2 The nature of the Policy The Policy is an excepted group life Policy as defined in section 482(2) of the Income Tax (Trading and Other Income) Act The Policy provides insurance to cover lump sum benefits payable on the death of a member under a discretionary trust. It provides evidence of a legal contract between you and us and takes effect from the commencement date. The Policy document includes: The Policy Conditions, which set out the standard terms of the contract, and include the signed Policy statement, and The Policy Particulars which set out the specific details of the cover we have agreed with you. The terms of the Policy are dependent upon the information you provide. If this is mis-stated, or if any material facts have changed since you provided the information, we may amend or discontinue the Policy. If you do not comply with all of the Policy terms and conditions, we will not pay claims. We may also cease cover under the Policy and will not be bound to accept any further premiums. In this event premiums under the Policy will be deemed to have discontinued, and cover under the Policy will cease. Third party rights Any person or company who is not a party to this Policy does not and shall not have or acquire any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Policy.

3 Excepted Group Life Assurance (Police Federations Policy) Policy statement This Policy is issued by Canada Life Limited (we) in response to a written proposal and declaration from the trustee(s) of the scheme named in the Policy Particulars (you). In addition to this Policy statement, the Policy comprises: the Policy Conditions provided with this Policy statement; and the Policy Particulars provided with this Policy statement. This Policy statement witnesses that: 1 We issue this Policy to you subject to the terms set out in this statement, the Policy Particulars, the Policy Conditions, and in any amendments or replacements we issue. These jointly form the Policy. 2 We will pay you the benefits set out in this Policy, if you have paid all the premiums we have asked for, in accordance with the terms set out in the Policy Conditions and provided that all other requirements of the Policy have been met. 3 The Policy and any benefits payable under the Policy are not assignable. We shall not be affected by any notice of any assignment, trust, charge or lien or by any other dealing of the Policy or the benefits. 4 Where we use words in the singular, the same applies to the plural (and vice versa), unless it is clear that this is not the case. 5 This Policy is subject only to English law. If there is any dispute between the parties about anything to do with the Policy, the UK Courts are the only courts which may make a judgement about the dispute. 6 This Policy will not have or accrue any surrender value. The total amount payable on the death of a member under this Policy together with any other amount paid in respect of the member prior to their death under Policy No.C43269/1 or C43271/1 or any previous policy taken out by the employer will be 50,000. The earlier of the annual revision date following the date on which the retired officer reaches age 60, or the attainment of age 75 by the eligible person. The total amount payable on the death of a member together with any other amount paid in respect of the member prior to their death under Policy C43268/1 or C43271/1 or any previous policy taken out by the employer will be 10,000. 16 What the Policy explains The Policy gives you clear details of: who you must include, from when and for what benefits, what is not covered, what premiums are payable by you and when, how and when the basis of the Policy can be changed, when and how you can make a claim. How does the Policy work? If you: provide us with all the details we ask for, when we ask for them; and pay all of the premiums when they are due, we will: cover the members for their insured benefits; and pay you a member s insured benefits on their death. If you do not comply with all of the Policy terms and conditions, we will not pay claims. We may also cease cover under the Policy and will not be bound to accept any further premiums. In this event premiums under the Policy will be deemed to have discontinued, and cover under the Policy will cease. You will need a trustees bank account in the name of trustees of the scheme and separate from the employer s trading accounts, to accept and distribute benefit payments.

19 Terms and expressions we use In this document the words we, us or our mean Canada Life Limited. When we refer to you or your, we mean the trustees of the scheme named in the Policy Particulars that attach to this document. We use everyday language in clearly marked sections, so that you can find what you need, when you need it. As it is a legal document, some terms have a specific meaning. We have tried to keep these to a minimum and have listed them together with their meanings below. Aggregate lump sum benefit : the total benefits payable from all your group life policies insured by our Group Insurance department. Annual revision date : the date in each calendar year when the premiums are calculated. The date is shown in your Policy Particulars. Catastrophic event : one originating cause, event or occurrence or a series of related originating causes, events or occurrences, resulting in the deaths of four or more members, irrespective of when or where the members die. Child : any natural or legally adopted child of a serving officer who is more than six months old and under 18 years old. Commencement date : the date that the Policy starts, as set out in your Policy Particulars. Discretionary entrant : someone who is an eligible person but who you want covered from a different date to their normal inclusion date. Eligible person : someone who meets the eligibility requirements for inclusion in the Policy. Employer : the Police Force(s) or any other employer or organisation that we have agreed to include in the Policy. 8

