2 Welcome This Product Disclosure Statement (PDS) is an important legal document that contains details of your motor vehicle insurance. If you decide to buy insurance from us, please read it through, then keep this PDS, together with your certificate of insurance, in a safe place. Cooling off period You have 21 days to consider the information in your PDS. This is the cooling off period. If you wish, you can cancel your insurance within 21 days from the day cover began. If you have not made a claim in this period, we will refund in full any premium you have paid. Information about the cost of the insurance The amount you pay for insurance depends on: the type of cover you choose (see page 17) and any endorsements to your policy your vehicle s type and its location, purpose of use, maximum radius of operation and/or sum insured and/or market value the drivers of your vehicle, including their age, driving, accident and insurance record the excess you agree to pay for each claim (an increased excess may not result in a decreased premium on every occasion) historical fluctuations in the numbers of your vehicles Please contact your insurance intermediary to get a quote based on the cover you want. If you decide to buy commercial motor fleet insurance from us, the price will include any discount, compulsory government charges, GST and Fire Services Levy (FSL) if applicable. These will be included in the amount payable, which is shown on your certificate of insurance. We might advertise special offers and benefits from time to time. If we have a special offer available that is not in this PDS, we can give you a separate terms and conditions brochure about the offer if you ask us. The offers might be short-term and we can withdraw them at any time. 2

3 Why the cost of insurance can change Each time you renew your insurance your premium is likely to change, even if your personal or business circumstances or insurance history has not changed. This is because premiums are affected by: the cost of claims we have paid to other customers any changes in government taxes or charges the cost of claims we expect to pay in the future our expenses of doing business. Other costs, fees and charges The costs, fees and charges that you might have to pay are listed in the table below. type of fee or charge excess contribution/ depreciation Refund of payment for hire car cancellation details The amount you might have to pay if you claim. The amounts for some types of excesses will be shown on your certificate of insurance. For details of other excesses that may apply to your claim see pages 35, 36 and 37. You might have to contribute to the cost of repairing tyres, engines, accessories, paintwork, bodywork, radiators, batteries, interior trims or caravan annexes affected by wear and tear or rust and corrosion. How much you pay depends on how worn these items were when the damage happened. If you withdraw your claim or we refuse to accept it, you might have to refund to us any payments we have already made for the hire of the car. Nil 3

9 Important terms explained The following table defines and explains the meaning of some terms used in this PDS. term accessories and modifications accident aircraft authorised driver certificate of insurance dangerous goods meaning Alterations or additions that change the performance, security or value of your vehicle, including the body, wheels, tyres, rims, engine, exhaust, extraction system, transmission, paintwork, suspension, instruments, sound system or interior. Accident means accidental loss or damage, fire, theft or attempted theft, malicious damage, or storm damage. Accidents must: happen in the period of insurance and be unforeseen and unintended by you. The type of cover you have determines which accidents are covered. Any thing made or intended to fly or move in or through the air or space other than model aircraft. A person controlling, driving or using your vehicle with your consent. The current certificate of insurance we issue you which forms part of your policy. It shows: your policy number the type of cover you have chosen the sum insured the amounts for insured vehicle, age and inexperience excess (for all vehicle types except prime movers) the period of insurance any endorsements to your policy that we are prepared to accept, alter or renew your insurance policy other details of your insurance. Goods classified as Dangerous Goods under the Australian Code for the transport of dangerous goods by road or rail (or under any rules replacing that Code). 9

10 Important terms explained (continued) term Duty of Disclosure meaning You have a Duty of Disclosure to tell us everything you know or should know, that is relevant to our decision to insure anyone under the policy, including you or any intended driver, and on what terms. It includes matters we specifically ask about when you apply for a policy, or renew or alter your policy, and any other matters that might affect whether we insure you and on what terms. The information you tell us can affect: the amount of your premium if we will insure you if special conditions will apply to your policy. You do not need to tell us of anything which: reduces the chances of you making a claim or we should know about because of the business we are in or we tell you we do not want to know. If you are unsure, it is better to tell us. If you do not tell us something which you know or should know is relevant, we might reduce a claim, refuse to pay a claim, cancel your policy or, if fraud is involved, we can treat the policy as if it had never existed. employee endorsement excess Any person: employed by you, including any person engaged under a contract of service or apprenticeship; supplied to you pursuant to a contract of labour hire. A written change or addition we make to your policy, particularly if we have changed the cover to meet your needs or excluded a specific cover we would normally have covered. Any endorsements that apply to your policy will be shown on your certificate of insurance, unless we send you the endorsement separately. Excess is the amount you might have to pay if you claim. The amounts of your vehicle excess and age and inexperience excess (for all vehicle types except prime movers) are shown on your certificate of insurance. Any punitive or fixed excess amounts imposed by us or voluntary excesses assumed by you will normally be included in your vehicle excess amount shown on your certificate of insurance. Depending on the circumstances, you may also have to pay an additional excess that isn t shown on your certificate of insurance (see pages 35, 36 and 37 for details, including details of age and inexperience excess for prime movers). You might have to pay more than one type of excess when you claim. You must pay the excess in full. 10

