3 Introduction This is the policy document for your mortgage payment, rent payment and/or loan payment protection insurance. This policy, any endorsement and your schedule of insurance make up your insurance documents. You should keep all these documents in a safe place. Please ensure that: You understand which sections of cover you have selected. Details of the cover you have selected are shown on your schedule of insurance. You understand what this policy covers and the restrictions and exclusions. You understand what your responsibilities are under this policy. The insurance cover we provide under this policy only relates to the sections of this policy that are shown on your schedule of insurance as being included. When drawing up this contract, we have relied on the information and statements that you have provided in your proposal. Please refer to Section 16 Disclosure of Important Information. The policy administrator is 3XD Limited who administer this policy on behalf of Lloyd s Syndicates 4444/958. Please contact the policy administrator immediately if you have any queries about this policy. The telephone number for policy queries is Lines are open 9am to 6pm Monday to Friday. Certification of Cover This policy, and your Schedule of Insurance are issued to you by 3XD in its capacity as agent of the Insurers Lloyd s Syndicates 4444/958 under contract reference B6039CR628. In exchange of your paying the premium amount referenced in your Schedule of Insurance, you are insured in accordance with the Terms & Conditions contained in these documents (and any amendments made to them) for the duration of your policy. 3

4 Section 1 - Definitions Within this policy document, there are special words shown in bold type. Wherever we use these words in bold type within this policy document, they will always have the following meanings: Benefit Period Benefits Office Business Carer s Allowance Ceased Trading Chronic Condition Claim Period Claims Administrator The number of months you will receive monthly benefit payments for an individual claim period. An Employment Service Job Centre (or the equivalent) in the United Kingdom, the Channel Islands or the Isle of Man. A company, profession, trade or industry, which is registered in the United Kingdom, the Channel Islands or the Isle of Man. A state benefit paid to you if you look after someone with substantial caring needs. The business has ceased to trade because you could not find enough work to meet all your day to day business and living expenses. A condition requiring treatment that occurs before the start date that cannot be cured or eradicated, or which continues indefinitely. Any separate period of unemployment or disability for which you receive monthly benefit payments. Jubilee Service Solutions Limited. Condition(s) Consultant Director Disability Disabled Doctor Any illness, injury, disease or sickness, including any related illness, injury, disease or sickness. A suitably qualified medical specialist who is a member of the Royal College of Surgeons, the Royal College of Physicians or any other Royal College of medical practitioners and who is not you or one of your family. You own more than 20% of the issued share capital of the business you work for. You are disabled and currently under the care and attendance of a doctor or a consultant. You have a condition that stops you from doing your normal work (or any other job you are reasonably able to do based on your experience, education or training) that is confirmed by a doctor or a consultant. A medical practitioner recognised by the General Medical Council who works in the United Kingdom, the Channel Islands or the Isle of Man and who is not you or one of your family. Eligible for Cover You meet all the eligibility requirements shown in Section 3. Employed or Employment End Date Existing Borrower Extra Cover Family Your work is permanent and your employer deducts PAYE tax and National Insurance contributions from your gross income or you work under a fixed term contract or sub-contracting basis where your sole income is earned from that contract. You must be working for a minimum of 16 hours per week. The date on which cover under this policy terminates due to one or more of the events shown in Section 13. Your mortgage, rent agreement or loan has been in force for more than one calendar month on the start date. An amount equal to 25% of the combined total of your mortgage payment, rent payment, loan payments, life insurance payment and home insurance payment. Your husband, wife, partner of either sex that you live with or a relative of you or your husband, wife or partner. 4

