Mandatory Criteria Please note a Yes response with subject to conditions or any other conditions for any of the Mandatory Criteria may be treated as a no response if those conditions are not acceptable to the Principal. 1.1 The Applicant agrees to fully accept all of the terms and conditions of the Data Licence Agreement, in the event the Applicant is offered a Data Licence Agreement by the Principal. The Principal requires each licensee to accept the same terms and conditions of use as detailed in the licence agreement document. 4 4 2. CAPABILITY CRITERIA 2.1 Experience Applicants are required to provide details of their experience in the information services market with particular emphasis on the value-adding of data. Demonstrated experience in the development and delivery of property and land information products is preferred. Please indicate if this experience includes servicing markets outside of Australia. Note: If the Applicants experience includes utilising services of third parties to develop and / or support delivery of the Applicants information products/services, separate details of those arrangements must be supplied (eg: nature and extent of that arrangement).

6 6 2.2 Data security Applicants are required to provide details of the security arrangements that currently exist (or will be implemented) to protect licensed data from unauthorised access and to ensure that it is not used in a manner contrary to the terms of the licensing arrangements (refer to Data Licence Agreement). 16 Privacy Although the licensed data does not contain names of natural persons, it is a license condition that Licensees do not diminish the privacy of natural persons by any means, including data matching or correlating the licensed data with data from other sources. Please provide information about privacy policies and practices the Applicant applies in its business. 2.6 Financial Applicants are required to demonstrate that they have the financial capacity to perform all the obligations as required by the licensing arrangements as detailed in the licence agreement. YES NO (please provide details below) 2.6 (e) The Principal requires each licensee to maintain adequate public liability and professional indemnity insurances for the life of the licence contract period. Successful applicants are required to provide copies of certificates of insurances (in the name of the Applicant entity) in the amounts of $20 million AUD for public liability and professional indemnity of $5 million AUD (for any one claim) and $10 million AUD (in aggregate claims). Applicants who do not have sufficient insurance cover must state their preparedness (below) to acquire such insurance cover in the event an offer of a licence to that Applicant is subsequently made by the Principal. 20 Organisational stability and maturity Execution of a Data Licence Agreement between a successful Applicant and the Principal will establish an on-going commercial relationship between the parties, for the life of the licence contract. It is a requirement of the Principal that the Applicant is able to demonstrate sound corporate behaviour. 21 Quality assurance processes Quality assurance processes assist organisations to mitigate risk and to satisfy compliance requirements. 23 Implementation capabilities The Applicant must provide details of the proposed implementation plan for using licensed data, including details of implementation issues and how the Applicant plans to undertake product delivery and provide the required services within a given timeframe. This plan should cover the major activities, timeframes and resources for an initial implementation and rollout.