11 Important terms explained (continued) term inexperienced driver lease payout market value period of insurance personal injury personal property policy meaning A person who is 25 years or over and has not held a drivers license for the class of vehicle being driven at the time of the accident for the past 2 consecutive years. The amount in full that you must pay: for the lease of your vehicle under a hire purchase agreement concerning your vehicle or for any other agreement to buy your vehicle from someone who sells vehicles or provides finance to the general public. It does not include any amount: due under any lease or other agreement which is unpaid at the date of the accident or that was not part of any lease or other agreement or that you did not have to pay. The amount we calculate the market would pay for your vehicle. It takes into account the age, make, model, kilometres travelled and condition of your vehicle immediately before the accident. We might use recognised industry publications to calculate the amount. The time you are covered by insurance. It is shown on your certificate of insurance. Bodily injury, death, sickness, disability, fright, shock, mental anguish, mental injury or loss of consortium. Items in your vehicle at the time of the accident. It does not include: animals information stored electronically or any other way items used for your business money, negotiable documents, cheques, credit cards, financial transaction cards, stamps, title deeds, passports, uncut gems or stones motor vehicles, motor bikes and motor scooters, hang gliders, aircraft, aerial devices and their equipment or watercraft, including surfboards, surf or waterskis, sailboards and accessories. Your insurance contract. It consists of this PDS, your application for insurance, any endorsements and your current certificate of insurance. 11

12 Important terms explained (continued) term premium Product Disclosure Statement (PDS) proposal road meaning The amount you pay us for insurance. You also pay stamp duty, GST, FSL and any other additional compulsory government charges. Your premium does not include any service fee charged to you by your insurance intermediary. PDS is the name of this document and it contains the terms of your insurance cover. It tells you what cover we provide, details of costs, fees and charges and other important information. It should be read together with your certificate of insurance and any endorsements that apply to your policy. The proposal form you complete and submit to us for this insurance. Any surveyed or unsurveyed land dedicated to public use, according to law, as a road (including a footpath or median strip). It also includes a toll road or a bridge which is open to the public and used as a road. sum insured It is the maximum amount we will pay if your vehicle is lost or damaged in an accident. Is shown on your certificate of insurance At each renewal you should consider whether your sum insured is adequate. You choose the sum insured and you can increase or decrease it at any time, however we will not backdate any request. You might suffer financial loss in a claim if your sum insured does not accurately reflect the value of your vehicle. In establishing the sum insured for your vehicle, please consider: the methods of settling claims when your vehicle is not economical to repair (refer to page 39 for details) the implications of GST (refer to pages 16 and 34 for details) and your vehicles market value (refer to page 11 for details) Includes the value of any accessories or modifications we have agreed to insure as part of your vehicle. Supplementary PDS A document that updates or adds to the information in the PDS. 12

The following accessories will also be insured if they are attached to or in or on your vehicle: baby capsule/car seats bicycle carriers binders bonnet protector built-in refrigerators built-in televisions bull bar caravan annexe cargo barrier CB and/or 2-way radio chains cruise control dash mats decorative wheel trims driving lights fire extinguishers floor mats gates headlamp guards motor cycle helmets, gloves, or associated riding clothes up to a total of $500 (if we pay a claim covering your motor cycle) mud flaps paint protection panel/rust protection pinstriping/decals protective mouldings rear louvre sunshade registration plate covers ring feeder seat covers side steps for a 4WD sleeping box sound systems (fitted as standard by manufacturer) spare wheel cover steering locks tarpaulins tools supplied as standard by the vehicle manufacturer or similar replacements tow bars vehicle signwriting costs weather shield winch. It also includes other vehicle accessories or modifications if we have agreed to insure them as part of your vehicle and they are shown on your certificate of insurance. 13

