1 CITY OF MISSION VIEJO SPECIAL PROVISIONS LANDSCAPE RODENT PEST CONTROL 1.01 SUMMARY A. PROJECT SCOPE All work performed shall include the furnishing of all equipment, labor and materials necessary to properly control the rodent population within contract limit boundaries (see appendix for map). The contract will be in force for 24 months/two (2) years during which time annual extension may be granted, assuming contract obligations and performance is satisfactory. This contract may be renewed on an annual basis by mutual agreement of both parties for one (1) additional two (2) year period DESCRIPTION OF WORK A. As a part of this contract, the Contractor will be required to utilize personnel with a Qualified Applicator s License to perform work at each site [check current licensing requirements as determined by California Department of Pesticide Regulations (CDPR) at Orange County Agricultural Commissioner s Office]. A one-time initial clean-up treatment may be necessary to lower existing infestations to maintainable levels. The Contractor shall guarantee at least 98% control of the rodent population with this initial treatment. B. Thereafter, each site shall be serviced not less than weekly by licensed technicians to maintain a 98% control and prevent reinfestation due to migration or population increases. A monthly work schedule shall be submitted by the Contractor to the City representative by the tenth (10 th ) day of each month. C. The Contractor shall provide the City representative with an evaluation and pesticide use report for each site serviced weekly. The report will include the current status of the site, location of treatments, and other professional observations and pertinent data regarding the site. D. The Contractor will list all of the materials to be used in the performance of the contract and the method of application, so that the scope of work bid can be evaluated by the City. All materials used and work performed shall conform to practices common to the trade. Materials used must be pre-approved by the City representative. SP-1
2 E. Throughout the entire contract period, all rodent control shall be in accordance with all applicable laws and regulations. Under no circumstances will applications which endanger non-targeted animals be allowed. See Section 5194 of the California Information Code SPECIFICATIONS A. LICENSES/QUALIFICATIONS The Contractor shall provide the services of a full-time biologist. The biologist shall hold a degree in agricultural biology/pest management from an accredited four-year university. The biologist shall be responsible to manage the contractor s personnel throughout the term of the contract. In addition, the Contractor shall employ persons possessing a current pest control advisor s license (PCA), valid pest control operator s license, and qualified applicator s license (QAL). All licenses shall reflect those categories required for the scope of work described in this contract. All applications of any pesticide shall be preceded by a written recommendation by licensed PCA. All technicians shall possess a current QAL or be under the direst supervision of a person holding a current QAL. B. WORK HOURS All work must be performed Monday through Friday between the hours of 7:00 a.m. and 4:00 p.m. C. SERVICE REQUESTS Special requests for service may be made by the City s representative. All such trouble calls will be handled by the Contractor on the next working day after notification by the City representative. Emergency call-outs may occur which will require an immediate response by the Contractor to perform rodent control services. All such emergencies shall be included at no extra charge to the City. D. DEFICIENCY DEDUCTIONS All Contractors working in the City of Mission Viejo are subject to deductions from payments for failure to perform satisfactorily. Refer to appendix for reference. Contractors are subject to deductions of $250 per occurrence per location for unsatisfactory performance. SP-2
3 E. CONFORMANCE TO ENVIRONMENTAL REGULATIONS All methods of control performed must comply with all Federal, State, County, and City laws and regulations. Contractor shall provide the City with a copy of all special use permits as required by the County Agricultural Commissioner s Office for chemicals used. F. METHODS OF APPLICATION (Not All-Inclusive) 1. All treated bait, traps, and gaseous applications used to control rodents must be placed in rodent s tunnel. Live trapping and relocation may be required in some instances. 2. All infestations occurring within fifteen feet (15 ) of any building must be controlled with the use of traps. Traps shall be covered with soil once inserted into the tunnel to ensure public safety. 3. Bait stations used above ground for ground squirrel control shall be anchored and will be tamper-resistant. The Contractor shall immediately be required to remove any bait station determined to be unsafe by the City Parks and Landscape Inspector. 4. The Contractor shall select application equipment (i.e., bait containers and/or applicators) of a type that will minimize spills. Any spilled bait shall be picked up or immediately buried. 5. After treatment of rodent tunnels, all existing mounds shall be knocked down flush with existing grades. Excess soil shall be removed from hardscapes (i.e., sidewalks, curbs and gutters) and soil neatly returned to the landscape. NOTE: Dead carcasses shall be removed immediately upon request and properly disposed of by the Contractor whenever and wherever they are found on surface areas within contract boundaries. SP-3
4 CITY OF MISSION VIEJO DEFICIENCY DEDUCTIONS LANDSCAPE RODENT PEST CONTROL Strict compliance to all specifications, conditions and directives given by the City s representative shall be adhered to by all contractors and subcontractors working in the City of Mission Viejo. To insure compliance, a brief list of sample deficiencies is provided on the following page. The amounts to be deducted from payments due to contractor for each occurrence are shown. SP-4

Other: Comments: *All damage due to rodent populations migrating to adjoining private properties shall be corrected solely at the Contractor s expense. Please initiate the necessary corrective action(s) and notify the Parks and Landscape Inspector for reinspection when complete. 6 San Diego Regional Water Quality Requirements The San Diego Regional Water Quality Control Board (SDRWQCB) has issued a permit, which governs storm water and non-storm water discharges resulting from municipal activities performed by or for the City of Mission Viejo (Permit No. R Copies of the Permit are available for review.) In order to comply with the Permit requirements, the City of Mission Viejo in conjunction with the County of Orange has developed Drainage Area Management Plan (DAMP), which contains Model Maintenance Procedures with Best Management Practices (BMPs) that parties conducting the municipal activities must adhere to. These Model Maintenance Procedures apply to any party conduction municipal activities and contain pollution prevention and source control techniques to minimize the impact of those activities upon dry-weather urban runoff, storm water runoff, and receiving water quality. Work performed under this CONTRACT shall conform to the Permit requirements, the DAMP, the City s Water Quality Ordinances, the Model Maintenance Procedures, applicable BMPs, and must be performed as described within all applicable Model Maintenance Procedures. The CONTRACTOR shall fully understand the Model Maintenance Procedures and BMPs applicable to activities that are being conducted under this CONTRACT prior to conducting them and maintain copies of the applicable Model Maintenance Procedures and applicable BMPs throughout the CONTRACT duration. In addition, the CONTRACTOR shall certify that he/she has trained all of its employees about the applicable Model Maintenance Procedures and applicable BMPs. Evaluation of activities subject to DAMP requirements performed under this CONTRACT will be conducted to verify compliance with DAMP requirements and may be required through CONTRACTOR self-evaluation as determined by the City. Failure to implement or comply with these requirements shall result in a Performance Deficiency Deduction of $ per occurrence. Contractor is also responsible for all damages and applicable fines from other agencies that are generated as the result of the contractor s work. SP-6
