3 PLEASE TAKE A FEW MOMENTS TO ANSWER ALL OF THE QUESTIONS BELOW ABOUT YOU OR YOU AND YOUR SPOUSE. IF YOU ARE HERE ABOUT A PARENT OR LOVED ONE, ANSWER THE QUESTIONS AS IF THEY WERE HERE. Instructions: Please circle either YES, NO, or UNSURE after each statement. There is a current immediate Health Care Power of Attorney to permit a spouse, children or family to make emergency health care decisions and end-of-life decisions in the event of a loss of function. There is a current immediate Durable Power of Attorney to permit a spouse, children or family, to handle financial affairs in the event of a loss of function. Both of the above documents are HIPAA and CMIA compliant. If there is a Revocable Living Trust in place as part of an estate plan, the trust gives instructions for the care of the settlor/settlors and allows gifting, transmutation of community property, self-dealing etc. I am satisfied with the persons named as executor/successor trustee in the current estate plan. There is a Plan in place to cover the cost of long term care. The trust gives complete authority to manage financial affairs and pay Long Term Care expenses. The trust allows for the spouse to maintain current standard of living and still pay for Long Term Care. The Estate Plan protects all assets from a Medi-Cal recovery or lien. The Trust clearly states that the needs of the settlors are the first priority. The trust or will avoids possible contests and disputes at death. The trust/will protects children s inheritance in the event the surviving spouse chooses to remarry. The Beneficiary designations of all retirement plans and life insurance policies do not name the estate or minor children, in any way, as a beneficiary. My Plan provides both creditor and lawsuit protection for assets passed to a spouse and children. My Plan maximizes income tax planning. My plan protects the special needs of a disabled child. My plan will minimize possible federal estate taxes at death, including taxes on the house, life insurance and IRA s. The Revocable Living Trust in place as part of the estate plan is fully funded so that the family can avoid the unnecessary delay and expense of probate. 4 SAMPLE AGENDA FOR FAMILY CONFERENCE Remember, this is only an outline. Your family is different from all other families. Be open and patient. Make sure everyone has a chance to speak and make sure you listen. This is about forming a consensus not just imposing a position or belief. At the end of the meeting, if you have not set out a logical, understandable path, then agree to meet again. The issues here are important and impact the lives and wellbeing of your loved one. At the end of all of this, once you have a plan, you must ACT. Only by acting can you move forward. Good Luck. The subjects presented are not in any special order. If you cannot deal with all of them at once, then choose those that make sense to you and move forward. DOCUMENTS. Trusts, wills, powers of attorney, advance health care directives, personal call contracts, HIPAA authorizations,deeds. Does someone have a copy? If someone died have they been taken off the property or trust? Are they all in place? Who has them? Can you understand them? Who are the heirs? Who has the power to act? Are the powers of attorney immediate or springing? Who can amend the trust? Are the trusts revocable or irrevocable? Do you have an A/B trust? Is there frailty language or do the documents only deal with death? Understanding documents is at the core of your meeting. FINANCES. Where are the assets? How much are they worth. Which banks or brokerage companies? Savings Bonds? Are there life insurance policies or annuities and with what companies. Are there IRAs and what kind? If you become ill who can manage all of these assets? How do you know. In what or whose name is the home? How do you know? Are the assets in joint tenancy, tenancy in common or community property? How do you know? Where are the credit cards? Who can pay your bills if you can t? Have your assets been reviewed in the last year or so? Who does your taxes? Do you have a safety deposit box? Who has accesses? Are you sure? AT DEATH. What are your funeral plans? Are they COMPLETE? Is EVERYTHING paid for? If you have no plans who can make one for you? Where will the funds come from? Who will pick up the remains? Who in your family knows about all of this? LONG TERM CARE. If you need care at the end of your life, where do you want it to be? Home, assisted living, independent living, board and care, your daughter s home? Who will take care of you? How will you pay for it? Has this all been worked out in advance by the family? No, really, what is the plan? VA benefits or Medi-Cal? This is just the beginning. There can be much more, but hopefully this will begin the discussion. Be honest about this. If you need help remember, I will be happy to sit in on your family meeting to help facilitate the discussion. It is FREE. Remember, no plan is still a plan, one that you do not control.