5 Fixed Term Contract A formal written contract with a business for a specified period of time. If you are an existing borrower a period of 90 days after the start date. The financial company that grants you a mortgage or loan. The normal monthly amount you pay for the life insurance or savings plan that protects or will pay off your mortgage or loan. A secured or unsecured borrowing agreement you have taken out with a lender for any purpose other than the purchase of a property. The normal monthly amount you pay to your lender for your loan. The amount of the monthly cover you have insured under this policy as shown on your schedule of insurance. This is also the maximum amount we will pay you in the event of a claim. If you have taken out split cover and one of you makes a claim, we only pay a proportion of the monthly cover you have insured under this policy. The secured borrowing agreement you have taken out with a lender to buy the private residential property you live in. The normal monthly amount you pay to your lender for your mortgage (excluding any voluntary overpayments). If you are employed, this is the average of the amounts shown on your payslips from your employer during the last 12 months. If you are selfemployed, this is the monthly average of the income you declared to HM Revenue & Customs for the previous tax year. Any payment you receive that relates to the notice period you should have served under your contract of employment or letter of employment, or any part of a compensation payment for loss of office (including any part of a payment under a compromise agreement) that is directly or indirectly related to the notice period your employer should have given you under your contract of employment or letter of appointment. The statement of cover provided in this document. 3XD Limited. The date 12 months after the start date and annually thereafter. Any medical condition that you knew about or should reasonably have known about at the start date or you had seen or arranged to see a doctor or consultant about during the 12 months immediately before the start date (including any visits to monitor the condition). The monthly amount you pay for your cover under this policy. The application form you completed and any other information you have given to us to support your application including information provided in writing, verbally or electronically. You own, alone or with others (except shareholdings), the business that you work for. The period of time that you need to be unemployed or disabled before you qualify for monthly benefit payments as detailed in section 5. 5

6 Relative Rent Agreement(s) Rent Payment(s) Schedule of Insurance Self-Employed or Self-Employment A person who is related to you by blood, marriage or civil partnership. The agreement you have taken out to rent the private residential property you live in (including any secondary agreement under a shared ownership scheme). The normal monthly repayment you make on your rent agreement. The document we send you that confirms your cover under this policy. Either of the following: You are classed as Schedule D for income tax purposes and are required to make Class 2 National Insurance contributions; or You are a proprietor or a director or you are a relative of either a proprietor or a director who works in the same business as you. You must be working for a minimum of 16 hours per week. Single Cover Split Cover Start Date Treatment(s) Type of Cover Unemployed Unemployment United Kingdom You are the only person shown on your schedule of insurance and you are insured for the whole monthly benefit. There are two people named on your schedule of insurance and both of you are insured for a proportion of the monthly benefit. The date your cover begins as shown on your schedule of insurance. Advice, examinations, consultations, medications or long term monitoring by a doctor or consultant. One of the following: Unemployment and disability cover; Unemployment only cover; or Disability only cover. You are entirely without work because of one of the following: If you are employed, your employer has totally and permanently terminated your job because of circumstances beyond your control; If you are self-employed, the business you work for has totally and permanently ceased trading; or You have had to stop working to become a full time carer for a member of your family and receive carer s allowance. You are unemployed and you are not receiving any form or payment or reward from your previous employment or self-employment. England, Scotland, Wales & Northern Ireland. We/Us/Our The insurer, Lloyd s Syndicates 4444/958. Work or Working You, your or yourself You are employed or self-employed and making the appropriate National Insurance Contributions, if you have more than one job, the hours you work for each job will be added together. The person or persons named on your schedule of insurance. 6