20 Terms and expressions we use Evidence of insurability : any documentary or medical evidence that we may reasonably require to include someone for benefits in the Policy. Excepted group life policy : a group life policy as defined in section 480(3) of the Income Tax (Trading and Other Income) Act HMRC : HM Revenue and Customs. Insured benefit : the total benefit (or benefits) for which the member has been included in the Policy. Member : an eligible person included in the Policy. Nationally agreed retention scheme : the 30+ Police Retention Scheme introduced under the Police Pay and Conditions Package, December 2002 or the 30+PLUS scheme introduced by the National Policing Improvement Agency on 1 April Normal entrant : an eligible person who you include in the scheme: on the first day that they meet the normal entry conditions; and for the normal scheme benefit. Normal inclusion date : the first day that an eligible person qualifies for inclusion in the Policy as shown in your Policy Particulars. Partner : the person that the serving or retired officer is married to (or the civil partner of), or any other person who is cohabiting with the serving or retired officer as a partner and has done so for at least six months and who is financially dependant or financially interdependent on or with the officer. Periodic review date : the date when your premium rates, Policy Conditions and Policy Fee are reviewed. The date is shown in your Policy Particulars. 9

21 Terms and expressions we use Police Federation : the Joint Branch Board of the Employer s local Police Federation affiliated to either the Police Federation of England and Wales, the Scottish Police Federation, or the Police Federation of Northern Ireland. Policy : the legal contract between you and us, which takes effect from the commencement date. It comprises: the Policy Conditions, including the signed Policy statement, which set out the standard terms of the contract and includes the signed Policy statement, and the Policy Particulars which set out the specific details of the cover we have agreed with you. Policy fee : an annual charge per Policy towards our costs. Retired officer : a person who, prior to leaving the service of the employer, was a serving officer who has chosen to continue membership of the scheme. Scheme : the scheme named against that heading in your Policy Particulars. Scheme benefit : the benefit (or benefits) set out in your Policy Particulars. Serving officer : a warrant holding police officer of any rank, employed by the employer, who has chosen to be a member of the scheme. Statutory leave : any statutory leave taken from active employment because of maternity, adoption or paternity. Termination of membership age : the age set out in your Policy Particulars as the age at which benefits normally cease. Underwriting : the process whereby evidence of insurability is obtained and assessed. 10

22 Policy guide Your commitment You must: give us accurate and complete information and data at all times and tell us if and when this changes; pay us all of the premiums we ask for, when they are due, in UK currency; establish a scheme by setting up a discretionary trust; abide by the terms and conditions of the Policy; advise us immediately of any members who change their work location; and submit any claims in line with the process described in section 7 of this document. You must also tell us immediately, whenever: a member dies. Any claim form relating to a claim for benefit or additional amounts of benefit must be received by us within 2 years of the date of the member's death. We will not pay any benefit or any amounts of additional benefit if we receive the completed claim form after this period. there is any change to the employers or groups of people included in the scheme; you wish to change the benefit basis; you want to include someone who is a discretionary entrant; you want to cancel cover completely. 11

23 Risk factors It is important that you fulfil your commitments under the Policy. A breach of certain commitments within the Policy will result in us rejecting your claim or withdrawing cover. We will only continue your cover if you keep your premium payments up to date and give us the information and data we need. Any delay in paying your premiums or giving us the information or data we need, may result in unexpected premium arrears or someone not being fully covered. We will not pay any benefit or any additional amounts of benefit, if a completed claim form, in respect of the benefit being claimed, has not been received by us within two years of the date of a member s death. We may alter the premium rates, Policy Conditions and Policy fee at the periodic review date or at any other time if a change that affects any of them, occurs. There may be changes to the legislation, regulation, HMRC practice or tax rules affecting the treatment of this Policy. 12

24 Section 1 Who is covered? Normal entrants We will include a normal entrant as a member: on the commencement date, if they joined the scheme on or before that date; or from their normal inclusion date, if they join the scheme after the commencement date. Your Policy Particulars will show what conditions apply. Can cover be provided for discretionary entrants? We may agree, at your specific request, to include a discretionary entrant in the Policy as a member. We will need evidence of insurability before we can accept cover for any benefit. We will tell you what evidence of insurability we need and the date that any cover for that member starts. What underwriting decisions can be made? When we have received all the evidence of insurability that we need to decide whether we can accept a member s benefits, we will tell you what terms, if any, we can offer. We may: accept the benefits at standard terms; decline the amount of benefit that was being underwritten; postpone making a decision to a later date if the medical condition is inconclusive; charge an additional premium for the amount of benefit that has been underwritten; exclude certain conditions or activities. If we do not receive the evidence of insurability we ask for to be able to complete underwriting the member s benefit, we will restrict the benefit to the lesser of the previously accepted level or nil benefit. If we can accept the member s scheme benefit we will tell you when cover for that benefit starts. You must tell us in writing if those terms are not acceptable to you. We will cancel that cover from the date we receive your letter. Premiums will be charged for the period we were on risk. 13