14 Your responsibilities When you buy insurance from us, you are responsible for keeping your details up to date and providing correct information. Your Duty of Disclosure You must comply with your Duty of Disclosure when you apply for insurance and each time you renew or alter your cover. (See page 10) Keeping details up to date and providing information You need to tell us immediately if: any details on your certificate of insurance are incorrect or have changed. your vehicle has been modified or has had accessories fitted that are not included as part of your vehicle (see pages 9, 13 and 25). there are any changes to the physical condition of your vehicle. there are any accidents involving your vehicle that might result in a claim on your policy. you change your address, your vehicle, the place where you keep your vehicle, the drivers of your vehicle or the way you use your vehicle. you or anyone who might drive or be in charge of your vehicle has, over the past 5 years, had changes to their: driving, accident or insurance record criminal conviction history relating to arson, drugs, burglary, housebreaking, theft, robbery, receiving stolen goods, fraud, criminal or wilful damage or injury or assault to anyone. However, these convictions do not need to be declared: if the person was convicted for the offence/s committed whilst under the age of eighteen (18), and the conviction is more than 3 years old. in the past 5 years, you (for the purposes of this particular point you does not include an authorised driver unless they are also an insured) have been: declared bankrupt unable to pay any debts or liabilities as they fell due placed in voluntary administration or had a receiver appointed. 14

15 Your responsibilities (continued) Other responsibilities for people covered by the policy You and anyone covered by this policy must: Follow all the conditions set out in your policy. Take all reasonable precautions to prevent loss, damage or legal liability. Keep your vehicle, its tools, parts and accessories in good condition (eg. free of rust). Not meeting your responsibilities If you or anyone covered by this policy do not tell us everything relevant, or if you mislead us, or if you fail to meet your responsibilities, we can refuse to pay a claim, reduce the amount we pay or cancel your policy. If you do not comply with your duty of disclosure and fraud is involved, we can treat the policy as if it had never existed. Paying your premiums We will tell you how much you have to pay and how much time you have for payment. You must pay the premium and other charges by the due date to get this insurance cover. If you pay after the due date, we can reject your payment and your policy will stop from the due date. If we accept your late payment, we might re-commence your cover from the date of payment. If so, you will have no cover for the period from the due date until the date of payment. Unless we tell you, any payment reminder we send you does not change the policy expiry date. If you do not pay the premium and other charges in full, we will reduce the period of insurance so it is in line with the amount you paid. 15

16 Cancellations You can cancel the cover at any time. The cancellation takes effect on the date we receive your request. We can cancel your cover at any time by complying with the laws relating to cancellation of your policy. We can cancel your cover if you do not pay the premium by the due date. We will refund any money we owe you less any non-refundable government charges. Renewals If we offer to renew your policy and then, before your policy is renewed, we learn of any change in circumstances that might affect our decision to insure you, we can: withdraw our offer or offer you renewal on different terms. If, after your renewal has come into force, we learn of any change in circumstances that you knew about or should have known about, we can: refuse to pay a claim or reduce the amount we pay or cancel your policy. If we cancel your policy, we might offer you a new policy on different terms. If fraud is involved, we can treat your policy as if it had never existed. GST and your sum insured If you are not entitled to an Input Tax Credit on your policy premium, all sums insured and limits of liability stated in your policy are GST inclusive (unless your policy states otherwise). If you are entitled to an Input Tax Credit on any part of the policy premium you paid, the sums insured and limits of liability stated in your policy are exclusive of GST to the extent of your input tax credit entitlement. 16

