can share together. My name is Robert Peters, I ve been practicing law since Prior to starting Florida State University as an undergrad, I was in the United States Air Force where I got to see the world and serve my country. I majored in accounting and real estate at Florida State University and earned a bachelors degree in I worked for Price Waterhouse as a CPA until law school in I graduated from Florida State University College of Law with high honors. I have been married for 19 years and have 3 children and a Boxer. My law practice focuses on consumer bankruptcy and foreclosure defense. Most of my clients are concerned about problems with creditors, potential lawsuits and how an adverse judgment will affect their family s future. I find this work interesting and challenging because it requires knowledge and integration of several different areas of law including creditor rights, bankruptcy law, tax law, estate planning, real estate and understanding of human nature. I feel a sense of accomplishment whenever I help my clients through a difficult financial period in their lives. I selected bankruptcy law because so many people s lives are affected by unexpected events that have devastating effects on their finances. You don t have to deal with aggressive, belligerent, unsympathetic bill collectors who are too stupid to realize that they are only a paycheck or two away from being in the same situation that you re in. Keep in mind, though, that for us to become a team, you ve got to be serious about finding a solution to your financial problems. That means that you ve got to work with me by answering all of my questions honestly and by giving me all the paperwork and documentation that I request from you. You have got to make a commitment to be responsive to my calls, just as I will commit to being responsive to yours. You ve got to commit to doing what I advise you to do, knowing that I have only your best interests in mind. You can t listen to your Uncle Louie when he tells you what happened to him when he filed bankruptcy in Alaska, and you can t listen to your co-worker when he tells you that his situation was just like yours, and he couldn t file bankruptcy. Remember that no two bankruptcy cases are the same. Everyone s facts and circumstances and temperament are different. Therefore, no one can tell you what to expect, other than an experienced bankruptcy attorney. So, I m going to require that you to listen to me and me alone. 3 I have helped hundreds of families, just like yours, keep their homes, get their cars back from repossession, stop their wages from being garnished and get the monkey off their back. Many of the ads that you read talk about getting rid of debts. Quite often these ads are speaking about straight bankruptcy. I want to discuss the difference between bankruptcies- Chapter 7, straight bankruptcy, and Chapter 13-also referred to as bill consolidation. Straight bankruptcy, or chapter 7 of the United States Federal Bankruptcy Code, allows you to discharge, which means get rid of and not pay back, debts, bills, and financial obligations and keep almost everything you own. Often you pay back very little and keep all of your property. Straight bankruptcy, in most instances, gives a family or a single adult, the chance to start again without the real burden of bills. Straight bankruptcy allows you to have a fresh start and even to buy property again. Did you know that many people do straight bankruptcy, chapter 7, and keep their home, car, furniture, and cash in the bank. Well they do! It s a federal law and it s their right. Let s talk a little about some of these statements. A lot of people come into the office and say Gee my mom or dad told me if I did a bankruptcy, I would never be able to buy a home again and in the old days, that might have been true. But todays it s not. You will have to save up a little bit of cash again, but you CAN buy property again, in as little as two years. Many people also say to me, What about a car, I m not going to be able to get a car again Well that s not true because when you do a bankruptcy, you get rid of all the debts. And, if you have a job, you are an excellent risk to the car lender and it gives the lender an opportunity for the lender to maybe charge you a little bit more interest for a little more money down. But he knows that you are not going to do a bankruptcy again for quite some time. On credit cards, people will say, Gee, I m not going to get a credit card ever again Not True. We will give you a list of banks that you can open a savings account, and they will hold that savings account as collateral and they ll give you a Visa or MasterCard. That s called a secured card and that s where you start. You make your card payment; make your visa payment, now you can cash checks. After one year of established credit, conventional lenders, that s banks and

4 lenders, will consider you for a loan, after 2 years the FHA, that s the federal government, will consider you for a low interest house loan, and that s basically how it works. There s a lot of information that you really need to have about bankruptcy to fully understand it. But basically, it was created because people shouldn t have to suffer. In fact, there is so much information that I have written and published several books so you can review the material in the comfort of your home. The first book is called, Myths, Secrets and the Truth and Bankruptcy in Florida. The second book is called the Florida Foreclosure Survival Guide and it helps you navigate the storm of a foreclosure lawsuit. The third book is on Social Security Disability, how it works and the keys to getting the benefits you deserve even if you have been denied. I also wrote another book on Credit Repair for after you file bankruptcy to help get you back on your feet. These books are yours free, just for taking action, and making a request. So, you can have a car, a home, you can have a credit card, but what does bankruptcy do to your credit report? Well, your credit report probably doesn t look too good to begin with. But at least it stops the aging process. In other words, those things that are two months, or three months, or four months will never get any older than that, and that s going to look good for you. If they are real old, you might as well get rid of them and start fresh with a straight bankruptcy if you can. But all of this is explained in my information package you received. The thing that I want to remember is it stops the aging process and that s important because when the aging process stops, the worst that your credit report will look is the day we filed your case. There are other alternatives to straight bankruptcy. Instead of a chapter 7, let me tell you about a chapter 13, also known as reorganization or bill consolidation. Now, a chapter 13 is not for everyone. People who are usually not suited for this form of reorganization of their debts have some steady income from a job or Social Security, they have a positive monthly income flow which means they have a little money left over each month. If you are behind and feel like you are slowly sinking deeper and deeper into debt this is an excellent opportunity to reorganize all of your bills into one, low monthly payment and save your home. Now I m not talking about a loan. Let me repeat what I am telling you about is a federal law, not a loan, and it requires your creditors to take less money monthly over a longer period of time. It is a powerful law because it carries the weight of the US government behind it. It s powerful, and because

5 it s the federal government, large corporations, banks, finance companies, credit card companies, skip tracers, repo men, and collectors all realize that under this form of debt reorganization you have the federal government behind you and most scare tactics stop quickly. When you start this process, on your very first day, all of your bill collectors can be referred by you to our office.