7 Section 2 The cover under this policy This policy is designed to protect your mortgage payment, rent payment or loan payment against unemployment or disability. The type of cover you have selected under the policy is shown on your schedule of insurance. If you have selected disability only cover, we will only pay out for disability and you will not be able to claim for unemployment. If you become unemployed whilst claiming for disability you will only continue to receive monthly benefit payments while you remain disabled. If you have selected unemployment only cover, we will only pay out for unemployment and you will not be able to claim for disability. If you become disabled when you are claiming for unemployment your monthly benefit payments will be suspended until you are able to continue actively seeking work. The maximum monthly benefit you can insure under this policy (including any extra cover) is either 1,500 or 65% of your normal income whichever is the lower amount. Subject to the maximum monthly benefit you can insure your mortgage payment, rent payment, loan payment, life insurance payment and home insurance payment. If your mortgage or loan allows you to make variable payments to your lender (excluding any voluntary overpayments), you should insure the average amount you intend to pay your lender each month as your mortgage payment or loan payment. Your monthly benefit does not automatically increase or decrease in line with changes to your mortgage payment, rent payment or loan payment. You should review your cover regularly to ensure you remain fully protected or you do not pay us for more cover than you need. You can amend your monthly benefit without notice if your mortgage payment, rent payment or loan payment changes. If you wish to increase your monthly benefit within 30 days of receiving notification from your lender or landlord, you will not be able to claim the increased monthly benefit amount for unemployment (including giving up work to become a carer) you become aware of during the 60 days from the date the change becomes effective. This increases to 90 days if you wish to increase your monthly benefit more than 30 days after receiving notification from your lender or landlord. Please be aware, that if you have insured more than your monthly mortgage payment, rental payment or loan payment, the extra amount of monthly benefit may affect your entitlement to certain State Benefits when you make a claim. Section 3 Eligibility for Cover You are eligible for cover if at the start date: You are over 18 and under 64 years of age; You are permanently residing in the United Kingdom, the Channel Islands or the Isle of Man; You are actively working in a business situated in the United Kingdom, the Channel Islands or the Isle of Man; The mortgage or rental agreement you are insuring under this policy is exclusively for the residential property you live in; and You agree to all the terms of this policy. You are not eligible for cover if at the start date: You are not named (or you are acting as guarantor) on any mortgage, rent agreement or loan you have insured under this policy; You are aware of any circumstance that could result in you becoming unemployed; Your work is casual, temporary or seasonal or you work for a temporary Employment Agency; 7

8 Your type of work is subject to regular or reoccurring periods of unemployment; or You are currently unable to work due to a disability. Section 4 Single and Joint Cover If your mortgage, rent agreement or loan is in your sole name, you can take out single cover to insure your whole monthly payment. If your mortgage, rent agreement, or loan is in joint names, you have the following options: If you are the main income earner, you can take out single cover to insure your whole monthly payment; If you are not the main income earner, you can only insure a proportion of your whole monthly payment. This must be the same as the proportionate contribution you make to your combined income, and will be assessed at the time of any claim; or If both parties to the mortgage, rent agreement or loan are eligible for cover, you can take out split cover in joint names to insure your whole monthly payment. If one person makes a claim, we will only pay out part of the monthly benefit in proportion to your average gross monthly incomes, calculated over the 12 month period immediately prior to the claim period. If there are different people named on separate agreements, you will need to take out a separate policy for each agreement. Section 5 Qualification Periods Your schedule of insurance shows the specific qualification periods you have selected for unemployment and/or disability under the policy. The period of time you will have to wait before you receive your first monthly benefit payment will depend on the qualification periods you have selected. The qualification period options under the policy are detailed below: Back to Day One cover after 30 days To qualify for monthly benefit, your unemployment or disability must last for at least 30 days in a row. On the 31 st day of continuous unemployment or disability, we will pay an amount equal to one monthly benefit. Thereafter we will pay an amount equal to 1/30 th of the monthly benefit for each day that you remain continuously unemployed or disabled. Monthly benefit is paid monthly in arrears. Back to Day One cover after 60 days To qualify for monthly benefit, your unemployment or disability must last for at least 60 days in a row. On the 61 st day of continuous unemployment or disability, we will pay an amount equal to two monthly benefit payments. Thereafter we will pay an amount equal to 1/30 th of the monthly benefit for each day that you remain continuously unemployed or disabled. Monthly benefit is paid monthly in arrears. 8