17 Types of Covers There are two types of cover available: Comprehensive cover Third Party Property Damage Cover The cover you choose will be shown on your certificate of insurance. Comprehensive Cover You are covered for loss of or damage to your vehicle caused by an accident in the period of insurance. It includes loss or damage to your vehicle caused by another party, even if they are not insured. It also includes the cover provided by Third Party Property Damage Cover. If we accept your claim and decide your vehicle is a total loss and repairs are not economical, or your vehicle is not recovered after being stolen, the most we will pay you is the sum insured of your vehicle. Third Party Property Damage Cover We will cover you for amounts you are legally responsible to pay another person because an accident in the period of insurance caused: personal injury or loss of or damage to property or loss of or damage to property or personal injury as a result of carrying dangerous goods. The cover also includes: the cost of removing or cleaning up escaped dangerous goods by a public authority or emergency services property damage or personal injury to another person that is the responsibility of your employer, principal or partner because you were driving your vehicle in connection with your occupation legal and other costs we have agreed to pay when you make a claim. We will only cover you if the loss of or damage to property or personal injury is caused by: you using your vehicle goods falling from your vehicle or goods being loaded or unloaded from your vehicle but this does not include collecting or delivering the goods to or from your vehicle beyond the limits of any road. Our cover is limited to: $30 million (unless a lower limit is shown on your certificate of insurance) for any claim not involving dangerous goods or $1 million for any claim involving dangerous goods. We may allow you to increase this limit to a maximum of $20 million, however we will not backdate any request. These limits also apply to any cover for your legal liability provided under any additional feature of this policy unless a lower limit is specified in the relevant additional feature. These limits are the most we will pay even if there are several claims against you relating to one accident. 17

18 Additional features Depending on whether you choose Comprehensive Cover or only Third Party Property Damage Cover, we offer these extra features if we accept your claim. Feature Comprehensive Third Party Cover Property Damage Cover damage by uninsured drivers if you do not have N/A Comprehensive Cover We pay up to $5,000 for loss of or damage to your vehicle in an accident caused by a collision with another vehicle driven by an uninsured driver. A driver is uninsured if neither the driver nor owner of the other vehicle had an insurance policy that would cover them for the loss or damage to your vehicle. This cover is for the cost of repairs or the market value of your vehicle (whichever is less). If your vehicle is a total loss, you will be covered for its market value up to $5,000. We only pay if: you show the accident was the fault of the uninsured driver and we agree and you can identify the other vehicle and its driver (name, residential address, phone number and registration details). Covered Not covered 18

19 Additional features (continued) Feature Comprehensive Third Party Cover Property Damage Cover emergency repairs, travel and accommodation We will pay reasonable costs up to: $500 if you need emergency repairs so you can get your vehicle to your destination or a repairer after an accident. $500 for your or the authorised driver s emergency travel and overnight accommodation if the accident was more than 100km from your home or the authorised driver s home and your vehicle was unroadworthy or unsafe to drive. $500 for temporary accommodation if your vehicle is an unregistered on-site caravan and it is damaged by an accident, providing that the unregistered on-site caravan is your only home and you can t live in it as a result of the accident. If you need emergency repairs or emergency travel and overnight accommodation we give you the authority to arrange these matters on our behalf up to the specified limit. You must produce tax invoices and receipts for all costs if we ask for them. hire car after theft We will pay for a hire car of a similar make and model to your vehicle for up to 14 days if your motorcycle, car, 4WD, utility or van of not more than 2 tonne carrying capacity is stolen and either not found or is found but is not driveable. This benefit stops if: your vehicle is returned undamaged or we repair your vehicle and return it to you or we have settled your claim. You are responsible for all running costs and extras of the hire car, including paying a deposit to the hire car company. If you withdraw your claim or we refuse to accept it, you might have to refund to us any payments for the hire car we have already made. The most we will pay is $1,500 for any one accident. Refer to Additional Feature Hired Vehicle on page 24 for details of the cover we provide for legal liability, or the theft of, or accidental loss of, or damage to, the hired vehicle. 20 Additional features (continued) Feature Comprehensive Third Party Cover Property Damage Cover new vehicle after total loss If you are the first registered owner of your vehicle which is a motorcycle, car, 4WD, utility or van of not more than 2 tonne carrying capacity, you can choose to accept a new replacement vehicle of the same make, model and series, if: your vehicle is a total loss because of an accident that occurred within 2 years of the date of your vehicle s original registration and the replacement vehicle is available within Australia and anyone who provided finance for your vehicle agrees in writing We will also pay all on-road costs and your insurance policy will continue to its expiry date if we agree to continue to insure you, and you pay any additional premium that we require. 21 Additional features (continued) Feature Comprehensive Third Party Cover Property Damage Cover personal accident We will pay $5,000 if your vehicle is being driven by you or any authorised driver and, as a direct and sole result of an accident involving your vehicle, the driver: dies permanently and totally loses sight in one or both eyes or permanently and totally loses the efficient use of one or both hands or feet. We will only pay one claim of $5,000 for any one accident. We pay the driver or, if the driver dies, we pay the driver s estate. We will not pay if the death or disability happens: more than 12 months from the date of the accident or because the driver committed or attempted to commit suicide. personal property We will pay the reasonable costs of up to $150 an item to a total of $500 if your or the authorised driver s personal property is damaged or stolen as a result of your vehicle: being damaged in an accident or being stolen. removal of debris If you are legally liable to pay the cost of cleaning up or removing goods that have fallen off your vehicle because it was in a collision or it overturned, we will pay those costs up to $25,000. We will not pay if the goods are dangerous goods. You must provide invoices or other proof of payment of costs if we ask for them. Covered Not covered 21

