Students with HIV in Higher Education Natalya Dell Updated June 2013
Premises Presentation slides updated after I attended Feb 2013 event: Principles of how universities work. Disclosure issues (updated). Types of support available. Disabled Students Allowances (DSA) Info. Links and Resources.
General Principles Students who are 18+ are legally adults. Encouraged to make their own decisions. University don t deal with parents/guardians by default. Minimise disclosure around university. Detail of impairment less important than impact and solutions. Academics don t need to know why. If illnesses are related to disability, we routinely take sick-notes and provide a letter for academic departments instead.
Legal Principles Equality Act (2010) which replaced Disability Discrimination Acts (DDA). Reasonable Adjustments (Section 20) Many of the things we put in place are reasonable adjustments This duty is anticipatory. Public Sector Equality Duty (Section 149) Create equality of opportunity and foster good relations for disabled people.
Disability support Best advice is getting students to contact Disability Services. We can: Arrange variety of support. Provide personalised advice, support and information to student. Support students with DSA process. Provide supporting statements for ill students. It is quicker for us to be able to deal with registered students needs than for a new student. We don t need a named diagnosis (see medical evidence section).
Medical Evidence #1 Disability services need medical evidence to ensure student is legally disabled. if you have a physical or mental impairment that has a substantial and long-term negative effect on your ability to do normal daily activities. Evidence does not need to name a diagnosis. Evidence for university and DSA needs to be from a medical doctor or nurse specialist.
Medical Evidence #2 Does not need to specify HIV, maybe medical condition immune disorder should say it s incurable. Recommended wording like: STUDENT s condition has a substantial impact on their day to day life as per definition of disability under the Equality Act (2010) Maybe include impact Condition affects STUDENT in XYZ ways Medication side effects can be Disability Services can provide more advice on this if needed.
Confidentiality Student can register and say confidential to details of their condition. Details of student s impairment/disability won t be sent anywhere else in or out of university without student s permission. We routinely provide supporting statements and support recommendations instead of details to academic departments. Students often worry we tell employers we don t. We can restrict access to a file to one caseworker.
Ideal recommendations 1. Make contact with university disability services. 2. Ensure they have local medical care e.g. GP/Hospital support. 3. Disclose on UCAS. Selecting either (I)You have a disability, impairment or medical condition that is not listed above (J)You have two or more impairments and/or disabling medical conditions. Additional information field readable to anyone handling admissions. I advise not using it. 4. Apply for Disabled Students Allowances (DSA)
Non-disclosure Students are not required to disclose unless the course has fitness to practice clearance requirements. If student doesn t disclose I recommend Having suitable medical evidence in a sealed envelope in case plus info about how to contact disability services in a crisis situation. Having a contingency plan for how they will manage in the event of illness or impairment.
Disabled Students Allowance (DSA) DSA is a non means tested grant for UK fees students. Usually administered by Student Finance England aka Student Loans Company. DSA is how some support is funded I ve indicated where this is likely. We encourage eligible students to apply. Medical evidence doesn t have to name diagnosis even for DSA. If you experience problems, disability services can help.
University Support Housing. Academic support. Library. Exams and assessments. Disability Support Services.
Housing DSA sometimes pays some of additional cost of more expensive rooms. Ground floor/lift accessible/adapted room. En-suite room for own bathroom facilities. Fridge in room for medication. Ensuite rooms are oversubscribed: To guarantee housing needs, tick disability box on application and/or register with disability services well before housing deadlines.
Academic Support recommendations document: Lecture handouts in advance. Materials in alternative formats. Workload management (extensions). Additional tutorial support. Understanding for medical absences. Extra extensions unavailable to non-disabled students. DSA: Study skills coaching (not permitted to fund subject specific support).
Library Extended library materials loans. Book collection to main front desk. Swipe-card for accessible entrances. Adaptations to working areas. Access to assistive technology booths. Vibrating fire alerters. DSA: Library assistant.
Exams / Assessment Smaller exam venues. Extra time and or stop the clock rest breaks. Use of a computer and specialist software. Enlarged exam papers. Scribe/Reader etc Alternative assessments (sometimes).
Questions Please ask! If you have any questions anyone can contact any university disability services and ask specific questions about how they would handle HIV or similar without giving prospective student s name or details. If you have any questions for University of Birmingham can me on n.dell@bham.ac.uk or our main address disability@bham.ac.uk