9 30 Day excess period To qualify for monthly benefit, your unemployment or disability must last for at least 30 days in a row. From the 31 st day onwards, we will pay an amount equal to 1/30 th of the monthly benefit for each day that you remain continuously unemployed or disabled. Monthly benefit is paid monthly in arrears and the first payment is made on the 61 st day. 60 Day excess period To qualify for monthly benefit, your unemployment or disability must last for at least 60 days in a row. From the 61 st day onwards, we will pay an amount equal to 1/30 th of the monthly benefit for each day that you remain continuously unemployed or disabled. Monthly benefit is paid monthly in arrears and the first payment is made on the 91 st day. 180 Day excess period disability cover only To qualify for monthly benefit, your disability must last for at least 180 days in a row. From the 181 st day onwards, we will pay an amount equal to 1/30 th of the monthly benefit for each day that you remain continuously disabled. Monthly benefit is paid monthly in arrears and the first payment is made on the 210 th day. Section 6 Benefit Period This policy has a maximum 12-month benefit period and your entitlement to monthly benefit will end once we have paid 12 monthly benefit payments for any claim period. Section 7 Making a Claim If you need to make a claim please telephone the claims administrator on If you are claiming for unemployment you will need to supply: A completed claim form; Independent evidence that you have registered with a benefits office as unemployed and available for work; Proof that you are actively looking for work; and Any other information we ask you to provide. If you were self-employed you will need to demonstrate that you have ceased trading and be able to show that HM Revenue & Customs are aware that you have ceased trading. If you are claiming for disability you will need to supply: A completed claim form; Independent evidence that you are disabled and under the care of a doctor or consultant; and Any other information we ask you to provide. If your claim is under the disability section of this policy, the cost of providing proof of your claim is your responsibility. Upon acceptance of your claim we will reimburse the charges made by your doctor in relation to completion of the claim form provided that you supply us with all the relevant receipts. If we require more than just medical certificates from your doctor, we will pay the cost of any medical examiners fee for any additional medical or psychiatric examinations they ask you to attend. If you fail to attend any additional medical or psychiatric examination we require, your entitlement to monthly benefit will cease. We may contact any other person or organisation that we consider necessary to assist in checking your claim and where necessary you must provide us with signed permission to obtain this information. 9

10 We may require sight of your personal bank statements. We will only make monthly benefit payments once we have received satisfactory evidence of your entitlement to claim. We may arrange for an agent representing us to visit you to gather details relating to your claim so we can assess your claim accurately. If you do not make yourself available for this visit your entitlement to monthly benefit will cease. Section 8 Claiming for Unemployment This section only applies if you have taken out unemployment cover. The type of cover you have selected is shown on your schedule of insurance. Subject to the unemployment exclusions, we will pay for unemployment if: You are registered as unemployed and available for work at a benefits office (unless you are exempt); You are actively looking for permanent work; and You provide us with evidence of your search for work when we request it. We will consider the first date of your unemployment to be the date you first registered as unemployed at a benefits office (unless you are exempt). Your qualification period only begins when your payment instead of notice has ended. If you are self-employed, to claim for unemployment, three conditions apply. You need to: have ceased trading because you could not find enough work to meet all your day to day business and living expenses; have declared this to HM Revenue & Customs; and present the claims administrator with a copy of your signed Jobseeker s Agreement and on-going proof that you are registered as unemployed with the Department for Work and Pensions, or provide suitable alternative proof of unemployment. If, under the conditions of this insurance, you are not self-employed, all other terms, conditions and exclusions of this policy will apply. In any event, you will need to have a Jobseeker s Agreement for the whole time you are claiming. If your previous employment was on a fixed term contract you must have at least 12 months continuous service with that business to receive the full entitlement to monthly benefit payments under the policy. If your previous employment was on a fixed term contract and you have less than 12 months continuous service with that business your entitlement to monthly benefit will cease on the date your fixed term contract was intended to end. Alternatively, we will also consider you as unemployed if you have to stop work to become a full time carer for a member of your family and you are receiving carer s allowance. In this case, we consider the first day of your unemployment to be the first date you qualified for carer s allowance and were without work. The policy will not pay out for unemployment if: You knew about unemployment on or before the start date; You knew you would have to leave work to become a full time carer on or before the start date; You were not in continuous work for 6 months before your first claim for unemployment (this is waived if you had been in continuous work for 6 months before the start date); Your work is casual, temporary or seasonal or you were working for a temporary Employment Agency; You are doing any other job (employed or self employed) for any form of payment or reward; 10

