1 Missouri General Assembly Legislative Update Cooperating School Districts of Greater Kansas City From Bert Kimble, Tom Rackers and Steven Carroll Week 9 March 6, 2014 This week the Missouri General Assembly was very active in dealing with issues involving public education. Numerous bills were heard in the House and Senate Education Committees. In addition, the House Budget Committee started their appropriation hearings and will begin final mark-up on appropriation bills next week and finish them before spring break. This week the House also passed HB 2014, which is the supplemental appropriation bill, which included a $22 million increase in funding for the foundation formula. As the House Budget Committee begins their mark-up next week, the House Budget chairman is taking a somewhat different approach in determining the amount of new money that will be available for the FY 2015 budget. As you know, Senate and House leaders have not been able to agree with the governor s projected revenue forecast. The House and Senate is forecasting roughly a 4.0 to 4.2 percent increase while the governor is projecting a 5.2 percent increase. At this point, we just don t see how the Governor s numbers can be correct. It has been a harsh first few months with winter and revenues are lagging, but the economy can certainly pick up as summer approaches. With this being said, the House Budget Committee chairman, Rick Stream, has devised an appropriation plan that will set up what s known as a new Surplus Revenue Fund. Thus, any new revenue growth that comes in above the House/Senate projections will go into this fund from which the governor may appropriate additional monies, such as addition dollars for the foundation formula. The House budget increases for HB 2002, that Rep. Stream has advocated using general revenue under his revenue growth calculations, are as follows. $122 million increase for the foundation formula; $25 million increase for transportation; $8.2 million for pre-k to be used for students in unaccredited and provisionally accredited schools only; and $34 million increase in Prop C. As you know, Governor Nixon requested a $278 million increase in his budget for the foundation formula based upon his growth numbers. This is $156 million less than what the House Appropriations Committee is currently projecting. However, whatever additional monies that do come in through economic growth, the monies would be moved to the Surplus Revenue Fund, and any additional dollars that flow into the fund would be used to further fund the foundation formula up to an additional $156 million.
2 The House Education Committee this week continued their hearings on Rep. Stream s and Rep. Cierpiot s student transfer bills. No action was taken on either bill and there will be a committee substitute. We included summaries of these two bills in last week s report, which you should already have. The House Education Committee also heard two bills HB 1843 and 1139, sponsored by the committee chairman, Rep. Cookson, of which the summaries are as follows. HB MINIMUM TEACHER SALARY This bill raises the minimum teacher salary beginning in school year from $25,000 to $30,000, subject to appropriation. The minimum salary for the holder of a master's degree is raised from $32,000 to $35,000, subject to appropriation, beginning in the school year but requires that the degree be in a field directly related to the teacher's assignment. The Minimum Teacher Salary Fund is created for moneys appropriated for distribution to each school district on the basis of the difference between the required minimum salary and the salary reported by the district on core data for each teacher who does not make the minimum salary and establishes a proration method in case of a less than adequate appropriation. HB MANDATORY SCHOOL HOURS Currently, school districts must schedule a minimum of 174 school days with 1,044 hours. This bill revises the requirement to be a calendar of 1,085 hours of planned attendance, with no requirement as to the number of days. The bill also defines a standard "summer school term" as no less than 144 hours with six weeks of no more than four days per week. Summer school must not start before the second Monday in June or extend beyond the last day of July, allowing for a July fourth holiday of four days. The regular school term must not open before September first or extend beyond the last day of May. The Department of Elementary and Secondary Education must provide a testing window for statewide assessments that allows the results to be received in time for determining if a student will be required to attend summer school. School districts must require students who score less than proficient on a statewide assessment to attend summer school; districts must also develop a summer school teacher selection policy that describes objective qualifications for summer school employment. The bill repeals some restrictions on the length of the school day and repeals the provisions that prescribe how a district may undertake a four-day school week. The bill becomes effective July 1, 2015.
3 In the Senate Education Committee hearing this week, four bills were heard. Two bills, SBs 538 and 539, sponsored by Sen. Keaveny, provides for funding for pre-k education in school districts. These bills call for when the formula is fully funded in SB 538, all children, ages 3 to 5, who are eligible for free and reduced lunch, would be calculated in the weighted average daily attendance. SB 539 would mandate all children in the state, ages 3 to 5, would be eligible. SB This act would allow a school district or a charter school that has declared itself as a local educational agency that operates an early childhood education program to receive state funding through the foundation formula for students between the ages of three and five who are eligible for free and reduced lunch. The district or charter school must provide full-day kindergarten and meet standards established by the State Board of Education. This act would become effective in the school year after the school year in which the foundation formula is fully funded and would remain in effect in any succeeding year. This act does not require school attendance beyond what is required under the state's compulsory attendance law and does not change or modify the state's kindergarten attendance age statutes. SB This act would allow a school district or charter school that has declared itself as a local educational agency that operates an early childhood education program to receive state funding through the foundation formula for students between the ages of three and five. SB 795, sponsored by Sen. Lager, repeals the prohibition on a quality rating system for early childhood education that is not established through Missouri statute. This act repeals the current statutory prohibition on higher education institutions, governmental entities and quasi-governmental entities establishing, operating, maintaining, offering incentives to participate in, or mandating participation in a quality rating system for early childhood education without statutory authority. SB 521, sponsored by Sen. Emery, makes major changes with teacher tenure in the state. Summary: SCHOOL REPORT CARDS: The State Board of Education must develop a simplified annual school report card for each school attendance center. Each
4 school will be given a letter grade of A, B, C, D or F based on percentages identified in the act that corresponds to the percentage of points earned in each of the standards on the simplified annual school report card. Each school will be given an overall letter grade that reflects the percentage of points the school earned of all points available on the report card. Alternative schools will not receive a report card unless they specifically request one. Grades will not be assigned to schools if the number of students tested is smaller than the minimum sample size necessary based on professional practices for statistical reliability. The report card must also identify each school's performance as having improved, remained the same, or declined based on the prior year in terms of the letter grade and value. (Section ) TEACHER TENURE AND REDUCTION IN FORCE: This act limits teacher tenure to teachers first hired by a district before August 28, Teachers hired on or after August 28, 2014 will not receive tenure. (Section & ) This act repeals the criteria that a school board uses when placing teachers on leave of absence because of a decrease in student enrollment, district reorganization, or financial condition. (Section & ) TEACHER AND ADMINISTRATOR EVALUATIONS: Current law requires each school board to cause a comprehensive, performance-based evaluation for each teacher and administrator. This act specifies that the evaluation be done annually. For teachers, the evaluation system developed by the Department of Elementary and Secondary Education must be used, or a district evaluation that utilizes the standards and indicators in the Department's system. In addition, this act requires the school board of the St. Louis City School District to perform such an evaluation for St. Louis teachers. (Sections & ) SALARY SCHEDULES: Each school district must develop and adopt a performance salary schedule for all instructional personnel by July 1, The performance salary schedule must review and may provide annual salary adjustments based upon performance determined by the annual evaluation system used by the district. Teachers must be evaluated using multiple, fair, rigorous, transparent, and valid measures. A district may use the model evaluation form developed by the Department of Elementary and Secondary Education or a district evaluation form that utilizes the standards and indicators in the Department's system. The performance salary schedule must not use advanced degrees as a basis for setting a salary schedule unless the advanced degree is in the area of certification or expertise. A district may develop additional salary schedules differentiated on assignment to a Title I school, teaching in a subject area for which there is a teacher shortage, or to reflect the supply and demand of the teacher labor market.