25 Section 2 What is covered? Lump sum A benefit is payable as a lump sum when a member dies. The scheme benefit payable is set out in your Policy Particulars. However, where a benefit in respect of the member has been paid from a terminal illness policy insured in conjunction with the group life policy, the amount of insured benefit will be reduced by the amount of the terminal illness benefit previously paid out. Where the insured benefit at the date of a member s death is lower than the terminal illness benefit amount already paid (because the member has moved from one category to another with a lower scheme benefit) no insured benefit will be payable on the death of the member. Where categories of membership have different benefit amounts, we will issue separate policies for each category. Policies may be issued in respect of different categories of membership. In addition, policies may be issued in respect of partners and children of the above categories. Where the amount of benefit is the same for two or more categories, we may combine the categories within a single Policy. 14

26 Section 3 When does cover cease? Serving officer Cover will normally cease for a serving officer: who reaches their termination of membership age; who ceases to be employed by the employer; on the date that a premium due in respect of a serving officer fails to be paid; who ceases to be included in the Policy, whichever occurs first. However, serving officers who have ceased to be employed by the employer may choose to be covered under the retired officer category under the terms applicable for retired officers. cover may continue for a serving officer during a period of leave of absence from active employment. If premiums continue to be paid in respect of a serving officer, we will continue to cover them: if leave of absence is on account of ill health or disablement, up to the termination of membership age; throughout any period of statutory leave prior to that age; during any period of secondment to another Police Force in Scotland, England or Wales or Northern Ireland, including secondment to the Serious Organised Crime Agency, or any other similar national body; or for up to a three years for any other reason. Where cover ceases at the termination of membership age this means that cover ceases at midnight on the day before the member s birthday for that age. For example if the termination of membership age is 65, cover ceases at midnight on the day before the person s 65th birthday. Cover does not continue past the stated termination age to the next date that a premium would have been due from the member. 15

27 A serving officer who is accepted into a nationally agreed retention scheme will continue at the serving officer level provided that: the serving officer has not elected to be treated as a retired officer. premiums throughout the period up to and following the application and acceptance in respect of the serving officer are paid continuously without interruption or break. cover for any period during which the serving officer is not in active service following his acceptance but prior to his re-engagement will be limited to a maximum of six months. If a serving officer is not re-engaged within six months of the date of retirement they will be treated as a retired officer and their cover will reduce to the retired officer level until such time as they are re-engaged. If, at a later date they are re-engaged as a serving officer under a nationally agreed retention scheme their cover will automatically revert to the serving officer level. The provisions of Section 3 of the Policy for a serving officer will continue to apply. Serving officer s partner Cover will normally cease for a serving officer s partner: who reaches their termination of membership age, who ceases to be a partner, when the serving officer ceases to be included in the Policy; or on the date that a premium due in respect of the serving officer s partner fails to be paid, whichever occurs first. A partner of a serving officer who ceases active employment and elects to continue membership as a retired officer, or a serving officer who is accepted into a nationally agreed retention scheme but not reengaged within six months of retirement will automatically be treated as the partner of a retired officer. 16

28 A partner of a serving officer who is accepted into a nationally agreed retention scheme, or an officer who, at a later date, is re-engaged as a serving officer under a nationally agreed retention scheme will automatically be treated as the of a serving officer s partner. Retired officer Cover will normally cease for a retired officer: who reaches their termination of membership age; or on the date that a premium due in respect of a retired officer fails to be paid, whichever occurs first. If, following the date of retirement, benefits change in accordance with any pre-agreed benefit basis provided under the terms of the scheme and agreed between you and us, membership will be maintained at the revised amount provided that the relevant premiums continue to be paid. Retired officer s partner Cover will normally cease for a retired officer s partner: who reaches their termination of membership age; who ceases to be a partner; when the retired officer ceases to be a included in the Policy; or on the date that a premium due in respect of the retired officer s partner fails to be paid, whichever occurs first. 17

29 Child Cover will normally cease for an officer s child: on the child s attainment of age 18; on the attainment of age 65 of the officer who is the child s parent; when the officer ceases to be included in the Policy; or on the date that a premium due in respect of the officer fails to be paid, whichever occurs first. Note: For officers and partners; where cover ceases at the termination of membership age this means that cover ceases at midnight on the day before the member s birthday for that age. For example if the termination of membership age is 65, cover ceases at midnight on the day before the person s 65th birthday. Cover does not continue past the stated termination age to the next date that a premium would have been due from the member. For children; cover ceasing on the attainment of age 18 means that cover ceases at midnight on the day before the child s 18th birthday. Cover will also cease for all categories of members if it is not allowed under the HMRC regulations applicable to an excepted group life policy. Section 4 Are there any Policy limitations? Catastrophic event Policy limitation We apply a limit on the total aggregate lump sum benefit arising as a result of a catastrophic event. What is the maximum amount that Canada Life will pay? 100,000,000 if the event occurs at a single location or at multiple sites. If the event affects members travelling together, the maximum amount payable will be 20,000,