11 Unemployment was a regular feature of your job; You resign or accept voluntary unemployment; You refuse any offer of reasonable alternative employment by your employer; You retire or take early retirement instead of unemployment; You are dismissed because of misconduct, fraud, dishonesty or breach of contract; You fail to meet any performance standards or targets laid down by your employer; You participate in industrial action; Your apprentice or training contract comes to an end; Your unemployment occurs as a result of any civil unrest, war, radioactive contamination or any related event; Your unemployment occurs while you are working away from the United Kingdom, Channel Islands or the Isle of Man for more than 90 days unless you are working for the British Armed Forces or British Embassy/Consulate or you were required by your employer to work in another location within the European Union; or Your unemployment is as a result of a disability. If you are an existing borrower, we will not pay out for unemployment if you become unemployed within the initial exclusion period or you were told about unemployment within the initial exclusion period even if your unemployment only begins after the initial exclusion period has ended. Section 9 Claiming for Disability This section only applies if you have taken out disability cover. The type of cover you have selected is shown on your schedule of insurance. Subject to the disability exclusions, we will pay for disability if: You are unable to work as a result of your disability; and You are not receiving any form of payment or reward other than your normal or statutory sick pay. We will consider the first day of your disability to be the date on which a doctor or consultant first certifies that you are unable to work. The policy will not pay out for disability if: You knew you would become disabled on or before the start date; Your disability is due to a pre-existing condition unless you have not received treatment or consulted a doctor or consultant about the condition in the two years before your disability occurred; Your disability is due to a chronic condition; Your disability is due to a self inflicted injury; Your disability is due to alcohol or drug abuse; Your disability occurred because you failed to follow medical advice; Your disability is due to stress, anxiety, depression or a nervous disorder unless a consultant confirms the condition stops you working; Your disability is due to backache or back related conditions where there is no physical or radiological evidence of a medical abnormality unless a consultant confirms the condition stops you working; Your disability is due to any operation or treatment that is not medically necessary (including cosmetic or beauty treatments); Your disability occurs as a result of any civil unrest, war, radioactive contamination or any related event; or You are doing any job for payment or reward or you are receiving any form of payment for managing or carrying out any part of the running of the business you work for. 11

12 Section 10 - General Conditions You must complete your proposal for this policy in full, truthfully and accurately to the best of your knowledge. You should tell us about any claim within six months of the event that caused the claim. If you do not and the delay in notifying us affects our ability to fully assess the claim or keep our losses to a minimum, this may mean that the claim will not be paid, or not paid in full. The policy only pays out if: Your claim occurs between the start date and the end date; You were employed or self-employed when your claim occurred; Your premiums are up to date; You give us all the evidence we request to check your claim; and You have selected the appropriate type of cover for the claim event. You cannot alter your cover during a claim period. We will reduce your monthly benefit if the insured amount is more than the maximum permitted cover levels on the date your claim starts. Your monthly benefit will be reduced if it is more than 65% of your normal income. If your mortgage or loan allows you to make variable payments to your lender, we will calculate the average amount you have paid your lender over the 12 months before your claim (or the term of the policy if less than 12 months). If you have insured your mortgage payment or loan payment for more than this amount, we will reduce your monthly benefit accordingly and you may be entitled to a partial refund of premium. If you have other unemployment or disability insurance cover for your mortgage payment, we will reduce the monthly benefit by the amount you receive from the other insurance cover. You can transfer a claim between unemployment and disability (or vice versa) but if you do, we will only pay out for one benefit period. You can make any new claim as long as you have returned to work for at least three months in a row. Two claims separated by less than three months work will be treated as the same claim period and you will only receive monthly benefit that was left over from the previous claim period. You can make a new claim for disability as long as you have returned to work for at least one month and the disability is due to a condition not linked to the disability that caused the previous claim period. If you are offered temporary work, you can suspend a claim for unemployment provided that your temporary work lasts for at least one week and no longer than six months. You can undertake government supported training during an unemployment claim for a maximum period of 12 months, without the claim being affected, provided that you still have a Jobseeker s Agreement and can provide evidence that you are still actively seeking work. If you, or anyone acting on your behalf, make a claim under the policy knowing it to be false, exaggerated or fraudulent we will not pay any monthly benefit. All cover under this policy will end immediately and we will be entitled to recover any monthly benefit paid and costs incurred as a result of any such fraudulent, false or exaggerated claim. We may also report the matter to the police. This policy does not have any cash in or surrender value. The policy consists of this policy document, your proposal, the schedule of insurance, and any endorsement attached thereto. 12

