2 Memorandum of Understanding Between Cape Fear Community College and New Hanover County Schools for Wilmington Early College High School CAPE FEAR COMMUNITY COLLEGE (sometimes referred to herein as College or the College ) and NEW HANOVER COUNTY BOARD OF EDUCATION (referred to herein as New Hanover County Schools ) agree to the following memorandum of understanding and for the terms of which WITNESS THE FOLLOWING: WHEREAS the parties to this Memorandum of Understanding partnered to create Wilmington Early College High School under the North Carolina Cooperative Innovative High School Act which supports partnerships of secondary and postsecondary institutions; WHEREAS Wilmington Early College High School, established in August 2007, is an autonomous high school situated on the premises of Cape Fear Community College s North Campus, located at 4500 Blue Clay Road in Castle Hayne, North Carolina ; WHEREAS Wilmington Early College High School grants students in grades 9-13 the opportunity to earn a high school diploma and two years of college transferable credit or an associate s degree within five years; NOW THEREFORE, the parties to this Memorandum of Understanding mutually agree as follows: GOVERNANCE: Wilmington Early College High School will be governed by New Hanover County Schools and will be subject to district, state, and federal policies and requirements. TUITION AND FEES: To the extent authorized by law, tuition for early college student enrollment in curriculum state-supported classes shall be waived. Student fees (technology, activity, security, and parking) may not be waived and may be covered by New Hanover County Schools. The College may charge tuition and fees for Wilmington Early College High School students who enroll in self-supporting curriculum or continuing education classes. New Hanover County Schools will only be responsible for fees associated with classes that have received prior approval from the Principal.

3 COLLEGE TEXTBOOKS AND COURSE SUPPLIES: Cape Fear Community College is responsible for the selection of required textbooks and supplies for college courses. New Hanover County Schools may provide these textbooks and supplies to early college high school students. The College will provide Wilmington Early College High School information on required textbooks and course supplies for college courses in which early college students enroll. EARLY COLLEGE LIAISON: Under the terms stipulated in the grant issued by the North Carolina New Schools Project for Wilmington Early College High School, Cape Fear Community College will employ a full-time early college liaison to act as the primary intermediary between the Cape Fear Community College and Wilmington Early College High School. New Hanover County Schools agrees to allocate to the College the entire amount designated by the New Schools Project grant each year. COLLEGE FACILITIES AND CLASSROOMS: Wilmington Early College High School will be situated on the first floor of the ND Building on the North Campus of Cape Fear Community College, located at 4500 Blue Clay Road in Castle Hayne, North Carolina Cape Fear Community College may schedule college classes or other events in early college high school classrooms on days and times in which high school classes are not in session. Wilmington Early College High School may work with the early college liaison to schedule the use of other classrooms or college facilities, and their instructors will be able to access the internet in those facilities. STUDENT CONDUCT: Wilmington Early College High School students will follow the student codes of conduct of both Cape Fear Community College and New Hanover County Schools. Students will honor college regulations and rules regarding the use of college facilities and equipment. Violations of any college or high school policy may result in appropriate disciplinary action by Cape Fear Community College and/or New Hanover County Schools. SAFETY: If a Wilmington Early College High School student, faculty/staff member, or visitor experiences an accident, sudden illness, or other incident that jeopardizes campus safety, both parties agree to notify appropriate representatives of the other party within a reasonable timeframe. Cape Fear Community College will respond to all incidents according to College guidelines and procedures.

4 INDEMNIFICATION: To the extent authorized by law, each party agrees to indemnify and hold harmless all agents, servants, and employees of the other party from and against any and all claims, debts, from either: (1) any claimed or actual defects in premises owned or controlled by the other party and used in the performance of this agreement; OR (2) any acts or omissions of the other party, its agents, servants, or employees, in the performance of this MOU and used in the performance of this MOU. RENEWAL AND TERMINATION OF AGREEMENT: This MOU contains the entire agreement between the parties regarding the subject matter hereof and may be amended only by mutual written agreement of both parties. The MOU will be in effect until May 31, 2014, following signing and is renewable based on the consent of the signatory parties. Cape Fear Community College and New Hanover County Schools reserve the right to terminate this MOU upon service of written notice to the other party 90 days prior to the date of termination. In this event, the date of termination will be the day after the end of the school year during which the 90 day period expires. LUNSFORD ACT: Cape Fear Community College shall: (1) Comply with NC House Bill 933, Section 21, (G.S. 115C, Article 22, part 6, as amended). The College shall conduct checks, not less than annually, of its employees and contractual personnel, as defined in the above referenced law, who have or are expected to have direct interaction with New Hanover County School students as part of their jobs. The checks must include the North Carolina State Sex Offender and Public Protection Registration Programs, the North Carolina State Sexually Violent Predator Registration Program, and the National Sex Offender Registry. The College shall prohibit its employees and contractual personnel listed with any such programs or registry from having direct interaction with students of the New Hanover County Schools; and (2) Provide the New Hanover County Schools with a notarized statement certifying that none of its employees or contractual personnel, who have or will have direct interaction with students of New Hanover County Schools, as part of the performance of this MOU, are listed with these programs or registry, within 30 days of the commencement of this MOU. In witness thereof, the parties have duly approved this Memorandum of Understanding in two original counterparts.