22 Additional features (continued) Feature Comprehensive Third Party Cover Property Damage Cover towing and storage costs After an accident, we will pay reasonable costs of: towing your vehicle to our nearest Assessing Centre or to a repairer that we nominate or agree to, if your vehicle is unroadworthy or unsafe to drive. In the case of an emergency we give you authority to arrange reasonable towing costs on our behalf. You must produce tax invoices and receipts for all costs if we ask for them. storing your vehicle, if these costs are for storage after you have lodged your claim. We do not cover storage costs for any period after your claim is settled. two-wheel or box trailer When your two-wheel trailer or box trailer is attached to or being towed by your vehicle, we will provide comprehensive cover on your trailer up to a limit of $1,000. You can insure your trailer for more if you insure it as a separate insured vehicle under your policy. Covered Not covered 22

23 Additional features (continued) Depending on whether you choose Comprehensive Cover or only Third Party Property Damage Cover, we offer these extra features in the period of insurance. Feature Comprehensive Third Party Cover Property Damage Cover cover for additional vehicles We automatically provide cover for any additional vehicle you get during the period of insurance. Unless we tell you otherwise, you must tell us about the additional vehicle within 21 days of getting it and pay any extra premium we ask for. If we are unable to continue covering the additional vehicle, we will tell you and give you 5 working days from the date we tell you so you can organise to insure the vehicle elsewhere. Cover on the additional vehicle will then be cancelled effective 4pm 5 days after we have told you we are unable to continue covering the additional vehicle. If you have Comprehensive cover with us for your vehicle, we automatically provide Comprehensive cover for an additional vehicle you get during the period of insurance (unless you tell us you want Third Party Property Damage cover only). If you have Third Party Property Damage cover only with us for your vehicle, we automatically provide Third Party Property Damage cover for an additional vehicle you get during the period of insurance (unless you tell us you want Comprehensive cover). If you have a combination of vehicles insured with us for Comprehensive and Third Party Property Damage cover, we automatically provide Comprehensive cover for an additional vehicle you get during the period of insurance (unless you tell us you want Third Party Property Damage cover only). We will not pay more than $5,000 for any claim accepted under this additional feature. We will only cover theft of these accessories if: you give us evidence to satisfy us that the sum insured reflects the value of your vehicle plus the accessories, and you can prove you owned the accessories. vehicles being test driven If a vehicle is being demonstrated to you or test driven by you or your authorised driver, we will cover your legal liability for: theft of, loss or damage to that vehicle up to $100,000 any one accident another person s personal injury or other property damage caused by an accident. We do not cover loss or damage to the: caravan or trailer (unless it is your vehicle or the trailer is insured under Additional Feature non-owned trailer in control liability) or, actual property which is loaded or unloaded from or which falls from your vehicle, the caravan or the trailer. legal liability for unregistered on-site caravans If your vehicle is an unregistered on-site caravan, you are covered for amounts you must legally pay for damages for personal injury or death of another person, or for loss of or damage to another person s property, caused by your use or occupation of the unregistered on-site caravan. Our cover is up to $30 million for: personal injury or death, but we will only pay amounts you must pay which are not covered by Medicare, workers compensation or another government scheme or arrangement, or private medical insurance and loss of or damage to property. These amounts include legal and other costs we agreed to pay at the time you made a claim. It is the most we will pay under any cover even if there are several claims against you relating to the accident. Covered Not covered 26