13 If you have made a claim in the current period of cover all instalments must be made until the next policy renewal date. The claims administrators may, at their discretion, deduct the outstanding premium instalments from any claim. We will deduct from your monthly benefit any amounts that we are required to deduct by law. If at any time any provision or part of this policy becomes invalid, illegal or unenforceable the remaining parts and provisions continue in full force and effect. The policy administrator and claims administrator have been appointed by us to receive and hold premiums, claims monies and premium refunds. In this capacity, the policy administrator and claims administrator are acting as our authorised agents. This means that once a premium is paid to the policy administrator it is deemed to have been received by us and that all claims benefits and premium refunds from us are not deemed to have been paid until they are actually credited to you from the claims administrator or policy administrator. Transferring Cover If you already have payment protection insurance with another provider, you can transfer your cover to this policy provided that: You meet the eligibility requirements for the policy (see Section 3); Your previous payment protection policy has been in force for at least six months; You have not made a claim on your previous payment protection policy; and You select the same type and level of cover you held under your previous payment protection policy. In these cases we will waive the initial exclusion period for unemployment cover. Section 11 When Claim Payments End We will stop paying monthly benefit on the date one or more of the following events occur: Your unemployment or disability ends; You fail to meet any of the policy terms for receiving payments; We have paid 12 monthly benefit payments for any one claim period; or The end date of the policy (as detailed in Section 13). If you have a valid claim in progress on this date, or if an event has occurred prior to this date that leads to a valid claim, we will accept and/or continue to pay your claim until it would otherwise have ended under the terms of this policy. Section 12 - Premium Payments Your policy is an annual contract payable by monthly instalments. Provided you do not alter your policy the premiums are guaranteed for the forthcoming annual period. Upon receiving notice of any changes or proposed changes, you may cancel cover in accordance with Section 15 if you are unhappy with the change or proposed change. For your convenience, we will arrange for the policy administrators to automatically renew, your cover each year (Auto-Renewal) unless you tell them not to (see telephone number below). You will be contacted a month before the renewal date and reminded of the cover you have and told about any changes to the premium or the policy terms and conditions. You will also be told if we are unable to renew your policy. If you do not want us to arrange to auto-renew your policy, just call the policy administrator on Otherwise they will continue to collect the premiums by Direct Debit. 13

14 You will have 14 days to cancel the policy after the policy renewal date and receive a refund of any premiums paid since the policy renewal date, as described below. Section 13 When Cover Ends Your cover will cease on the first of the following events: The date you die; The date you retire; The date you reach age 65; However, where you have a valid claim in progress on this date, or if an event has occurred prior to this date which leads to a valid claim, we will accept and/or continue to pay your claim until it would otherwise have ended under the terms and conditions of your policy, The date on which all of the mortgages, rent agreements and loans insured on the policy come to an end (unless we agree to transfer your cover to a new agreement); Where you have insured your mortgage payment the date on which your home becomes the subject of repossession proceedings in a county court or high court; Your premium remains unpaid 30 days after it is due; or The date on which you or we cancel your cover. Section Day Cooling Off Period You can cancel this policy by contacting the policy administrator within 30 days of either: The date you receive your policy documents; or The start date of the policy, whichever is the later. If you cancel this policy within the 30-day cooling off period, we will refund any premium you have paid, provided you have not made a claim on this policy. Section 15 - Cancelling your Insurance You may cancel this policy at any time by contacting to the policy administrator. We may only change the terms or conditions of this policy (including the premium payable) at the policy renewal date. We will give at least 30 days written notice of such change sent to your last known address. We may terminate cover at the policy renewal date under this policy by giving not less than 90 days written notice to you at your last known address. Termination by us will not affect our liability for events occurring during the period of insurance which may give rise to a claim. If a claim has been submitted or there has been any incident likely to give rise to a claim during the period of insurance, no refund for the unexpired portion of the premium will be given. You must continue to pay the premium until the end date. If any month s premium is not paid for any reason, you will receive a letter from us asking for payment so that the insurance can continue. If we do not receive payment within 30 days from when it was due, the insurance will stop from the end of the last month for which premium was received. Section 16 Disclosure of Important Information When you applied for this insurance, and/or when you applied to make any change to the cover, you were asked a number of questions. Section 17 - Law & Jurisdiction applicable to the Insurance Under the laws of the United Kingdom, both you and we may choose the law that applies to this contract, to the extent permitted by those laws.