30 Section 5 How do we calculate your premiums? What information do we need to calculate your premiums? The premiums we calculate depend on various factors including: the level and amount of benefits, eligibility and entry conditions, membership profile such as age, gender, occupation and locations of the members, claims history; and the amount of the Policy Fee. There is a minimum annual premium of 1,000. Your Policy Particulars show the premium due for each member, for each category of membership, in accordance with the premium frequency you have chosen and agreed with us. The calendar or lunar monthly premium due for each category is the number of members in that category multiplied by the calendar or lunar monthly premium shown for that category. The total premiums due in any calendar month is the total of all calendar and/or lunar monthly premiums due for all categories in that month. You must supply the total premium due for each month together with the number of members insured. At each periodic review date we will recalculate the premiums and advise you of any change. In order to do this we will require data showing at least the following information: age, gender, lump sum benefits, scheme benefit category, and operating location for serving offices (including post code). 19

31 When are premiums payable? The premiums shown in your Policy Particulars will be payable by you to us monthly in arrears on the last day of each month (or such other date as agreed between you and us). They will comprise the total of all amounts of premiums paid to you by the members in respect of benefits under the Policy during the month (or such other period agreed between you and us). How you can pay your premiums You will normally pay your monthly premiums by electronic funds transfer or by cheque payable to Canada Life Limited. What will happen if you do not pay your premiums? You must pay your premiums within 30 days of the date they are due. If you do not pay your premiums, we may either: agree to allow you more time; or deem that premium payments have stopped and we will cease cover under the Policy. If we cease your cover, we will tell you in writing the date that cover ceases. Premiums will be due for the period of cover up to that date. If we agree to allow you more time to pay your premiums, we will tell you in writing. Our agreement may be subject to special terms and conditions including a late payment charge. You may not simply stop paying your premiums as a way of ceasing your cover and the Policy. 20

32 Section 6 Alterations to the Policy What you must tell us You must tell us if: you wish to change the benefit basis, you want to include a further employer or group of people in the Policy, or remove an employer or group of people from the Policy, the scheme, or any part of it, ceases to be regarded as an excepted group life policy, as defined in section 480(3) of the Income Tax (Trading and Other Income) Act 2005, either the number of members or the total insured benefits increase or decrease by more than 25% of the total number or the total insured benefit applicable on the last periodic review date (or on the commencement date if later), any change is made to the terms of the scheme that affects someone s inclusion or exclusion as a member or affects the member s scheme benefits. No amendments made will affect the terms of the Policy, unless agreed by us, or you want to cancel or cease the Policy. When you can make an alteration You can request an alteration to the Policy cover at any time. You must tell us in writing before the date you want to alter the Policy and its cover. We will tell you what evidence of insurability we will need to be able to make the change. When will the alteration be effective? We will write to tell you when we have altered the Policy and from what date the change is effective. 21

33 When can we alter the premium rates, Policy terms and Policy fee? We may alter the premium rates, Policy terms and Policy fee on any periodic review date. We may also alter the premium rates and Policy terms at any other time if: you ask us to change the amount of benefits provided under the Policy, you ask us to change the eligibility conditions for inclusion in the Policy either the number of members or the total insured benefits increase or decrease by more than 25% of the total number or the total insured benefit applicable on the last periodic review date (or on the commencement date if later), you ask us to include an additional employer or an additional group of people in the Policy or an employer or group of people are removed from the Policy, or any new legislation (or change in legislation) or change of HMRC practice after the commencement date affects the treatment of your premiums and/or the scheme benefits for tax purposes for you, your members or us, or the tax treatment of our life assurance fund (into which premiums are paid). How you can cancel or cease the Policy You must tell us in writing before the date you want to cancel or cease the Policy and its cover. The Policy will continue until we receive your written instructions and premiums will continue to be due up to the date we cease the Policy and cover stops. 22

34 Section 7 Making a claim The evidence we need to support a claim If you want to make a claim you must submit a completed claim form. Our claims guides and claims forms can be downloaded from our website: You must provide us with any documents and information that we may need to process your claim. This will include but will not be limited to: a fully completed current claim form. an original copy (not a photocopy) of a Registrar s or Coroner s Certificate of Death of the member. We may also ask for: medical records relating to the deceased, a copy of any relevant trust documents that identify who is empowered to sign for and act on behalf of the trustees. Where the claim is for a spouse or civil partner, we will also need original copies of the spouse s marriage certificate and the civil partner s civil partnership certificate. Where the claim is for any other financially dependant partner we will need documentary evidence of the relationship. Where the claim is for a child we will require original copies of the child s birth certificate, or adoption certificate (if applicable). 23