27 Additional features (continued) Feature Comprehensive Third Party Cover Property Damage Cover locks and keys If your vehicle keys are stolen and police investigations conclude they are unlikely to be found, we will pay for the difference between the cost of replacing the keys and/or re-coding your vehicle s locks and any excess you might have to pay. We will not pay more than $1,000. non-owned trailer in control liability If your vehicle is a prime mover or rigid body truck, we will pay all amounts you are legally liable to pay in respect of loss of or damage to a trailer you do not own, lease or hire if: the trailer is in your legal possession or control at the time of the accident and you or an authorised driver are using it in conjunction with your vehicle. We will not cover your legal liability for: damage to a trailer that is a tanker, tipper, convertible, refrigerated, freezer or chiller trailer damage to goods or property being carried in the non-owned trailer more than $50,000 any one accident We may allow you to increase the maximum we will pay under this Additional Feature to $120,000 any one accident and remove the restrictions relating to the type of trailers that are in your lawful custody or control, however we will not backdate any request. An extra premium will be payable if we agree to your request. The non-owned trailer excess is $2,500 payable per trailer. If there is also a claim for loss or damage to your vehicle, you pay the excess shown on your certificate of insurance for your vehicle in addition to the non-owned trailer excess (see page 36). 28 When we will and will not pay a claim The amount we pay depends on the type of cover and sum insured shown on your certificate of insurance. We will pay a claim We will pay a claim if, in the period of insurance and as a result of an accident: you suffer loss or damage or are legally liable for loss or damage or personal injury covered by your policy and none of the following exclusions, or other exclusions appearing in this policy, applies to your claim. When we will not pay a claim (exclusions) You are not covered for an accident occurring when your vehicle is being driven by, or is in the charge of, someone who: was under the influence of, or had their judgement affected by, any alcohol or drug had more than the legal limit of alcohol in their breath or blood, as shown by analysis refused to take a legal test for alcohol or drugs or was not licensed, not correctly licensed or not complying with the conditions of their licence. We will cover you if you were not the driver or person in charge of your vehicle at the time of the accident and you can satisfy us that you did not know, and could not have reasonably known, of any of the above circumstances. If we pay a claim we can recover those costs from the person who was driving or in charge of your vehicle. You are not covered under this policy: if you or an authorised driver does something or neglects to do something that is not in accordance with this policy or does not give us the information or assistance that we ask for for an accident that occurs outside Australia for structural, mechanical, electrical or electronic failure or breakdown for wear, tear, rust, corrosion or depreciation for loss, damage or legal liability arising while your vehicle is being driven or used at, in or on any aircraft hangar or any part of an airport or airfield used by aircraft for loading, unloading, taxiing, takeoffs or landings for damage to tyres caused by braking, punctures, cuts or bursting if we decide that the amount we would pay is less than the excess you have to pay for damage to your vehicle s engine because it was driven in a damaged condition after an accident unless we agree that you could not reasonably have known that the damage was occurring 28

29 When we will and will not pay a claim (continued) for theft of or malicious damage to your vehicle when anyone insured under this policy has not taken reasonable care to prevent this loss or damage for financial loss: occurring because you cannot use your vehicle because your vehicle s value was less after being repaired because your vehicle s working life has been reduced if your vehicle is legally taken or confiscated for loss of or damage to a drill rod or bit attached to your vehicle while the drill rod or bit is being used for its designed purpose. For the purposes of this exclusion, a drill rod or bit includes any part attaching to or forming part of the drill rod or bit including but not limited to pipes, guides, filters, gaskets, plugs, caps, beacons, beacon housings, tool heads, nozzles and/or any other electronic mechanism for theft by anyone who has hired or leased your vehicle or who has taken it as security for a debt for the cost to repair or replace burnt out electric motors or wiring of appliances in your caravan for damage to your caravan, caravan annexe, trailer or personal property caused by biting, chewing or scratching by an animal or bird for damage to your caravan, caravan annexe or personal property caused by tenant/s if your unregistered on-site caravan is unoccupied for 60 consecutive days. (If you want cover over 60 days, you need to ask us for an extension of time and we must agree in writing. We might charge an extra premium or impose special terms.) for action by the sea, high water, tsunami or tidal wave or flood to an unregistered on-site caravan, its annexe and contents for loss or damage caused by revolution, war, (whether war is declared or not) or acts of a foreign enemy, military coup or any looting or rioting following these occurrences for loss or damage caused by radioactivity or the use, existence or escape of nuclear fuel, nuclear material or waste, or action of nuclear fission including detonation of any nuclear device or nuclear weapon or any looting or rioting following these occurrences for loss or damage caused by any biological, bacterial, viral, germ, chemical or poisonous pollutant or contaminant or any looting or rioting following these occurrences 29

30 When we will and will not pay a claim (continued) You are not covered under this policy for legal liability: as a result of discharge or escape of contaminants, pollutants or other dangerous goods from your vehicle unless they are substances you are legally allowed to carry if caused by the emission of exhaust fumes or by the application or attempted application of any material applied or intended for application to land or vegetation. for loss of or damage to property you own, control or are responsible for, or which belongs to someone who normally lives with you for personal injury to anyone who was your employee at the time of the accident for personal injury if you were or anyone else was required by law to have insurance for compensation, damages or similar insurance for injury (eg. compulsory third party insurance or workers compensation required by law) for personal injury if your vehicle is registered in the Northern Territory of Australia where you cause your own personal injury, or if you injure or cause the death of someone who normally lives with you occurring because you or an authorised driver of your vehicle agreed to accept liability because of any agreement you or anyone under this policy enters into, unless liability would have applied anyway resulting from the use of your vehicle if it was unregistered at the time of the accident, unless your vehicle is an unregistered on-site caravan (see page 26) in respect of fuel contamination caused by you delivering: the incorrect type of fuel, or the fuel to the incorrect place for property damage resulting from an accident arising out of the use of your vehicle while it is digging, excavating, boring or drilling. However, we will pay if your vehicle is being used for the sole purpose of travelling to or from any work site or transporting or carting goods at the time of the accident and is not being used at the time of the accident for any other purpose including any specific activity for which the vehicle was designed to pay fines or punitive, exemplary or aggravated damages. 30

31 When we will and will not pay a claim (continued) You are not covered if, at the time of an accident, your vehicle was: damaged, unsafe or unroadworthy being used in a race, contest, trial, test, hill climb or any similar activity being used on a competition race track, circuit, course or arena being used by you for illegal purposes carrying passengers for payment or reward unless it was a car pool, child care arrangement or fare paying passenger bus carrying a greater number of passengers than it was designed for or is allowable according to law conveying, towing, lifting or carrying a load not secured according to law conveying, towing, lifting or carrying a load in excess of that which it was designed for or is allowable according to law being used to move dangerous goods or substances that pollute or contaminate unless this was done legally travelling on railway lines being used for subterranean mining (but we will cover you if your vehicle was being used for open cut mining). 31

33 Making a claim What you must do if there is an accident that could lead to a claim Call us as soon as possible we re available 24 hours a day. Our staff will help you with quotes, towing, repairs, storage etc. We will give you the name of your nearest Suncorp Recommended Repairer, although you can use your own. Do everything reasonable to limit and prevent further loss or damage. If someone has stolen, attempted to steal or maliciously damaged your vehicle, call the police immediately. You must produce details of the name of the police officer and station where you made the report if we ask for them. If your vehicle is involved in an accident, get the full names, residential addresses and phone numbers of all drivers, passengers and witnesses involved. You will also need the vehicle registration numbers and insurance details of all drivers involved. Give us any information and help we need to handle the claim. If you get demands, a notice of prosecution, details of an inquest or similar communications from other parties involved in the accident, please tell us immediately. Tell us your entitlement to Input Tax Credits (ITCs) for your insurance premium if you are registered or should be registered for Goods and Services Tax (GST) purposes. If information you give us is incorrect, we will not cover you for any resulting fines, penalties or tax charges. If the only damage to your vehicle is windscreen breakage we give you the authority to arrange for the repair and replacement of the vehicles windscreen and/or windows at a reasonable cost on our behalf. If you have authorised any emergency repairs (see page 19), towing (see page 22) or windscreen repairs on our behalf you must produce tax invoices and receipts if we ask for them. What you must not do Admit to anyone else involved in the accident that it was your fault. Negotiate or promise anyone payment. Authorise any repairs, except windscreen breakage and emergency repairs to your vehicle (see page 19), or dispose of any damaged property unless we have agreed in writing. Enter into any agreement or make any admissions which have the effect of limiting or excluding your rights or our rights to recover payments. 33
